Further: In the verse here it says "And Moshe wrote <b>all the words of Hashem</b>" — the <b>same</b> wording that appears in an earlier verse<sup>2</sup>
נאָך מער: אין פסוק דאָ שטייט „ויכתוב משה את כל דברי ה׳ " — דער זעלבער לשון וואָס שטייט אין אַ פריערדיקן פסוק
"And Moshe came and told the people <b>all the words of Hashem</b>" — which Rashi explains there "all the words of Hashem — the commandments of separation and boundary."
„ויבא משה ויספר לעם את כל דברי ה׳ " — וואָס רש”י טייטשט דאָרט „את כל דברי ה׳ — מצות פרישה והגבלה”.
So what is the reason to change the explanation of "And Moshe wrote all the words of Hashem" in this verse,

from the explanation in the earlier verse?

Even if one learns that since the commandment of separation and boundary was a one-time matter
אפילו מ׳זאָל לערנען אַז וויבאַלד אַז מצות פרישה והגבלה איז געווען אַז איין מאָליגער ענין
(as preparation for the Giving of the Torah),

therefore it is not plausible that

upon this refers the "And Moshe wrote",

which Moshe's writing indicates a matter that pertains to later,

or moreover a permanence for generations — one can nevertheless

The difficulty in this is even greater:

<b>In the example </b>of Rashi's commentary one finds in the Mechilta<sup>6</sup>
בדוגמא צו פירוש רש”י געפינט מען אין מכילתא
— but Rashi <b>changes </b>from the Mechilta,

in such a way that Rashi's commentary is contrary to all opinions!

The Mechilta brings <b>three </b>opinions: "Rabbi Yosi bar Rabbi Asi says: From the beginning of Genesis until here,
די מכילתא ברענגט דריי דיעות: „ר׳ יוסי ברבי אסי אומר מתחלת בראשית ועד כאן,
Rabbi says: The commandments that were commanded to Adam the first, and the commandments that were commanded to the children of Noah, and the commandments that were commanded in Egypt and in Marah, and all the rest of the commandments,

<b>Rashi</b> however <b>combines</b> the first two opinions <b>together</b>.

(Even if Rashi learns the plain meaning in the Mechilta,

that Rabbi is not rejecting the first opinion,

because Rabbi counts not only the commandments that were commanded at Marah

"And he took the Book of the Covenant and read it in the ears of the people" — Rashi explains the words "Book of the Covenant" — "from Bereishis until the giving of the Torah and the commandments that were commanded at Marah."
„ויקח ספר הברית ויקרא באזני העם” איז רש”י מפרש די ווערטער „ספר הברית” — „מבראשית ועד מ”ת ומצות שנצטוו במרה”.
The reason why Rashi needs here at all to say an explanation on "Book of the Covenant",
דער טעם וואָס רש”י דאַרף דאָ בכלל זאָגן אַ פירוש אויף „ספר הברית”,
is understood,
איז מובן,
because earlier it is not mentioned that what Moshe wrote was the Book of the Covenant,
ווייל פריער ווערט ניט דערמאָנט אַז דאָס וואָס משה האָט געשריבן איז געווען דער ספר הברית,
Rashi must explain that it is the same thing.

And see the language of Rashbam here: "Sefer HaBris — as it is written above, Vayichtov Moshe etc."

At first glance, one could say,

But one cannot teach it this way,

Regarding the generalities of the portion

there is a dispute among the commentators of the Torah — when the portion was said and when all the events about which the portion speaks occurred:

According to Rashi, "all the words of Hashem" means

The essence of a covenant is to strengthen the connection and bond between those who participate in the covenant<sup>17</sup>,

נאָר באופן וואָס גיט אַרויס דעם תוכן וענין המצוות
(and as Rashi's language: <b>and the writing of commandments</b><sup>23</sup>),

here there was not the category of writing sections of <b>the Torah</b>,
דאָ איז ניט געווען גדר כתיבת פרשיות של תורה ,
but a category of writing commandments<sup>24</sup>.
נאָר אַ גדר פון כתיבת מצות .
And likewise is the difference whether the "Vayichtov Moshe" was before Mattan Torah or
און עד”ז איז דער אונטערשייד צי דער „ויכתוב משה” איז געווען פאַר מ”ת אָדער
(as the opinions that it was)
(ווי די דיעות אַז ס׳איז געווען)
after Mattan Torah.

