that you are in the bearing of iniquity? The verse says: 'And you shall not bear a sin on it.'"

And superficially it appears that there is here a dispute between the Gemara and the Sifri,

unlike the language of the Talmud "on the good": in the Talmud the emphasis is on the differences in the quality of the grain and fruits,

But it seems that one should examine if we should interpret that the Talmud disagrees with the Sifri in this,

"Any place where there is a priest, he separates terumah from the choice produce"

for wherever we find in the Mishnah and Gemara the prohibition against separating from the bad,

And seemingly one can infer thus from the language of the Ramban in his glosses on the Book of Commandments of the Rambam,

if he builds a house of prayer, it should be beautiful from his dwelling place, etc. If he consecrates something, he should consecrate from the best of his possessions, and so it says<sup>35</sup>
אם בנה בית תפלה יהי' נאה מבית ישיבתו כו' הקדיש דבר יקדיש מן היפה שבנכסיו וכן הוא אומר<sup>35</sup>
All the fat is for the Lord, etc."
כל חלב לה' וגו'".
And one should investigate if the obligation of terumah from the best
ויש לחקור אם החיוב דתרומה מן היפה
("when you separate its fat from it")
("בהרימכם את חלבו ממנו")
is only a detail of the general obligation of "all fat is for the Lord",
אינו אלא פרט מהחיוב הכללי ד"כל חלב לה'",
or that this is a special law regarding terumah.
או שזהו דין מיוחד גבי תרומה.
And it can be said that regarding this the Talmud and the Sifri disagree:
וי"ל דבזה פליגי הש"ס והספרי:
According to the method of the Talmud, this obligation is only a detail of the general law of "all fat is for Hashem",
לשיטת הש"ס חיוב זה אינו אלא פרט מהדין הכללי ד"כל חלב לה'",
and therefore one cannot say that when he does not fulfill this, he is included in "bearing a sin",
ולכן אין לומר דכשאינו מקיים זה הרי הוא בכלל "נשיאות חטא",
for this general law is only an adornment for one who "wants to merit himself"
שהרי דין כללי זה אינו אלא הידור למי ש"רוצה לזכות עצמו"
(as the Rambam wrote there).
(כמ"ש הרמב"ם שם).
And therefore the Talmud holds that only when one separates from the bad on the good is it "bearing a sin",
ולכן ס"ל להש"ס שרק כשתורמים מן הרע על היפה הוי "נשיאות חטא",
for then it is a disgrace to the terumah,
שאז הוא בזיון התרומה,
that the remnants are good and the terumah
ששירי' הם יפים והתרומה
(which permits the remnants)
(המתירה את השיריים)
is from the bad.
היא מן הרע.
But not so according to the method of the Sifri,
משא"כ לשיטת הספרי,
that the law of "when you separate its fat from it" is a specific law in terumah,
שהדין ד"בהרימכם את חלבו ממנו" הוא דין מיוחד בתרומה,
it is understood that this is a complete obligation to separate from the choicest,
מובן שזהו חיוב גמור להפריש מן המובחר,
and consequently,
ובמילא,
when one does not separate from the choicest "you are in bearing of iniquity".
כשאין מפרישים מן המובחר "אתם בנשיאות עון".

ו.
And perhaps one could say further,
ואולי יש לומר עוד,
And with the introduction of the dispute of Tanna Kamma and Rabbi Yehuda
ובהקדם פלוגתת ת"ק ור' יהודה
(the above beginning of section 2)
(הנ"ל ריש סעיף ב)
whether when there is no kohen they separate from that which keeps, or they always separate from the best even when there is no kohen.
אם כשאין כהן תורמין מן המתקיים או לעולם תורמין מן היפה גם כשאין כהן.
That one must explain that they dispute whether the obligation to separate from the best is a condition in the separation or a condition in the giving to the kohen<sup>36</sup>
שיש לבאר דפליגי אם החיוב לתרום מן היפה הוא תנאי בההפרשה או תנאי בהנתינה לכהן<sup>36</sup>

