Regarding the making of the covenant at the time of the Giving of the Torah,

It is brought in the Gemara<sup>1</sup>

that our forefathers "did not enter the covenant except through circumcision and immersion and the presentation of blood

and sprinkled on the people, and there is no sprinkling without immersion."

And behold the verses "And he sent the youths of the children of Israel..

And Moses took the blood etc." were said in the portion of Mishpatim,

And Tannaim disagree in the Mechilta<sup>6</sup>

About the time of this portion: according to the Tanna Kamma it was the 27th of Iyar,

That then Moses built an altar and offered the sacrifices and sprinkled the blood etc.

That is on the seventh of Sivan

it is explicit that the knowledge of "all these deeds were done on that day",
מפורש שהדיעה ד"כל אלו המעשים בו ביום נעשו",
namely in the morning of the day of the Giving of the Torah before the Ten Commandments<sup>14</sup>,
היינו בבוקר יום מ"ת קודם עשרת הדברות<sup>14</sup>,
and so is the simple interpretation of the words of Rabbi Yosi "on that day they were done",
וכן היא פשטות הפירוש של דברי ר' יוסי "בו ביום נעשו",

And behold, ostensibly one can answer,
והנה לכאורה יש לתרץ,
for the prohibition of immersion of a convert on Shabbat is only a rabbinical shevut — because two reasons are stated for the prohibition of immersion for conversion on Shabbat: a)
כי האיסור דטבילת גר ביום השבת אינו אלא שבות דרבנן — כי שני טעמים נאמרו באיסור טבילת גירות בשבת: א)
In the Gemara<sup>28</sup>
בגמ'<sup>28</sup>
it is stated because "we do not fix a person on Shabbat",

he wrote that "since the matter

But still there is difficulty in the matter,

for it is not reasonable to say,

that the entry of Israel into the covenant should be through an act
שכניסת ישראל לברית תהי' ע"י מעשה
(the opposite)<sup>32</sup>

that has a trace of prohibition,
שיש בו סרך איסור,
whatever it is
איזה שהוא
(even a prohibition of shevut),

for this is like a thing and its opposite.
שהרי זה כמו דבר והיפוכו.
[And although the discussion is about a prohibition that is only a Rabbinic decree — behold, Chazal said<sup>33</sup>
[ואע"פ שהמדובר באיסור שאינו אלא גזירה דרבנן — הרי אמרו חז"ל<sup>33</sup>
"Avraham Avinu fulfilled the entire Torah..
"קיים אברהם אבינו כל התורה כולה..
even eiruvei tavshilin"

but a scribal enactment that future [scribes] would enact"<sup>34</sup>),

that Avraham was careful also regarding "shevut on Shabbos" and from this it is understood,

that the essence of the act of shevut

before the Giving of the Torah)

has in it a disgrace

And even more difficult according to what is explained in the commentaries<sup>36</sup>,

that according to the opinion<sup>37</sup>

that circumcision on Shabbos is forbidden because of the labor of "repairing a vessel"

since through circumcision "the child becomes a complete Jew" — also immersion of a convert on Shabbos is forbidden by Torah law,

that the immersion of Bnei Yisrael then for the sake of conversion<sup>39</sup>

And one may say regarding this,

with the preface of what there is<pg>29</pg>

to be precise in the statement of our Sages that entry into the covenant is "by circumcision and immersion and the presentation of blood",
לדייק במאמר חז"ל שהכניסה לברית היא "במילה וטבילה והרצאת דם",
that at first glance why did they not also include acceptance of the commandments,
שלכאורה אמאי לא מנו גם קבלת מצוות,
which is a primary matter in conversion,
שהיא ענין עיקרי בגירות,
and on the contrary,
ואדרבה,
this is the essence of conversion,
זהו עיקר הגירות,
as it is ruled in the Shulchan Aruch<sup>41</sup>

that if there was no acceptance of the commandments before three

But the explanation of this — is simple: acceptance of the commandments is not

one of the things that bring a person into the covenant,

"By three things did Israel enter into the covenant..

