The proof on this is:

The words "Atem Nitzavim" - which are seemingly out of place,

why does it say "Nitzavim" — an unusual expression — and not the expression "Omdim,"

Therefore Rashi brings a second explanation “and an Aggadic midrash,”
דעריבער ברענגט רש“י אַ צווייטן פירוש „ומדרש אגדה“,
that this comes in continuation of the curses and “Moshe began to appease them: ‘You are standing today
אַז דאָס קומט בהמשך צו די קללות און „התחיל משה לפייסם אתם נצבים היום
(so much so that although)
(אויף אַזוי פיל אַז חאָטש)
you have angered the Omnipresent many times and He did not make you cease to exist, and behold you stand before Him’” - the emphasis especially is on the word “Nitzavim,”
הרבה הכעסתם למקום ולא עשה אתכם כליי‘ והרי אתם קיימין לפניו“ - די הדגשה במיוחד איז אין דעם וואָרט „נצבים“,
which indicates a strong standing etc.
וואָס ווייזט אויף אַן עמידה חזקה כו‘.
And according to this explanation, it changes
און לויט דעם פירוש בייט זיך
(not only the intent and meaning of the word "Nitzavim",
(ניט בלויז דער מכוון און טייטש פון וואָרט „נצבים“,
but)
נאָר)
also the meaning of "Hayom":
אויך דער טייטש פון „היום“:
Since these are words of appeasement regarding the curses,
וויבאַלד אַז דאָס זיינען דברי פיוס אויף די קללות,
one must say simply that this was in temporal proximity to the admonition,
דאַרף מען זאָגן בפשטות אַז דאָס איז געווען בסמיכות בזמן צו דער תוכחה,
and consequently it is not plausible that this was on the day of his death<sup>25</sup>,
ובמילא איז ניט מסתבר אַז דאָס איז געווען ביום מותו ,
because: a)

the intent of the admonition is
די כוונה פון דער תוכחה איז
Yet he was to urge them regarding the fulfillment of Torah and mitzvos,
דאָך געווען לזרזם אויף קיום התורה ומצות,
he certainly did not wait with this until the day of his death,
האָט ער זיכער ניט געוואַרט דערמיט ביז יום מותו,

It is not plausible that on the day of his death Moshe would say to them curses<sup>26</sup>
ס‘איז ניט מסתבר אַז ביום מותו זאָל זיי משה זאָגן קללות
(on the contrary,

on the day of his death,
ביום מותו,
close to his death,
סמוך למיתתו,
he blessed them<sup>27</sup>).

Therefore Rashi must also learn that the word "today" has a different meaning,
דעריבער מוז רש“י אויך לערנען אַז דער וואָרט „היום“ האָט אַן אַנדער טייטש,
which comes in continuation of the explanation of "You are standing."
וואָס קומט בהמשך צו דעם פירוש פון „אתם נצבים“.
Since "You are standing" means "Behold you are enduring before Him etc. and the curses and afflictions sustain you and establish you before Him," so too the meaning of "today" is "like this day which is enduring etc."
וויבאַלד אַז „אתם נצבים“ מיינט „הרי אתם קיימין לפניו כו‘ והקללות והיסורין מקיימין אתכם ומציבין אתכם לפניו“ איז אויך דער טייטש פון „היום“ - „כיום הזה שהוא קיים כו‘“.
And since the words of appeasement must be adjacent to the rebuke,
און וויבאַלד אַז די דברי פיוס מוזן זיין בסמיכות צו דער תוכחה,
Rashi adds,
איז רש“י מוסיף,
that the verses more adjacent to this,
אַז די פסוקים היותר סמוכים צו דעם,
the "section above this is appeasement: 'You have seen etc.'"
די „פרשה שלמעלה מזו פיוסין הם אתם ראיתם וגו‘“.

But also this interpretation is difficult,
אָבער אויך דער פירוש איז שווער,
because: a)

According to this, it should have stood earlier "You are standing" and afterwards the section "You have seen etc.",
לפי“ז האָט געדאַרפט שטיין פריער „אתם נצבים“ און דערנאָך די פרשה „אתם ראיתם גו‘“,
which is the explanation of the main appeasement "He did not make you like etc. and behold you exist before Him etc. and the curses and sufferings sustain you and establish you etc."
וואָס איז דער אויסטייטש פון דעם עיקר הפיוס „לא עשה אתכם כליי‘ והרי אתם קיימין לפניו כו‘ והקללות והיסורין מקיימין אתכם ומציבין אתכם כו‘“.

