there is, however, a proof for it also from the Written Torah: from this same verse itself "And Pinchas saw etc. and took a spear etc."<sup>3</sup>

Seemingly one can ask: if the Torah wants to let us hear the law of "zealots may strike him" — why is this halacha brought in the verse in a manner of a story and not
לכאורה קען מען פרעגן: אויב די תורה וויל אונז לאזן הערן דעם דין פון ״קנאין פוגעין בו״ — פאר־ וואס ווערט אט־די הלכה געבראבט אין פסוק אין אן אופן פון סיפור און ניט
In a manner of a law,
אין אן אופן פון א דין,
as the other laws stand in the Torah?
ווי עס שטײען אין תורה די אנדערע דינים?
So the explanation in this is:
איז דער ביאור אין דעם:
Regarding the matter of "zealots may strike him",
ביי דעם ענין פון "קנאין פוגעין בו",
it states<sup>7</sup>

"one who comes to inquire, we do not instruct him".
"הבא לימלך אין מורין לו".
Therefore the law cannot stand in the Oral Torah
קען דעריבער דער דין ניט שטיין אין תושב״ב
(except in the manner of a narrative),

because the eternity of the Oral Torah — since it is matters of <b>Written</b> [Torah],

In this law of "one who cohabits with an Aramean woman, zealots may strike him" — since "his death is not handed over to the court",

so much so that the court may not at all instruct the zealot that he should kill him — there are early authorities<sup>11</sup>

who learn,

As soon as the law "they strike him" was said regarding the <b>zealot</b>,

And therefore Zimri was permitted to kill Pinchas — because "if one comes to kill you, rise early to kill him"<sup>15</sup>.

But from the <b>simple</b> language of the Gemara<sup>16</sup>

"Who would say something that the Merciful One exempts him and we should arise and kill him?" implies<sup>17</sup>

that "zealots strike him" applies also to the one who cohabited — he is <b>liable</b> to death<sup>19</sup>.

Only <b>the</b> liability to death is different from other capital offenders,

So also Rashi in his commentary on the Torah holds like the view that "zealots strike him" is because the one who cohabits with a gentile woman is <b>destroying</b> <b>death</b>:

When Rashi explains "he aimed at the male organ of Zimri and the female organ of her" he adds as above: "And all saw that not for nothing did he kill them."

And at first glance it is perplexing:

If Pinchas had not intended "within the male organ etc.",

then one would have thought that Pinchas killed them <b>after</b> he separated<sup>21</sup>,

and then it would have turned out that Pinchas killed them <b>not</b> <b>according to law</b>,

So the explanation of this is:

The law is that in certain cases the court must give lashes or even kill also those who are not themselves destroying in this — "to make a fence for the Torah.
דער דין איז אז אין געוויסע פאלן דארף דער ב״ד געבן מלקות אדער אפי׳ הרג׳נען אויך אזעלכע וואס זיינען מצד עצמם ניט מחריב אין דעם — "לעשות סייג לתורה.
And since the court sees that the people have breached in the matter,

they must fence and strengthen the matter as it seems to them"<sup>22</sup>.

And consequently,

in the case of Pinchas,

even if he had not aimed "into the membrum etc."

One must however understand: since that according to the above,

the one who has relations with an Aramean woman <b>destroys</b> death,

why is his death only through zealots and only at the time of the act?
פארוואס איז זיין מיתה בלויז דורך קנאין און נאר בשעת מעשה?
The question is even greater: By one who cohabits with an Aramean woman there is also a liability of kares,
די קשיא איז נאך גרעסער: ביי בועל ארמית איז פאראן אויך א חיוב כרת,
as the Gemara derives it from the verse "and one who cohabits with a daughter of a foreign god,

And the liability of kares is indeed

and derives from the soul as it is above the revealed faculties

Because with every other sin,

one does not cross the "boundaries" which the Most High established between Israel and the nations

And another matter in this: the Gemara<sup>43</sup>

says "three partners in a person,

father and mother etc. and the Holy One, blessed be He, places in him a soul".