And so for generations, when a gentile wishes to enter the covenant and take shelter under the wings of the Shechinah and accepts upon himself the yoke of Torah, he requires circumcision, immersion, and the offering of a sacrifice."
וכן לדורות כשירצה הגוי להכנס לברית ולהסתופף תחת כנפי השכינה ויקבל עליו עול תורה צריך מילה וטבילה והרצאת קרבן".
Thus,
הרי,
that the matter of "he accepts upon himself the yoke of Torah" is a part of the desire "to enter the covenant."
שהענין ד"יקבל עליו עול תורה" הוא חלק מהרצון "להכנס לברית".
And from this it is understood simply why acceptance of the commandments is not counted among the conditions of conversion,
ומזה מובן בפשטות למה לא נמנית קבלת מצוות בין תנאי הגירות,
because when there is no acceptance of the commandments,
כי כשאין קבלת מצוות,
it is not a deficiency in the conditions of conversion,
אין זה חסרון בתנאי הגירות,
but rather there is no conversion here<sup>44</sup>,
אלא אין כאן גירות<sup>44</sup>,
and only after he desires "to enter and take shelter under the wings of the Shechinah and accepts upon himself the yoke of Torah" does the reality of conversion take effect through circumcision and immersion<sup>45</sup>,
ורק לאחר שרוצה "להכנס ולהסתופף תחת כנפי השכינה ויקבל עליו עול תורה" יש חלות הגירות במילה וטבילה<sup>45</sup>,
but if he did not precede [with] acceptance of the yoke of Torah and commandments,

there is here no act of conversion.

And based on this, it can be said,

that the conversion of the children of Israel at the time of the Giving of the Torah is distinct from conversions after the Giving of the Torah: After the Giving of the Torah,
שחלוקה הגירות דבני ישראל בעת מ"ת מגירות שלאחרי מ"ת: לאחרי מ"ת,
when the three things come after the acceptance of the commandments,
שג' הדברים באים לאחרי קבלת מצוות,
they actually bring him into the covenant and make him a convert; but not so in the conversion of the children of Israel at the Giving of the Torah,

that before the Giving of the Torah

this saying is not considered as an act of acceptance of commandments regarding the commandments after the Giving of the Torah,

as will be explained below in section 4]

— behold, through their immersion and the sprinkling of the blood they had not yet actually entered the covenant,

and their conversion was not completed until the saying of "We will do and we will hear",

for then was their acceptance of the commandments

[And what our Sages said that our forefathers "did not enter the covenant except through circumcision, immersion, and the sprinkling of blood",

the intention in this is not,
אין הכוונה בזה,
that immediately after the performance of these three things they entered the covenant,

but rather that for their entry into the covenant they needed these three things
אלא שבשביל כניסתם לברית היו צריכים לג' דברים אלה
(and without them their acceptance of the commandments would not avail to enter the covenant),

therefore we learn from this for all generations that "they shall not enter the covenant except through circumcision, immersion, and the sprinkling of blood"<sup>47</sup>

; but the conversion then and the actual entry into the covenant was done at the time of the Giving of the Torah itself].

And this is also the reason that there was not then a prohibition to immerse on the Sabbath day for the sake of conversion — for only in conversion after the Giving of the Torah,
וזהו גם הטעם שלא הי' אז איסור לטבול ביום השבת לשם גירות — דרק בגירות שלאחרי מ"ת,
when the immersion completes<pg>30</pg>

the conversion and through it they actually enter into the covenant,

it was prohibited because of "preparation of the person"<sup>48</sup>

; but not so in the immersion of a Jew before the Giving of the Torah,

where the conversion was not completed through it,

there is no reason to prohibit this immersion on the Sabbath because of "preparation of the person".

And also the reason of the Rambam
וגם טעם הרמב"ם

— that we do not immerse a convert on Shabbat because "the matter requires a court" — does not apply to the conversion of the Children of Israel at the time of the Giving of the Torah.

Because only in conversion after the Giving of the Torah,

when circumcision and immersion etc. come after acceptance of the commandments and they effect the conversion and complete it,

it is in the category of "judgment" that requires a court; but not so regarding the conversion of the Children of Israel at the Giving of the Torah,

that it refers to the commandment of separation and boundary,

Rashi explained that "the Book of the Covenant" is "from Bereishis until the giving of the Torah and the commandments that were commanded in Marah."