Before Mattan Torah there were two matters: the sections of the Torah<sup>25</sup>
לפני מתן תורה זיינען געווען צוויי ענינים: פרשיות התורה
and the commandments that were commanded at Marah,
און מצוות שנצטוו במרה,
and consequently also in "Vayichtov Moshe" there were two types of writing,
ובמילא זיינען אויך אין „ויכתוב משה” געווען צוויי סוגי כתיבה,
as above — the writing of the sections of the Torah and the writing of <b>commandments </b>
כנ”ל — כתיבת פרשיות התורה און כתיבת מצות
(that were commanded at Marah)

not as they are a part of the sections of the Torah;
ניט ווי זיי זיינען אַ חלק פון פרשיות התורה;
After the giving of the Torah, however, there is no reason to make a distinction<sup>26</sup>,
נאָך מתן תורה אָבער איז ניטאָ קיין טעם צו מאַכן אַ חילוק ,
Rather "and he wrote" everything in the same manner — also the commandments
נאָר „ויכתוב” אַלעס אין זעלבן אופן — אויך די מצות

were written by Moses as sections of the Torah
זיינען געשריבן געוואָרן דורך משה אַלס פרשיות התורה
(which contain the commandments).

With this the reason becomes understood,
דערמיט ווערט פאַרשטאַנדיק דער טעם,
that coming to the verse "And he took the Book of the Covenant",
וואָס קומענדיק צום פסוק „ויקח ספר הברית”,
Rashi needs to explain and interpret what the "Book of the Covenant" is:
דאַרף רש”י מבאר און מפרש זיין וואָס דער „ספר הברית” איז:
Since we learned earlier that Moshe wrote two separate topics,
היות מ׳האָט געלערנט פריער אַז משה האָט געשריבן צוויי באַזונדערע ענינים,
in two different categories of writing — and here it says "Sefer HaBris" in singular — Rashi must explain that this Sefer HaBris consists of the same two different topics: "from Bereishis until the giving of the Torah and the commandments that were commanded in Marah"; with this it is also brought out that the covenant with Jews was on both topics:
אין צוויי פאַרשידענע גדרי כתיבה — און דאָ שטייט „ספר הברית” לשון יחיד — דאַרף רש”י מפרש זיין אַז דער ספר הברית באַשטייט פון די זעלבע צוויי פאַרשידענע ענינים: „מבראשית ועד מ”ת ומצות שנצטוו במרה”; מיט דעם ווערט אויך אַרויסגעבראַכט אַז דער ברית מיט אידן איז געווען אויף ביידע ענינים:

on Torah and its study,
אויף תורה ולימודה,
which this was through the writing "from Bereishis until the giving of the Torah",
וואָס דאָס איז געווען דורכן שרייבן „מבראשית ועד מ”ת”,
the sections of the Torah.

On the fulfillment of the commandments<sup>27</sup>

— through the writing of the "commandments that were commanded at Marah."

And based on this it will be sweetened,

That after Moshe Rabbeinu read the Book of the Covenant "in the ears of the people,"
וואָס נאָכדעם ווי משה רבינו האָט געלייענט דעם ספר הברית „באזני העם”,
the Jews said: "All that the L-rd has spoken <b>we will do and we will hear</b>"<sup>28</sup>
האָבן די אידן געזאָגט: „כל אשר דבר ה׳ נעשה ונשמע ”
"Na'aseh" — in connection with the "<b>mitzvos that were commanded </b>in Marah",
„נעשה” — בקשר צו די „ מצות שנצטוו במרה”,
which he read; and "Nishma" in continuation of the reading of the portions "from Bereishis until the giving of the Torah"<sup>29</sup>
וואָס ער האָט געלייענט; און „נשמע” בהמשך צו קריאת הפרשיות „מבראשית ועד מ”ת”
— and this was the preparation and preface to the study of the Torah and fulfillment of the mitzvos that Jews accepted upon themselves*<sup>29</sup>
— און דאָס איז געווען די הכנה והקדמה צום לימוד התורה וקיום המצות וואָס אידן האָבן אויף זיך מקבל געווען*
from now onward; through the double acceptance and in a manner of "<b>covenant</b>",
מכאן ולהבא; דורך דער קבלה כפולה ובאופן של „ ברית ”,
they became worthy to receive the Torah.
זיינען זיי געוואָרן ראוי צו מקבל זיין די תורה.

