and they have between them a certain likeness and commonality,

And therefore one cannot say that "to distinguish between the impure and between the pure" means "between half of the <b>esophagus</b> having been slaughtered and the majority of it having been slaughtered"; since the law of "impure" comes immediately at the first <b>any amount</b> of perforation of the esophagus

one cannot determine with certainty that it is indeed no more than half; it could be that there was one hair more than half,

only one cannot detect it.

The question arises: Why does the Torah rule "to distinguish between the impure etc." — that if half of the windpipe was cut it is impure,
פרעגט זיך די קשיא: פארװאס פסק׳נט אפ תורה "להבדיל בין הטמא גו׳ ״ — אז נשחט חציו של קנה איז טמא,
it could be that there was a kosher slaughter,
עס קען דאך זיין אז עס איז דא געווען א כשר׳ע שחיטה,
with one hair more than half,
מיט איין האר מער ווי חציו,
and since that is already considered a majority of the siman, should the animal not be pure?
און וויבאלד דאס הייסט שוין דאן א רוב סימן דארף דאך זיין די בהמה טהור ?
The question, however,
די קשיא אבער,
can be asked only according to the opinions
קען מען פרעגן בלויז לויט די שיטות
which hold that the law "a doubt regarding a Torah law is stringent"
וועלכע האלטן אז דער דין "ספיקא דאורייתא לחומרא"
is only rabbinic; according to Torah law, a doubt is permitted,
איז נאר מדרבנן; מדאורייתא איז א ספק מותר,
only the rabbis were stringent that a doubt regarding a Torah law should be stringent.
נאר די רבנן האבן מחמיר געווען אז ספיקא דאורייתא זאל זיין לחומרא.
One can then ask: How does the Torah say that "half of the windpipe was cut" is impure — at the time that the Torah permits it due to the doubt that must arise in such a case,
קען מען דאן פרעגן: ווי אזוי זאגט תורה אז ״נשחט חציו״ איז טמא — אין דער צייט אז תורה איז עס מתיר צוליבן ספק וואס מוז זיך שאפן אין אזא פאל,
not being able to determine exactly with human measure whether it is indeed exactly half or a hair more?
ניט קענענדיק באשטימען גענוי מיט דער מענטשליכער מאס צי ס׳איז טאקע פונקט העלפט אדער א האר מער ?
Not so according to the opinions
משא״כ לויט די דיעות
which hold that a doubt regarding a Torah law is stringent is from the Torah,
וואס האלטן אז ספיקא דאורייתא לחומרא איז מן התורה,
it is not possible to ask the aforementioned question — because since this doubt regarding a Torah law,
איז ניט שייך צו פרעגן קושיא הנ״ל — ווארום וויבאלד אז אט־דער ספק דאורייתא,
whether half of the windpipe was cut or most of it,
צי נשחט חציו אדער רובו,
is <b>from</b> <b>the Torah</b> stringent,
איז מן התורה לחומרא,
consequently it turns out that in such a case the Torah rules that in any case it is impure.
במילא קומט אויס אז אין אזא פאל פסק׳נט תורה אז סייווי איז עס טמא.

Regarding the opinion of <b>Rashi</b>

(with whom we are dealing)

in the matter of a doubt regarding a Torah law — one could seemingly prove,
אין ענין פון ספיקא דאורייתא — וואלט מען געקענט לכאורה מוכיח זיין,
from his commentary on the Gemara,
פון זיין פירוש אויף גמרא,
that he holds that a doubt regarding a Torah law is from the Torah lenient: The Gemara
אז ער האלט אז ספיקא דאורייתא איז מן התורה לקולא: די גמרא
brings a baraisa: "Two pots, one of non-sacred food and one of terumah, and before them two mortars, one of non-sacred food and one of terumah, and these fell into those — they are permitted."
ברענגט א ברייתא "שתי קדרות אחת של חולין ואחת של תרומה ולפניהם שתי מדוכות אחת של חולין ואחת של תרומה ונפלו אלו לתוך אלו מותרין"

Because we assume that "terumah fell into terumah and non-sacred food fell into non-sacred food."