And behold, the acceptance of the seven commandments of the children of Noach is certainly not in the category of acceptance of commandments of Israel

דאם קיבל עליו כל התורה כולה חוץ מדבר א' אינו גר<sup>55</sup>
— and accordingly, also in Marah, with the acceptance of the commandments that were commanded in Marah, there is no acceptance of the entire Torah.
— וא"כ גם במרה בקבלת מצות שנצטוו במרה אין כאן קבלת כל התורה.
And this requires examination.

And it appears to say,
ונראה לומר,
that also according to the simple understanding of the Gemara's discussion<sup>56</sup>
שגם לפי פשטות סוגיית הגמ'<sup>56</sup>
that the saying of "we will do and we will hear" was the acceptance of the entire Torah
שאמירת נעשה ונשמע היתה קבלת כל התורה כולה
(that they accepted it before they heard it,
(שקבלו אותה קודם ששמעו אותה,
the precedence of "we will do" to "we will hear")
הקדמת נעשה לנשמע)
— it is impossible to consider this saying that was before the Giving of the Torah as a definition of acceptance of commandments
— א"א להחשיב אמירה זו שקודם מ"ת גדר של קבלת מצוות
(that is necessary for conversion).
(הנצרך לגירות).
And with the introduction of the reason for the order of acceptance of conversion for generations,
ובהקדם הטעם לסדר קבלת גירות לדורות,
that they must inform him "some<pg>31</pg>
שצריכים להודיע אותו "מקצת<pg>31</pg>
Severe commandments..
מצות חמורות..
And we inform him of the punishment of the commandments"<sup>57</sup>,
ומודיעין אותו עונשן של מצות"<sup>57</sup>,
that the need for this notification is simply,
שהצורך בהודעה זו הוא בפשטות,
(also)
(גם)
because if we do not inform him of some of the severe ones,
לפי שאם לא נודיע אותו מקצת החמורות,
and likewise their punishment of the commandments,
וכן עונשן של מצות,
it is lacking in his acceptance of the commandments<sup>*57</sup>
חסר בקבלת מצות שלו<sup>*57</sup>
(since it is possible that when he becomes aware of the severe commandments or their punishment he will regret etc.<sup>**57</sup>).
(שיתכן שכשיוודע ע"ד המצוות החמורות או עונשן יתחרט כו'<sup>**57</sup>).
And along these lines it can be said in our matter,
ועד"ז י"ל בעניננו,
that as long as the Torah was not given at Sinai from the mouth of the Almighty,
דכל זמן שלא ניתנה תורה בסיני מפי הגבורה,
it is impossible to have acceptance of the commandments after the Giving of the Torah.
א"א להיות קבלה על מצוות שלאחרי מ"ת.
Since the commandments before this are not in the category of the commandments after the Giving of the Torah,
דכיון שהמצוות שלפנ"ז אינם בגדר של המצוות שלאחרי מ"ת,
and as understood,
וכמובן,
that the severity of the commandments that the Patriarchs kept on their own is not at all comparable,
שאינה דומה כלל חומרת המצוות שקיימו האבות מעצמם,
to the severity of the commandments after they were commanded on them,
לחומרת המצוות לאחרי שנצטוו עליהם,
and likewise the severity of the commands that Israel was commanded through Moses before the Giving of the Torah is not at all comparable,
ועד"ז אינו דומה כלל חומר הציווים שנצטוו ישראל ע"י משה לפני מ"ת,
to the severity of the commands after the Giving of the Torah,
לחומר הציוויים לאחרי מ"ת,
for then they heard the Ten Commandments from the Almighty<sup>58</sup>,
שאז שמעו את עשה"ד מפי הגבורה<sup>58</sup>,
[As the words of the Rambam<sup>59</sup>

"That everything we distance from or do today we do only by the command of the Holy One, blessed be He, through Moses our teacher, peace be upon him..

