A.
א.
Regarding the obligation of education of minors,
בחיוב דחינוך הקטנים,
It is stated in many places that "education is rabbinic"<sup>1</sup>,
איתא בכ"מ ד"חינוך מדרבנן"<sup>1</sup>,
But from the Torah there is no obligation of education — and it requires explanation:
אבל מן התורה ליכא חיוב חינוך — ודרוש ביאור:
Since according to the Torah, the moment a minor becomes an adult he is immediately obligated in the fulfillment of all the commandments of the Torah,
כיון שמן התורה ברגע שהקטן נעשה גדול חייב מיד בקיום כל מצוות התורה,
if so, if there is no obligation from the Torah to prepare him for the time of his adulthood,
א"כ באם אין חיוב מן התורה להכינו לזמן גדלותו,
will he transgress the commandments of the Torah due to lack of knowledge and lack of preparation?
יעבור על מצות התורה מחמת חסרון ידיעה וחוסר הכנה?
Simply put, one can say,
בפשטות יש לומר,
that this is included in the general commandment of Talmud Torah,
שזה נכלל במצוה הכללית דתלמוד תורה,
"It is a positive commandment from the Torah for a father to teach his minor son Torah..
"מצות עשה מן התורה על האב ללמד את בנו הקטן תורה..
as it is said<sup>2</sup>
שנאמר<sup>2</sup>
And you shall teach them to your children to speak of them"<sup>3</sup>,
ולמדתם אותם את בניכם לדבר בם"<sup>3</sup>,
and as the Ramban explained on the verse<sup>4</sup>
וכמו שפי' הרמב"ן בפסוק<sup>4</sup>
"And you shall repeat them to your children",
"ושננתם לבניך",
"Since He commanded regarding the statute of an eternal statute for your generations<sup>5</sup>..
"מאחר שציוה במצות חוקת עולם לדורותיכם<sup>5</sup>..
behold we are commanded that our children should know the commandments<sup>6</sup>,
הנה אנחנו מצווים שידעו בנינו המצוות<sup>6</sup>,
and how will they know them if we do not teach them"<sup>7</sup>.
ואיך ידעו אותם אם לא נלמדם"<sup>7</sup>.
And according to this, there is from the Torah an obligation of chinuch as preparation for the fulfillment of the commandments in his adulthood,
ולפ"ז ישנו מן התורה חיוב של חינוך בתור הכנה לקיום המצות בגדלותו,
and on the contrary,
ואדרבה,
this is the foundation of the general commandment of Talmud Torah for children,
זהו יסוד המצוה הכללית דת"ת לבנים,
as above.
כנ"ל.
But that from the Torah the commandment is "that they should know the commandments of our children,"
אלא שמן התורה המצוה היא "שידעו בנינו המצות",
and the Rabbis came and instituted that there is also a commandment to educate the son in the fulfillment of the commandments,
ואתו רבנן ותיקנו שגם מצוה לחנך את הבן בקיום המצות,
and as the early authorities wrote,
וכמ"ש ראשונים,
that it is in order "to accustom the minor to the commandment..
שהוא כדי "להרגיל את הקטן למצוה..
so that he should be educated and accustomed to the commandments"<sup>8</sup>,

"to guide him so that he should be habituated after his custom when he grows up"<sup>9</sup>,

like the matter that is said<sup>10</sup>
כענין שנאמר<sup>10</sup>
"Train the youth according to his way, even when he grows old he will not depart from it"<sup>11</sup>.
"חנוך לנער על פי דרכו גם כי יזקין לא יסור ממנה"<sup>11</sup>.
But at first glance this is not sufficient<sup>12</sup>
אבל לכאורה אין זה מספיק<sup>12</sup>

That knowledge of the commandments itself is not enough that he will fulfill them in practice when he grows up,
שידיעת המצות עצמה אינה די' שיקיימן בפועל כשיגדיל,
and as is proven from this very thing that the Sages obligated to educate him in the fulfillment of the commandments in practice so that he will become accustomed to them,
וכדמוכח מזה גופא שחכמים חייבו לחנכו בקיום המצות בפועל שיתרגל בהן,

