After Rashi explains the reason that it is said "the heads of the tribes for the children of Israel" — "He gave honor to the princes to teach them first and afterwards all the children of Israel etc.",

but only for this detail that the annulment is done by "an individual expert

"The release of vows fly in the air and they have nothing to rely on",

and Rashi explained "The release of vows that the sages said that the sage permits the vow, a small hint there is in Scripture and there is nothing to rely on, but rather so it is transmitted to the sages in the Oral Torah",

At first glance, one can say,

The annulment of vows by a sage is a simple thing according to the simple meaning of Scripture,
התרת נדרים ע"י חכם היא דבר פשוט ע"פ פשוטו של מקרא,
and no special study is needed for this,
ואין צריך לימוד מיוחד על זה,
for the annulment of the vow according to its simple meaning is by opening for him an opening for his vow,
כי התרת הנדר לפי פשוטו היא ע"י שפותחים לו פתח לנדרו,
that if he had known from the beginning that such and such would happen,

And so is proven the opinion of Rashi in his commentary to the Talmud,

that he explained the statement of Rabbi Yochanan<sup>10</sup>

"No sage annuls anything except through regret" — "that he opens<sup>11</sup>

an opening for the vower with matters that come to him through this vow, that if he had known from the beginning that thus it would be, he would not have vowed; it turns out that from its beginning it is not a vow."

The annulment of vows from its root is through a regret-based opening,

For although it is stated in the Talmud that the annulment of a vow is in two ways,

through regret or through an opening<sup>13</sup>,

nevertheless, the essence of the annulment of vows

is through an opening for his vow.

The annulment of the vow is not an action performed

Beyond this: the annulment is not in the category of nullification,

but rather it is a revelation of the matter<sup>16</sup>

that it is not a vow from its beginning,
שאינו נדר מתחילתו,
and therefore Rashi specifies "it is found that from its beginning it is not a vow"<sup>17</sup>

And based on this, it is understood that Rashi did not bring the exposition "He does not forgive, but others forgive him" because according to the plain meaning of Scripture,
ועפ"ז מובן זה שלא הביא רש"י הדרש "הוא אינו מוחל אבל אחרים מוחלין לו" כי ע"פ פשש"מ,
not only is there no need for this study,
לא רק שאין צורך בלימוד זה,
but rather this exposition does not correspond to the content of the matter of the dissolution of vows — because the dissolution is not dependent on others who effect the dissolution of the vow.
אלא שדרש זה אינו מתאים לתוכן ענין התרת נדרים — כי ההתרה אינה תלוי' באחרים שהם פועלים התרת הנדר.
And even the body of the homily "He shall not profane his word..

but others may absolve him" does not fit the matter of annulment according to the plain meaning,

for Rashi explained "He shall not profane his word,

like he shall not profane his word, he shall not make his words profane"<sup>22</sup>,

and if so there is no place
וא"כ אין מקום
(at least according to the plain meaning)

to expound "but others make it profane"<sup>23</sup>

This explanation has a place in the way of the halacha in Rashi's commentary,

but not in Rashi's commentary on the Torah according to its plain meaning,

for we do not find in the plain meaning of Scripture the different modes of annulling vows by a sage, whether by <pg>189</pg>
שהרי לא מצינו בפשוטו של מקרא חילוקי אופנים דהתרת נדרים ע"י חכם אם ב<pg>189</pg>
mere regret or by a pretext and the like,
חרטה סתם או ע"י פתח וכיו"ב,
that there is no hint of this in the plain meaning of the text regarding the modes of annulling vows.

And beyond this: in Rashi's commentary on the verse "This is the thing — it is a limitation to say that the sage in the language of absolution and the husband

And therefore Rashi did not bring a special teaching on this,

since it is stated at the beginning of the portion "And Moses spoke to the heads of the tribes",

so every Jewish man is under the authority of the court and is obligated to do all that the court instructs him, and every one who vows, behold this is as if he stipulated at the time of the vow on condition that the court agree with him, and when they do not agree, the vow is uprooted from its root, and every single expert is called a court, and any three laymen have in their hand to permit his vow."