from Sinai" — and not because "the Holy One, blessed be He, said this to the prophets before him",
מסיני" — ולא מפני "שהקב"ה אמר זה לנביאים שלפניו",
for even these were commands of the Holy One, blessed be He, to the prophets,
דאף שגם אלה היו ציוויי הקב"ה לנביאים,
nevertheless,
מ"מ,
it is not at all comparable to the commands of the Holy One, blessed be He, at Sinai],
אינו דומה כלל לציוויי הקב"ה בסיני],
Therefore,
לכן,
any matter of acceptance of commandments before hearing the Ten Commandments from the mouth of the Almighty,
כל ענין של קבלת מצוות קודם שמיעת עשה"ד מפי הגבורה,
should not be considered as "acceptance of commandments" after the Giving of the Torah,
אין להחשיבו כ"קבלת מצוות" שלאחרי מ"ת,
for before there was the force of the Torah and commandments after the Giving of the Torah
דקודם שהי' התוקף דתומ"צ שלאחרי מ"ת
(which are "from the mouth of the Almighty")
(שהם "מפי הגבורה")
in the world,
בעולם,
it is not applicable that there be upon this acceptance
לא שייך שתהי' ע"ז קבלה
(true),
(אמיתית),
for it is a thing that has not yet come into the world
דהוי דבר שלא בא לעולם
(and they have no concept of such types of commands<sup>58</sup>).
(ואין להם מושג בסוג ציוויים כאלה<sup>58</sup>).
[And although the notification
[ואע"פ שהודעת
(reward)
(שכר)
of the commandments and their punishment does not impede<sup>60</sup>
המצות ועונשן אינה מעכבת<sup>60</sup>
— there is a distinction between the notification after the Torah and commandments have already been given to Israel and it is applicable that he knows them,
— יש לחלק בין ההודעה לאחרי שכבר ניתנה תורה ומצוות לישראל ושייך שידע אותם,
but the court did not notify the reward of commandments and their punishment to this convert who comes to convert
אלא שב"ד לא הודיעו שכר מצות ועונשן לגר זה הבא להתגייר
(and particularly in this one can say that since he comes to convert,
(ובפרט שבזה י"ל שכיון שבא להתגייר,
we rely that he investigated and inquired and knows on his own the nature of the commandments that he will be obligated in when he converts)

behold it is not applicable to this the category of "acceptance",
הרי לא שייך על זה גדר של "קבלה",
since it is a thing that has not yet come into the world,
כיון שהוא דבר שלא בא לעולם,
as above].

And based on this, there will be additional explanation in the view of the commentators
ועפ"ז יתוסף ביאור בשיטת המפרשים
(the above section 1),

that this entire portion
שכל פרשה זו
(of the end of Parshat Mishpatim)
(דס"פ משפטים)
after the Giving of the Torah was said — which is seemingly,
לאחרי מ"ת נאמרה — שלכאורה,
the time suitable for acceptance of commandments is before the giving of the Torah
זמן המתאים לקבלת מצות הוא קודם נתינת התורה
(when they will agree to accept upon themselves the yoke of commandments, the Torah will be given to them)?
(שכאשר יסכימו לקבל עליהם עול מצוות תינתן להם התורה)?
And according to the above, it is understood,
וע"פ הנ"ל מובן,
that on the contrary,
שאדרבה,
it is the giver: since the content of the portion is the sealing of a covenant on the fulfillment of Torah and commandments,
היא הנותנת: כיון שתוכן הפרשה הוא כריתת ברית על קיום התומ"צ,
they hold that this matter is possible only after the Giving of the Torah and hearing the Ten Commandments from the mouth of the Almighty,
ס"ל שענין זה אפשרי רק אחרי מ"ת ושמיעת עשה"ד מפי הגבורה,
but before that a covenant on Torah and commandments is not possible,
משא"כ לפני כן לא יתכן ברית על תומ"צ,
since they are in the category of a thing that has not yet come into the world
שהן בגדר דבר שלא בא לעולם
(since all that they knew and were commanded<pg>32</pg>
(כיון שכל מה שידעו ונצטוו<pg>32</pg>
Before the Giving of the Torah,
לפני מ"ת,
is not at all in that category of the commandments after the Giving of the Torah).
אינו כלל באותו הגדר של המצוות שלאחרי מ"ת).