his reason — because this obligation is a law in the separation of terumah,

The content of the matter of separating terumah is — the separation to G-d<sup>37</sup>,
תוכן ענין הפרשת תרומה הוא — ההפרשה לה'<sup>37</sup>,
as the expression of the verse<sup>38</sup>
כלשון הכתוב<sup>38</sup>
"All the fat of the oil etc. which they give to G-d, to you I have given them",
"כל חלב יצהר גו' אשר יתנו לה' לך נתתים",
"So shall you separate, also you, a terumah to G-d"
"כן תרימו גם אתם תרומת ה'"
(except that afterwards they give it to the kohanim),
(אלא שאח"כ נותנים אותה לכהנים),
and therefore upon the separation itself falls an obligation that it be from its fat
ולכן חל על עצם ההפרשה חיוב שתהי' מחלבו
(in the manner of "All fat is for G-d"),
(ע"ד "כל חלב לה'"),
and for this reason R' Yehuda holds that even though it does not endure we are not concerned for the loss of the kohen,
ומטעם זה ס"ל לר' יהודה דאע"פ שאינו מתקיים לא חיישינן לפסידא דכהן,
for the main thing is that the separation to G-d be from the best<sup>39</sup>.
כי העיקר הוא שההפרשה לה' תהי' מן היפה<sup>39</sup>.
But the Tzemach Tzedek holds that this is primarily for the Kohen,
משא"כ הת"ק ס"ל שזהו בעיקר בשביל הכהן,
that the giving to him should be from the best<sup>40</sup>,
שהנתינה אליו תהי' מן היפה<sup>40</sup>,
so that the provision of his needs by Bnei Yisrael will be in the best possible manner,
כדי שהספקת צרכיו על ידי בנ"י תהי' באופן היותר טוב,
from the best and the choicest.
מן היפה והמובחר.
And according to this approach, if the best does not keep, the law of precedence applies to that which keeps.
ולאופן זה אם היפה אינו מתקיים דין קדימה להמתקיים.
And based on this, it can be said,
ועפ"ז יש לומר,
that the aforementioned question
שהשאלה הנ"ל
(whether the obligation to separate Terumah from the choicest is part of the general obligation of "all the fat is for Hashem" or not)
(אם החיוב להפריש תרומה מן המובחר הוא חלק מהחיוב הכללי ד"כל חלב לה'" או לא)
depends on the definition of "all the fat is for Hashem".
תלוי בגדר ד"כל חלב לה'".
For it is stated elsewhere<sup>41</sup>
דהנה נת' במ"א<sup>41</sup>
in explaining the view of the Rambam who did not bring that which [says] "adorn yourself before Him with mitzvos"<sup>42</sup>
בביאור שיטת הרמב"ם שלא הביא הא ד"התנאה לפניו במצות"<sup>42</sup>
(which is learned from "This is my G-d and I will adorn Him"<sup>43</sup>)
(שנלמד מ"זה אלי ואנוהו"<sup>43</sup>)
but only the law that "everything that is for the sake of the good G-d should be from the beautiful and the good,
אלא רק הדין ד"כל דבר שהוא לשם האל הטוב יהי' מן הנאה והטוב,
if he builds a house of prayer it should be more beautiful than his dwelling place, etc. if he consecrates an item he should consecrate from the finest of his possessions, and so it says 'all the fat is for the L-rd' etc." — that the intention in this is for a matter that is similar to a sacrifice upon the altar
אם בנה בית תפלה יהי' נאה מבית ישיבתו כו' הקדיש דבר יקדיש מן היפה שבנכסיו וכן הוא אומר כל חלב לה' וגו'" — שהכוונה בזה לדבר שהוא דומה לקרבן ע"ג מזבח
(a sacrifice to the L-rd),
(קרבן לה'),
that he gives over the matter to the L-rd,
שמוסר את הדבר לה',
like "build a house of prayer",
כמו "בנה בית תפלה",
"consecrate an item"
"הקדיש דבר"
[and also the examples in the Rambam there of "fed the hungry, etc. clothed the naked" is because it deals with charity which is for atonement<sup>44</sup>],
[וגם הדוגמאות שברמב"ם שם ד"האכיל רעב כו' כסה ערום" הוא מפני שאיירי בצדקה שהיא לכפרה<sup>44</sup>],
that in this it must be "from the finest of his possessions",
שבזה צ"ל "מן היפה שבנכסיו",
because this pertains to the object,
כי זה נוגע להחפצא,
that by the matter being "from the finest" the offering to the L-rd is in completeness and with more adornment.
שע"י שהדבר הוא "מן היפה" הרי ההקרבה לה' היא בשלימות ובהידור יותר.
And according to this, the view of the Rambam in our subject is explained
ולפי זה מבוארת שיטת הרמב"ם בנדו"ד
(separating terumah from the finest)
(הפרשת תרומה מן היפה)
: since we hold as law like the first Tanna that when there is no kohen they separate from that which keeps,
: כיון שנקטינן להלכה כת"ק שכשאין כהן תורמין מן המתקיים,
and this is because this is a law in giving to the kohen,
והיינו מפני שזהו דין בנתינה לכהן,
it follows,
נמצא,
that this law is not connected to the general obligation of "all the fat is for the L-rd"
שאין דין זה שייך לחיוב הכללי ד"כל חלב לה'"
(which is only regarding "everything that is for the sake of the G-d"),
(שזהו רק ב"כל דבר שהוא לשם האל"),
therefore the Rambam holds that this is a new and specific law regarding separating terumah that they must give to the kohen from the finest,
ולכן ס"ל להרמב"ם שזהו דין חדש ומיוחד גבי הפרשת תרומה שצריכים לתת לכהן מן היפה,
and since this is a specific law in terumah he also holds that it is not merely an adornment ab initio,
וכיון שזהו דין מיוחד בתרומה ס"ל ג"כ שאינו רק הידור לכתחילה,
but rather if they do not fulfill this law there is bearing of iniquity
אלא דאם אין מקיימים דין זה יש בו נשיאות עון
(like the view of the Sifri),
(כשיטת הספרי),
and therefore he wrote "they may only separate terumah from the finest",
ולכן כתב "אין תורמין אלא מן היפה",
as above.
כנ"ל.
But not according to the method of the Talmud,
משא"כ לשיטת הש"ס,
that there is an obligation of beautification of a commandment in all commandments,
שיש חיוב דהידור מצוה בכל המצות,
"Adorn yourself before Him with commandments"
"התנאה לפניו במצות"
(And it can be said that according to the method of the Talmud there is no difference between the law of beautification of a commandment in general,
(וי"ל שלשיטת הש"ס אין חילוק בין דין הידור מצוה בכלל,
and the obligation of "all the fat is for the Lord"),
והחיוב ד"כל חלב לה'"),
and therefore they hold that the obligation to tithe from the choice is only a detail in the general obligation of beautification of a commandment and "all the fat is for the Lord"<sup>45</sup>,
ולכן ס"ל שהחיוב לתרום מן היפה הוא רק פרט בחיוב הכללי דהידור מצוה ו"כל חלב לה'"<sup>45</sup>,
and therefore it is impossible to say that because of this<pg>126</pg>
ולכן אא"פ לומר שבגלל זה<pg>126</pg>
that one who is not among the beautifiers will have in this "bearing of sin".
שאינו מן המהדרים תהי' בזה "נשיאות חטא".

