that Rashi in his commentary on the Torah answers <b>every</b> question that can arise in the study of the plain meaning of Scripture,

and there where Rashi finds no explanation

when one comes to a verse where there is seemingly a difficulty and Rashi does <b>not</b> address it,

is from this itself a proof,

that according to <b>the plain meaning</b> it is from the outset no question; or,

that the question is answered according to a Rashi commentary <b>before this</b>.

one must accordingly have an explanation in our parshah,
דאַרף מען לפ״ז האָבן אַ ביאור בפרשתנו,
where the Torah says<sup>2</sup>
וואו די תורה זאָגט
"If there be a quarrel between men and they approach the court and they judge them and they justify the righteous and they condemn the wicked.
„כי יהי׳ ריב בין אנשים ונגשו אל המשפט ושפטום והצדיקו את הצדיק והרשיעו את הרשע.
And it shall be if the wicked one is liable to be beaten and the judge casts him down etc." — that the words "and they justify the righteous and they condemn the wicked" are seemingly superfluous<sup>3</sup>

Regarding the words "and they shall condemn the wicked" one could learn

that they are an introduction and preface to "and it shall be, if the wicked one is worthy of stripes".

there is a teaching that learns from the words "and they justify the righteous" — "declare him righteous so that he will not be lashed",
איז פאַראַן אַ מ״ד וואָס לערנט אָפּ פון די ווערטער „והצדיקו את הצדיק״ — „צדקהו כדי שלא ילקה",
and as commentators
און ווי מפרשים
explain this that one must open in his merit — that first of all one must seek for the litigant a merit "so that he will not be lashed" and only afterwards — a matter of wickedness — in the manner of capital cases where the law is that "we open in his merit".

But one cannot say that Rashi assumes the explanation,

that that which Rashi does not need to protect the question
אַז דאָס וואָס רש״י דאַרף ניט באַוואָרענען די שאלה
(because of what it says "and they justified the righteous and condemned the wicked"),
(צוליב וואָס שטייט „והצדיקו את הצדיק והרשיעו את הרשע"),
is because it is understood from Rashi on the beginning of the verse "for there will be a quarrel" — "their end is to come to judgment,
איז ווייל דאָס איז מובן פון פרש״י אויף התחלת הכתוב „כי יהי׳ ריב״ — „סופם להיות נגשים אל המשפט,
say from now on there is no peace that comes out of a quarrel,
אמור מעתה אין שלום יוצא מתוך מריבה,
what caused Lot to separate from the righteous, you must say this quarrel".
מי גרם ללוט לפרוש מן הצדיק הוי אומר זו מריבה".
In this arises the question

: what is here the deficiency that "their end is to come to judgment"?

And on the contrary: through their "coming to judgment" there will be among them <b>peace</b><sup>14</sup>,

The wonder is even greater: the source of this Rashi is from Sifri<sup>9</sup>,

but there the wording is: "Peace does not emerge from strife..
אָבער דאָרט איז דער לשון: „אין שלום יוצא מתוך מריבה ..
What caused this <b>to be stricken </b>? We must say it is strife"

One finds in several places,

that a dispute between two people

(which is brought before a judge)

is designated in the Torah with the word
ווערט באַצייכנט אין תורה מיטן וואָרט
"davar"<sup>18</sup>,

they have a <b>matter </b>that has come to me, and I will judge between a man and his neighbor",

Why then does the verse use here specifically the word "strife" and not "matter"?
פאַרוואָס־זשע נוצט דער פסוק דאָ דוקא דעם וואָרט „ריב" און ניט „דבר"?
Rashi explains: "because there will be <b>strife </b>— their end is to come before the court, say
איז רש״י מפרש: „כי יהי׳ ריב — סופם להיות נגשים אל המשפט אמור
"Now there is no peace that comes out of <b>quarrel</b>" — here it speaks about a conflict in a manner of <b>strife</b>,
מעתה אין שלום יוצא מתוך מריבה " — דאָ רעדט זיך וועגן אַ סכסוך אין אַן אופן פון ריב ,
and from <b>this</b> "there is no peace that comes out",
און פון דעם איז „אין שלום יוצא",
even not <b>through</b> "<b>judgment</b>"<sup>30</sup>