And therefore it is logical to say,
ולכן מסתבר לומר,
that the essential matter of acceptance of commandments
שעיקר ענין קבלת מצוות
(through which Israel entered into the covenant)
(שעל ידה נכנסו ישראל לברית)
was at the time of hearing the Ten Commandments,
הי' בעת שמיעת עשה"ד,
for then the Holy One, blessed be He, announced the unity of the Name and the prohibition of idolatry — "I am" and "You shall not have"
שאז הודיע הקב"ה ייחוד השם ואיסור ע"ז — אנכי ולא יהי' לך
[with their punishments — "a jealous God, etc."<sup>61</sup>]
[עם עונשם — "אל קנא גו'"<sup>61</sup>]
and the prohibition of Shabbat and more of the severe ones
ואיסור שבת ועוד מהחמורות
(which are punishable by death),
(שהם בעונש מיתה),
and also from the light ones.
וגם מהקלות.
And based on this, the difficulty of the Tosafot is simply resolved<sup>62</sup>
ועפ"ז מתורצת בפשיטות קושיית התוס'<sup>62</sup>
in the Chazal<sup>63</sup>
במחז"ל<sup>63</sup>
that "He overturned the mountain upon them like a tub"
ש"כפה עליהם את ההר כגיגית"
(And therefore "from here a great protest against the Torah"<sup>63</sup>,
(ולכן "מכאן מודעה רבה לאורייתא"<sup>63</sup>,
that Israel has an answer regarding this that they did not fulfill the Torah,
שיש לישראל תשובה ע"ז שלא קיימו התורה,
"because they received it under duress"<sup>64</sup>),
"שקבלוה באונס"<sup>64</sup>),
and behold "they already preceded 'we will do' to 'we will hear'"<sup>65</sup>
והרי "כבר הקדימו נעשה לנשמע"<sup>65</sup>
— and according to the above it can be said,
— וע"פ הנ"ל י"ל,
that the saying of "we will do and we will hear" does not have in it the status of "acceptance of commandments",
שאמירת נעשה ונשמע אין בזה תורת "קבלת מצוות",
and the acceptance of the commandments of Israel was at the time of the Giving of the Torah,
וקבלת המצוות דישראל היתה בשעת עשה"ד,
and then it was in a manner of "He overturned the mountain upon them like a tub".
ואז הי' זה באופן ד"כפה עליהם הר כגיגית".
And this is also the explanation according to the view of Rebbe Yishmael above,
וזהו גם הביאור בשיטת ריבר"י הנ"ל,
that their immersion for the sake of conversion was on the Sabbath day — because this act of immersion of the Children of Israel did not have in it the effect of entering into the covenant,
שטבילתם לשם גירות היתה ביום השבת — כי מעשה טבילה זו של בנ"י לא היתה בו חלות כניסה לברית,
since there was not yet acceptance of commandments,
כיון שעדיין לא היתה קבלת מצוות,
and the actual entry into the covenant and the effect of conversion was brought about afterwards by the act of the Holy One, blessed be He<sup>66</sup>
והכניסה לברית בפועל וחלות הגירות נפעלה אח"כ ע"י מעשה הקב"ה<sup>66</sup>
(in the saying of the Giving of the Torah as above),
(באמירת עשה"ד כנ"ל),
for then there was acceptance of Torah and commandments by Israel.
שאז היתה קבלת תומ"צ ע"י ישראל.