The Gemara there asks: Now if one will say that eating terumah
פרעגט דארט די גמרא: היינט אויב מען וועט זאגן אז אכילת תרומה
(an olive's bulk within the time it takes to eat a half-loaf)
(כזית בכדי אכילת פרס)
is from the Torah,
איז דאורייתא,
how can one then assume that "terumah fell into terumah etc." and therefore one may eat the pot of non-sacred food — could it not be that into the pot of non-sacred food the terumah fell?
ווי קען מען דאן אננעמען אז "תרומה לתוך תרומה נפלה כו׳ " און דעריבער זאל מען מעגן עסן די קדרה של חולין — עס קען דאך זיין אז אין דער קדירה של חולין איז אריינגעפאלן די תרומה?
Rashi explains the Gemara's question: "And we rely leniently regarding the sin of death" — that.
איז רש״י מפרש די גמרא׳ס קשיא: ״ותלינן לקולא בעון מיתה״ — ד.

How can one by doubtful terumah rely leniently, since it concerns "the sin of death" of terumah to a non-priest?
ווי קען מען ביי ספק תרומה תולה זיין לקולא וויבאלד דא האנדלט זיך וועגן "עון מיתה" פון תרומה לזר?
From these words in Rashi,
פון אט־די ווערטער אין פרש״י,
one can seemingly deduce that he holds<sup>35</sup>
קען מען לכאורה ארויסדרינגען אז ער האלט
: specifically there where there is a sin of death, a doubt of Torah law is from the Torah stringent,
: דוקא דארט וואו ס׳איז דא אן עון מיתה איז ספיקא דאורייתא מן התורה לחומרא,
but in a case where there is no sin of death — a doubt of Torah law is lenient
אין פאל אבער וואו ס׳איז ניטא קיין עון מיתה — איז ספיקא דאורייתא לקולא
(from the Torah).

But one finds in many places<sup>36</sup>
אבער מען געפינט אין א סך ערטער
where Rashi says <b>explicitly</b>,
וואו רש״י זאגט בפירוש ,
that a doubt of Torah law is stringent from the Torah.
אז ספיקא דאורייתא איז לחומרא מן התורה.
One must therefore reinterpret,
מוז מען דעריבער איינלערנען,
that what Rashi adds in the case of two pots etc. that one cannot permit the pot of non-sacred food due to the doubt because of the fact that terumah is a "sin of death" — and he does not suffice with the general reason that a doubt of Torah law is stringent — it is due to the reasoning that the pot of non-sacred food has a presumption of permissibility<sup>37</sup>
אז דאס וואס רש״י איז מוסיף ביים פאל פון שתי קדרות כו׳ אז מען קען ניט מתיר זיין די קדרה של חולין מצד הספק מחמת דעם וואס תרומה איז א "עון מיתה״ — און ער באנוגנט זיך ניט מיטן אלגעמיינעם טעם וואס ספיקא דאורייתא איז לחומרא — איז עס מצד דער סברא וואס די קדרה של חולין האט א חזקת היתר
; and if terumah to a non-priest were not a prohibition of death,
; און ווען תרומה לזר וואלט ניט געווען קיין איסור מיתה,
then one could say that the presumption of permissibility of the pot of non-sacred food outweighs the doubt of Torah law — toward leniency.
וואלט מען דאן געקענט זאגן אז די חזקת היתר פון דער קדירה של חולין וועגט איבער דעם ספק דאורייתא — לצד היתר.
— In such a case, however, where in this doubt of Torah law there is no presumption of permissibility,
— אין אזא פאל אבער וואו אין דעם ספק דאורייתא איז ניטא קיין חזקת היתר,
Rashi holds that a doubt of Torah law is, from the Torah, stringent.
האלט רש״י אז ספיקא דאורייתא מן התורה לחומרא.
And all the more so that Rashi holds thus in our case,
און עאכו״כ אז רש״י האלט אזוי אין אונזער פאל,
regarding "if half of the windpipe was cut": because not only is there no presumption of permissibility,
ביי נשחט חציו של קנה: ווארום ניט בלויז איז דא ניטא קיין חזקת היתר,
but on the contrary: the animal has upon itself during its lifetime a presumption of prohibition<sup>38</sup>
נאר אדרבה: די בהמה האט אויף זיך בחיי׳ א חזקת איסור
— It is thus certainly that when a doubt arises in the slaughter,

a doubt of Torah law is stringent from the Torah.