הרי,
that from the Torah,
שמן התורה,
when the minor grows up and reaches the age of thirteen years and one day,
כשיגדל הקטן ויגיע לגיל י"ג שנה ויום אחד,
there is lacking in his preparation and his complete training so that he will be able to fulfill in practice all the commandments properly when he grows up.
חסר בהכנתו והכשרתו השלימה כדי שיוכל לקיים בפועל כל המצוות כדבעי כשיגדל.
For if the minor becomes accustomed to conduct without the guarding of the Torah and the commandments,
דאם נתרגל הקטן להתנהג ללא שמירת התורה והמצוות,
behold even if he knows
הרי גם אם יודע
(in his intellect and his thought)
(בשכלו ומחשבתו)
the laws of all the commandments,
הלכות כל המצוות,
it is impossible that in one moment he will begin to fulfill them all in practice properly
אי אפשר שבן רגע יתחיל לקיימן כולן בפועל כדבעי
(contrary to his nature and his previous custom).

Seemingly one could say,
לכאורה יש לומר,
that indeed there is an obligation of education<sup>13</sup>
שאכן ישנה חובת חינוך<sup>13</sup>
from the Torah<sup>14</sup>
מדאורייתא<sup>14</sup>
[and not only in knowledge of the commandments]
[ולא רק בידיעת המצות]
— and with an introduction:
— ובהקדם:
When the Torah obligates to fulfill some mitzvah,
כשהתורה מחייבת לקיים איזו מצוה,
for example laying tefillin,
ולדוגמא הנחת תפלין,
it is simple that the obligation is not only for one who has before him a pair of tefillin that he is obligated to lay them,
פשוט שאין החיוב רק למי שיש לפניו זוג תפלין שמחוייב להניחן,
but the mitzvah obligates him to do all that is necessary in order to obtain tefillin,
אלא המצוה מחייבתו לעשות כל הדרוש כדי להשיג תפלין,
And if he did not exert himself and because of this did not lay them, he has nullified a positive commandment.
ואם לא השתדל ומשו"ז לא הניחן ביטל מ"ע.
And likewise with several mitzvos,

that he is obligated from the Torah to do all that is necessary so that he can fulfill the mitzvah,

And in the language of the Rambam<sup>15</sup>

"There are positive commandments that a person is obligated to exert himself and pursue until he performs it, such as tefillin and sukkah and lulav and shofar."
"יש מצות עשה שאדם חייב להשתדל ולרדוף עד שיעשה אותה כגון תפלין וסוכה ולולב ושופר".
And even though the essence of the obligation is only a specific action like laying tefillin and taking the lulav, nevertheless this obligation itself obligates him in all the preparations necessary so that he can fulfill
ואף שגוף החיוב אינו אלא פעולה מסויימת כהנחת תפלין ונטילת לולב מ"מ חיוב זה עצמו מחייבו בכל ההכנות הדרושות כדי שיוכל לקיים

And furthermore,

that if he did not exert himself to learn and know how to fulfill the mitzvah,

and therefore did not fulfill it according to its law,

behold this too is considered a nullifier of a positive commandment.

And if so,
וא"כ,
regarding a minor who becomes an adult,
בקטן שנעשה גדול,
that then he becomes obligated immediately from the Torah in the fulfillment of the entire Torah,
שאז מתחייב מיד מדאורייתא בקיום כל התורה כולה,
behold since it is impossible that he fulfill all that is incumbent upon him without prior preparation,
הרי כיון שא"א שיקיים כל המוטל עליו בלי הכנה קודמת,
both learning and knowledge of the mitzvos,
הן לימוד וידיעת המצות,
and both his preparation and qualification that he become accustomed to fulfill them in practice
והן הכנתו והכשרתו שיתרגל לקיימם בפועל
(which is similar to the exertion to obtain tefillin or lulav and the like),
(שזהו ע"ד ההשתדלות להשיג תפילין או לולב וכיו"ב),
if so this preparation is also,
א"כ הכנה זו היא ג"כ,
apparently,
לכאורה,
an obligation from the Torah<sup>16</sup>.
חובה מה"ת<sup>16</sup>.
And since there is an obligation upon the minor to prepare himself for his adulthood except that a minor is not subject to obligation,
ומאחר שישנו חיוב על הקטן להכין עצמו לגדלותו אלא שקטן אינו ברחיובא,
therefore there is room to say that this obligation passes to the father

[And similar to what the Rivash wrote<sup>17</sup>

regarding pidyon haben,
לגבי פדיון הבן,
that "the essence of the mitzvah is upon himself except that in his minority it is impossible"<sup>18</sup>,
ש"עיקר המצוה בעצמו אלא שבקטנותו אי אפשר"<sup>18</sup>,
therefore it was imposed upon the father].

