that this happened at a certain time),

Regarding the second question, the commentators say<sup>5</sup>

: Since in the last verses of the previous portion it speaks about the manner and order of conduct of Moshe's speech to Jews — which relates to a longer period of time <b>after</b> Yom Kippur<sup>6</sup>
: היות ווי אין די לעצטע פסוקים פון דער פריערדיקער סדרה רעדט זיך וועגן דעם אופן וסדר ההנהגה פון משה׳ס דיבור צו אידן — וואס דאס באציט זיך צו א לענגערן משך זמן לאחרי יוה״כ
— therefore one could think,

that also the matter of "Vayakhel Moshe"

took place a prolonged time after Yom Kippur; therefore Rashi needs to clarify that it was on the morrow of Yom Kippur.

It is, however, difficult to explain thus:

Let us assume even that "Vayakhel Moshe" was as far removed in time from Yom Kippur,

it must still turn out that the order of conduct that is told in the verses at the end of Parshas Tisa

learn that that which the verses — which describe the manner of speech of Moshe to Jews and their conduct thereby — come in the text earlier <b>before</b> "Vayakhel Moshe" it is because this order was initiated and began immediately when Moshe came down from the mountain,

And since so,

is then the question returns to its place: why should one have a mistake and think that the "Vayakhel Moshe" was a duration of time after Yom Kippur and not learn according to the simple reasoning,

that he did this immediately after Yom Kippur?

Because there is a foundation to say,

At first glance one could say that the necessity for his interpretation
לכאורה וואלט מען געקענט זאגן אז דעם הכרח אויף זיין פירוש
(that "Vayakhel Moshe" is "<b>the day after</b> Yom Kippur" and not on Yom Kippur itself)
(אז "ויקהל משה" איז " למחרת יום הכפורים" און ניט ביוה״כ גופא)
Rashi takes from the fact that before conveying to the Jews the command regarding the work of the Mishkan, Moshe preceded them only with the warning regarding the observance of Shabbos
נעמט רש״י דערפון וואס פארן איבערגעבן צו אידן דעם ציווי אויף מלאכת המשכן האט זיי משה מקדים געווען בלויז די אזהרה אויף שמירת שבת
(in order to say that the work of the Mishkan "does not override Shabbos")<sup>11</sup>,
(בכדי צו זאגן אז מלאכת המשכן "אינו דוחה את השבת") ,
but not the announcement of "the warning of Yom Kippur".

— Now if one were to say,

that the "Vayakhel Moshe" occurred on Yom Kippur itself,

he would have first of all had to announce to them the warning of Yom Kippur in order to prevent them from doing the work of the Mishkan<sup>12</sup>

immediately on this first day itself.

In truth, however, one cannot answer like that.

Because the reason for all the laws of Yom Kippur — and included in them "and no work shall you do"<sup>13</sup>
ווייל דער טעם אויף אלע דינים פון יו״כ — ובכללם "וכל מלאכה לא תעשו״

as explained in Scripture<sup>14</sup>

"For on this day He shall atone for you, etc."

it is therefore understandable that the entire concept of Yom Kippur began only at the moment when the Almighty said "I have forgiven according to your words",

And since that is so,

it is therefore simple that on that day when Moses came down from the mountain,

on which it first began that the day of "in the seventh month, on the tenth of the month"<sup>13</sup>

should be a day of forgiveness — it is not possible that the laws of Yom Kippur should apply to it

(even not to the part of the day that was already after the "I have forgiven"<sup>16</sup>)

before the Almighty said "I have forgiven",

was not Yom Kippur<sup>17</sup>.