If the section is words of appeasement of Moses - how do "your little ones" come there,
אויב די פרשה איז דברי פיוס פון משה‘ן - ווי קומען דאָרט „טפכם“,
who do not understand the admonition,
וואָס זיי פאַרשטייען ניט די תוכחה,
and consequently they do not need the words of appeasement.
ובמילא דאַרפן זיי ניט די דברי פיוס.
Therefore Rashi brings a third explanation "because the Israelites were going from leader to leader from Moses to Joshua therefore he made them a monument in order to spur them etc.",
דעריבער ברענגט רש“י אַ דריטן פירוש „לפי שהיו ישראל יוצאין מפרנס לפרנס ממשה ליהושע לפיכך עשה אותם מצבה כדי לזרזם כו‘“,
according to which the wording "Nitzavim" is understandable
וואָס עפ“ז איז פאַרשטאַנדיק דער לשון „נצבים“
(not - "Omdim"),
(ניט - „עומדים“),
because the wording also indicates spurring.
וואָרום דער לשון ווייזט אויך אויף זירוז.
And according to this explanation,

the meaning of "Hayom" - "on the day of his death"
דער טייטש „היום“ - „ביום מותו“
(as according to the first explanation)

- obviously in plain sense,

since this is after all connected with the going from leader to leader.

it is understood why earlier Moses said "You have seen etc." and only afterwards "You are standing today",
מובן וואָס פריער האָט משה געזאָגט „אתם ראיתם גו‘“ און ערשט דערנאָך „אתם נצבים היום“,
because this needed to be as close as possible to his death when going from leader to leader.
וואָרום דאָס האָט געדאַרפט זיין וואָס מער סמוך למיתתו ווען יוצאין מפרנס לפרנס.

it is understood the bringing of the children,
מובן דער ברענגען די טף,
because they too go over from leader to leader.

The difficulty in this explanation however is: since this is connected with the departure from one leader to another leader,
די שוועריקייט אין דעם פירוש אָבער איז: וויבאַלד אַז דאָס איז פאַרבונדן מיט דער יציאה מפרנס לפרנס,
Moshe should have said this entirely at the end,
האָט דאָס משה געדאַרפט זאָגן גאָר צו לעצט,
after the portion of Vayelech,
נאָך פרשת וילך,
close to his actual death - why does it appear earlier?
סמוך למיתתו ממש - פאַרוואָס שטייט עס פריער?
since this was relevant after they would cross the Jordan,
וויבאַלד דאָס איז געווען נוגע לאחר שעברו את הירדן,
it is not necessary that it be close to his actual death
איז ניט מוכרח אַז עס זאָל זיין סמוך למיתתו ממש
(since this cannot in any case be close to its subject),
(היות דאָס קען סיי ווי סיי ניט זיין סמוך לענינו),
but according to the third explanation,
אָבער לויטן דריטן פירוש,
that this is connected with the departure from one leader to another leader,
אַז דאָס איז פאַרבונדן מיט דער יציאה מפרנס לפרנס,
it should have been close to the actual departure].
האָט עס געדאַרפט זיין סמוך להיציאה ממש].
And even though the second explanation is "Midrash Aggadah",
ואעפ“י אַז דער צווייטער פירוש איז „מדרש אגדה“,
it is closer to the plain meaning of the verse than the third explanation,
איז ער נעענטער צו פשוטו ש“מ ווי דער דריטער פירוש,
because according to the third explanation, "Atem
וואָרום לויטן דריטן פירוש איז „אתם
Nitzavim" is a matter in itself that has no connection to "And Moses called to all Israel" from the end of Parsha Ki Tavo<sup>28</sup>.
נצבים“ אַן ענין בפ“ע וואָס האָט ניט קיין שייכות צו „ויקרא משה אל כל ישראל“ פון ס“פ תבא .
However, according to the second explanation,
משא“כ לויטן צווייטן פירוש,
not only is "Atem Nitzavim" a continuation of Moses' words "You have seen etc." from the end of Parsha Ki Tavo,
איז ניט נאָר „אתם נצבים“ בהמשך צו די רייד פון משה „אתם ראיתם גו‘“ פון ס“פ תבא,
but this was also the purpose and ultimate goal of the gathering "to appease",
נאָר דאָס איז אויך געווען די מטרה און תכלית הכינוס „לפייסן“,
that the main appeasement is in "Atem Nitzavim" as above,
וואָס דער עיקר הפיוס איז אין „אתם נצבים“ כנ“ל,
and in this it is closer and similar to the first explanation that the purpose of "their gathering by Moses" is explained in our parsha "to bring them into the covenant".
און אין דעם איז דאָס נעענטער און בדומה צום ערשטן פירוש אַז די מטרה פון „כינסם משה“ איז מבואר בפרשתנו „להכניסם בברית“.