But nevertheless this obligation is not in the category of a commandment,
אלא שאעפ"כ אין חובה זו בגדר מצוה,
but rather only preparation and readiness alone,
כי אם רק הכשר והכנה בלבד,
in the manner and example of cutting wood to make charcoal to make iron
ע"ד ובדוגמת כריתת עצים לעשות פחמים לעשות ברזל
(scalpel for circumcision)<sup>19</sup>.

And this is what was added in the commandment of education that is rabbinic,
וזהו שנתוסף במצות חינוך שמד"ס,
that there is in this a category of obligation<pg>63</pg>

the commandment.

And it may be said,
ויש לומר,
that from the aspect of the obligation from the Torah, the minor's own action is not in the category of fulfilling a commandment,
שמצד החיוב מן התורה אין עשיית הקטן עצמה בגדר קיום מצוה,
but rather action in order that he become accustomed,
כ"א עשי' כדי שיתרגל,
while rabbinically the minor's action is in the category of a commandment,
ואילו מדרבנן עשיית הקטן היא בגדר מצוה,
and therefore from the Torah the fulfillment of the commandment that the minor does does not need to be in all the details,
ולכן מן התורה קיום המצוה שעושה הקטן אינו צריך להיות בכל הפרטים,
in complete fitness,
בהכשר גמור,
because from the aspect of preparation there is no difference so much in the manner of his doing,
כי מצד ההכנה אין נפק"מ כ"כ אופן עשייתו,
but unlike this, from the aspect of the rabbinic commandment of education, the minor needs to fulfill the commandments in all the details like an adult<sup>20</sup>.
משא"כ מצד מצות חינוך דרבנן צריך שהקטן יקיים המצות בכל הפרטים כגדול<sup>20</sup>.

And we find something similar in the commentary of Rabbeinu Manoach on what the Rambam wrote in Hilchos Shevisas Asor<sup>21</sup>,
ואת"ל מצינו כעין זה בפירוש רבינו מנוח במ"ש הרמב"ם בהל' שביתת עשור<sup>21</sup>,
"A minor of nine years and ten years, we train them for hours. How so? If he was accustomed to eat at two hours into the day, we feed him at three; if he was accustomed at three, we feed him at four. According to the child's strength we add to afflict him in hours. An eleven-year-old, whether male or female, fasts and completes [the fast] by rabbinic decree in order to train him in the commandments."
"קטן בן תשע שנים ובן עשר שנים מחנכין אותן לשעות כיצד הי' רגיל לאכול בשתי שעות ביום מאכילין אותו בשלש הי' רגיל בשלש מאכילין אותו בארבע לפי כח הבן מוסיפין לענות אותו בשעות בן אחת עשרה שנה בין זכר בין נקבה מתענה ומשלים מדברי סופרים כדי לחנכו במצות".
And Rabbeinu Manoach wrote about this: "And what the Rav wrote here 'in order to train him in the commandments' and above also wrote 'we train them for hours' comes to inform us that there are two types of training, as we say in the Gemara<sup>22</sup>
וכתב ע"ז רבינו מנוח: "ומה שכתב הרב כאן כדי לחנכו במצות ולעיל נמי כתוב מחנכין אותו לשעות בא להודיענו דתרי חנוכי הוו כדאמרינן בגמרא<sup>22</sup>
Rabbah said: There are two types of training, one for affliction and one for completion,
אמר רבה תרי חנוכי הוו חד לעינוי וחד להשלמה,
and the training of hours is not an obligation by rabbinic decree, but rather an obligation incumbent upon every person on his own to teach and accustom his children to walk in the paths of uprightness, as it is written: 'Train a youth according to his way' etc., and in order to bring them under the wings of the Shechinah..
וחנוך השעות אינו חובה מדרבנן אלא חובה המוטלת על כל אדם מעצמו ללמד ולהרגיל בניו ללכת בדרכי יושר כדכתיב חנוך לנער על פי דרכו וגומר וכדי להכניסם תחת כנפי השכינה..