This is also implied from what is told in Parshas Yisro<sup>18</sup>.
וואס אזוי איז אויך משמע פון דעם וואס עס ווערט דערציילט אין פ׳ יתרו .
Earlier it states there: "And Yisro, Moses' father-in-law, took a burnt-offering and sacrifices for G-d etc. to eat bread etc.",
פריער שטייט דארט: "ויקח יתרו חותן משה עולה וזבחים לאלקים גו׳ לאכל לחם גו׳",
and immediately after that begins the verse "And it was on the next day" about which Rashi says "It was the day after Yom Kippur".
און גלייך נאך דעם הויבט אן דעם פסוק "ויהי ממחרת" אויף וועלכן רש״י זאגט "מוצאי יום הכפורים הי׳".
And since in the plain sense "And it was on the next day" also means — the morning after "And Yisro took",
און וויבאלד אז אין פשטות מיינט דער "ויהי ממחרת" אויך — אויף מארגן פון "ויקח יתרו",
it thus turns out that "And Yisro took" was on the day of Yom Kippur,
קומט דאך אויס אז דער "ויקח יתרו" איז געווען אין טאג פון יום־כפור,
when Moses our teacher came down from Mount Sinai.

— And since on that day they offered "a burnt-offering and sacrifices"

it is thus proven that the laws of Yom Kippur did not apply at all on that day<sup>20</sup>.

After Rashi explains that "And he assembled Moshe" was on the morrow of Yom Kippur,

that he does not gather people by hand but they are gathered by his word.

And its Targum is 'and he gathered.'"

Here too it is difficult to understand:

that since "he does not gather people by hand but they are gathered by his speech" the active voice is appropriate even when someone gathers them together<sup>32</sup>.
אז וויבאלד "אינו אוסף אנשים בידים אלא הן נאספים ע״פ דיבורו" פאסט דער לשון הפעיל אויך ווען עמעצער זאמלט זיי צונויף .
For after all he does not gather the people together actually with his hands,
ווארום סוף־סוף קלייבט ער די מענטשן ניט צונויף בפועל מיט די הענט,
but only that his speech brings about that they should be "gathered".

Based on this, one will also understand what Rashi concludes "ותרגומו ואכניש":

Since with "ויקהל משה" the verse comes to tell an important matter and a virtue regarding Moses,
וויבאלד אז מיטן "ויקהל משה" איז דער פסוק אויסן צו דערציילן אן ענין חשוב און א מעלה וועגן משה׳ן,
that <b>he</b>—Moses—had gathered together the Jews,
אז ער — משה — האט צוזאמענגעקליבן די אידן,
then why should one learn that "ויקהל

" is in the causative form and to teach—that since it was only "by means of his speech" it is not considered an "action"

Why did Moshe indeed wait with giving them the command about the making of the Mishkan until the next day,

and he did not give it to them on that same day?

it is told about the greatness of the elevation of the giving of the Torah and the giving of the Tablets,

how this caused the tremendous mesirah and nesinah and devotion of Jews to the matter of receiving the Torah and the Tablets.

One must therefore understand,
דארף מען בכן פארשטיין,
that likewise it was at the time when Moshe brought down the second Tablets,

And on the contrary: one can say that even more than with the first tablets.

Because the second tablets

were indeed connected with "Hashem was appeased to Israel with joy and a whole heart and said to Moshe: I have forgiven according to your words"<sup>38</sup>,

It is understandable that Moshe with the Jews were on that very day entirely absorbed in the matter of "I have forgiven" and within that the tablets — Torah — and there was for them no place for other things,

even not for such a matter as the making of the Mishkan.

And therefore that day was occupied exclusively with matters of

("I have forgiven" — repentance and)

Torah.

And although also these matters of Torah
און כאטש אז אויך די דאזיקע עניני תורה
(which Moshe then learned with them)

contained commandments regarding action — but in the then-current study of the sections and the halachos, only the aspect of <b>the Torah</b> of it was heard<sup>39</sup>.

Only on the second day,

<b>the day after</b> Yom Kippur,

he gathered together the Jews and said to them: "These are the words that Hashem commanded to do them",

"This is the thing that Hashem commanded"; then he conveyed to them the command of the Most High regarding

That <b>the day after</b> his descent from the mountain "Moshe sat to judge the people etc. between a man and his fellow, and I make known the statutes of God and His teachings."
אז ממחרת רדתו מן ההר "וישב משה לשפוט את העם גו׳ בין איש ובין רעהו והודעתי את חוקי האלקים ואת תורותיו".

