And in Rashi's commentary: "Uncover for them the house of slaughter — so that they should not say, 'I eat the meat of the stabbed animal'<sup>4</sup>,
ובפרש"י "פרע להן בית השחיטה — שלא יאמרו בשר הנחירה אני אוכל<sup>4</sup>,
because the sons of Jacob were observers of commandments<sup>5</sup>,

And in our case, Yosef said to "the one over his house" to slaughter,

and thus this is the slaughter of a non-Jew<sup>10</sup>,
וא"כ ה"ז שחיטת נכרי<sup>10</sup>,
that even if it was done according to law
שגם אם נעשתה כדין

But Rashi according to his approach that there was no valid shechitah and did not explain that the one appointed over his house

At first glance there is place to say that it was a kosher slaughter
לכאורה יש מקום לומר שהיתה שחיטה כשירה
(even though the slaughterer was an Egyptian),
(אף שהשוחט הי' מצרי),
In the introduction of what is explained in M”A<sup>14</sup>
בהקדם המבואר במ"א<sup>14</sup>
regarding that the Patriarchs fulfilled the <pg>182</pg>
בהא דקיימו ה<pg>182</pg>
the entire Torah before it was given,
אבות כל התורה כולה עד שלא ניתנה,
about which the commentators disagree<sup>15</sup>
שנחלקו המפרשים<sup>15</sup>
whether the Patriarchs left the category of Bnei Noach or did not leave the category of B”N — that according to the simple explanation it seems to say that the fulfillment of the entire Torah by the Patriarchs was a stringency that they accepted upon themselves,

And based on this, one can say that the disqualification of slaughter by a non-Jew

did not apply before the giving of the Torah,

since the Patriarchs were not excluded from the category of the children of Noah<sup>17</sup>.

And thus, Joseph who commanded "the one over his house" to slaughter according to law,

his slaughter is valid even though he was an Egyptian.

But it is somewhat forced to say that the Egyptian man who was over Joseph's house was knowledgeable in the laws of slaughter and accustomed to slaughter without pressing, etc.
אבל דוחק קצת לומר שהאיש המצרי שעל בית יוסף הי' בקי בדיני שחיטה ורגיל בשחיטה שלא ידרוס וכו'.
And additionally: according to several opinions,
ועוד: לכמה דיעות<sup>18</sup>,
the essential disqualification of slaughter by a non-Jew is that it is the slaughter of an idolater
עיקר הפסול של שחיטת נכרי הוא להיותה שחיטת עכו"ם<sup>19</sup>
(and the disqualification of slaughter by a non-Jew who does not worship idols is only rabbinic),

and this disqualification also applies before the giving of the Torah,

Moreover: according to the simple meaning — there is no place to interpret that Joseph commanded to slaughter according to law

— for in any case his brothers could not eat from this slaughter,

for they did not know that he was Joseph,

[And in one novella of the Maharsha<sup>22</sup>

he explains that this is the precise wording of the Gemara "he uncovered for them the place of slaughter",

that "if one of the house of Joseph had slaughtered even before them it would not have helped because the slaughter of a non-Jew is invalid even if a Jew stands over him,
ד"אם הי' שוחט אחד מבית יוסף אפי' לפניהם לא הי' מועיל כיון דשחיטת עכו"ם פסולה אפי' בעומד ע"ג,
and 'he uncovered for them the place of slaughter' means that he let them uncover for themselves",

and he refers to his words in the novellae on Halachah,
ומציין לדבריו בחידושי הלכות,
where there he distinguishes between the term "and slaughter" and the term "and prepare",

that "and slaughter is not a term of command"<sup>23</sup>,

and this means that he did not command the one over his house to slaughter,

but rather that he let them slaughter.

But in Rashi's commentary on the Torah there is no hint of this,

and this is not at all according to the plain meaning of the verse,

for Joseph's brothers are the ones who slaughtered this feast].