And from his words it appears that there is a general obligation
ומדבריו נראה דישנו חיוב כללי
(as we learn from the verse "Train the youth")
(דילפינן מקרא ד"חנוך לנער")
to educate his children that they should go in the way of the Torah and the commandments<sup>23</sup>,
לחנך בניו שילכו בדרך התורה והמצוות<sup>23</sup>,
And this obligation, since it is only to accustom them to the commandments, does not require that the commandments be fulfilled in their proper form and according to their halacha.
וחיוב זה מאחר שאינו אלא להרגילם במצוות אינו מחייב שיתקיימו המצוות כתקונן וכהלכתן.
And in addition to this, the Sages obligated that the minor should perform each and every commandment according to its law and in all its details like the performance of an adult.
ונוסף על זה חייבו חכמים שהקטן יעשה כל מצוה ומצוה כמשפטה ובכל פרטי' כעשיית הגדול.

And one could say,

that what Rabbeinu Manoach wrote there that "the education of the hours is not an obligation from the Rabbis but an obligation incumbent upon every person from himself etc.",
שמ"ש רבינו מנוח שם ד"חינוך השעות אינו חובה מדרבנן אלא חובה המוטלת על כל אדם מעצמו כו'",
means that the responsibility of the father to educate his son

(in a general manner)

is proven from logic,

and a person is obligated in it from himself without there being a specific command and obligation for this.

That is: Since according to the Torah every person is obligated from the time he reaches the age of thirteen years and one day to fulfill the entire Torah and commandments,

it is understood and simple that every Jewish man will educate and accustom his sons "to walk in the path of uprightness",

just as it is simple that every upright person guides and educates his children in the good and upright path without having a command about this,

because this is the nature of a father,

and in the language of the verse<sup>24</sup>

regarding Abraham "he will command his children and his household after him to keep the way of the Lord to do righteousness and justice".
גבי אברהם "יצוה את בניו ואת ביתו אחריו לעשות צדקה ומשפט".
And based on this, one can say that there is in this a category of Torah law<sup>25</sup>,
ועפ"ז י"ל שיש בזה גדר דאורייתא<sup>25</sup>,
and as explained in many places in the Talmud that a matter that is proven from logic is from the Torah<sup>26</sup>
וכמבואר בכ"מ בש"ס דדבר המוכח מסברא הוא מה"ת<sup>26</sup>

However, at first glance it is a great novelty to say that there is an obligation of education from the Torah<sup>27</sup>,
אולם לכאורה חידוש גדול הוא לומר שישנה חובת חינוך מדאורייתא<sup>27</sup>,
and this is not mentioned in the poskim,
ולא הוזכר זה בפוסקים,
rather all of them held that the obligation of education is only from the words of the Scribes,
אלא כולם נקטו דחובת החינוך אינו אלא מד"ס,
and as explicit in the language of the Alter Rebbe in his Shulchan at the beginning of Hilchos Talmud Torah mentioned above "that a minor is exempt from all the commandments and also his father is not obligated to educate him in the commandments from the Torah, only from the words of the Scribes etc."<sup>28</sup>.
וכמפורש בלשון אדמו"ר הזקן בשלחנו ריש הל' ת"ת הנ"ל "שהקטן פטור מכל המצות וגם אביו אינו חייב לחנכו במצות מן התורה אלא מד"ס כו'"<sup>28</sup>.
And based on this, since from the Torah, the moment a minor becomes an adult he is immediately obligated in the fulfillment of the entire Torah,
ועפ"ז כיון שמה"ת ברגע שקטן נעשה גדול מחוייב מיד בקיום כה"ת כולה,
and if he was not educated and accustomed to the commandments beforehand, it is impossible that he will be able to be careful as required in all positive and negative commandments immediately when he grows up,
ואם לא נתחנך ונתרגל במצוות לפנ"ז מן הנמנע שיוכל להזהר כדבעי בכל מ"ע ומל"ת מיד כשיגדל,
then how can it be said that there is no obligation from the Torah to prepare him and make him ready for the time of his adulthood, lest he transgress the commandments of the Torah due to

And why did the Torah not transfer the obligation to the father or the court,

And it appears,

That since as soon as the minor grew up, he is obligated in all the commandments entirely,