that is,

the content and inner-meaning of the <b>entire</b> sedra,

is indicated in its name

(and certainly its conclusion — which is interwoven<sup>40</sup>

their beginning is in their end and their end is in their beginning).

One can ask: what connection do the words and the subject of "to distinguish between the impure and the pure" have to the name "Shmini"?
קען מען פרעגן: וואס פאר א שייכות האבן די ווערטער און דער ענין פון "להבדיל בין הטמא ובין הטהור" צו דעם נאמען ״שמיני״?
And on the contrary: Shmini is a holy number<sup>41</sup>,
ואדרבא: שמיני איז א מספר מקודש ,
and from the aspect of the virtue that exists in "Shmini"
און מצד דער מעלה וואס איז דא אין ״שמיני״
(also — in the language of Torah — from the word shemen<sup>42</sup>)

this day took ten crowns<sup>43</sup>
האט דער דאזיקער טאג גענומען עשר עטרות
— now when here it speaks about such a high level about which it says "no evil shall sojourn"<sup>44</sup>,
— היינט בשעת דא רעדט זיך וועגן אזא הויכער מדריגה וואס אויף איר שטייט "לא יגורך רע" ,
how does a matter of tumah come here — for which the separation "between the impure and the pure" is required?
ווי קומט אהין אן ענין פון טומאה — וואס דערפאר פאדערט זיך די הבדלה "בין הטמא ובין הטהור״ ?
The explanation in this is: at the time that it deals about the distinction between impure and pure which consists only in a something of a hair's breadth,
דער ביאור אין דעם איז: בעת עס האנדלט זיך וועגן דער אנטשיידונג פון טמא און טהור וואס באשטייט בלויז אין א משהו פון א חוט השערה,
which from that perspective it could appear that the impure is actually pure,
וואס מצד דעם קען זיך אויסדוכטן אז דער טמא איז גאר טהור,
and yet one should distinguish between him and the pure — establish that he is impure and declare him impure — for this one needs a special empowerment specifically,
און דאך זאל מען מבדיל זיין צווישן אים און דעם טהור — פעסטשטעלן אז ער איז טמא און מדהה זיין אים — דערויף דארף מען האבן א נתינת כח מיוחד דוקא,
from the high level of "Shmini":
פון דער הויכער מדריגה פון ״שמיני״:
When one holds only at "the seven days of <b>the building"</b><b><sup>45</sup></b>
בעת מען האלט בלויז ביי "שבעת ימי הבנין״
the aspect of chain-like descent,
בחי׳ השתלשלות,
it is difficult to come together properly and distinguish in such a doubt where it concerns a hair,
איז שווער צו פאנאנדערקלייבן זיך ווי געהעריק און אנטשיידן אין אזא ספק וואו עס איז נוגע א האר,
a hair's breadth.
א חוט השערה.
On the contrary: the evil inclination is indeed a "clever one",
אדרבה: דער יצה״ר איז דאך א "קלוגינקער",
he puts himself on in a "silk cap",
טוט ער זיך אן אין א "זיידענע זופיצע",
in a cloak of holiness "<sup>46</sup>,
אין אן איצטלא דקדרשה ״ ,
and argues to the person:
אין טענה׳ט צום מענטשן:
Since every thing that the Almighty invites a person to is certainly in order that the person should refine the divine spark that is found in that thing,
היות אז יעדער זאך וואס דער אייבערשטער איז מזמין א מענטשן איז עס דאך בכדי דער מענטש זאל מברר זיין דעם ניצוץ אלקי וואס געפינט זיך אין דער זאך,
so how do you have the right — argues the evil inclination — not to use that food and to reject the divine spark that is in it?
היינט ווי האסטו דאס רעכט — טענה׳ט דער יצה״ר — ניט צו באנוצן זיך מיט דעם מאכל און מדחה זיין דעם ניצוץ אלקי וואס אין אים ?
Oh,
אי,
it is a doubt,
ס׳איז א ספק,
perhaps it is actually a forbidden thing,
טאמער אפשר איז עס גאר א דבר האסור,
so who tells you to be concerned about such things! In general — argues the evil inclination — when one slaughters an animal it is a kosher slaughter; most slaughters are kosher,
איז ווער הייסט דיר חושש זיין וועגן אזעלכע זאכן! בכלל — טענה״ט דער יצה״ר — אז מען שעכט א בהמה איז עס א שחיטה כשרה; רוב שחיטות זיינען כשירות,
so why must you be concerned,
איז וואס דארפסטו חושש זיין,
and because of this concern to reject<sup>47</sup>
און צוליב אט־דעם חשש מדחה זיין
the divine spark that is in the thing?
דעם ניצוץ אלקי וואס אין דער זאך?
When a Jew, however, has the aspect of "Shemini" which is above the chain of descent,
בעת א איד האט אבער די בחינה פון "שמיני" שלמעלה מהשתלשלות,
he has the correct will not to deviate, heaven forbid, a hair's breadth from the supernal will,
ער האט דעם ריכטיקן ווילן ניט אפצוטרעטן ח״ו אויף קיין האר פון דעם רצון העליון,
and this will is with a force that is above the limitations of intellect — then one does not let oneself be fooled by the temptations of the evil inclination,
און אט־דער ווילן איז מיט א תוקף וואס איז העכער פון הגבלות השכל — דאן לאזט מען זיך ניט אפנארן פון די פיתויי היצר,
because upon the essential will of a Jew
ווייל אויפן רצון עצמי פון א אידן
(which is above the chain of descent in the soul)

