and they bring Him in, as it were, as a witness on the deposit

because from the plain sense of the language of the verse it is implied,

When two people have a negotiation between themselves and they draw in someone else as a witness — a confirmation and assurance on the matter — it is not possible to call that one as the "third" between them: he becomes between them only a mediator who confirms and clarifies the negotiation between them,

One must understand: what kind of change is there by "and he denies to his fellow",

; is when the depositee denies the deposit and wants to take from him the object,

it means a denial in the ownership of the Almighty — "denies <b>the third party</b> between them",
הייסט עס א פארלייקענונג אין דער בעה״ב׳שקייט פון אויבערשטן — "מכחש בשלישי שביניהם",
and therefore it is called "and commits a trespass against the Lord" — that through his denying this,
און דעריבער הייסט עס "ומעלה מעל בה׳" — אז דורך זיין פארלייקענען דאס,
it consequently comes out as if he removes, so to speak, the deposit from the domain of the Holy One, blessed be He.
קומט במילא אויס כאילו ער נעמט ארויס כביכול דעם פקדון פון רשותו של הקב״ה.
And although according to this it turns out that also by denying a loan there is the concept of "denying" in the Above's ownership over the money — because <b>the Above</b> gave it to the lender — it is nevertheless not comparable:
און הגם אז לפ״ז קומט אויס אז אויך ביים פארלייקענען א מלוה איז דא דער ענין פון "מכחש" אין דעם אויבערשטנס בעל־הבתי׳שקייט אויפן געלט — ווארום דער אויבערשטער האט עס דאך געגעבן צום מלוה — איז אבער פארט ניט דומה:
By a loan,
ביי מלוה,
since "whoever lends etc. does so only with witnesses and a document",
וויבאלד אז "כל המלוה כו׳ אינו עושה אלא בעדים ובשטר",
he did not here connect the loan,
האט ער דא ניט פארבונדן די הלואה,
in a special manner,
אין אן אופן מיוחד,
with the ownership of the Above; but by a deposit,
מיט דער בעל־ הבתי׳שקייט פון אויבערשטן; משא״כ ביי א פקדון,
where "he does not want any soul to know of it <b>except a third</b> between them",
וואו "אינו רוצה שתדע בו נשמה אלא שלישי שביניהם",
he indeed in this specifically relied on the "third between them",
האט ער דאך אין דעם זיך באזונדערס פארלאזן אויפן "שלישי שביניהם",

the depositor believed the bailee only because he reckoned that the bailee would not go against the ownership of the Above,

and by denying the deposit he is therefore "denying the third between them" and is "unfaithful with G-d".
און פארלייקענדיק דעם פקדון איז ער דעריבער "מכחש בשלישי שביניהם" און איז "מועל בה׳".

After all this, an explanation is still required in this: When one denies the other's deposit,
לאחר כל זה פאדערט זיך נאך ביאור אין דעם: ווען איינער פארלייקנט דעם צווייטנ׳ס פקדון,
it is true indeed that he does a thing that is against the will of the Most High,
איז אמת טאקע אז ער טוט א זאך וואס איז קעגן דעם אויבערשטנס רצון,
but after all, the object remains — also after the denial — in the domain of the Most High — so why is it still called a "ma'al baHashem",
אבער סוכ״ס בלייבט דאך דער חפץ — אויך נאך דער פארלייקענונג — אין רשות פון דעם אויבערשטן — היינט פארוואס הייסט עס פארט א "מעל בה׳",
a <b>change</b> in the domain of the Holy One, blessed be He?
א שינוי אין רשותו של הקב״ה?
True,
אמת,
it is indeed not a strong question,
קיין שטארקע קשיא איז עס טאקע ניט,
because as said,
ווארום ווי געזאגט,
he goes here against the Most High's order in the matter of ownership,
גייט ער דא אנטקעגן דעם אויבערשטנס סדר אין בעל־הבתי׳שקייט,
and that means consequently as if he had taken out a thing from the domain of the Most High — but still it is not so simple.
און דאס הייסט במילא כאילו ער וואלט ארויסגענומען א זאך פון אויבערשטנס רשות — אבער דאך איז עס ניט אזוי גלאטיק.
Therefore Rashi indeed warns about this — but only in a hint-like manner — by adding the name of the author of the discourse <b>R. Akiva</b>:
דעריבער באווארנט דאס טאקע רש״י — אבער בלויז אין א רמז׳דיקן אופן — דורך צוגעבן דעם נאמען פון דעם בעל המאמר ר' עקיבא :
The reason that on the first day the Levites in the Holy Temple would say the psalm "To God belongs the earth and its fullness",
דער טעם וואס ביום הראשון פלעגן די לויים אין ביהמ״ק זאגן דעם מזמור "לה׳ הארץ ומלואה",

is, as it were, dependent on that He gives it and makes it belong to a certain person — then it follows automatically,

according to <b>R. Akiva</b>,

that if someone does not allow the "to give acquisition",

that that which "and he lies about his neighbor's property" is divided in the verse into two manners: "If a soul sins" and "and commits a trespass .

