English translation 2

At the end of our parshah1

English translation 3

Rashi brings from Rabbi Moshe HaDarshan: Why is the section of the wood-gatherer juxtaposed to the section of idolatry? To say that one who desecrates the Sabbath is like an idolater, for it (idolatry) is also equivalent to all the commandments, etc.2.

English translation 4

In Tosafos3

English translation 5

it stands: The incident of the wood-gatherer was at the beginning of the forty [years], immediately after the incident of the spies, as it says in the Midrash that he intended for the sake of Heaven, because Israel was saying: Since it has been decreed upon them not to enter the Land from the incident of the spies, they are no longer obligated in the commandments. He arose and desecrated the Sabbath in order that he be killed and others see.

English translation 6

According to this, the juxtaposition of the section of the wood-gatherer to the entirety of our parshah is understood,

English translation 7

where it speaks about the sin of the spies

English translation 8

(which is the main story in our parshah, and after it the entire sidrah is called – Parshas Sh'lach),

English translation 9

because the incident of the wood-gatherer came as a result of the incident of the spies.

English translation 10

Since the Torah places the portion of idolatry between the incident of the spies and the portion of the wood-gatherer,

English translation 11

it is understood,

English translation 12

that also according to the Tosafot the portion of the wood-gatherer is related to the portion of idolatry in the manner that Rashi brings from Rabbi Moshe HaDarshan,

English translation 13

and as Tosafot4

English translation 14

explains the Gemara5

English translation 15

"Moses our teacher knew that the wood-gatherer was liable to death, as it is said6

English translation 16

'its desecrators shall surely be put to death,' but he did not know by which death"7,

English translation 17

that "although*7

English translation 18

an unspecified death is strangulation,

English translation 19

from the reasoning he would compare it to an idolater who is stoned, for one who desecrates Shabbat in public is like a denier of the fundamental principle, a denier of Maaseh Bereishit"8.

English translation 20

And one may add: This connection

English translation 21

(of the portion of the wood-gatherer to the portion of idolatry)

English translation 22

is

איז

English translation 23

(only)

English translation 24

in the very essence of the sin of Shabbat and idolatry.

English translation 25

But from the fact that the juxtaposition is not merely to a general sin of desecration of Shabbat,

English translation 26

but specifically to the sin of the wood-gatherer,

English translation 27

it is plausible to say,

English translation 28

that the portion of idolatry has a connection to the manner of desecration of Shabbat as it was with the wood-gatherer,

English translation 29

"for the sake of Heaven he intended."

English translation 30

And one must say,

English translation 31

Since all this is a part of Parshas Shelach,

English translation 32

whose main subject is the section of the spies,

English translation 33

one must say,

English translation 34

that also this matter has a connection to the content of "the incident of the spies."9

English translation 35

B.

ב.

English translation 36

One will understand this with an introduction of an explanation in the words of the Midrash that Tosafos brings: "That for the sake of Heaven he intended, for Israel were saying: Since it was decreed upon them not to enter the Land from the incident of the spies, they are no longer obligated in the commandments,

English translation 37

he stood and desecrated the Sabbath in order that he be killed and others will see."

English translation 38

At first glance, in order to bring out that one is still obligated in mitzvos – why did he specifically need to desecrate the Sabbath,

English translation 39

And especially since through this comes an additional very great sin "your blood for your souls" – a shedder of his own blood10

English translation 40

– he brings to this that "he should be killed",

English translation 41

He could have brought it out by transgressing another commandment,

English translation 42

Even a very minor sin,

English translation 43

Which is liable for lashes,

English translation 44

Monetary [penalty] and the like?

English translation 45

Also in Targum Yonatan11

English translation 46

It states the general content that the wood-gatherer did not intend to desecrate intentionally but intended for the sake of Heaven,

English translation 47

But Targum Yonatan explains why he specifically desecrated the Sabbath: Because they then only knew "the decree of the Sabbath" but the punishment for desecrating the Sabbath – "the penalty of the Sabbath was not known to them",

English translation 48

So this was the intention of the wood-gatherer that through his deeds "the penalty became known

English translation 49

(of the Sabbath)

English translation 50

to all the house of Israel".