From the wondrous matters in this commentary of Rashi:

In the Gemara<sup>30</sup>
אין גמרא
there is a dispute between Rebbi Yochanan and Reish Lakish,
איז דאָ אַ מחלוקת צווישן ר”י און ר”ל,
whether "the Torah was given scroll by scroll"
צי „תורה מגילה מגילה ניתנה”
("When a portion was said to Moshe, he would write it,
(„כשנאמרה פרשה למשה הי׳ כותבה,
and at the end of 40 years, when all the portions were completed, he joined them with sinews and sewed them" — Rashi<sup>31</sup>),
ולבסוף מ׳ שנה כשנגמרו כל הפרשיות חיברן בגידין ותפרן” — רש”י ),
or "the Torah was given sealed"
אָדער „תורה חתומה ניתנה”
("It was not written until the end of 40 years, after all the portions were said, and those said to him in the first year and second year were arranged by heart until he wrote them" — Rashi<sup>32</sup>).
(„לא נכתבה עד סוף מ׳ לאחר שנאמרו כל הפרשיות כולן והנאמרות לו בשנה ראשונה ושני׳ היו סדורות לו על פה עד שכתבן” — רש”י ).
Tosafos<sup>33</sup> raises
שטעלט זיך תוס׳
on the opinion that holds "the Torah was given sealed" and asks: "It is astonishing, for it is written: 'And he took the Book of the Covenant and read it in the ears of the people,' and Rashi in his commentary on Chumash
אויף דעם מ”ד וואָס האַלט „תורה חתומה ניתנה” און פרעגט: „תימה דכתיב ויקח ספר הברית ויקרא באזני העם ופרש”י בפי׳ חומש
That is, from Bereishis until here”<sup>34</sup>,
דהיינו מבראשית ועד כאן” ,
and answers: “And we see to explain that it does not say that it was given sealed, that it was not written until the end, but rather that it was written in order, that there are sections that were said earlier before those verses that precede them and were not written until that which is written before it was said to him, and he writes this after it.”
און פאַרענטפערט: „ונראה לפרש דלא קאמר חתומה ניתנה שלא נכתבה עד לבסוף אלא שעל הסדר נכתבה דיש פרשיות שנאמרו תחילה לפני אותם הכתובים לפניהם ולא נכתבה עד שנאמר לו אותה שכתובה לפני׳ וכותב זאת אחרי׳”.
The Maharal<sup>35</sup>
דער מהר”ל
explains,
איז מסביר,
that Rashi in our parshah is not in contradiction to the one who says the Torah was given sealed
אַז פרש”י בפרשתנו איז ניט בסתירה צום מ”ד תורה חתומה ניתנה
(also according to Rashi in his commentary on the Talmud,
(אויך לדעת רש”י בפי׳ לש”ס,
that this means “it was not written until the end of forty”)
אַז דאָס מיינט „לא נכתבה עד סוף מ׳”)
— because this was “a necessity of the commandment”,
— ווייל דאָס איז געווען „צורך מצוה”,
and therefore “this is not considered giving of the Torah, only making a covenant”<sup>36</sup>.
און דעריבער איז „אין זה נתינת תורה נחשב רק לכרות ברית” .
According to the above will be sweetened: For although the writing "from Bereishis until Matan Torah" is ge-

when in the manner of the writing of the sections of the Torah,

this is however certainly not in the category of

the sections of the Torah,

rather a part of "Sefer HaBris",
נאָר אַ טייל פון „ספר הברית”,
which also contained the "commandments that were commanded at Marah" — and their writing was indeed <b>entirely </b>different from the writing in sections of the Torah and the two types of writing indeed together comprised <b>one </b>"Sefer HaBris".
וואָס האָט אויך אַנטהאַלטן די „מצות שנצטוו במרה” — און זייער שרייבן איז דאָך געווען אינגאַנצן אַנדערש פון דער כתיבה בפרשיות התורה און די ביידע סוגי כתיבה האָבן דאָך צוזאַמענגעשטעלט איין „ספר הברית”.
And that which Tosafos asks from the commentary of Rashi — it can be said according to the view of Tosafos: Since the sections that Moshe wrote from Bereishis until the Giving of the Torah are not different
און דאָס וואָס תוס׳ פרעגט פון דעם פירוש רש”י — איז י”ל לדעת התוס׳: וויבאַלד אַז די פרשיות וואָס משה האָט געשריבן מבראשית ועד מ”ת זיינען ניט אַנדערש

than the sections written afterwards in the Torah<sup>37</sup>,

so even though Moshe in the "Book of the Covenant" <b>joined </b>to them <b>also </b>the commandments that were commanded at Marah
איז אע”פ אַז משה האָט אין „ספר הברית” צו זיי מצרף געווען אויך די מצוות שנצטוו במרה
(which were written not like the sections of the Torah),
(וואָס זיינען געשריבן געוואָרן ניט ווי פרשיות התורה),
this however does not nullify or detract from that which the sections from Bereishis until the Giving of the Torah are a matter of the writing of the sections of the Torah.
איז דאָס אָבער ניט מבטל אָדער גורע פון דעם וואָס די פרשיות מבראשית ועד מ”ת זיינען אַן ענין פון כתיבת פרשיות התורה.
and does not mention the conclusion of Rashi's language "commandments that were commanded at Marah"<sup>39</sup>
און דערמאָנט ניט דעם סיום לשון רש”י „מצות שנצטוו במרה”
— because the