ז.
And behold, there is yet another difference between the language of the Sifri and the language of the Talmud,
והנה יש עוד שינוי בין לשון הספרי ולשון הש"ס,
for in the Talmud the language is "And if there is no sin-offering, why a bearing of sin?"
דבש"ס הלשון "ואם אין קדוש נשיאות חטא למה"
(and it is like the language of the verse itself "and you shall not bear sin because of it"),
(והוא כלשון הכתוב עצמו "ולא תשאו עליו חטא"),
but in the Sifri it changes and says "that you are in the bearing of iniquity,"
אבל בספרי משנה ואומר "שאתם בנשיאות עון",
and it is known that "iniquity" is more severe than sin<sup>46</sup>.
וידוע ד"עון" חמור יותר מן החטא<sup>46</sup>.
And behold, although it was said above that this law
והנה אע"פ שנת"ל שדין זה
(that only because it lacks "the choicest" there is in this a "bearing of iniquity")
(שרק משום שחסר "מן המובחר" יש בזה "נשיאות עון")
is only regarding terumah — nevertheless,
הוא רק בתרומה — מ"מ,
one may learn from this also regarding the rest of the commandments of the Torah, when one lacks in the beautification of the commandment — for although one is not obligated and compelled regarding beautification,
יש ללמוד מזה גם לגבי שאר מצוות התורה החומר כשחסר בהידור מצוה — דאע"פ שאין לחייבו ולכופו על הידור,
nevertheless,
מ"מ,
when one does not beautify in the commandments,
כשאינו מהדר במצות,
it is not only that the virtue of beautification of the commandment is lacking in him,
אין זה רק שחסרה בו המעלה דהידור מצוה,
but rather there is in this
אלא שיש בזה
(a kind of)
(מעין)
bearing of iniquity<sup>47</sup>
נשיאות עון<sup>47</sup>
(that it is considered a deficiency in the commandment itself).
(שנחשב לחסרון בהמצוה עצמה).
And the measure of good is greater etc. — that when one performs commandments with beautification,
ומרובה מדה טובה כו' — דכאשר מקיימים מצות בהידור,
behold, in addition to the reward for the beautification of the commandment,
הרי נוסף על השכר עבור ההידור מצוה,
there is an addition in the reward of the commandment itself.
יש הוספה בשכרה של המצוה עצמה.