But in the Gemara it continues: "And what<sup>39</sup>

Here 'the heads of the tribes' — so too below 'the heads of the tribes' in the section of vows, for what halachic purpose?
כאן ראשי המטות אף להלן ראשי המטות בפרשת נדרים למאי הלכתא
(We require regarding vows Aaron and his sons and all Israel<sup>40</sup>)

Rabbi Elazar bar Yosei said: to qualify three laymen
אר"א ב"י להכשיר שלשה הדיוטות
(For this the gezerah shavah is effective as if it were written in vows 'Aaron and his sons and all Israel' to tell you that all Israel are equal for annulling vows, even laymen<sup>40</sup>),
(להכי אהני גזירה שוה כאילו נכתב בנדרים אהרן ובניו וכל ישראל לומר לך ששקולין כל ישראל להתיר נדרים ואפילו הדיוטות<sup>40</sup>),
But 'the heads of the tribes' is written,
והא ראשי המטות כתיב,
Rabbi Chiya said etc.: by an individual expert.
אר"ח כו' ביחיד מומחה.
'The heads of the tribes' in 'those who slaughter outside' — for what halachic purpose? Rav Sheshet said: to say that there is a question [of annulment] regarding consecrated property."
ראשי המטות בשחוטי חוץ למאי הלכתא אמר רב ששת לומר שיש שאלה בהקדש",
And this means that according to the Gemara, the gezerah shavah of the section of vows and 'those who slaughter outside' is to learn from it that the annulment of vows can also be by three laymen,
והיינו שלפי הגמ' הגז"ש דפרשת נדרים ושחוטי חוץ היא למילף מיני' שהיתר נדרים יכול להיות גם בשלשה הדיוטות,
and that there is a question [of annulment] regarding consecrated property.
ושיש שאלה בהקדש.
But Rashi did not bring the gezeirah shavah for the halachic matter
אבל רש"י לא הביא הגז"ש לענין ההלכתא
(that annulment of vows [is done] by three laymen)
(שהתרת נדרים בג' הדיוטות)
only for this matter that this section "was said to all of them"
אלא רק לענין זה שפרשה זו "נאמרה לכולן"
(in continuation of the beginning of his commentary that it was said to all of Israel).
(בהמשך לתחילת פירושו שלכל ישראל נאמרה).
And based on this, it is puzzling why Rashi needed to add "And if there is no expert individual, he annuls with three laymen,"
ועפ"ז צ"ע למה הוצרך רש"י להוסיף "ואם אין יחיד מומחה מפר בשלשה הדיוטות",
for what relevance does this halacha have to his commentary itself
דלמאי נפק"מ הלכה זו לגוף פירושו
(that it was said to all of Israel)<sup>41</sup>.
(שלכל ישראל נאמרה)<sup>41</sup>.
And also it is puzzling,
וגם צ"ע,
that since he explains the words "Heads of the tribes," Rashi should have used the language "experts" and not "by an expert individual,"
דכיון שמפרש התיבות "ראשי המטות" הו"ל לרש"י לנקוט בלשון "מומחין" ולא "ביחיד מומחה",
and in the manner of the language of the Sifri,
וע"ד לשון הספרי,
the source of Rashi
מקורו של פרש"י
(that he showed respect<pg>191</pg>
(שחלק כבוד<pg>191</pg>
To the princes who precede the congregation)
לנשיאים שהם קודמים לעדה)
That concludes "indicating that there is no permission of vows except from the mouths of experts"
שמסיים "מגיד שאין היתר נדרים אלא מפי מומחים"
(And not "an individual expert").
(ולא "יחיד מומחה").
[And also does not add in the Sifri "And if there is no individual expert, three laymen permit" — and on the contrary,
[וגם אינו מוסיף בספרי "ואם אין יחיד מומחה מתיר בשלשה הדיוטות" — ואדרבה,
they reversed its meaning,
הפכו משמע,
as the simple language of the Sifri "that there is no permission etc. except from the mouths of experts"].
כפשטות לשון הספרי "שאין היתר כו' אלא מפי מומחים"].
But Rashi did not come to teach us here the laws of annulment of vows,
אלא שרש"י לא בא להשמיענו כאן דיני התרת נדרים,
but rather to emphasize its definition according to the plain meaning of the verse,
אלא להדגיש גדרה ע"פ פשש"מ,
that the annulment of vows by the heads of the tribes is in the same category as the nullification of vows by the husband and father,
שהתרת נדרים ע"י ראשי המטות היא באותו גדר דהפרת נדרים ע"י הבעל והאב,
because he is the prince of the tribe — a "single expert"<sup>*41</sup>
להיותו נשיא שבט — "יחיד מומחה"<sup>*41</sup>
(and not because they are ordinary "experts")<sup>**41</sup>
(ולא מצד היותם "מומחים" דעלמא)<sup>**41</sup>
; and from this it is understood that the nullification of the vow by three laymen is only a matter of ex post facto,
; ומזה מובן שהפרת הנדר ע"י ג' הדיוטות הוא רק ענין של בדיעבד,
that is, not because the Torah included three laymen for nullification of vows from a gezerah shavah
היינו לא לפי שהתורה רבתה ג' הדיוטות להפרת נדרים מגז"ש
(of Aaron and his sons and all of Israel)
(דאהרן ובניו וכל ישראל)
of slaughtering outside<sup>42</sup>,
דשחוטי חוץ<sup>42</sup>,
that their power is equal to a single expert,
שכחם שוה ליחיד מומחה,
but only with difficulty and ex post facto<sup>*42</sup>,
אבל רק בדוחק ובדיעבד<sup>*42</sup>,
"And if there is no single expert, he nullifies with three laymen."
"ואם אין שם יחיד מומחה מפר בשלשה הדיוטות".