The writing of the commandments that were commanded at Marah has no connection to the discussion in Tosafos.
כתיבת מצות שנצטוו במרה האָט קיין שייכות ניט להשקו”ט אין תוס׳.
The question is only from "the writing from Bereishis until the Giving of the Torah,"
די קשיא איז נאָר פון „כתיבת בראשית ועד מ”ת”,
which is a category of writing the portions of the Torah<sup>40</sup>].
וואָס איז אַ גדר פון כתיבת פרשיות של תורה ].
Rashi's opinion, however, is,
דעת רש”י איז אָבער,
that since both matters of writing became <b>one</b> "Book of the Covenant" — then even the portions from Bereishis until the Giving of the Torah are not a matter of writing the portions of the <b>Torah</b>,
אַז וויבאַלד ביידע עניני כתיבה זיינען געוואָרן איין „ספר הברית” — איז אפילו די פרשיות מבראשית ועד מ”ת זיינען ניט אַן ענין פון כתיבת פרשיות של תורה ,
but rather — a matter of the "Book of the Covenant."
נאָר — אַן ענין פון „ספר הברית”.

The meaning of the Torah in this Rashi commentary — it can be said:
מיינה של תורה שבפירוש רש”י זה — י”ל:
Although the entirety of the matter of the covenant is the connection and bonding between those who are cutting the covenant,
אע”פ אַז כללות ענין הברית איז דער קישור והתחברות צווישן די וואָס זיינען כורת דעם ברית,
And in our subject — the connection and unification of the Most High with Jews,
ובנדו”ד — די התחברות והתאחדות פון אויבערשטן מיט אידן,
But there is a difference in the content of the covenant whether the covenant was made before the Giving of the Torah,
איז אָבער דאָ אַ חילוק אין דעם תוכן הברית צי דער ברית איז געמאַכט געוואָרן לפני מ”ת,
Or after the Giving of the Torah:
אָדער לאחרי מ”ת:
Until the Giving of the Torah, there was the decree that the upper ones should not descend to the lower ones and the lower ones should not ascend to the upper ones<sup>41</sup>.
ביז מ”ת איז געווען די גזירה אַז העליונים לא ירדו לתחתונים והתחתונים לא יעלו לעליונים .
It turns out,
קומט אויס,
that the covenant before the Giving of the Torah was still connected with the person, not with the object.

Moreover: it indeed brought about through Torah and commandments
ויתרה מזו: עס האָט זיך טאַקע אויפגעטאָן דורך תורה ומצות

an ascent and a connection with the Upper One,

There is however an elevation in the understanding

and with the aspect of Divinity that is drawn down through it,

that after <b>such </b>a preparation the refinement and elevation of the created beings at the Giving of the Torah was more complete,
אַז נאָך אַזאַ הכנה איז דער זיכוך ועליית הנבראים ביי מ”ת געווען נאָכמער בשלימות,
and consequently they
ובמילא זיינען זיי
were from the standpoint of <b>their level </b>fit recipients to receive the Torah that is above the category of created beings.

but not according to these opinions,
משא”כ לויט די דיעות,
that the covenant was after the Giving of the Torah,
אַז דער ברית איז געווען לאחרי מ”ת,
then at the time of the Giving of the Torah, [the Torah] was completely above their level and essence, and the giving of the Torah was primarily from the side of Above<sup>46</sup>.
איז בשעת מ”ת תורה געווען למעלה לגמרי פון מדריגתם וענינם און די נתינת התורה איז בעיקר געווען מצד למעלה .

And based on this, one can explain the aforementioned difference

From the aspect of the definition of created beings, there is a division between Torah and mitzvos,
מצד גדר הנבראים הערט זיך התחלקות פון תורה און מצות,
and consequently also in the acceptance of Yisrael, “naaseh” separately and “nishma” separately.
ובמילא אויך אין דער קבלה פון אידן „נעשה” באַזונדער און „נשמע” באַזונדער.
But from the aspect of the Creator, there is no division.
אָבער מצד הבורא הערט זיך ניט קיין התחלקות.
Just as the Above is absolute oneness,
פּונקט ווי דער אויבערשטער איז אחדות הפשוטה,
so too it expresses itself also in Torah as it is from the aspect of Above: everything is <b>one </b>matter of Torah<sup>47</sup>.
אַזוי זאָגט זיך עס אַרויס אויך אין תורה ווי זי איז מצד למעלה: אַלעס איז איין ענין פון תורה .