And it is well known<sup>44</sup>,

It thus follows,
קומט דאך במילא אויס,
that through the sin of one who cohabits with a gentile woman,
אז דורכן חטא פון בועל ארמית,
he takes the power of procreation of a Jew — which by Jews the power of the Ein Sof is in revelation<sup>45</sup>,
נעמט ער דעם כח ההולדה פון א אידן — וואס ביי אידן איז דער כח הא״ס בגילוי ,
and
און
He uses it for the opposite, G‑d forbid — for "for he will turn away your son from after Me — he removes him from being after G‑d."
ער נוצט עס אויס אויפן היפך ח״ו — אויף "כי יסיר את בנך מאחרי — מסיר אותו מלהיות אחרי ה׳".
And therefore it says by Pinchas "because he was zealous for his G‑d",
און דערפאר שטייט ביי פנחס׳ן "תחת אשר קנא לאלקיו ",
because the zeal that Pinchas was zealous in the sin of cohabiting with a gentile woman was "for his G‑d",
ווייל די קנאות וואס פנחס האט מקנא געווען באם חטא פון בועל ארמית איז גע־ ווען " לאלקיו ",
because of the power of the Ein Sof
צוליב דעם כח הא״ס
(which is revealed)
(שבגלוי)
that goes over, heaven forfend, to the opposite of G‑dliness<sup>46</sup>.
וואס גייט איבער ר״ל צו דעם היפך פון אלקות .

It is, however, not understandable: since the distinction "between Israel and the nations" is one of the "boundaries" that are established in the nature of creation — how can a Jew cross this boundary
ס׳איז אבער ניט פארשטאנדיק: וויבאלד אז די הבדלה "בין ישראל לעמים" איז איינער פון די "גבולות" וואס זיינען איינגעשטעלט בטבע הבריאה — איז ווי קען א איד אריבער־ גיין דעם גבול

So the explanation in this is:
איז דער ביאור אין דעם:
The power of choice that exists by a Jew,
דער כח הבחירה וואס איז דא ביי א אידן,
comes from that "Behold, the man has become like one of us"<sup>47</sup>,
קומט דערפון וואס "הן האדם הי׳ כאחד ממנו" ,
he is in likeness, as it were, to the Most High — that "there is none who can stay His hand" and He can choose in what He wants<sup>48</sup>.
ער איז בדומה כביכול צום אויבערשטן — וואס "אין מי שיעכב על ידו" און ער קען בוחר זיין אין וואס ער וויל .
And since the Most High is, after all, not defined, heaven forbid, by the laws of nature,
און וויבאלד אז דער אויבערשטער איז דאך ניט מוגדר ח״ו אין חוקי הטבע,
to the extent that He is not defined even in the distinction between Israel
ביז אז ער איז ניט מוגדר אפילו אין דער הבדלה שבין ישראל
to the nations<sup>49</sup>
לעמים
(because <b>He</b> indeed <b>made</b> the separation,
(ווארום ער האט דאך אויפ ־ געמאכט די הבדלה,
and <b>in His choosing</b> <b>the Cushite</b>),
און בבחירתו החבשית ),
therefore, from the aspect that the power of choice which derives "from a very high level" came down below and a Jew can use it to choose also in the opposite G‑d forbid — he can
איז דעריבער מצד דעם וואס דער כח הבחירה וואס נעמט זיך "מבחי׳ גבוה מאד" איז געקומען למטה און א איד קען דאס אויסנוצן אויף צו בוחר זיין אויך אין דעם היפך ח״ו — קען ער
(by begetting a gentile, heaven forbid)