And one should add a source for the matter mentioned
ויש להוסיף מקור לענין האמור
(that the giving of the Torah was activated only at the time of the Giving of the Torah)
(שהגירות דמ"ת נפעלה רק בעת עשה"ד)
in the words of the Midrash<sup>67</sup>,
בדברי המדרש<sup>67</sup>,
that "when the Holy One, blessed be He, created the world He decreed and said<sup>68</sup>
ד"כשברא הקב"ה את העולם גזר ואמר<sup>68</sup>
The heavens are heavens for the Lord and the earth He gave to the children of man,
השמים שמים לה' והארץ נתן לבני אדם,
when He wanted to give the Torah He nullified the first decree and said the lower ones shall ascend to the upper ones and the upper ones shall descend to the lower ones and I begin as it is said<sup>69</sup>
כשביקש ליתן את התורה בטל את הגזירה הראשונה ואמר התחתונים יעלו לעליונים והעליונים ירדו לתחתונים ואני המתחיל שנאמר<sup>69</sup>
And the Lord descended upon Mount Sinai."
וירד ה' על הר סיני".
From the words of the Midrash it is understood,
מדברי המדרש מובן,
that even though we find revelation of the Lord to righteous ones and to prophets before the Giving of the Torah,
שאע"פ שמצינו התגלות ה' לצדיקים ולנביאים לפני מ"ת,
nevertheless,
מ"מ,
since it was before the nullification of the "first decree",
כיון שהי' לפני בטול "גזירה הראשונה",
this is considered that still the "upper ones"
ה"ז נחשב שעדיין ה"עליונים"
(the Divine Presence)
(השכינה)
had not descended below.
לא ירדו למטה.
And as is explained in several places,
וכמבואר בכמה מקומות,
that before the Giving of the Torah there was no completeness in the revelation of the Holy One, blessed be He,
שקודם מ"ת לא היתה שלימות בהתגלותו של הקב"ה,
and only at the time of the Giving of the Torah was the revelation of "I am the Lord your God",
ורק בעת מ"ת היתה ההתגלות של "אנכי ה' אלקיך",
and therefore only then was the decree nullified that upper ones shall not descend to lower ones.
ולכן רק אז בטלה הגזירה דעליונים לא ירדו לתחתונים.
And from this it is understood also regarding Moshe Rabbeinu himself,
ומזה מובן גם בנוגע למשה רבינו עצמו,
that although the Holy One, blessed be He, revealed Himself to him in the [burning] bush and more,
דאף שהקב"ה נתגלה אליו בסנה ועוד,
nevertheless,
מ"מ,
this is not at all in that category of "revelation of G-d" as it was at the time of the descent of G-d on Mount Sinai and the saying of the Ten Commandments.
אין זה כלל באותו הגדר של "התגלות ה'" כפי שהיתה בעת ירידת ה' על הר סיני ואמירת עשרת הדברות.
And with this one can explain that which Matan Torah is considered as
ובזה יש לבאר מה שמ"ת נחשב כ
the conversion of the Jewish people,
גירות של עם ישראל,
that the matter of conversion
שענין הגירות
is that the convert becomes a new reality,
הוא שהגר נעשה מציאות חדשה,
as-
כ
A minor who was born, of the [70]
קטן שנולד דמי<sup>70</sup>,
And seemingly, behold already in the Exodus from Egypt it is said [71]
ולכאורה הרי כבר ביציאת מצרים נאמר<sup>71</sup>
"To take for Him a nation from within a nation" [72]
"לקחת לו גוי מקרב גוי"<sup>72</sup>,
And more difficult according to the first [pg. 33]
וביותר יוקשה לפי הראשו<pg>33</pg>
im [73]
נים<sup>73</sup>
who hold that the Patriarchs already departed from the category of Bnei Noach and they had the law of Israel,
שס"ל שהאבות כבר יצאו מגדר ב"נ והי' להם דין ישראל,
And one cannot say that at the Giving of the Torah was the conversion of the people of Israel [74].
ואין לומר שבמ"ת היתה הגירות של עם ישראל<sup>74</sup>.
And according to the above it is explained,
וע"פ הנ"ל מבואר,
that although they were already bound to G-d before the Giving of the Torah,
דאע"פ שכבר היו קשורים לה' לפני מ"ת,
behold the manner of the revelation of the Holy One, blessed be He, to all of Israel at the time of the Giving of the Torah caused in them a complete renewal,
הרי אופן ההתגלות דהקב"ה לכל ישראל בעת מ"ת פעלה בהם התחדשות גמורה,
until they became like a completely new existence,
עד שנעשו כמציאות חדשה ממש,
like a newborn infant they are considered.
כקטן שנולד דמי.
And this is also the difference between the commandments before the Giving of the Torah and the commandments of the Torah that were given to us at Sinai,
וזהו גם ההבדל בין המצוות שלפני מ"ת לתומ"צ שניתנו לנו בסיני,
because this revelation of the Holy One, blessed be He, is "given" in the Torah and commandments<sup>75</sup>,
כי התגלות זאת של הקב"ה "ניתנה" בתורה ומצוות<sup>75</sup>,
in such a manner,
באופן כזה,
that through a Jewish person learning Torah and fulfilling commandments,
שע"י שאיש ישראל לומד תורה ומקיים מצוות,
he becomes bound and connected with the Essence of the Holy One, blessed be He,
מתקשר ומתחבר עם עצמות הקב"ה,
and in the language of our Sages,
ובלשון חז"ל,
that through Torah "Me you are taking"<sup>76</sup>.
שע"י תורה "אותי אתם לוקחים"<sup>76</sup>.
