behold, if you did not refrain, there is sin."

Also one learns<sup>3</sup>

from a gezerah shavah "refrain, refrain" — "It is written here: 'For you refrain from vowing'<sup>4</sup>

and it is written there<sup>5</sup>

'There the wicked cease from raging' — that "Whoever vows<sup>6</sup>

even though he fulfills it<sup>7</sup>

is called a wicked person."

Both teachings are brought down for halachah in the Shulchan Aruch<sup>8</sup>

Regarding the deficiency of vowing — at the end of Hilchos Nedarim the Rambam says: "Whoever vows is as if he built a private altar, and if he transgressed and vowed, it is a mitzvah to seek absolution for his vow."
וועגן דעם חסרון פון נודר זיין - בסוף הל׳ נדרים זאגט דער רמב״ם "כל הנודר כאילו בנה במה ואם עבר ונדר מצוה להשאל על נדרו".
And it requires explanation: Why does he not bring the aforementioned studies from verses,
וצריך ביאור: פארוואם ברענגט ער ניט די לימודים הנ״ל פון פסוקים,
but rather "All who vow etc." — on which he does not bring a verse<sup>13</sup>?
נאר ״כל הנודר כו״׳ — אויף וועלכן עם ברענגט זיך ניט קיין פסוק ?
Also one must understand: the matter,
אויך דארף מען פארשטיין: דעם ענין,
that one should refrain from vowing,
אז מ׳זאל זיך אפהאלטן פון נודר זיין,
the Rambam already says earlier,
זאגט שוין דער רמב״ם פריער,
in Hilchos De'os<sup>14</sup>,
אין הל׳ דעות ,
where he speaks about how a person's conduct should be in general regarding worldly matters — from which one must separate and from which one must not — and this is his language: "Therefore the Sages commanded that a person should not refrain himself except from things that the Torah alone forbade,
וואו ער רעדט ווי אזוי ס׳דארף זיין הנהגת האדם בכלל בנוגע דברים שבעולם — פון וועלכע מ׳דארף זיך אם־ שיידן און פון וועלכע מ׳דארף ניט — וז״ל: "לפיכך צוו חכמים שלא ימנע אדם עצמו אלא מדברים שמנעתו התורה בלבד,
and he should not forbid himself by vows and oaths regarding permitted things.
ולא יהא אוסר עצמו בנדרים ובשבועות על דברים המותרים.
Thus said the Sages<sup>15</sup>
כך אמרו חכמים
'Is it not enough for you what the Torah forbade, that you also forbid upon yourself other things?'"

It is not smooth: why does he not bring there the deficiency in Nedarim of the aforementioned maamarim,
איז ניט גלאטיק: פארוואס ברענגט ער ניט דארטן דעם חסרון אין נדרים דמאמרים הנ״ל,
that "whoever vows etc. is called a sinner
אז "כל הנודר כו׳ נקרא חוטא
(a transgressor),

as if he built a private altar"?

—which is indeed stricter than the claim "not enough for you" etc.

One will understand this through the explanation of the words of the Rambam in the aforementioned halacha: "Whoever vows is as if he built a private altar,
וועט מען דאם פארשטיין בהק־ דים ביאור דברי הרמב״ם אין דער הלכה הנ״ל: "כל הנודר כאילו בנה במה,
and if he transgressed and vowed, it is a mitzvah to seek absolution for his vow so that there should not be a stumbling block before him."
ואם עבר ונדר מצוה להשאל על נדרו כדי שלא יהא מכשול לפניו".
The source of the halachah,
דער מקור פון דער הלכה,
is the statement of Rabbi Nathan that is brought several times in the Talmud<sup>16</sup>,
איז דער מאמר פון רבי נתן וואס ווערט גע־ בראכט כמה פעמים בש״ס ,
and R. N. concludes "and one who fulfills it is as if he offered a sacrifice upon it"<sup>17</sup>.
און ר״נ פירט אוים "והמקיימו כאילו הקריב עלי׳ קרבן" .
It is not understood: why does the Rambam also not bring the conclusion of the statement which further brings out the magnitude of the sin if one does not ask about the vow
איז ניט מובן: פארוואם ברענגט ניט דער רמב״ם אויך דעם סיום פון דעם מאמר וואם ברענגט נאכמער ארויס דעם גודל החטא אויב מ׳איז ניט שואל אויפן נדר

that "if he is afraid lest he come to a stumbling block and fulfills his vow and does not ask about it, it is as if he offered a sacrifice upon it,

but if it is certain to him that he will not come to a stumbling block, if he wishes to fulfill, he should fulfill."

