And in Rashi on the verse he brings two reasons for this law

that according to the second explanation in Rashi — "Because he should have prayed etc." — the intent of the verse "and he shall dwell there until the death of the High Priest" is,

that "the High Priest was punished..

for not having prayed"<sup>6</sup>.

And seemingly one must wonder: Where is it hinted in the verse and law "he shall dwell there until the death of the high priest" that there is here a punishment for the high priest?
ולכאורה יש לתמוה: היכן מרומז בכתוב ודין "וישב בה עד מות הכהן הגדול" שיש כאן עונש על הכהן גדול?
And what is the punishment for the high priest<sup>7</sup>
ומהו העונש לכהן גדול<sup>7</sup>
In this, that the murderer must dwell in his city of refuge until the death of the high priest<sup>8</sup>?
בזה שהרוצח צריך לישב בעיר מקלטו עד מות הכהן הגדול<sup>8</sup>?

In Sichas Purim Katan it is written that this "that it is written 'until the death of the high priest' the verse tells you that the murderer will lengthen days after the high priest because the high priest will die soon, and why,

And seemingly its explanation is difficult to understand,

for the intention of the verse "he shall dwell there until the death of the Kohen Gadol" simply is only to impose an obligation upon the murderer

verse is to emphasize the length of the murderer's stay in his city of refuge.

There are commentators<sup>12</sup>,

that "because the High Priest did not pray etc., therefore the Torah obligated him to this, that he should sit in his city of refuge until the death of the High Priest and suffer that he cannot return to dwell in his home as long as the High Priest is alive, and from this he will pray for the death of the High Priest and his prayer will be accepted and the High Priest will receive his punishment..

And at first glance it is very forced to explain thus in the language of Rashi,

that he did not mention at all

And also the content of the explanation — that the reason the Torah said "until the death of the high priest" is so that the murderers would pray for the death of the high priest — is very perplexing,

that this that the Torah said "he shall dwell there until the death of the high priest" is a punishment for the high priest,

And also in the second explanation, Rashi's intention is to explain why the punishment of the murderer
וגם בפירוש השני כוונת רש"י היא לבאר מדוע עונש הרוצח

[And so it also appears from the language of Rashi,

And from this it is also understood in our subject,

that the death of the Kohen Gadol is effective to atone for the sin of the murderer<sup>14</sup>.

But it is difficult for Rashi — what is the special connection between this sin of killing a person unintentionally and specifically the death of the Kohen Gadol

(and not another righteous person<sup>15</sup>)?

And therefore Rashi explained, "Because the Kohen Gadol should have prayed that this mishap not occur, etc.,"

That is, that the prevention of this mishap is connected to

And this will be understood by prefacing what we find in Rashi's commentary on the Torah,

except when the reason pertains to understanding the simple meaning.

And from this it is understood also in our case,

that this that Rashi brought here the reasons about the murderer's sitting in his city of refuge "until the death of the High Priest" is not merely to expound the reason of the verse but to resolve a difficulty in the verses here<sup>22</sup>

And it is puzzling,

And if so it is perplexing: since the murderer's stay in the city of refuge is to save him from the vengeance of the blood redeemer

"the avenger of blood, he shall put the murderer to death when he meets him",
"גואל הדם הוא ימית את הרוצח בפגעו בו",
and this is that upon the avenger of blood there is an obligation from the Torah to kill the murderer<sup>39</sup>.
והיינו שעל גואל הדם יש חיוב מן התורה להרוג את הרוצח<sup>39</sup>.
And following this it is said regarding one who kills a person unintentionally "and they shall judge<sup>40</sup>
ובהמשך לזה נאמר דבהורג נפש בשגגה "ושפטו<sup>40</sup>
the congregation between the striker and the avenger of blood according to these judgments.
העדה בין המכה ובין גואל הדם על המשפטים האלה.
And the congregation shall rescue the murderer from the hand of the avenger of blood etc. and he shall dwell there until the death of the high priest etc. And if the murderer shall go out etc. and the avenger of blood finds him etc. and the avenger of blood kills the murderer, he has no blood",
והצילו העדה את הרוצח מיד גואל הדם גו' וישב בה עד מות הכהן הגדול גו' ואם יצא יצא הרוצח גו' ומצא אותו גואל הדם גו' ורצח גואל הדם את הרוצח אין לו דם",
from which it is understood,
שמזה מובן,
that these matters are laws of the Torah — that the judge forbids the avenger of blood to kill the murderer when he is in his city of refuge,
שענינים אלה דיני תורה הם — שהשופט אוסר על גואל הדם להרוג את הרוצח כשהוא בעיר מקלטו,
and "if the murderer shall go out beyond the border of his city of refuge etc. and the avenger of blood finds him etc.
ו"אם יצא יצא הרוצח את גבול עיר מקלטו גו' ומצא אותו גואל הדם גו'
(the judgment is determined that)

and the avenger of blood kills the murderer",
ורצח גואל הדם את הרוצח",
and the reason for this is because outside his city of refuge "he has no blood",
והטעם ע"ז מפני שחוץ לעיר מקלטו "אין לו דם",
"he is like one who kills a dead person"
"הרי הוא כהורג את המת"

because in this state his judgment is determined for death<sup>41</sup>.