And one could say, even more than this,
ויש לומר יתירה מזו,
that even to Yosef it is forbidden to feed his brothers from this slaughter.

For even though it was slaughtered according to law,
דאף שנשחט כדין,
nevertheless,
מ"מ,
since they think it is neveilah,
כיון שהם חושבים שהוא נבילה,
behold, if they eat it they require atonement

(as explained in the Gemara<sup>24</sup>

"One who intended to have in his hand pig meat and had in his hand lamb meat requires atonement and forgiveness",

and also according to the simple meaning of the verse it is so,
וגם ע"פ פשוטו של מקרא כן הוא,
as Rashi explains on the verse<sup>25</sup>

"And Hashem will forgive her" — "Of what does the verse speak?
"וה' יסלח לה" — "במה הכתוב מדבר,
Of a woman who vowed to be a nazirite and her husband heard and annulled it for her and she did not know and transgresses her vow etc. This is one who requires forgiveness")
באשה שנדרה בנזיר ושמע בעלה והפר לה והיא לא ידעה ועוברת על נדרה כו' זו היא שצריכה סליחה")
— and thus also<pg>183</pg>

Yosef is forbidden to feed them this meat from the aspect of "before a blind person"<sup>26</sup>.
יוסף אסור להאכילם בשר זה מצד "לפני עור"<sup>26</sup>.
And it can be said that also for this reason Rashi did not explain that there was here a kosher slaughter,
וי"ל שגם מהאי טעמא לא פרש"י שהיתה כאן שחיטה כשירה,
since this does not help at all to permit slaughter for the tribes.
כיון שאין זה מועיל כלל להתיר בשחיטה לשבטים.

And seemingly, how did the tribes eat this meat?
ולכאורה איך אכלו השבטים בשר זה?
And it can be said that there was no prohibition in eating the meat because they were compelled in this due to fear of the kingdom
וי"ל שלא הי' איסור באכילת הבשר כי היו מוכרחים בזה מצד יראת המלכות
(and according to what is said in the Maharsha<sup>27</sup>
(וע"ד מ"ש במהרש"א<sup>27</sup>
regarding "and they drank and became drunk with him"<sup>28</sup>,
לענין "וישתו וישכרו עמו"<sup>28</sup>,
that on that day they drank wine with Joseph — even though they considered him a gentile and it would be their stam yeinam which is forbidden

and in Rashi "and Onkelos gave a reason for the matter,"

And therefore it seems to me that in the simple meaning of Scripture we do not find that also the tribes,

observed the entire Torah in its entirety before it was given.

Regarding the Patriarchs, Rashi brings that they fulfilled the entire Torah,
אצל האבות מביא רש"י שקיימו כל התורה כולה,
and as it is said that Avraham fulfilled<pg>184</pg>
וכמ"ש שאברהם קיים<pg>184</pg>
even Rabbinic decrees<sup>34</sup>,
אפילו גזירות דרבנן<sup>34</sup>,
and likewise with Yaakov<sup>35</sup>
וכן ביעקב<sup>35</sup>
it says "and I have kept the 613 commandments"<sup>36</sup>
כ' "ותרי"ג מצות שמרתי"<sup>36</sup>
— but regarding the tribes, it is not mentioned in Rashi's commentary on the Torah anywhere<sup>37</sup>

that they were careful in observing the 613 commandments.

And on the contrary: Rashi brings in his commentary on the Torah<sup>38</sup>

that Joseph suspected his brothers of [eating] a limb from a living animal,

And behold, all this only answers the question of how the tribes ate from this slaughter

— but still the difficulty of the explanation of "slaughter slaughter and prepare" —

And we find many times in the Torah regarding the arrangement of meals,

and the details of the preparations for the meal were not specified,

because the tribes also knew about the chief of the slaughterers of Pharaoh<sup>53</sup>,
כי גם השבטים ידעו ע"ד שר הטבחים של פרעה<sup>53</sup>,
whose meaning is the chief of "slaughterers of the king's animals"<sup>54</sup>,
שענינו שר של "שוחטי בהמות המלך"<sup>54</sup>,
and if so, certainly also by Joseph it was so,
וא"כ בטח שגם אצל יוסף הי' כן,
that they slaughtered the animals
שטבחו הבהמות
(and there was no meat from a living animal).
(ולא הי' בשר מן החי).