against the Lord" — although in <b>every</b> manner it is a "trespass" against the Most High

From this it is understood,

that the difference between "if a soul sins" and "and commits a trespass against the Lord" is only in relation to revelation,
אז דער חילוק צווישן "נפש כי תחטא" און "ומעלה מעל בה׳" איז נאר בשייכות צו גילוי,

This means,

that although this appears merely as a simple sin
אז הגם דאס זעט אויס בלויו ווי סתם א חטא
(but not a matter of heresy, may it not be said, and heaven forbid)

— it is <b>inwardly</b> a matter of "denying the third between them",
— איז עס בפנימיות אן ענין פון "מכחש בשלישי שביניהם",
like a matter of heresy, may it not be said<sup>22</sup>

; and even more: it is also a <b>misappropriation</b> of God — he thereby <b>changes</b>, as it were, in the domain of the Holy One, blessed be He.

— Through his not fulfilling the task incumbent upon him to make from his portion in the world a dwelling place for Him, may He be blessed,

he removes, as it were, that portion from the domain of the Holy One, blessed be He.

That which the Torah inserted the instruction of "If a person sins and commits a trespass against the Lord"
דאס וואס די תורה האט אריינגעשטעלט די הוראה פון "נפש כי תחטא ומעלה מעל בה׳"

specifically by "and deals falsely <b>with his neighbor</b>",

it is in order to emphasize,

regarding matters between man and his fellow

(and not only regarding between man and the Omnipresent)

One should have no mistake and think,
מען זאל קיין טעות ניט האבן און מיינען,
that regarding matters between man and the Omnipresent,
אז ביי ענינים שבין אדם למקום,
it is understandable that every detail "touches" upon the ownership of the Most High; regarding between man and his fellow however,
איז פארשטאנדיק אז יעדער פרט "רירט" אן אין די בעל־הבתי׳שקייט פון אויבערשטן; בנוגע צו בין אדם לחבירו אבער,
although that the commands about this are indeed <b>from</b> the <b>Most High</b> — it is nevertheless in order to protect "his fellow",
כאטש אז די ציוויים אויף דעם זיינען טאקע פון אויבערשטן — עס איז דאך אבער בכדי צו פארהיטן "חבירו",
is even when he should wrong him,
איז אפילו ווען ער זאל אים בא׳עולה׳נען,
it touches primarily a <b>person</b> but not the Most High —
רירט עס אן בעיקר א מענטשן אבער ניט דעם אויבערשטן —
Therefore the Torah states clearly,
זאגט דעריבער די תורה קלאר,
that "if a soul sins",
אז "נפש כי תחטא",
is although this is in a manner that externally it pertains only to "his fellow"
איז הגם אז דאס איז אין אן אופן וואס בחיצוניות איז עס שייך נאר צו " עמיתו "
(not to the Most High, heaven forbid),
( ניט צום אויבערשטן ח״ו),
nevertheless it is already a matter of "and commits a trespass against the Lord"<sup>23</sup>
פונדעסטוועגן איז עס שוין אן ענין פון ״ומעלה מעל בה״׳
; and even when he merely "lacked"
; און אפילו ווען ער האט בלויז "פארפעלט״
("sin — language of deficiency")
(״חטא — לשון חסרון")
doing his fellow a favor,
צו טאן זיין חבר א טובה,
etc. — it is,
וכיו״ב — איז עס,
inwardly,
בפנימיות,
already a matter of "trespass against the Lord",
שוין אן ענין פון "מעל בה׳",
as above.

But it is, however, "nothing stands before repentance"<sup>24</sup>
עס איז דאך אבער "אין לך דבר העומד בפני התשובה״
Is the parshah therefore concluding: "And he shall atone for him etc. and it shall be forgiven him"<sup>25</sup>.
איז די פרשה דעריבער מסיים: "וכפר עליו גו׳ ונסלח לו" .
So that not looking upon that which he was in a state of "When a soul shall sin"
אז ניט קוקנדיק אויף דעם וואס ער איז געווען אין א מצב פון "נפש כי תחטא"
(Which that itself is already inwardly a "treachery against the Lord",
(וואס דאס אליין איז שוין בפנימיות א "מעל בה׳",
as above),

And even when there was by him <b>openly</b> the "and committed a treachery against the Lord",
און אפילו ווען ס׳איז געווען ביי אים בגלוי דער "ומעלה מעל בה"׳,
Is as soon as he does teshuvah,
איז ווי נאר ער טוט תשובה,
Is "and he shall atone etc. and it shall be forgiven him",
איז "וכפר גו׳ ונסלח לו",
And so too in general: And when a soul shall sin — becomes
און אזוי אויך בכללות: ונפש כי תחטא — ווערט
("Because of our sins)

— we were exiled",
— גלינו",
Israel does teshuvah <b>and immediately</b> they are redeemed"<sup>26</sup>,
איז ישראל עושין תשובה ומיד הן נגאלין" ,
With the coming of Mashiach our righteousness,
בביאת משיח צדקנו,
Very soon and in our days<sup>27</sup>.