In general,
בכלל,
when two people have between themselves a conflict that is <b>not</b> in the category of quarrel,
ווען צוויי מענטשן האָבן צווישן זיך אַ סכסוך וואָס איז ניט בגדר מריבה,
the conflict can be resolved and brings peace — either they come through between themselves alone,
קען דער סכסוך אויסגעגליכן ווערן און בריינגט שלום — אָדער זיי קומען דורך צווישן זיך אַליין,
or the court finds a compromise; and even in a case when the court decides that one side is entirely correct,
אָדער ב״ד געפינט אַ פשרה; און אפילו אין אַ פאַל ווען ב״ד איז מחליט אַז איין צד איז אינגאַנצן גערעכט,
since they do not have any "strife" between themselves and they seek the truth,
איז וויבאַלד זיי האָבן ניט קיין „ריב" צווישן זיך און זיי זוכן דעם אמת,
will also <b>the</b> verdict bring them to peace.
וועט זיי אויך דער פסק דין צוברענגען צו שלום.
But when there is a <b>quarrel</b>—that the conflict turns into a fight,
בשעת אָבער עס איז דאָ אַ ריב — אַז דער סכסוך ווערט פאַרוואַנדלט אין אַ קריגעריי,
then peace cannot come.
קען דאַן קיין שלום ניט ווערן.
They will come to judgment and the court will issue a <b>definitive</b> verdict,
זיי וועלן קומען למשפט און דער ב״ד וועט אַרויסגעבן אַ פסק דין חתוך ,
who is right and who is wrong,
ווער איז גערעכט און ווער איז אומגערעכט,
but even after the verdict, "peace does not emerge"<sup>31</sup>.
אָבער אויך נאָכן פסק דין איז „אין שלום יוצא" .
And on this Rashi brings a proof and example from Lot — "What caused Lot <b>to separate</b> from the righteous one, say it was this quarrel": For at first glance — the quarrel there was indeed
און אויף דעם ברענגט רש״י אַ ראי׳ ודוגמא פון לוט — „מי גרם ללוט לפרוש מן הצדיק הוי אומר זו מריבה": דלכאורה — דער ריב דאָרט איז דאָך געווען

and Lot had to separate "from the righteous one".

Based on this it is answered automatically why the verse says "and they shall justify the righteous and condemn the wicked" — because according to Rashi,
עפ״ז ווערט פאַרענטפערט בדרך ממילא פאַרוואָס דער פסוק זאָגט „והצדיקו את הצדיק והרשיעו את הרשע״ — ווייל לויט פרש״י ,
this is the meaning of the verse<sup>33</sup>,
איז דאָס די כוונה פון פסוק ,
that "when there will be a quarrel",
אַז „כי יהי׳ ריב",
"no peace will emerge" — there will be no peace,
איז „אין שלום יוצא״ — עס וועט קיין שלום ניט ווערן,
even through the judgment,
אפילו דורכן משפט,
because here the judgment is in a manner of "and they shall justify the righteous and condemn the wicked":

Here it does not speak about litigants who seek the truth and consequently — a judgment that brings peace between them,
דאָ רעדט זיך ניט וועגן בעלי דינים וואָס זוכן דעם אמת ובמילא — אַ משפט וועלכער ברענגט שלום צווישן זיי,
but rather — one is a <b>righteous</b> and the other a <b>wicked</b>,
נאָר — איינער איז אַ צדיק און דער צווייטער אַ רשע ,
and the purpose of the verdict is only to ascertain and <b>vindicate</b> the righteous <b>and condemn</b> the wicked.
און דער צוועק פונעם פסק דין איז בלויז צו אויסגעפינען און מצדיק זיין דעם צדיק והרשיעו את הרשע.

And one may add further,
ויש להוסיף עוד,
that the verse warns here about another matter:
אַז דער פסוק באַוואָרנט דאָ נאָך או ענין:
One might think that since this is a "quarrel",
מען קען מיינען אַז וויבאַלד דאָס איז אַ „ריב",
that they are conducting a dispute,
אַז זיי פירן אַ מחלוקת,
that one of them,
אַז איינער פון זיי,
or both of them are quarrelsome people
אָדער זיי ביידע זיינען בעלי מחלוקת

it is not possible that one should be entirely right,