When the Torah obligates in some mitzvah,

it is simple that the obligation applies only in a way that it can be fulfilled in a natural manner,

for the Torah was not given to ministering angels<sup>30</sup>,

"From the beginning of the seventh hour..

every moment that chametz is found in his domain and he is not occupied with removing it, he transgresses a positive commandment of the Torah",

or if prior effort is needed to obtain the objects of the mitzvah, like the four species and the like,
או אם צריך השתדלות מוקדמת כדי להשיג חפצי המצוה כמו ד' מינים וכדומה,
it is understood obviously that the obligation of preparation begins before the time of the fulfillment of the mitzvah, so that when its time arrives he can fulfill it properly<sup>32</sup>.
מובן לכאורה שחיוב ההכנה מתחיל לפני זמן קיום המצוה כדי שבבוא זמנה יוכל לקיימה כתיקונה<sup>32</sup>.
And to note, the obligation to fulfill the entire Torah in its entirety is a constant obligation,
ולהעיר דהחיוב לקיים כל התורה כולה הוא חיוב תמידי,
and also mitzvos<pg>66</pg>
וגם מצוות<pg>66</pg>
That the essence of their existence must be at a specific time,
שעצם קיומן צ"ל בזמן מסויים,
Nevertheless, the obligation that they be fulfilled in their time is constant.
מ"מ החיוב שיתקיימו בזמנן הוא תמידי.
And therefore, one who was lazy to obtain the Four Species before the holiday,
ולכן מי שנתעצל להשיג ד' מינים קודם החג,
And therefore could not fulfill the mitzvah of taking them in its time,
ולכן לא הי' יכול לקיים מצות נטילתם בזמנה,
Is considered as one who nullifies a positive commandment<sup>33</sup>.
נחשב כמבטל מ"ע<sup>33</sup>.
However, regarding a minor who grew up,
אמנם בקטן שנתגדל,
Since a minor is exempt from the entire Torah,
כיון שקטן פטור מכל התורה כולה,
And there does not apply to him
ולא שייך בי'
(When he was a minor)
(בהיותו קטן)
Any trace of obligation from the Torah<sup>34</sup>,
שום סרך של חיוב מה"ת<sup>34</sup>,
And the beginning of<pg>67</pg>
והתחלת<pg>67</pg>
The entire reality of obligation is only after he has grown up,
כל המציאות של חיוב אינו אלא משנתגדל,
therefore if from the nature of things a time of study and preparation is necessary until he can fulfill all the commandments,
לכן אם מצד טבע הדברים נחוץ זמן של לימוד והכנה עד שיוכל לקיים כל המצות,
then this time of preparation
הרי זמן הכנה זו
(from the Torah)
(מה"ת)
begins only after he has grown up,
מתחיל רק אחרי שנתגדל,
and then it is impossible that he transgress any commandment until the time of the preparation required for the fulfillment of that commandment passes.
ושוב אא"ל שעובר על שום מצוה עד שחולף הזמן של ההכנה הדרושה לקיום אותה מצוה.
And although this is a great novelty in halachah,
ואף כי זהו חידוש גדול בהלכה,
nevertheless it seems that from logic it is necessary,
מ"מ נראה דמסברא מוכרח הוא,
for how can any obligation apply in a way that by its very nature it is impossible to fulfill it,
דאיך יחול איזה חיוב באופן שמעצם טבעו א"א לקיימו,
and since the possibility of fulfilling the commandment properly is only through a preparation of study and education that requires a specific time,
ומכיון שהאפשריות של קיום המצוה כדבעי אינה אלא ע"י הקדמה של לימוד וחינוך הדורש זמן מסויים,
therefore it must be that all this is included in the essence of the obligation.
לכן צ"ל דכל זה נכלל בעצם החיוב.
And therefore there is no logic that the Torah would obligate to educate him while he is still in his minority so that he can fulfill all the commandments when he grows up,
ולכן אין סברא שהתורה תחייב לחנכו בעודו בקטנותו כדי שיוכל לקיים כל המצוות כשיגדיל,
and on the contrary,
ואדרבה,
the beginning of the application of the obligation is only at the moment he has grown up,
התחלת חלות החיוב אינה אלא ברגע שנתגדל,
and if a time of education and training is needed,
ואם צריך זמן של חינוך והכשרה,
then this is included in the essence of the application of the obligations that apply after he has grown up<sup>35</sup>.
הרי זה כלול בעצם חלות החיובים שחלים אחרי שנתגדל<sup>35</sup>.