And one can say the explanation of this:
ויש לומר הביאור בזה:
In Joseph's conduct with his brothers,
בהנהגת יוסף עם אחיו,
we find contradictory things: it is said<sup>55</sup>
מצינו דברים הפכיים: נאמר<sup>55</sup>
"And he made himself strange to them and spoke harshly to them",
"ויתנכר אליהם וידבר אתם קשות",
that the reason in simple sense for this conduct was<sup>56</sup>
שהטעם בפשטות להנהגה זו הי'<sup>56</sup>
in order to test them if they regret selling him
כדי לבחון אותם אם מתחרטים על מכירתם אותו
(And as we find that through the speaking with them he brought them to this that they said "But we are guilty etc. and Reuben answered etc."<sup>57</sup>)
(וכפי שמצינו שע"י הדו"ד עמהם הביאם לכך שאמרו "אבל אשמים אנחנו גו' ויען ראובן גו'"<sup>57</sup>)

But on the other hand we find that although initially Joseph imprisoned Simeon,
אבל לאידך מצינו שאע"פ שלכתחילה אסר יוסף את שמעון,
it was only "before their eyes,
הי' זה רק "לעיניהם,
and when they went out they brought out and fed and gave him drink"<sup>58</sup>
וכיון שיצאו הוציאו והאכילו והשקהו"<sup>58</sup>
(And certainly when they returned to Egypt Simeon told them all this),
(ובודאי שכאשר חזרו למצרים סיפר להם שמעון כ"ז),
and also now he brought them to his house to eat with him
וגם עתה הביאם אל ביתו לאכול אתו
(And when it entered their mind that this is only "to roll upon us and to fall upon us and to take us as slaves etc."<sup>59</sup>,
(וכאשר עלה על דעתם שזה רק "להתגולל עלינו ולהתנפל עלינו ולקחת אותנו לעבדים גו'"<sup>59</sup>,
the man who was over his house assured them that it is not so,
הבטיח להם האיש אשר על ביתו שאינו כן,
but rather "Peace to you"<sup>60</sup>),
אלא "שלום לכם"<sup>60</sup>),
and Joseph himself ate with them,
ויוסף עצמו אכל עמהם,
until "they drank and became drunk with him"<sup>28</sup>.
עד ש"וישתו וישכרו עמו"<sup>28</sup>.
And it must be said that Yosef wanted that when he would be revealed to his brothers they would believe him,
ויש לומר שיוסף רצה שכאשר יתוודע אל אחיו יאמינו לו,
and therefore he did several things so that afterwards it would become clear to them that all his actions were to hint to them that he is Yosef and he conducts himself with them as a brother.
ולכן עשה כמה דברים כדי שאח"כ יתברר להם שכל מעשיו היו לרמז להם שהוא יוסף ומתנהג עמהם כאח.