cross the boundaries between Israel and the nations.
אריבערגיין די גבולות שבין ישראל לעמים.
And this is also the explanation in that the reward of Pinchas is "a covenant of eternal priesthood" — although priesthood is a matter of nature — because since the sin of Zimri
און דאס איז אויך דער ביאור אין דעם וואס שכר פנחס איז "ברית כהונת עולם״ — אע״פ אז כהונה איז אן ענין פון טבע — ווייל וויבאלד אז דער חטא פון זמרי
(which brought out the zeal of Pinchas)
(וואס האט ארויסגעבראכט קנאות פנחס)
consisted in removing the separation between Israel and the nations,
איז בא־ שטאנען אין אראפנעמען די הבדלה שבין ישראל לעמים,
which is analogous to "and He separated between the light and between the darkness" as above,
וואס איז בדוגמת "ויבדל גו׳ בין האור ובין החשך" כנ״ל,
therefore "in <b>place of</b> that he was zealous for his God",
דעריבער איז " תחת אשר קנא לאלקיו",
he received the reward — measure for measure,
האט ער באקומען דעם שכר — מדה כנגד מדה,
"and it was for him and for his seed after him a covenant of eternal priesthood"<sup>50</sup>.
"והיתה לו ולזרעו אחריו ברית כהונת עולם" .

This matter regarding the sin of one who cohabits with a non-Jewish woman,
אט דער ענין ביים חטא פון בועל ארמית,
through which is transferred, G‑d forbid, the power of the Infinite One into the side of impurity, to distinguish,
וואס דורך אים ווערט אריבערגעטראגן ר״ל דער כח הא״ס אין לעומת־זה להבדיל,
is only at the time of the act:
איז נאר בשעת מעשה:
By all other sins,
ביי אלע אנדערע חטאים,
although the power of the divine soul that is clothed in the act of transgression descended into the three completely impure shells,
הגם אז דער כח פון נפש האלקית המלובש במעשה העבירה האט יורד געווען אין ג׳ קליפות הטמאות,
it nevertheless remains still a power of holiness.
בלייבט ער אבער נאך אלץ א כח פון קדושה.
It is only that the power of the divine soul becomes absorbed in the "intentional sins" which conceal it<sup>51</sup>.
ס׳איז נאר וואס דער כח פון דעם נה״א ווערט נבלע אין די "זדונות" וועלכע זיינען אויף אים מעלים .
And therefore the sinner can — through his repentance — elevate that power back into holiness;
און דעריבער קען דער חוטא — דורך זיין תשובה — מעלה זיין דעם כח צוריק אין קדושה;
And even in a case when "he came upon a forbidden relation and fathered from her a mamzer" which then it is a "perversion that cannot be rectified"<sup>52</sup>,
און אפילו אין פאל װען ״בא על הערוה והוליד ממנה ממזר" וואס דאן איז עס א "מעוות שלא יוכל לתקון" ,
it is only regarding the rectification of the sin — because "his iniquity is revealed and remembered as long as the mamzer exists"<sup>53</sup>.
איז עס בלויז בנוגע צום תיקון החטא — ווייל "עוונו גלוי ונזכר כל זמן שממזר קיים" .
that since the vitality that came into this world,
אז היות ווי דער חיות וואס איז געקומען לעוה״ז,
became clothed in a body of flesh and blood
איז נתלבש געווארן בגוף בשר־ודם
(which was created through the transgression),
(וואס איז באשאפן געווארן דורך דער עבירה),
he cannot elevate that vitality into holiness].
קען ער ניט מעלה זיין דעם חיות אין קדושה].
But nevertheless,
אבער אעפ״כ,
since also the mamzer is "considered within the Jewish people",
וויבאלד אז אויך דער ממזר איז "בכלל ישראל נחשב",
even when the vitality is clothed in that mamzer — it is still a vitality of holiness.
איז אפילו בעת דער חיות איז מלובש אין דעם ממזר — איז עס נאך אלץ א חיות פון קדושה.
And therefore transgressions have a continuation also after the commission of the transgression — because as long as he does not do repentance,
און דעריבער האבן עבירות א המשך אויך לאחרי עשיית העבירה — ווא־רום כל זמן ער טוט ניט קיין תשובה,
there is found a power of holiness in "intentional sins"; but not so in the case of one who cohabits with a non-Jewish woman,
געפינט זיך א כח פון קדושה אין ״זדונות״; משא״כ אין פאל פון בועל ארמית,
since immediately as the vitality passes over to the non-Jewish woman it becomes <b>devoid</b> of holiness — it is therefore a matter that exists only at the time of the act*<sup>54</sup>
וויבאלד אז גלייך ווי דער חיות גייט אריבער צו דער ארמית ווערט עס אויס קדושה — איז עס במילא אן ענין וואס איז פאראן נאר בשעת מעשה*
Regarding the general power of a person that is clothed in the act of sin — because also the one who cohabits with a gentile woman, "even though he sinned, he is [still] Israel,"
בנוגע צום כללות הכח פון מענטשן וואס איז מלובש אין מעשה החטא — וויבאלד אז אויך דער בועל ארמית ״אע״פ שחטא ישראל הוא",
it is similar to all transgressions,
איז עס גלייך צו אלע עבירות,
that also <b>after</b> the commission of the sin, the power of holiness remains clothed in evil.
וואס אויך לאחרי עשיית החטא בלייבט דער כח הקדושה מלובש אין רע.
And therefore there is upon him the obligation of kares even later; but regarding the "loss" — see Rambam — by one who cohabits with a gentile woman
און דערפאר איז פאראן אויף אים דער חיוב כרת אויך שפעטער; אבער בנוגע צום ״הפסד״ — בל׳ הרמב״ם — ביי בועל ארמית
(which is <b>not</b> by other sins)
(וואס איז ניטא ביי אנדערע חטאים)
— from the aspect of the vitality as it passes over, heaven forbid, to gentiles,
— מצד דעם חיות ווי ער גייט איבער ר״ל צו גויים,
<b>that</b> matter is only at the time of the act,
דער ענין איז נאר בשעת מעשה,
as above.