And from this one can derive a lesson in the service of man
און דערפון קען מען ארויסלערנען א הוראה אין עבודת האדם
(like the commentaries of Rashi,

which also contain "the wine of Torah"<sup>41</sup>

— inner-directed lessons in the service of God)

There are those whose entire hishtadlus is — to make from the world a "Mishkan and Mikdash" to the Above — they need to know,
עס זיינען פאראן אזעלכע וואס זייער גאנצע השתדלות איז — צו אויפמאכן פון וועלט א "משכן ומקדש" צום אויבערשטן — דארפן זיי וויסן,
that as high as such avodah is,
אז ווי הויך ס׳איז אזא עבודה,
it cannot replace
קען זי ניט פארבייטן
(the mitzvah and)
(די מצוה און)
the matter of limud haTorah,
דעם ענין פון לימוד התורה,
which is greater than all mitzvos<sup>42</sup>.
וואס איז גרעסער פון אלע מצות .
And therefore during the learning one must be so united with the matter being learned<sup>43</sup>
און דעריבער דארף מען בעת הלימוד זיין אזוי מיוחד מיטן ענין הנלמד
and so mesur and naton to Torah,
און אזוי מסור ונתון צו תורה,
until one should have no connection then to any other matters,
ביז מ׳זאל ניט האבן קיין שייכות דאן צו קיינע אנדערע ענינים,
even not to the matter of "Kechu me'item terumah... yavo'u veya'asu... es haMishkan..."<sup>44</sup>
אפילו ניט צום ענין פון "קחו מאתכם תרומה גו׳ יבואו ויעשו גו׳ את המשכן גו׳״
; until the halachah<sup>45</sup>

And as hinted in our parshah <b>itself,</b>
וכמרומז בפרשתנו עצמה,
and as a preface to the Mishkan — "Veshachanti"<b>: He preceded </b>for them the warning of Shabbos to the command of the work of the Mishkan, to say<b> that it does not </b>override Shabbos<sup>47</sup>.
וכהקדמה למשכן — ״ושכנתי״ : הקדים להם אזהרת שבת לציווי מלאכת המשכן לומר שאינו דוחה את השבת .
But,
אבער,
on the other hand,
לאידך גיסא,
one can think that one can fulfill [the obligation] with the study of Torah alone — about this they say,
קען מען דאך מיינען אז מען קען יוצא זיין מיט לימוד התורה אליין — אויף דעם זאגט מען,
that "<b>the day after</b> Yom Kippur",
אז " למחרת יום הכפורים",
immediately <b>after</b> learning,
גלייך נאכן לערנען,
one must exert oneself in the service of making the world a dwelling place for Him, blessed be He.
דארף מען זיך משתדל זיין אין דער עבודה פון מאכן די וועלט פאר א דירה לו ית׳.
For whoever says, "I have only Torah," even Torah he does not have,
ווארום כל האומר אין לי אלא תורה אפילו תורה אין לו,
together with Torah there must also be acts of kindness<sup>48</sup>.

Another matter of "the wine of Torah"

in our Rashi commentary:

The wording of the verse is "<b>And he assembled</b> Moshe".
דער לשון הפסוק איז " ויקהל משה".
But Rashi in his commentary on this uses the wording<b> </b>
אבער רש״י אין זיין פירוש אויף דעם באנוצט דעם לשון
(<b>Not</b> <b>"</b>he does not <b>assemble </b>etc. <b>assembled ones etc.",</b>
( ניט " שאינו מקהיל כו׳ נקהלים כו"׳,
but)