ו.
And a proof for this reasoning can be brought from a convert who comes to convert,
והוכחה לסברא זו יש להביא מגר הבא להתגייר,
for we have a rule that we inform him
דקי"ל דמודיעין אותו
(only)
(רק)
some of the light commandments and some of the severe commandments
מקצת מצות קלות ומקצת מצות חמורות
[and this too only so that he might withdraw,
[וגם זה רק כדי שיפרוש,
as it is stated in the Gemara]<sup>36</sup>.
כדאיתא בגמ']<sup>36</sup>.
And the Rambam<sup>37</sup>
והרמב"ם<sup>37</sup>
added "and we inform him of the fundamentals of the religion, which are the unity of the Name and the prohibition of idolatry, and we elaborate on this matter, and we inform him of some of the commandments...
הוסיף "ומודיעין אותו עיקרי הדת שהוא ייחוד השם ואיסור עכו"ם ומאריכין בדבר הזה ומודיעין אותו מקצת מצות..
And we do not elaborate on this matter."
ואין מאריכין בדבר זה".
And it is simple that if he was not taught and educated in the performance of all the commandments before his conversion,
והנה פשוט דאם לא נתלמד ונתחנך בעשיית כל המצוות קודם גירותו,
he will not be able to fulfill them immediately after the conversion<sup>38</sup>,
לא יוכל לקיימן מיד אחר הגירות<sup>38</sup>,
and if so, why do we not teach him all the commandments and all their details,
וא"כ למה אין מלמדין אותו כל המצוות ובכל פרטיהם,
and on the contrary — "we do not elaborate on this matter."
ואדרבה — "אין מאריכין בדבר זה".
And therefore it must be said as above regarding a minor,
וע"כ צ"ל כנ"ל בנוגע לקטן,
that since the entire essence of the obligation in Torah and commandments applies only after the conversion,
דכיון שכל עיקר החיוב בתומ"צ חל רק אחרי הגירות,
therefore also the obligation of preparation and study begins only then,
לכן גם החיוב של הכנה והלימוד מתחיל רק אז,
and if he would require a period of preparation and habituation until he can fulfill certain commandments according to their law,
ואם ידרוש זמן של הכנה ורגילות עד שיוכל לקיים מצוות מסויימות כהלכתן,
then during all that time he does not transgress these commandments.
הרי כל משך אותו הזמן אינו עובר על מצוות אלו.
And analogous to a minor who has grown up
ובדוגמת קטן שנתגדל
(and a convert who has converted)
(וגר שנתגייר)
happened to our forefathers at the time of the Giving of the Torah, when they were obligated for the first time in Torah and commandments<sup>39</sup>,
אירע לאבותינו בשעת מ"ת שאז נתחייבו לראשונה בתורה ובמצוות<sup>39</sup>,
and certainly a time of study and preparation was required until they were able to fulfill the commandments<sup>40</sup>,
ובודאי נדרש זמן של לימוד והכנה עד שהיו יכולים לקיים המצוות<sup>40</sup>,
and likewise until they were able to prepare the objects of the commandments, such as tzitzis and tefillin<sup>41</sup>,
וכן עד שהיו יכולים להכין חפצי המצוות כמו ציצית ותפלין<sup>41</sup>,