But it is seemingly not smooth to learn thus in the Rambam,

From the plain language of the Rambam "כל הנודר כאילו בנה במה ואם עבר ונדר מצוה להשאל על נדרו כו'" it implies,

that just as the beginning speaks about every manner of vow

means that in any manner,

How can it be that he will not come to a stumbling block — since our Sages of blessed memory said in their Mishnah<sup>25</sup>

and they asserted to place themselves in a test<sup>26</sup>.

Superficially, one can answer this based on the precise language of the Rambam "Whoever vows is as if he built a private altar" — not as in several places in the Talmud<sup>27</sup>
לכאורה קען מען דאס פאר־ ענטפערן ע״פ דיוק לשון הרמב״ם "כל הנודר כאילו בנה במה״ - ניט ווי בכמה מקומות בש״ס
(and similarly in the Shulchan Aruch<sup>28</sup>)

where it says "whoever vows" simply — what must be said is the intention of the Rambam in this:

The Rambam continues and concludes the halacha,
דער רמב״ם איז ממשיך ומסיים די הלכה,
that "And if he transgressed and vowed, it is a mitzvah to seek absolution for his vow etc. In what matters is this said? In vows of prohibition, but vows of consecration, it is a mitzvah to fulfill them etc."
אז "ואם עבר ונדר מצוה להשאל על נדרו כו׳ במה דברים אמורים בנדרי איסר אבל נדרי הקדש מצוה לקיימן כו"׳.
From the fact that the Rambam makes a distinction between vows of prohibition and vows of consecration only in the second case of "And if he transgressed and vowed",

that regarding vows of prohibition it is "a mitzvah to seek absolution for his vow" and "vows of consecration, it is a mitzvah to fulfill them and not to seek absolution for them except under duress" — and not regarding the first case of "Whoever vows"

that the statement of Rabbi Nathan speaks even about vows of charity,

because "even though it is a mitzvah to give charity, nevertheless when he vows and obligates himself with a vow, it appears as if he is adding to the commandments of the Holy One, blessed be He, as if the Holy One, blessed be He, did not complete His statutes in what He commanded us"].

And therefore the Rambam is precise "all who vows" — to include also vows of consecration<sup>30</sup>.

According to this is also answered why the Rambam does not bring the continuation of the statement of R. N. "and the one who fulfills it is as if he offered a sacrifice upon it": since that "all who vows is as if he built a high place" means also vows of consecration — then if the Rambam would have continued "and the one who fulfills it is as if he offered a sacrifice upon it",

it would have been in contradiction to the ruling in Rambam "in what matters are these said? In vows of prohibition, but vows of consecration it is a mitzvah to fulfill them and one should not ask about them except under duress, as it is said 'vows to the Lord I will pay'."

Since that the fulfillment of the vow is "as if he offered a sacrifice upon it" — how can one say regarding vows of consecration "it is a mitzvah to fulfill them"?

And based on this it is also resolved why the Rambam does not bring down "one who vows is as if he built a private altar" in Hilchos De'os,
[ועפ״ז איז אויר מתורץ וואם דער רמב״ם ברענגט ניט אראפ ״כל הנודר כאילו בנה במה" אין הל׳ דעות,
because there he speaks about abstinence from worldly matters and vows of prohibition; but about vows of consecration — he does not speak there].
ווארום דארטן רעדט ער וועגן פרישות פון עניני העולם ונדרי איסור; אבער וועגן נדרי הקדש — רעדט ער ניט דארטן].
It remains, however, not understood: Since also vows of consecration are "as if he built a private altar" — why does the Torah say that one should leave the "stumbling block before him"
עם בלייבט אבער ניט מובן: וויבאלד אז אויר נדרי הקדש זיינען "כאילו בנה במה״ — פארוואס זאגט תורה אז מען זאל איבערלאזן דעם "מכשול לפניו"

And we must explain all this:

As an introduction — the matter of "as if he built a bamah" the Rambam says — and so it stands in the Gemara — only regarding nedarim
בהקדם — דעם ענין פון "כאילו בנה במה״ זאגט דער רמב״ם — און אזוי שטייט אין גמרא — נאר לגבי נדרים
("all who makes a neder"),
("כל הנודר"),
but not regarding shevuot
אבער ניט לגבי שבועות
"he who makes a neder or he who makes a shevuah etc."