"he does not <b>gather etc. gathered ones etc."</b>
"שאינו אוסף כו׳ נאספים כו"׳.
In the way of the simple meaning, it is no question — because gathering is a word that is more common than assembling.
אין דרך הפשט איז עס קיין קשיא ניט — ווייל אסיפה איז א לשון וואס איז מער מורגל ווי הקהלה.
But in the inner aspects of the matters, one could say that Rashi thereby
אבער אין פנימיות הענינים י״ל אז רש״י איז דערמיט
(with his changing from the term assembly to a term gathering)
(מיט זיין משנה זיין פון ל׳ קהלה אויף א ל׳ אסיפה)
hints at a matter of the inner dimension of the Torah:
מרמז אויף אן ענין פון פנימיות התורה:
The word "קהל" is a name that denotes the collective
דער ווארט "קהל" איז א שם וואס באצייכנט דעם כלל
(men)
(אנשים)
not as a multitude and combination of several individuals but as a new reality — <b>קהל״׳.</b>
ניט ווי א ריבוי וצירוף כמה פרטים נאר ווי א נייע מציאות — קהל״׳.
And in this consists the advantage of "ויקהל" over "ויאסוף": "ויאסוף" means — he gathered together a number of people in one place
און אין דעם באשטייט דער יתרון פון "ויקהל" אויף ״ויאסוף״: ״ויאסוף״ מיינט — ער האט צונויפגעזאמלט א צאל מענטשן אין איין מקום
(or matter),
(אדער ענין),
but even after the gathering it can be that each one of the gathered ones is a separate reality.
אבער אויך לאחרי האסיפה קען זיין אז יעדערער פון די נאספים איז א באזונדער מציאות.
In contrast "ויקהל" means that he created from them a "קהל": everyone who enters into the קהל becomes nullified from his individual distinctiveness and becomes a part of the קהל.
דאקעגן "ויקהל" מיינט אז ער האט פון זיי געשאפן א ״קהל״: יעדערער וואס גייט אריין אין קהל ווערט נתבטל פון זיין פרטיות׳דיקער באזונדערקייט און ווערט א טייל פון דעם קהל.
And this is the reason that by the making of the Mishkan it says <b>"ויקהל </b>משה את כל עדת בני ישראל",
און דאס איז דער טעם וואס ביי עשיית המשכן שטייט "ויקהל משה את כל עדת בני ישראל",
that Moshe made from all Jews one קהל — because the purpose of "ועשו לי מקדש" is indeed the revelation of G‑dliness of "ושכנתי בתוכם",
אז משה האט פון אלע אידן אויפגעמאכט איין קהל — ווארום דער תכלית פון "ועשו לי מקדש" איז דאך דער גילוי אלקות פון "ושכנתי בתוכם",
therefore all Jews had to become one קהל,
דערפאר האבן אלע אידן געמוזט ווערן איין קהל,
for specifically then,
וואס דוקא דאן,
when they are "כולנו כאחד",
ווען זיי זיינען "כולנו כאחד",
can there be among them the revelation of "הוי׳ אחד"<sup>50</sup>.
קען ביי זיי זיין דער גילוי פון ״הוי׳ אחד״ .
Therefore one also finds,
דעריבער געפינט מען אויך,
that the Tabernacle had to be built specifically from public funds
אז דער משכן האט געמוזט געבויט ווערן דוקא פון ממון ציבור
(just as the public,

also their money is <b>one</b> thing),
ווערט אויך זיין ממון איין זאך),
and not from money that belongs to many individuals as a partnership<sup>*50</sup>.

True indeed,

that only at the making of the Tabernacle did it become public funds,

but <b>came</b> it nevertheless from <b>individual</b> donations,

everyone whose <b>heart</b> motivates him shall bring it,

every Jew had to donate according to <b>his</b> heart from his <b>particular</b> property<sup>51</sup>

already at the <b>announcement</b> of the donations for the Tabernacle — because this itself is the lesson: this donation that every Jew gave according to his heart from his own money,

he had to give from the outset in such a way that his particular ownership in that money should become nullified,

that it should become public funds.

Every thing that feels like a reality cannot by nature suffer any other reality.

integration — even only in an integration of "assembly"

— this is connected with a movement of self-nullification on the part of those assembled and integrated.