And it is simple that one cannot say that all that time that they were occupied with preparation they were nullifying a positive commandment
ופשוט דאין לומר שכל אותו הזמן שהיו עסוקים בהכנה היו מבטלים מ"ע
(and they were exempt only because of the principle that the Merciful One exempts one forced),
(ונפטרו רק משום דאונס רחמנא פטרי'),
but rather since then the entire essence of the obligation began,
אלא שכיון שאז הותחל כל עיקר החיוב,
therefore it took effect in a manner that they could fulfill them,
לפיכך חל באופן שיוכלו לקיימן,
namely with the preparation of all the necessary preparations,
דהיינו בהקדמת כל ההכנות הדרושות,
including also the training and habituation.
כולל גם החינוך והרגילות.
And so it is with every minor who has grown up
וכן הוא אצל כל קטן שנתגדל
(and likewise a convert who converted),
(ועד"ז גר שנתגייר),
that all his obligation in Torah and commandments begins only upon his reaching majority,
שכל החיוב שלו בתורה ומצוות מתחיל רק בהגיעו לגדלות,
therefore all the time that he needs to occupy himself with study and preparation and training until he can fulfill some commandment properly or be careful about some transgression,
לכן כל הזמן שהוא צריך להתעסק בלימוד והכנה וחינוך עד שיוכל לקיים איזו מצוה כהלכתה או להזהר מאיזו עבירה,
he is not nullifying that positive commandment and he is not transgressing that negative commandment,
אינו מבטל אותה מ"ע ואינו עובר על אותה מל"ת,
and on the contrary he is occupied with their fulfillment<sup>42</sup>,
ואדרבה ה"ה עסוק בקיומם<sup>42</sup>,
and therefore there is no obligation of training while he is a minor from the Torah<sup>43</sup>.
ולהכי ליכא חובת חינוך בעודו קטן מן התורה<sup>43</sup>.
7.
ז.
Based on the above, we must explain a puzzling matter in connection with our father Abraham:
ע"פ הנ"ל יש לבאר ענין תמוה בשייכות לאברהם אבינו:
In the verse<sup>44</sup>
בפסוק<sup>44</sup>
"And Abraham was old, advanced in days," our Sages, of blessed memory, said<sup>45</sup>
"ואברהם זקן בא בימים" ארז"ל<sup>45</sup>
that our father Abraham performed his service throughout all the days of his life,
שאברהם אבינו עבד עבודתו במשך כל ימי חייו,
so that all his days were "complete days"<sup>46</sup>.
עד שכל ימיו היו "יומין שלימין"<sup>46</sup>.
And at first glance, this requires explanation: How can it be said that all of Abraham's days were in completeness,
ולכאורה צריך ביאור: איך אפשר לומר שכל ימיו של אברהם היו בשלימות,
when the first three years of his service were lacking,
והרי חסרו בעבודתו ג' שנותיו הראשונות,
as our Sages, of blessed memory, said<sup>47</sup>
כמחז"ל<sup>47</sup>
"At the age of three years Abraham recognized his Creator, as it is said<sup>48</sup>
"בן ג' שנים הכיר אברהם את בוראו שנאמר<sup>48</sup>
Because Abraham hearkened to My voice,
עקב אשר שמע אברהם בקולי,
its numerical value is one hundred and seventy-two years."
חושבני' מאה ושבעין ותרין שנין".
And all the more so according to the opinions that at the age of forty years he recognized his Creator,
וכ"ש וק"ו לפי הדיעות דבן ארבעים שנה הכיר את בוראו,
or at forty-eight<sup>49</sup>,
או בן מ"ח<sup>49</sup>,
it requires explanation how it can be said of him "advanced in days,"
שצריך ביאור איך אפשר לומר עליו "בא בימים",
that not even one day was lacking for him,
שלא הי' חסר אצלו אפילו יום אחד,
and even to the extent that our Sages, of blessed memory, said<sup>50</sup>
ועד שאמרו רז"ל<sup>50</sup>
(regarding Sarah,
(בנוגע לשרה,
from which it is apparently understood that so it is with Abraham)
שלכאורה מזה מובן שכן הוא באברהם)
"all of them are equal for good"?
"כולן שוין לטובה"?
And according to the above,
וע"פ הנ"ל,
that the matter of preparation and qualification for a mitzvah is a result and detail of the essence of the obligation,
דענין ההכנה והכשרה למצוה הוי תוצאה ופרט בעצם החיוב,
one can say in this manner also regarding Avraham Avinu:
יש לומר עד"ז גם בנוגע לאברהם אבינו:
This that Avraham recognized his Creator at the age of three years came through his preparation and qualification in the time prior to this,
זה שאברהם הכיר את בוראו בהיותו בן ג' שנה בא ע"י הכנתו והכשרתו בזמן שלפנ"ז,
to investigate and seek out God,
לחקור ולדרוש את האלקים,
and in the language of the Rambam<sup>51</sup>
ובלשון הרמב"ם<sup>51</sup>
"he began to roam in his mind..
"התחיל לשוטט בדעתו..