English translation 51

But according to the midrash

English translation 52

(cited in Tosafot)

English translation 53

that he did this in order to bring out that one is obligated in mitzvot,

English translation 54

it is not understood why he specifically chose desecration of Shabbat,

English translation 55

as above?

English translation 56

Then the explanation of this is — according to the words of the Maharsha12

English translation 57

on the question: how did he desecrate Shabbat in order to inform by which death is one judged for desecrating Shabbat?

English translation 58

He explains13

English translation 59

: Since he did not need to come to the melachah except "to know by which death etc.,

English translation 60

it is a melachah she-einah tzrichah legufah, like one who digs a pit and needs only its dirt, which is exempt according to Rabbi Shimon,"

English translation 61

and he elaborates: "And so one may say according to the midrash that Tosafot wrote etc. that it is also a melachah she-einah tzrichah legufah."

English translation 62

And according to this it is understood according to the midrash brought in Tosafos why he brought this out specifically through a forbidden labor on Shabbos,

English translation 63

because he did not want to commit a sin and specifically thereby should be the clarification mentioned above,

English translation 64

and this is specifically on Shabbos where a labor that is not needed for its own sake is exempt

English translation 65

(for Rabbi Shimon)14,

English translation 66

until as it stands in Kedushas Levi*14

English translation 67

– "if so he did not desecrate Shabbos at all".

English translation 68

3.

ג.

English translation 69

Nevertheless the Almighty said "the man shall be put to death, stone him, etc."15,

English translation 70

that he was liable to death – although it is revealed before Heaven that it was a labor that is not needed for its own sake,

English translation 71

and for the sake of Heaven he intended,

English translation 72

until that "he did not desecrate Shabbos at all"

English translation 73

(and in general – Torah and commandments)16

English translation 74

among Jews]17

English translation 75

explains the Maharsha12

English translation 76

that this is because "the witnesses did not know that they had warned him that he acted with this intent, and they are only matters of the heart, and they would have sentenced him to death based on the testimony."

English translation 77

is not the explanation in this that they stoned him by mistake

English translation 78

(due to the lack of knowledge of the witnesses)

English translation 79

– because Torah is indeed Torah of truth,

English translation 80

so if according to the truth18

English translation 81

according to his intent,

English translation 82

"he did not desecrate Shabbat at all",

English translation 83

the Almighty would not have commanded "the man shall surely be put to death, etc."19

English translation 84

Only the obligation of stoning "in human courts"20

English translation 85

is according to the Torah of truth on the deed and action,

English translation 86

and since his action was an action of desecration of Shabbos,

English translation 87

this is according to the law of the lower court21

English translation 88

an action for which one is liable for stoning,

English translation 89

and it is entirely not relevant his intention22.

English translation 90

D.

ד.

English translation 91

According to this is understood the connection of the portion of the wood-gatherer to the portion of idolatry:

English translation 92

Regarding idolatry, one finds a special matter that is not found in the other commandments of the Torah: Every Jew, even the most insignificant of the insignificant,

English translation 93

when it comes to a test of idolatry,

English translation 94

he sacrifices his life "even if it is only to do some act alone against the belief in the One G-d, such as bowing to an idol even though he does not believe in it at all in his heart"23.

English translation 95

And it requires explanation: The main sin of idolatry is the belief in the heart,

English translation 96

he considers as an entity one of all the creations besides the Most High,

English translation 97

an angel,

English translation 98

sphere or star24,

English translation 99

he accepts

English translation 100

(the idol worship)

English translation 101

as a god25,

English translation 102

and when "he does not believe in it at all in his heart" this is not the sin of idolatry,

English translation 103

he has not separated himself from the Most High,

English translation 104

and on the other hand,

English translation 105

even when he does not sacrifice his life, he does not receive any punishment because it is an act under duress26.

English translation 106

Only because this is a matter of idolatry,

English translation 107

even though this is not the content of the sin of idolatry,

English translation 108

it is called among Jews down here the prohibition of idolatry,

English translation 109

and he sacrifices himself for this.