the animal soul cannot obscure<sup>48</sup>.

(And in the manner as it is known<sup>49</sup>

in the matter of teshuvah,

that for a doubtful sin the teshuvah is more difficult and deeper than for a definite sin,

therefore chatat bat danka

— so too regarding that one should initially not come to the prohibition,

that to guard oneself from a doubtful prohibition<sup>54</sup>,

especially such a doubt where one needs the "lehavdil" — one must come to the aspect of "shmini").
בפרט אזא ספק ביי וועלכן מען דארף האבן דעם ״להבדיל״ — מוז מען אנקומען צו בחינת "שמיני").
And this is also the continuation of Parshat Shmini to the parshah that follows it — "Isha ki tazria veyaleda zachar": through that which one arouses the "shmini" in the soul,
און דאס איז אויך דער המשך פון פרשת שמיני צו דער סדרה וואס נאך איר — ״אשה כי תזריע וילדה זכר״: דורך דעם וואס מען איז מעורר דעם "שמיני" שבנפש,
in which there are no changes,
וואס אין אים איז ניטא קיין שינויים,
and even when in intellect it turns out not as it is according to the supernal will,
און אפילו ווען אין שכל קומט אויס ניט ווי דאס איז לויטן רצון העליון,
one still stands with a strength etc. — then one comes to the aspect of "veyaleda <b>zachar"</b><b><sup>55</sup></b>
שטייט מען פארט מיט א תוקף כו׳ — דאן קומט מען צו דער בחינה פון ״וילדה זכר״
shir chadash leshon zachar<sup>56</sup>,
שיר חדש לשון זכר ,
which will be in the future redemption,
וואס דאס וועט זיין אין דער גאולה העתידה,
redemption after which there is no exile
גאולה שאין אחרי׳ גלות
(above changes),
(למעלה משינויים),
in the true and complete redemption,
אין דער גאולה האמיתית והשלימה,
with the coming of Mashiach Tzidkeinu,
בביאת משיח צדקנו,
very soon.