Moreover: in Hilchot Deot,
נאכמער: אין הל׳ דעות,
where the Rambam speaks
וואו דער רמב״ם רעדט
(as above)

about the deficiency of forbidding to oneself things that are permitted,
וועגן דעם חסרון פון אסר׳ן אויר זיר דברים המותרים,
he includes nedarim and shevuot together].
איז ער כולל נדרים ושבועות צוזאמען].
And as is proven at the end of Hilchos Shvuos,
און ווי ס׳איז מוכח אין סוף הל׳ שבועות,
where the Rambam says: "And it is a great goodness for a person not to swear at all" and he continues "And if he transgressed and swore

(according to his language regarding a vow at the end of Hilchos Nedarim: And if he transgressed and vowed)

And he does not say about this "as if he built a bamah".

The Rogatchover<sup>32</sup>
דער ראגאטשאווער
explains this: "For regarding an oath, which is a prohibition on the person and the prohibition does not take effect on any object, it is not applicable to say 'as if he built a bamah'<sup>33</sup>
איז דאם מבאר: "דגבי שבועה דהוא איסור גברא ולא חל האיסור על שום דבר לא שייך לומר כאילו בנה במה
for the prohibition is the oath and not something else."
דהאיסור הוא השבועה ולא דבר אחר".
The explanation of this:

In this the reason of the matter,

why one says that one who makes a vow is "as if he built a bamah",

: "It seems to me that this is why we compare him to one who builds a bamah, because it enters the mind of the vower that he is doing a mitzvah,

for the Merciful One prohibited him in matters of prohibition and he also prohibits upon himself."
דרחמנא אסרי׳ במילי דאיסורא ואיהו נמי אסר אנפשי'".
And on this one says "He errs,
און אויף דעם זאגט מען "דטעי,
for on the contrary, he is like one who builds a bamah, for although the Merciful One commanded him to offer sacrifices inside,
דאדרבה לבונה במה דמי דנהי דרחמנא אזהרי׳ לאקרובי קרבנות בפנים,
He commanded him not to add to it to build a bamah and to offer outside,
אזהרי׳ דלא לוסיף עלי׳ לבנות במה ולהקריב בחוץ,
so too, although the Merciful One prohibited to him forbidden things, when he adds to what the Merciful One prohibited, he transgresses,

that they said in the Yerushalmi in the chapter Potechin<sup>35</sup>

This setup can be interpreted in two ways — in what the deficiency and sin of the one who vows consists: a)

In the action of the person,
אין פעולת הגברא,
That he prohibits matters that the Torah did not prohibit.
וואם ער אסר׳ט ענינים וואם די תורה האט זיי ניט גע׳אסר׳ט.

In the object,

In that through his vow an object of prohibition was created,

That the Torah did not prohibit.

And also regarding vows to give charity,

And in general vows of consecration — although there no object of prohibition is created,

one can learn the deficiency

Based on this, the precision of the language will be sweetened

The Rambam says however that this is "as if he built

According to this, the language of the Rambam is also precise: "And if he transgressed and vowed, it is a mitzvah to seek annulment for his vow, so that there should not be a stumbling block before him."

For at first glance: According to this explanation of the Radbaz

And the reason that the Rambam teaches thus — is because of the very thing that the Gemara says that

Only regarding a vow,
נאר בנוגע לנדר,
and not regarding an oath: if because of the action of the person,

there is also regarding an oath.

According to this, the difference between the words of the Rambam in Hilchos Deos and in Hilchos Nedarim is also understood:

גברא,
which includes several matters: beginning from the general conduct of separation from the ways of the world in a manner that "he should not eat meat nor drink wine nor marry a woman etc. and the like of them",
וואס איז כולל כמה ענינים: אנהויבנדיק פון דער הנהגה כללית של פרישה מדרכי העולם באופן אז "לא יאכל בשר ולא ישתה יין ולא ישא אשה כו׳ וכיוצא בהן",
and that "it is an evil way and it is forbidden to go in it.
וואם "דרך רעה היא ואסור לילך בה.
One who walks in this way is called a sinner, for it says about a nazir etc."; and likewise in particular matters "that a person should not refrain himself except from things that the Torah alone has forbidden him" as above,
המהלך בדרך זו נקרא חוטא שהרי הוא אומר בנזיר כו׳"; און עד״ז בענינים פרטיים "שלא ימנע אדם עצמו אלא מדברים שמנעתו התורה בלבד" כנ״ל,
in which vows and oaths are equal
וואס אין דעם זיינען נדרים ושבועות בשווה
(as the Rambam continues there),
(ווי דער רמב״ם איז דארטן ממשיך),
because in the separation of the person from "permitted things" — there is no difference in what manner this is done<sup>44</sup>
ווארום אין דער פרישות הגברא פון "דברים המותרים״ — איז קיין נפק״מ ניט באיזה אופן דאס ווערט געטאן
In contrast, in Hilchos Nedarim, the Rambam speaks about the deficiency from the side of the object,
משא״כ אין הל׳ נדרים רעדט דער רמב״ם וועגן דעם חסרון מצד דער חפצא,
and that he has made a thing forbidden.
וואם ער האט אויפגעמאכט א דבר איסור.
Therefore he says specifically there that "it is as if he built a private altar" and not by oaths as above.
דערפאר זאגט ער דוקא דארטן אז "כאילו בנה במה" און ניט ביי שבועות כנ״ל.
And this is also the reason that the Rambam does not bring here "All who vows even though he fulfills it is called a sinner" or "is called a wicked one",
און דאס איז אויך דער טעם וואס דער רמב״ם ברענגט דא ניט "כל הנודר אע״פ שמקיימו נקרא חוטא" אדער "נקרא רשע",
because in Hilchos Nedarim the Rambam speaks only about the novelty and special concept regarding vows — namely that the vower creates an object of prohibition
ווארום אין הל׳ נדרים רעדט דער רמב״ם נאר וועגן דעם חידוש וענין מיוחד ביי נדרים — והיינו וואס דער נודר מאכט אויף א חפצא של איסור
(and therefore "All who vows is as if he built a bamah" as above),
(און דערפאר "כל הנודר כאילו בנה במה״ כנ״ל),
but that which "is called a wicked one" and "is called a sinner",
משא״כ דאס װאם "נקרא רשע" און "נקרא חוטא",
name and description of the person,
שם ותואר הגברא,
which is not a special concept regarding vows,
וואם איז ניט קיין ענין מיוחד ביי נדרים,
and in the manner that the Gemara<sup>45</sup>
וע״ד ווי די גמרא
says that "All who fasts is called a sinner".
זאגט אז "כל היושב בתענית נקרא חוטא".
And the content of this concept
און תוכן ענין זה
(the sin regarding vows from the perspective of the person)
(דעם חטא ביי נדרים מצד הגברא)
the Rambam indeed brings in Hilchos Deos,
ברענגט טאקע דער רמב״ם אין הל׳ דעות,
that "One who walks in this way
אז "המהלך בדרך זו
(he separates himself from worldly matters)
(ער איז זיך פורש פון עניני העולם)
is called a sinner",
נקרא חוטא",
and continuing from this: "Therefore the sages commanded etc. and he should not forbid himself with vows and oaths regarding permitted things etc.
און בהמשך לזה: "לפיכך צוו חכמים כו׳ ולא יהא אוסר עצמו בנדרים ובשבועות על דברים המותרים כו׳
(And included in this rule are those who fast constantly etc. and the sages forbade that a person afflict himself with fasting<sup>46</sup>)
(ובכלל הזה אלו שמתענים תמיד כו׳ ואסרו חכמים שיהא אדם מסגף עצמו בתענית )