And therefore the law of "zealots may strike him" is specifically <b>before</b> he withdraws — because the striking of the zealots is connected with the "loss" at the sin of one who cohabits with a gentile woman,
און דערפאר איז דער דין פון "קנאין פוגעין בו״ דוקא קודם שפירש — ווייל די פגיעת הקנאין איז פארבונדן מיט דעם "הפסד" ביים חטא פון בועל ארמית ",
which is only at the time of the act,
וועלכער איז נאר בעת מעשה,
and as above.

יא.
Based on the above, one can also explain, possibly, that which the death penalty for one who cohabits with a non-Jewish woman was not handed over to the court
ע״פ הנ״ל קען מען אויך מבאר זיין בדרך אפשר דאס וואס דער חיוב מיתה פון בועל ארמית איז ניט איבערגעגעבן געווארן צו ב״ד
(like all other capital offenses),
(ווי אלע אנדערע חיובי מיתה),
but to zealots:
נאר צו קנאין:
The choice, as it was given to a Jew from the aspect of <b>Torah</b>,
די בחירה ווי זי איז איבערגעגעבן געווארן צו א אידן מצד תורה ,
is only that he can choose "the life and the good"<sup>56</sup>
איז בלויז אז ער קען אויםקלײבן ״את החיים ואת הטוב"
or, heaven forbid, the opposite — "the death and the evil"<sup>56</sup>,
אדער ח״ו דעם היפך — "את המות ואת הרע" ,
but <b>not</b> to transform from evil to good or from good to evil.
אבער ניט צו איבערמאכן פון רע טוב אדער פון טוב רע.
That this is the explanation in that teshuvah is higher than Torah<sup>57</sup>,
וואס דאס איז דער ביאור אין דעם וואס תשובה איז העכער פון תורה ,
Because from the side of Torah, intentional sins cannot be turned into good<sup>58</sup>
ווייל מצד תורה קענען זדונות ניט נהפך ווערן צו טוב
; but specifically a Jew — that Israel <b>preceded</b> the Torah<sup>59</sup>,
; נאר דוקא א איד — וואס ישראל קדמו לתורה ,
<b>He</b> has the power to transform even from intentional sins to merits<sup>60</sup>.
ער האט בכה צו מהפך זיין אויך פון זדונות לזכיות .
And just as it is regarding the matter of intentional sins become for him like merits,
און כשם ווי דאס איז ביים ענין פון זדונות נעשים לו כזכיות,
so too is it also
אזוי איז עס אויך
(and all the more so<sup>61</sup>)