And this is also the reason that he said "and slaughter a slaughter and prepare",
וזהו גם הטעם שאמר "וטבוח טבח והכן",
that they prepare for them a special meal,
שמכין עבורם סעודה מיוחדת,
that this is a sign of extra affection.
שזהו אות לחיבה יתירה.
And one may add further: In addition to the conduct in a manner of drawing close,
ויש להוסיף עוד: נוסף על ההנהגה באופן של קירוב,
we find that Yosef did several things that his brothers would suspect that he knows who they are.
מצינו שיוסף עשה כמה דברים שאחיו יחשדו שהוא יודע מי הם.
And like this that he seated them before him "the firstborn according to his birthright etc."<sup>61</sup>
וכמו זה שהושיב אותם לפניו "הבכור כבכורתו גו'"<sup>61</sup>
(And he counted them according to the order of their generations,
(ומנאם לסדר תולדותם,
according to Rashi's commentary)
כפרש"י)
until "and the men marveled, each to his brother"<sup>61</sup>.
עד ש"ויתמהו האנשים איש אל רעהו"<sup>61</sup>.
And this is also the reason for the saying "and slaughter a slaughter and prepare",
וזהו גם הטעם לאמירת "וטבוח טבח והכן",
that he emphasized the matter of "and slaughter": the matter of slaughtering as preparation for eating is an important conduct that has details that the shechitah should be proper,
שהדגיש ענין של "וטבוח": ענין הטביחה כהכנה לאכילה היא הנהגה חשובה שיש בה פרטים שתהי' שחיטה יפה,
unlike by a Ben Noach where there is no place to emphasize the slaughtering in itself,
משא"כ בב"נ שאין מקום להדגיש הטביחה כשלעצמה,
because it is only a preparation for feeding it.
כי אינה אלא הכנה להאכילה.
And this was the intention of Yosef in his saying "and slaughter a slaughter and prepare",
וזו היתה כוונת יוסף באמרו "וטבוח טבח והכן",
that he used such language to hint to them<sup>51</sup>
שנקט לשון כזו לרמז להם<sup>51</sup>
that he knows of the custom in the house of Yaakov that there is need to warn especially about the manner of slaughtering the animal.
שהוא יודע מהנוהג בבית יעקב שיש צורך להזהיר במיוחד על אופן טביחת הבהמה.

ח.
And along the lines of mussar it can be said,
וע"ד המוסר יש לומר,
that in this itself that the verse emphasizes "and slaughter a slaughter and prepare" — that according to Rashi he prepared for his brothers meat of the trachea — it comes to teach us the desirable way in the effort of hospitality:
שבזה גופא שהכתוב מדגיש "וטבוח טבח והכן" — שלפרש"י הכין עבור אחיו בשר נחירה — בא ללמדנו את הדרך הרצוי' בההשתדלות בהכנסת אורחים:
Hospitality properly is that the host toils with all his strength to provide for his guests all their needs.
הכנסת אורחים כדבעי היא שהמארח טורח בכל כחו לספק לאורחיו את כל צרכיהם.
And even if it is doubtful to him whether they will take their portion from all that he prepared for them — nevertheless he provides them all good generously.
וגם אם ספק אצלו אם יטלו את חלקם מכל מה שהכין להם — מ"מ מספק להם כל טוב בהרחבה.
And furthermore — that he should not mix his stringencies in his effort in hospitality,
ועוד זאת — שאין לו לערב החומרות שלו בהשתדלותו בהכנסת אורחים,
if thereby their needs will be diminished<sup>*61</sup>.
אם עי"ז יוגרע מטיב צרכיהם<sup>*61</sup>.
And furthermore: It is possible that his guests will be stringent upon themselves like him,
ויתירה מזו: יתכן שאורחיו יחמירו ע"ע כמותו,
but it is not his role to force them regarding this, only to prepare a meal with abundance,
אבל אין ענינו להכריחם ע"ז כ"א להכין סעודה בהרחבה,
and the choice is in their hand whether to be stringent upon themselves and to what extent.
והבחירה בידם אם להחמיר על עצמם ועד כמה.
And through increase in love of Israel, one nullifies the cause of the exile<sup>62</sup>,
וע"י הוספה באהבת ישראל מבטלים סיבת הגלות<sup>62</sup>,
and the true and complete redemption comes through our righteous Mashiach,
ובאה הגאולה האמיתית והשלימה ע"י משיח צדקנו,
speedily in our days, literally.
במהרה בימינו ממש.