According to the above, the difference between the two explanations of Rashi and the reason that Rashi was compelled to bring the second explanation is understood:

According to the first explanation,
לפירוש הראשון,
that "he comes to cause the Divine Presence to rest, etc., and the murderer comes to remove, etc., he is not worthy to be before the High Priest",
ש"הוא בא להשרות כו' והרוצח בא לסלק כו' אינו כדאי שיהא לפני כהן גדול",
it follows,

that the murderer's dwelling in his city of refuge is not a punishment and atonement for his sin,

But this explanation is difficult

The departure of the murderer from his city of refuge should be so severe that "he has no blood"

— And because he places himself in a situation that "he is not worthy
— וכי בשביל שהוא מעמיד עצמו במצב ש"אינו כדאי
(to be before the High Priest)

" should the death penalty be imposed upon him<sup>42</sup>?

Furthermore: according to this, it is found,

that this that the city of refuge is a protection and rescue

from the hand of the blood avenger,

this is a result and consequence from

in order to save him "from the hand of the blood avenger".

And therefore Rashi brings a second reason<sup>43</sup>,
ולכן מביא רש"י טעם שני<sup>43</sup>,
that until the death of the high priest his iniquity was not yet atoned for him.
שעד מיתת הכהן גדול עדיין לא נתכפר לו עונו.
And based on this is understood the reason that if he goes out from his city of refuge "he has no blood",
ועפ"ז מובן הטעם שאם יוצא מעיר מקלטו "אין לו דם",
for until the death of the high priest there is still upon him the punishment of death because of his act of murder,
כי עד מיתת הכהן הגדול עדיין יש עליו עונש מיתה בגלל מעשה הרציחה שלו,
except that as long as he is found in his city of refuge it protects and saves him from this punishment.
אלא שכל זמן שנמצא בעיר מקלטו ה"ה מגינה ומצלת עליו מעונש זה.

And from all this there is to learn a wonderful lesson in the matter of love and unity of Israel:
ומכל זה יש ללמוד הוראה נפלאה בענין דאהבת ואחדות ישראל:
Kohen Gadol is the highest level among the Jewish people,
כהן גדול הוא הדרגא הנעלית ביותר שבעם ישראל,
and one who kills a person unintentionally is the lowest level
ומכה נפש בשגגה הוא הדרגא הפחותה ביותר
[for one who kills a person intentionally, his punishment is death and he is a dead man,
[דמכה נפש במזיד הרי עונשו מיתה וגברא קטילא הוא,
but among those who remain alive, there is none lower than one who kills a person unintentionally,
אבל בין הנשארים בחיים אין למטה מהורג נפש בשגגה,
therefore only regarding him do we find the punishment of exile<sup>44</sup>].
שלכן רק בו מצינו עונש גלות<sup>44</sup>].
And the verse teaches us — that they also
ומלמדנו הכתוב — שגם הם
(the two extremes among the Jewish people)
(שתי הקצוות שבבנ"י)
are dependent on each other,
תלויים זב"ז,
to the extent that the Torah made the atonement of this killer dependent on the Kohen Gadol,
עד שתלתה התורה כפרת מכה נפש זה עם הכהן גדול,
for this is the essence of the Kohen Gadol — a lover of Israel,
כי זהו ענינו של הכהן גדול — אוהב ישראל,
as we find regarding Aharon the Kohen Gadol, who was "a lover<sup>45</sup>
כמו שמצינו באהרן כהן גדול שהי' "אוהב<sup>45</sup>

And this is also the connection between the two explanations of Rashi — that in both of them the greatness of the love of Israel of the High Priest is emphasized: in the first explanation — on the positive side,

as the days<sup>48</sup>

of the tree are the days of My people",
העץ ימי עמי",
and "the High Priest is connected to length of days as it is said<sup>49</sup>
ו"כהן גדול שייך לאריכות ימים כמ"ש<sup>49</sup>
length of days in its right hand, behold that length of days is drawn from the aspect of<pg>212</pg>
אורך ימים בימינה הרי שאריכות ימים נמשך מבחי'<pg>212</pg>
right, that is, kindnesses..

and it is the aspect of the High Priest"<sup>50</sup>]

And afterwards Rashi adds even more,
ואח"כ מוסיף רש"י עוד יותר,
that the Kohen Gadol involves himself even in the welfare of such people that need to pray about them that a mishap should not occur through them to Israel — behold, also for them he prays,
שהכה"ג מכניס את עצמו אפילו בטובת אנשים כאלה שצריכים להתפלל עליהם שלא תארע תקלה על ידם לישראל — הנה גם עליהם מתפלל,
and his prayer is accepted that there should be only good and kindness for Israel,
ותפלתו מתקבלת שיהי' אך טוב וחסד לישראל,
always, all the days.