The essence of the Torah in Rashi's commentary:
מיינה של תורה שבפרש"י:
In the content of the matter of vows,
בתוכן ענין הנדרים,
that a person prohibits upon himself something that is permitted to him,
שאדם אוסר על עצמו דבר המותר לו,
several aspects were said about this in Chazal,
נאמרו בזה כמה אופנים בחז"ל,
and in the words of the Rambam we find about this three halachos:
ובדברי הרמב"ם מצינו בזה ג' הלכות:
In Hilchos Nedarim<sup>43</sup>
בהל' נדרים<sup>43</sup>
the Rambam wrote: "One who vows vows in order to establish his character traits and to correct his deeds, behold this one is zealous and praiseworthy,
כתב הרמב"ם "מי שנדר נדרים כדי לכונן דעותיו ולתקן מעשיו הרי זה זריז ומשובח,
How so? For example, one who was a glutton and prohibited upon himself meat for a year or two, or one who was etc. All of them are in the way of service for the sake [of Heaven] and about these vows and the like of them the Sages said<sup>44</sup>
כיצד כגון מי שהי' זולל ואסר עליו הבשר שנה או שתים או מי שהי' כו' כולן דרך עבודה לשם הם ובנדרים אלו וכיוצא בהן אמרו חכמים<sup>44</sup>
Vows are a fence for abstinence";
נדרים סייג לפרישות";
And in the halacha after this<sup>45</sup>
ובהלכה שלאח"ז<sup>45</sup>
He continues "And although they are work
ממשיך "ואע"פ שהן עבודה
(for the sake of)
(לשם)
a person should not multiply in vows of prohibition and should not accustom himself to them, but rather he should distance himself from things from which it is proper to distance himself without a vow";
לא ירבה אדם בנדרי איסור ולא ירגיל עצמו בהם אלא יפרוש מדברים שראוי לפרוש מהן בלא נדר";
And in the Laws of Opinions the Rambam wrote<sup>46</sup>
ובהל' דעות כתב הרמב"ם<sup>46</sup>
"The sages commanded that a person should not withhold himself except from things that the Torah alone forbade him..
"ציוו חכמים שלא ימנע אדם עצמו אלא מדברים שמנעתו התורה בלבד..
So said the sages<sup>47</sup>
כך אמרו חכמים<sup>47</sup>
Is it not enough for you what the Torah forbade, that you also forbid upon yourself other things".
לא דייך מה שאסרה תורה אלא שאתה אוסר עליך דברים אחרים".
Behold, before us are three modes in the service of G-d: a)
הרי לפנינו ג' אופנים בעבודת ה': א)
Abstinence from permissible things by means of a vow.
פרישות מדברים המותרים ע"י נדר.
b)
ב)
Abstinence without a vow.
פרישות בלא נדר.
c)
ג)
Not to abstain from permissible things.
לא לפרוש מדברים המותרים.
And the explanation regarding this is known,
וידוע הביאור בזה,
that the discussion is about different levels in the service of G-d<sup>48</sup>
שהמדובר אודות דרגות שונות בעבודת ה'<sup>48</sup>
:

One who is found on a low level in the service of G-d needs to separate himself even from things that are permitted,
מי שנמצא בדרגא נמוכה בעבודת ה' זקוק לפרוש א"ע גם מדברים המותרים,
because from his pursuit after luxuries
כי מצד המשכתו אחרי מותרות
(things that are permitted)
(דברים המותרים)
a person descends lower,
יורד האדם למטה יותר,
and since<pg>192</pg>
וכיון<pg>192</pg>
that he is from his own essence bound and connected with worldly matters,
שהוא מצד עצמו אסור וקשור עם עניני העולם,
he needs a vow to separate himself
זקוק הוא לנדר לפרוש א"ע
(the opposite of his will from his own essence)
(היפך רצונו מצ"ע)
— and such a person, the way of his service to G-d must be with strengthening through a vow.
— ואדם כזה הרי דרך עבודתו להשם צ"ל בהתחזקות ע"י נדר.
Above this there is a person who is not drawn after luxuries,
למעלה מזה ישנו אדם שאין נמשך אחרי מותרות,
and consequently does not need a vow to separate himself,
ובמילא אינו זקוק לנדר להפריש עצמו,
but nevertheless, since he has not yet reached a lofty level in the service of G-d, he separates himself without a vow from permissible things,
אבל מ"מ כיון שעדיין לא הגיע לדרגא נעלית בעבודת ה' פורש את עצמו בלא נדר מדברים המותרים,
and this is what the Rambam said in a law in its own chapter "Even though it is service
וזהו מ"ש הרמב"ם בהלכה בפ"ע "אע"פ שהן עבודה
(for the sake [of Heaven])
(לשם)
a person should not multiply in vows of prohibition etc. but rather separate from things that are proper to separate from without a vow",
לא ירבה אדם בנדרי איסור כו' אלא יפרוש מדברים שראוי לפרוש מהן בלא נדר",
and fulfills the command<sup>49</sup>
ומקיים הציווי<sup>49</sup>
"Sanctify yourself with what is permitted to you",
"קדש עצמך במותר לך",
and this is because the discussion is about a person who has risen to a higher level in the service of G-d.
והיינו כי המדובר באדם שעלה במעלה עליונה יותר בעבודת ה'.
Above this is one who has already reached a more lofty level in the service of G-d, where there is no place to fear that the permitted thing will cause him a descent,
למעלה מזה הוא מי שכבר הגיע לדרגא נעלית יותר בעבודת ה' שאין מקום לחשוש שהדבר המותר יגרום אצלו ירידה,
and about him our Sages said,
ועליו ארז"ל
(as brought in the Rambam above)
(כמובא ברמב"ם כנ"ל)
"Is it not enough for you what the Torah has forbidden" — because a person at this level,
"לא דייך מה שאסרה תורה" — כי אדם בדרגא זו,
who has no concern of descent,
שאין אצלו חשש של ירידה,
indeed on the contrary,
הרי אדרבה,
he should engage with worldly matters,
עליו לעסוק עם עניני העולם,
to refine and purify the permissible things,
לברר ולזכך את דברים המותרים,
as the Rambam concludes
כפי שמסיים הרמב"ם
(in Hilchos Deos<sup>50</sup>)
(בהל' דעות<sup>50</sup>)
"The Sages commanded and said<sup>51</sup>
"ציוו חכמים ואמרו<sup>51</sup>
and all your deeds shall be for the sake of Heaven",
וכל מעשיך יהיו לשם שמים",
and even in a manner of "In all your ways know Him"<sup>52</sup>
ועד באופן של "בכל דרכיך דעהו"<sup>52</sup>
and to elevate them to the level of holiness of the person.
ולהעלותם לדרגת קדושה של האדם.