English translation 110

And this is the continuation of the portion of the wood-gatherer on the Sabbath day to the portion of idolatry:

English translation 111

The labor of Shabbos is indeed entirely connected with his thought and intention – "Intentional labor the Torah forbade",

English translation 112

Therefore27

English translation 113

one is not liable for a labor that is not needed for its own sake

English translation 114

this is entirely not an act of desecration of Shabbos]28

English translation 115

– Nevertheless,

English translation 116

since the act in itself as it appears in the world is an act of desecration of Shabbos

English translation 117

(Because the fact that it was a labor not needed for its own sake was entirely not apparent in the act),

English translation 118

according to the true Torah law,

English translation 119

stoning comes upon him for the act.

English translation 120

5.

ה.

English translation 121

Based on all the above one will also understand the connection in content of the incident of the wood-gatherer to "the incident of the spies":

English translation 122

It is explained in several places29

English translation 123

that the reason why the spies wanted to remain in the desert and not enter the Land of Israel,

English translation 124

is because the main occupation of Jews in the desert

English translation 125

(where they did not need to occupy themselves with the matter of making a livelihood etc.)

English translation 126

was in the study of Torah

English translation 127

(and as the saying of our sages30

English translation 128

: The Torah was given to be expounded only to eaters of the manna),

English translation 129

that the study of Torah is its essence – the understanding and comprehension31

English translation 130

in intellect and thought32

English translation 131

(and also – bringing it down into speech33)

English translation 132

; but not so in the Land of Israel,

English translation 133

where there is indeed "six years you shall sow your field etc. you shall prune your vineyard"34,

English translation 134

and in the inner dimension – the main service there is – deed,

English translation 135

practical commandments

English translation 136

(and especially the fulfillment of the commandments dependent on the Land*34),

English translation 137

and good deeds in general

English translation 138

(good deeds).

English translation 139

With this one will understand the words of the midrash

English translation 140

(brought in Tosafot)

English translation 141

mentioned above: that Israel would say, since it was decreed upon them not to enter the Land from the incident of the spies, they are no longer obligated in the commandments.

English translation 142

From the plain meaning of the language of the midrash it is implied,

English translation 143

that they did not mean to rebel against the Most High, heaven forbid, by that which they would not fulfill commandments,

English translation 144

but35

נאר

English translation 145

"they are not obligated in the commandments".

English translation 146

And superficially it is perplexing: What is the reason of their initial assumption?

English translation 147

they would have said "since the decree of death was decreed upon them"36

English translation 148

and the like – one could still explain their initial reasoning

English translation 149

(with great difficulty – at any rate),

English translation 150

that since their judgment for death was concluded,

English translation 151

they are like a dead man and they have no obligations.

English translation 152

But what is the initial reasoning "since it was decreed upon them not to enter the land etc. they are no longer obligated in the commandments"?

English translation 153

Only according to the above it can be said that this itself was their initial reasoning: since the matter of entering the land is indeed

English translation 154

(primarily)

English translation 155

for the sake of fulfillment of the commandments in action,

English translation 156

they considered,

English translation 157

"since it was decreed upon them not to enter the land from the incident of the spies they are no longer obligated in the commandments" – to them the service of fulfillment of the commandments in action does not apply

English translation 158

and especially since many many commands were given as a preparation for entering the land37

English translation 159

(that in the merit of these commandments one will enter the land of Israel38)],

English translation 160

and their entire service consists only in the study of the Torah

English translation 161

(in thought and speech)

English translation 162

– "they are not obligated in the commandments".

English translation 163

And upon this comes the continuation of the story of the wood gatherer – "He stood and desecrated the Shabbos in order that he be killed and others see": This brings out,

English translation 164

that also in the matters whose entire content is "intentional work",

English translation 165

and he did it "for the sake of Heaven" not to transgress the will of Hashem – nevertheless,

English translation 166

also in this the main thing is – the actual deed,

English translation 167

which is why the Torah of Truth says that the halachic ruling below is that this is desecration of Shabbos and it carries the penalty of stoning.

English translation 168

And this taught the Jews who then remained in the desert,

English translation 169

that even though "it was decreed upon them not to enter the Land",