And he was astonished how it is possible that this sphere should always conduct itself and not have a leader,
והי' תמה האיך אפשר שיהי' הגלגל הזה נוהג תמיד ולא יהי' לו מנהיג,
and who would cause it to revolve,
ומי יסבב אותו,
and his heart roamed and understood until he grasped the way of truth etc."
ולבו משוטט ומבין עד שהשיג דרך האמת כו'".
And since during all the three years<sup>52</sup>
וכיון שבמשך כל ג' השנים<sup>52</sup>
he was occupied with preparation and readiness for knowing his Creator,
הי' עסוק בהכשר והכנה להכרת בוראו,
it is appropriate to say that they were "complete days",
שייך לומר שהיו "יומין שלימין",
also in the years before he knew his Creator,
גם בשנים לפני שהכיר את בוראו,
and also regarding the first three years.
וגם בנוגע לג' שנים הראשונות.
But nevertheless this is not included in "Avraham listened to my voice" all the time that he did not actually know his Creator,
אלא שאעפ"כ אין זה בכלל "שמע אברהם בקולי" כל זמן שלא הכיר את בוראו בפועל,
and nevertheless there is no deficiency in that he did not yet know his Creator then,
ומ"מ אין שום חסרון בכך שעדיין לא הכיר אז את בוראו,
for so it is necessary in the nature of things,
כי כך מוכרח בטבע הדברים,
that it required a time of preparation and readiness.
שהי' דורש זמן של הכנה והכשרה.
[Regarding the above,
[ע"ד הנ"ל,
That a thirteen-year-old and one day old cannot immediately begin to fulfill the commandment in its completeness,
דזה שבן י"ג שנה ויום א' אינו יכול להתחיל מיד בקיום המצוה בשלימותה,
This does not mean that there is a deficiency in him regarding the fulfillment of the commandment and only that he is not punished because he is in the category of "ones" (forced) from which the Merciful One exempts,
אין הפירוש בזה שיש חסרון אצלו בקיום המצוה ורק שאינו נענש כי הוא בגדר "אונס" דרחמנא פטרי',
But rather that from the outset it is so conditioned in the essence of the obligation,
אלא שמלכתחילה כך מותנה בעצם החיוב,
That at first he engages in preparation and qualification etc. and afterwards fulfills in practice and in completeness etc.].
שבתחלה עוסק בהכנה והכשרה כו' ואח"כ מקיים בפועל ובשלימות כו'].

ח.
And behold, all the above is from the Torah,
והנה כל הנ"ל הוא מן התורה,
But from the words of the Scribes there is a full command and obligation in the education of a minor,
אבל מדברי סופרים ישנו ציווי וחיוב גמור בחינוך קטן,
And on the contrary — the words of the Scribes are more stringent and beloved than the words of the Torah<sup>53</sup>.
ואדרבה — חמורים וערבים דברי סופרים יותר מדברי תורה<sup>53</sup>.
And one should add,
ויש להוסיף,
that the entirety of the matter of the fulfillment of the commandments during the time of exile is a matter of "training" regarding the fulfillment of the commandments after the redemption,
שכללות הענין דקיום המצות בזמן הגלות הוא ענין של "חינוך" לגבי קיום המצות אחרי הגאולה,
as it is stated in the Sifri<sup>54</sup>
כדאיתא בספרי<sup>54</sup>
"Even though I am exiling you from the land to outside the land,
"אע"פ שאני מגלה אתכם מן הארץ לחוצה לארץ,
be distinguished in commandments,
היו מצויינין במצוות,
so that when you return they will not be new to you..
שכשאתם חוזרים לא יהיו עליכם חדשים..
Set up<sup>55</sup>
הציבי<sup>55</sup>
for yourself markers",
לך ציונים",
indeed,
שכן,
"the essence of all the commandments is for those who dwell in the land of the L-rd"<sup>56</sup>.
"עיקר כל המצוות ליושבים בארץ ה'"<sup>56</sup>.
And through the fulfillment of the commandments during the time of exile,
וע"י קיום המצוות בזמן הגלות,
they hasten and expedite the time of the fulfillment of the commandments in perfect completeness,
ממהרים ומזרזים את הזמן דקיום המצוות בתכלית השלימות,
as the commandment of Your will<sup>57</sup>,
כמצות רצונך<sup>57</sup>,
in the true and complete redemption through our righteous Moshiach,
בגאולה האמיתית והשלימה ע"י משיח צדקנו,
speedily in our very days.
במהרה בימינו ממש.