And behold, according to the above, the entire content of the matter of the annulment and dissolution of vows in the service of G-d is understood,
והנה ע"פ הנ"ל מובן כללות תוכן הענין דהפרת והתרת נדרים בעבודת האדם,
that a person who vows a vow and prohibits himself from permitted things,
שאדם הנודר נדר ואוסר עצמו מדברים המותרים,
behold, it is in the power of the father
הרי בכחו של האב
(and husband)
(ובעל)
and a sage<sup>53</sup>
וחכם<sup>53</sup>
to elevate him to a higher level,
להעלות אותו לדרגא נעלית יותר,
so that he will not need a vow to separate himself from permitted things.
שלא יצטרך לנדר לפרוש א"ע מדברים המותרים.
And in this there are two ways:
ובזה יש ב' אופנים:
One who is on a lower level,
מי שנמצא בדרגא נמוכה יותר,
who still needs the conduct of abstinence from worldly matters,
שעדיין צריך להנהגה של פרישות מעניני העולם,
they annul and nullify the vow,
מפירים ומבטלים את הנדר,
meaning they elevate him to a level where he will not need a vow to abstain himself,
היינו שמעלים אותו לדרגא שלא יצטרך לנדר כדי להפריש א"ע,
for he can already abstain from his own power and good will,
כי יכול כבר לפרוש מכחו ורצונו הטוב,
without a vow; and this is also the content of the matter of the annulment of the vow,
בלא נדר; וזהו גם תוכן הענין דהפרת הנדר,
which indicates that he still has a connection to the matter of the vow,
שמורה שעדיין יש לו שייכות לענין הנדר,
but they annul and nullify it,
אלא שמפירים ומבטלים אותו,
and this is because the man from his own side is still connected to the category of the matter of vows,
והיינו לפי שהאדם מצד עצמו שייך עדיין לגדר ענין הנדרים,
namely the conduct of abstinence,
דהיינו הנהגה של פרישות,
but in actual practice he has been elevated to a level where he can abstain himself without a vow,
אלא שבנוגע לפועל נתעלה לדרגא שיכול להפריש את עצמו בלא נדר,
"Sanctify yourself with what is permitted to you."
"קדש עצמך במותר לך".
Above this is the matter of the release of vows by a sage
למעלה מזה הוא ענין דהתרת נדרים על ידי חכם
("Heads of the tribes")<sup>54</sup>,
("ראשי המטות")<sup>54</sup>,
who says "it is permitted to you,"
שאומר מותר לך,
and in the service of man it is that the sage draws down a supernal holiness into the man until he has the power to engage in worldly matters in a way that elevates them to the level of the holiness of man.
ובעבודת האדם הוא מה שהחכם ממשיך קדושה עליונה בהאדם עד שבכחו להתעסק בדברים שבעולם באופן שמעלה אותם לדרגת קדושת האדם.
[And one could say,
[ויש לומר,
that the concept of a sage uproots the vow from its root is,
שהענין דחכם עוקר הנדר מעיקרו הוא,
that the sage reveals the innerness of a Jewish person,
שהחכם מגלה הפנימיות של איש ישראל,
that each and every one has the power
שלכל או"א יש התוקף
(and the wisdom)
(והחכמה)
needed in order to draw down holiness<pg>193</pg>
הנצרך כדי להמשיך קדושה<pg>193</pg>
in worldly matters.
בעניני העולם.
For the need for the matter of the vow is because this power in his soul was in concealment; and the sage reveals in him this power of the soul,
דהצורך בענין הנדר הוא כי כח זה שבנשמתו הי' בהעלם; והחכם מגלה בו כח זה של הנשמה,
in a manner that it becomes clear that the vow is founded on an error,
באופן שנתברר שהנדר בטעות יסודו,
that he did not know his true power,
שלא הי' יודע אמיתית כחו,
but "if he had known" and it had been in revelation of this power from the outset he would not have vowed,
אבל "אילו הי' יודע" והי' בגילוי כח זה מעיקרא לא הי' נודר,
but rather would have engaged in refining and purifying the world].
אלא הי' עוסק בבירור וזיכוך העולם].