regarding the changing from good to evil,
בנוגע צום איבערמאכן פון טוב לרע,
which is caused by the sin of one who cohabits with a gentile woman: that in <b>that</b> choice which exists by a Jew,
וואס ווערט דורכן חטא פון בועל ארמית: אז אין דער בחירה וואס איז דא ביי א אידן,
is expressed the root of souls as they are rooted in the Essence — higher than Torah<sup>62</sup>,
דריקט זיך אויס דער שרש הנשמות ווי זיי זיינען מושרש אין עצמות — העכער פון תורה ,
which
וואס
from the aspect of "Who can say to You what You shall do"<sup>83</sup>,
מצד "מי יאמר לך מה תפעל" ,
a Jew has the power to take, as it were, the power of the Infinite One and to generate through this such a one who "removes him from being after the L-rd".
האט א איד בכח צו נעמען כביכול דעם כח הא״ס און מוליד זיין דורך דעם אזא וואס איז "מסיר אותו מלהיות אחרי ה׳".
And therefore also the punishment for this sin — for a punishment is indeed according to the manner of the blemish<sup>64</sup>
און דעריבער איז אויך דער עונש אויף דעם חטא — וואס אן עונש איז דאך לפי אופן הפגם
— was handed over not to beit din who rule based on <b>Torah</b>,
— איבערגע־ געבן געווארן ניט צו ב״ד וואס פסק׳־ נען ע״פ תורה ,
but to "zealots",
נאר צו "קנאין",
to Jews who sacrifice themselves for zeal for G‑d,
צו אידן וואס זיינען זיך מוסר נפש אויף קנאת ה׳,
even in a matter that
אפילו אין אזא ענין וואס
(from the perspective of Torah)
(מצד תורה)
is "<b>one does not</b> instruct him"<sup>65</sup>.

Based on all the above one will also understand the connection of the counting of the children of Israel; the division of the land; and the portion of the offerings

(which ends with the matter of "on the eighth day of assembly it shall be for you")

(for the name Pinchas is indeed on <b>all</b> parts and matters of the sidra<sup>66</sup>)

"Count of the children of Israel" — where every Jew,
״מנין בני ישראל״ — וואו יעדער איד,
not looking at his level in the study of Torah and fulfillment of the commandments,

counted with the same number — <b>one</b> — expresses the essence of Jews as they are above Torah<sup>67</sup>

Also the division of the land,

that one may not give away or sell from the Land of Israel to the nations of the world<sup>68</sup>

the division of the Land of Israel is)

which the matter of the lot indicates<sup>69</sup>

upon the aspect of the essence of the soul which is above reason and intellect<sup>70</sup>
אויף בחי׳ עצם הנשמה שלמעלה מטעם ודעת
And also the portion of the offerings,
און אויך פרשת הקרבנות,
which ends as above with "on the eighth day of assembly it shall be <b>for you</b>",
וועלכע ענדיקט זיך כנ״ל מיט "ביום השמיני עצרת תהי׳ לכם ",
emphasizes the distinction between Israel and the nations,
איז מדגיש די הבדלה שבין ישראל לעמים,
as it brings upon this the verse "they shall be for you alone and not for strangers with you"<sup>73</sup>.
ווי עס ברענגט זיך" דערויף דער פסוק" "יהיו לך לבדך ואין לזרים אתך" .