For the very fact that they come together in one assembly for one purpose,

already indicates a certain measure of self-nullification,

of absence of self-spreading
פון העדר ההתפשטות
(because when one's reality is in self-spreading,
(ווייל בשעת ביי איינעם איז זיין מציאות בהתפשטות,
he will not be able to even just come together with the other<sup>52</sup>).
וועט ער ניט קענען אפילו נאר צוזאמענקומען זיך מיטן צווייטן ).
But nevertheless,
אבער אעפ״כ,
the self-nullification that exists by "assembly",
איז דער ביטול וואס איז דא ביי "אסיפה",
is no more than a matter of nullification of the somethingness
איז ניט מער ווי אן ענין פון ביטול היש
(only the nullification of his "somethingness",
(בלויז דער ביטול פון זיין "יש",
as the reality stands in selfhood and self-spreading — and <b>not </b>nullification in reality).
ווי די מציאות שטייט אין ישות און התפשטות — און ניט ביטול במציאות).
Not so by "and he assembled" it is an integration in a manner of nullification <b>in reality: </b>he becomes nullified entirely from his own reality and becomes only a part of the congregation-reality.
משא״כ ביי "ויקהל" איז עס א התכללות אין אן אופן פון ביטול במציאות: ער ווערט נתבטל לגמרי פון זיין אייגענער מציאות און ווערט בלויז א טייל פון קהל־מציאות.
And this is the precise meaning of "And Moshe assembled": this—the power that exists by a Jew,
און דאס איז דער דיוק פון "ויקהל משה״: אט־דער כח וואס איז דא ביי א אידן,
that he should hear how his entire existence is only a part of K'lal Yisrael,
ער זאל דערהערן ווי זיין גאנצע מציאות איז בלויז א טייל פון כלל ישראל,
of the congregation of Yisrael — "Vayakhel" — it comes from "Moshe" whose meaning is self-nullification of "and we [are] what" — self-nullification in actuality<sup>51</sup>

Nevertheless, Rashi changes his language and says: "that I [do not] gather ..

because with this he wants to indicate a lesson in the order of the service: the empowerment from Moshe the faithful shepherd and the ultimate elevation is indeed the manner of self-nullification in actuality,

which the Torah says and exhorts of Jews.

Rashi, however,
רש״י אבער
(whose purpose is to teach a Jew gradually,
(וואס ענינו איז צו לערנען א אידן בהדרגה,
beginning from a "five-year-old" etc.)
אנהייבנדיק פון א ״בן חמש״ כו׳)
is precise and teaches,
איז מדייק און לערנט,
that the beginning is in the manner of "assembly",
אז די התחלה איז אינעם אופן פון "אסיפה",
self-nullification of the existent.

And then from level to level,
און דערנאך מדרגא לדרגא,
until — to the self-nullification in actuality of "And Moshe assembled".
ביז — צום ביטול במציאות פון "ויקהל משה".
But also the language "gathering" of Rashi is connected with "And Moses assembled"<sup>55</sup>.
אבער אויך דער לשון "אסיפה" פון רש״י איז מחובר מיט ״ויקהל משה״ .

When the illumination of the aspect of "Moshe" shines for a Jew, which is commensurate with his existence,
בשעת ס׳איז מאיר ביי א אידן די הארה פון בחי׳ "משה" וואס איז בערך צו זיין מציאות,
then only "bittul hayesh" is opened in him — he does not lose his entire selfhood,
דאן ווערט ביי אים אויפגעטאן בלויז ״ביטול היש״ — ער פארלירט ניט זיין גאנצע פאראנענקייט,
because this illumination of Moshe,
ווייל אט־די הארת משה,
which opens up the bittul,
וואס טוט אויף דעם ביטול,
is indeed measured and contracted according to his existence; but when the aspect of Moshe shines in him,

but "hif'il" through his speech — for speech in general is "something felt and seen as a thing in itself, separate from its source"<sup>56</sup>.