Based on all the above, one must explain the difference between the action of the sage according to the simple meaning versus as it is according to the law:
ע"פ כל הנ"ל יש לבאר החילוק בין פעולת החכם ע"פ דרך הפשט לכמו שהיא ע"פ הלכה:
The study according to the simple meaning — corresponding to the world of action<sup>55</sup>
הלימוד ע"ד הפשט — כנגד עולם העשי'<sup>55</sup>
— it is in accordance with a simple and low level in the service of man,
— הוא בהתאם לדרגא פשוטה ונמוכה בעבודת האדם,
and therefore according to the simple meaning,
ולכן ע"פ פשט,
the action of the sage is only in the category of "annulment"
פעולת החכם היא רק בגדר "הפרה"
(as above at length),
(כנ"ל בארוכה),
because such a person is not yet worthy to rise to such a level that he needs to deal with physical matters in a manner of "in all your ways know Him."
לפי שאדם כזה אינו ראוי עדיין להתעלות לדרגא כזו שצריך להתעסק בדברים גשמיים באופן של "בכל דרכיך דעהו".
But according to the homily and the law in the Oral Torah,
אבל ע"פ הדרוש וההלכה בתורה שבע"פ,
that this is in accordance with a person who elevated himself above the world of action and the simple meaning<sup>56</sup>,
שזהו בהתאם לאדם שהגבי' א"ע למעלה מעולם העשי' והפשט<sup>56</sup>,
in this level it is possible to have the annulment of vows,
בדרגא זו יכול להיות היתר נדרים,
that the sage acts upon the person so that he can elevate physical matters to the service of God.
שהחכם פועל בהאדם שיוכל להעלות הדברים גשמיים לעבודת ה'.
And more deeply it can be said — that this, that according to law a sage annuls the vow of every single Jew,
ובעומק יותר יש לומר — דזה שע"פ הלכה חכם מתיר נדרו של כאו"א מישראל,
without distinction
בלי הבדל
(even one who is on a low level in the service of God)
(גם מי שהוא בדרגא נמוכה בעבודת ה')
— is because this is the power of a true sage,
— הוא לפי שזהו כחו של חכם אמיתי,
that he can draw down a supernal power into every single Jew,
שיכול להמשיך כח עליון בכאו"א מישראל,
to elevate him to a higher level
להעלותו לדרגא עליונה יותר
(disproportionate to his state on his own).
(שלא לפי ערך מצבו מצ"ע).
And this is the hint in the language of our Sages<sup>57</sup>
וזהו הרמז בלשון חז"ל<sup>57</sup>
that "the annulment of vows fly in the air and have nothing upon which to rely"<sup>58</sup>
ש"היתר נדרים פורחין באויר ואין להם על מה שיסמוכו"<sup>58</sup>
— that this, that a sage can annul the vow of any Jewish man, is a thing that "flies in the air",
— דזה שחכם יכול להתיר נדר של כל איש ישראל הרי הוא דבר "פורח באויר",
that it is a thing that remains above and separate from the person who vowed,
שהוא דבר שנשאר למעלה ומובדל מהאדם הנודר,
and there is not in him
ואין בו
(in the one who vowed)
(בהנודר)
upon what to "rely" this power of the sage,
על מה ש"יסמוך" כח זה של החכם,
that it be grasped in him in an internal manner.
שיותפס בו באופן פנימי.
But not according to the simple meaning of the verse — corresponding to the world of action — since "they have nothing upon which to rely",
משא"כ ע"פ פשוטו של מקרא — כנגד עולם העשי' — כיון ש"אין להם על מה שיסמוכו",
this power of the sage
אין כח זה של החכם
(to annul the vow)
(להתיר הנדר)
can actually affect the vower
יכול לפעול בפועל בהנודר
(who is not on this level).
(שאינו בדרגא זו).
And this is the explanation
וזהו הביאור
(the inner one)
(הפנימי)
of this,
בזה,
that even according to Rashi
שגם לפי פרש"י
(that the sage annuls the vow)
(שהחכם מפר הנדר)
the sage must say in the language of "absolution"
צריך החכם לומר בלשון "התרה"
(and not in the language of annulment)
(ולא בלשון הפרה)
— because that the sage only annuls the vow,
— כי זה שהחכם רק מפר הנדר,
is only due to the state of the vower,
הוא רק מחמת מצבו של הנודר,
that he is not a "vessel" for the sage's power,
שאינו "כלי" לכחו של החכם,
and therefore the sage's action upon him is only a category of annulment of the vow; but from the sage's side, his power is that he can absolve the vow,
ולכן פעולת החכם בו היא רק גדר של הפרת הנדר; אבל מצד החכם הרי כחו הוא שיכול להתיר הנדר,
and therefore the sage's language is — absolution.
ולכן לשונו של החכם היא — התרה.