Based on all this, one will also understand the difference between vows of prohibition and vows of consecration.
ע״פ כל זה וועט מען אויך פאר־ שטיין דעם חילוק צווישן נדרי איסור און נדרי הקדש:
By vows of prohibition,
ביי נדרי איסור,
through his vow an object of prohibition was created,
איז דורך זיין נדר געווארן א חפצא של איסור,
and consequently he made an object,
ובמילא האט ער געמאכט א חפצא,
a "stumbling block before him."
א "מכשול לפניו".
And therefore "it is a mitzvah to seek absolution for his vow so that there should not be a stumbling block before him";
און דעריבער איז "מצוה להשאל על נדרו כדי שלא יהא מכשול לפניו";
But not so with vows of consecration,
משא״כ ביי נדרי הקדש,
his vow created
האט זיין נדר געשאפן
(not an object of prohibition,
(ניט א חפצא של איסור,
but on the contrary)
נאר אדרבה)
a status of obligation of charity
א חלות חיוב של צדקה
(and similarly with other consecrations)
(וכיו״ב בשאר הקדשות)
; and therefore the object is not a matter of "stumbling block before him" — on the contrary,
; און דעריבער איז די חפצא ניט אן ענין פון "מכשול לפניו" — אדרבה,
it is an object of a mitzvah,
ס׳איז א חפצא של מצוה,
"it is a mitzvah to fulfill them."
"מצוה לקיימן".
And this is also the precise point in the comparison to "as if he built a bamah": building a bamah if he builds it initially not for a forbidden act — is not a prohibition<sup>47</sup>.
און דאס איז אויך דער דיוק אין דעם צושטעל צו "כאילו בנה במה": בנין במה אויב ער בויט עם מלכתחילה ניט צוליב א פעולה אסורה - איז ניט קיין איסור .
It is only a preparation<sup>48</sup>
ס׳איז נאר א הכשר
for actions on a bamah which can be a prohibition
צו פעולות בבמה וועלכע קענען זיין אן איסור
(offering a sacrifice)
(הקרבת קרבן)
or a mitzvah
אדער א מצוה
(a place of honor for his father and his teacher,
(מקום כבוד לאביו ורבו,
reading the Torah,
קריאה בתורה,
saying words of awakening from a "high" place — as the language of the verse<sup>49</sup>
אמירת דברי התעוררות ממקום ״גבוה״ - כלשון הכתוב
: upon a high mountain go up to you etc. lift up with strength your voice etc.,
: על הר גבוה עלי לך וגו׳ הרימי בכח קולד גו׳,
and the like)
וכיו״ב)
or a matter of permission and ordinary.
או דבר הרשות וסתם.
And therefore the Rambam does not bring here the explicit verse
און דעריבער ברענגט דא ניט דער רמב״ם דעם פסוק מפורש
"That which is gone out of your lips you shall keep and do as you have vowed",
"מוצא שפתיך תשמור ועשית כאשר נדרת",
that it is a positive commandment from the Torah that he should fulfill his vow,
אז ס׳איז א מ״ע מן התורה ער זאל מקיים זיין נדרו,
as the Rambam says earlier
ווי דער רמב״ם זאגט פריער ,
only because it is "vows to the Lord"
נאר וויבאלד ס׳איז ״נדרי לה'" ,
that is
דאס איז
(not his own prohibition and obligation,
(ניט זיין אייגענער איסור וחיוב,
but that is)
נאר דאס איז)
became a matter for the Lord
געווארן אן ענין לה׳ ,
therefore it is — "I will pay".

Regarding the matter of the oath
בנוגע ענין שהזמ״ג,
7 of Consolation — the oath
ז׳ דנחמתא — דער שבועה
of the Supreme One to bring Jews into the Land of Israel,
פון דעם אויבערשטן אויר אריינברענגען אידן אין ארץ ישראל,
and in general about the redemption
און בכלל אויף דער גאולה ,
this is a matter that the Supreme One promised,
איז דאם אן ענין וואם דער אויבערשטער האט מבטיח געווען,
and moreover — bound Himself, as it were, with an oath,
און נאכמער — זיר געבונדן כביכול מיט א שבועה,
and moreover: through this it opened up in the object of the world — since the speech of the Holy One, blessed be He, is considered an action,
און נאכמער: דורך דעם האט זיר דאם אויפגעטאן אין דער חפצא דהעולם — וויבאלד דיבורו של הקב״ה חשיב מעשה,
it is — from the side of the existence of the world "it demands that Jews should enter into the Land of Israel,
איז — מצד דער מציאות פון וועלט "מאנט זיח אז אידן זאלן אריינגיין אין ארץ ישראל,
and that the true and complete redemption should come through Mashiach our righteous one.
און אז עם זאל קומען די גאולה האמיתית והשלימה ע״י משיח צדקנו.
And therefore,
און דעריבער,
as soon as Jews will do teshuvah, then "immediately they will be redeemed"<sup>56</sup>,
ווי נאר אידן וועלן תשובה טאן איז "מיד הן נגאלין" ,
and there are no obstacles and delays G‑d forbid from anything in the world,
און עם איז ניט שײר קײנע מניעות ועיכובים ח״ו מצד עפעס אין וועלט,
on the contrary — the world itself demands that the redemption should come,
דאדרבה — וועלט גופא מאנט אז עם זאל קומען די גאולה,
and may it come speedily in our days, literally.
און קומען במהרה בימינו ממש.