From the wine of Torah in this Rashi: Parshat Nitzavim is always read before Rosh Hashanah<sup>29</sup>,
פון יינה של תורה אין דעם פרש“י: פרשת נצבים לייענט מען אַלעמאָל קודם ר“ה ,
and this is hinted in the word "today" which refers to Rosh Hashanah<sup>30</sup>.
און דאָס איז מרומז אין דעם וואָרט „היום“ וואָס גייט אויף ר“ה .
And in this Rashi explains "it teaches that Moshe assembled them before the Holy One, blessed be He, on the day of his death to bring them into the covenant": although earlier at the end of Parshat Ki Tavo it already states what Moshe said to the Jews "You have seen etc. the great trials etc. and you shall keep the words of this covenant and do them" - fulfillment of the Torah and commandments,
און אין דעם איז רש“י מפרש „מלמד שכינסם משה לפני הקב“ה ביום מותו להכניסם בברית“: כאָטש אַז פריער אין סוף פ‘ תבוא שטייט שוין וואָס משה האָט געזאָגט די אידן „אתם ראיתם גו‘ המסות הגדולות גו‘ ושמרתם את דברי הברית הזאת ועשיתם אותם“ - קיום התורה ומצוות,
but the purpose of the assembly "on the day of his death" - a day of judgment - "to bring them into the covenant",
איז אָבער די מטרת הכינוס „ביום מותו“ - אַ יום הדין -„להכניסם בברית“,
that a covenant is higher than understanding and comprehension<sup>31</sup>,
וואָס אַ כריתת ברית איז העכער פון הבנה והשגה ,
on Rosh Hashanah the essential connection of Jews with the Most High is opened,
בר“ה טוט זיך אויף די התקשרות עצמית פון אידן מיטן אויבערשטן,
which the connection is "He assembled them before the Holy One, blessed be He",
וואָס די התקשרות איז „כינסם לפני הקב“ה“,
a unity
אַ יחוד
And the inclusion with the Supreme One Himself,
והתכללות מיטן אויבערשטן אַליין,
higher even than tzaddikim and the righteous<sup>32</sup>.

Nevertheless,

as an introduction to this was the speech that should bring to "And you shall keep the words of this covenant and do them",

because this essential connection that Israel and the Holy One, blessed be He, are entirely one,

which at first glance, regarding three things that are interconnected with each other, there exist only two connections.
וואָס לכאורה באַ דריי זאַכן המתקשרים זה בזה זיינען פאַראַן בלויז צוויי קשרים.
But — after Israel become connected with the Most High through the Torah,
נאָר - לאחרי ווי אידן ווערן פאַרבונדן מיטן אויבערשטן ע“י התורה,
Israel become connected with the Most High also by themselves,
ווערן אידן פאַרבונדן מיטן אויבערשטן אויך מצ“ע,
a connection that is higher than the connection through the Torah<sup>35</sup>,
אַ התקשרות וואָס איז העכער ווי די התקשרות ע“י התורה ,
and consequently it becomes three connections
ובמילא ווערט דאָס דריי קשרים
(Israel, Torah, Holy One blessed be He, Israel — like the example of the circle).

And consequently the introduction of "And you shall guard etc." must be,
ובמילא מוז זיין די הקדמה פון „ושמרתם גו‘“,
but the purpose and goal of the gathering on Rosh Hashanah is the essential connection of Israel with the Most High.
אָבער מטרת ותכלית הכינוס ביום ר“ה איז די התקשרות עצמית פון אידן מיט דעם אויבערשטן.
This is however not enough: the covenant,
דאָס איז אָבער ניט גענוג: דער ברית,
the essential connection must be revealed,
דער עצמיות‘דיקער פאַרבונד דאַרף קומען בגילוי,
and in spirituality and
און ברוחניות און
(also)
(אויך)
in physicality,
בגשמיות,
have material good influence from the Above in a revealed and evident good.
האָבן השפעת טוב גשמי פון דעם אויבערשטן בטוב הנראה והנגלה.
that there should be fulfillment of the Torah

and the commandments in actual deed,
והמצות במעשה בפועל,
the deed is the main thing; so do Jews ask and receive from the Above all the influences and they come down in physicality in a revealed and evident good - in actual deed],
המעשה הוא העיקר; אַזוי בעטן און באַקומען אידן פון דעם אויבערשטן די אַלע השפעות און זיי קומען אַראָפּ בגשמיות בטוב הנראה והנגלה - במעשה בפועל],
On this comes the second explanation,
אויף דעם קומט דער צווייטער פירוש,
that "Moshe began to appease them",
אַז „התחיל משה לפייסם“,
Moshe,

The intermediate who connects the upper with Jews,
דער ממוצע המחבר פון אויבערשטן מיט אידן,
acts<sup>36</sup>

that "they stand before Him" and in the manner of "Nitzavim" - "with an upright stance" physically<sup>37</sup>.

Even more: "And the curses and afflictions establish you and make you stand before Him" - the undesirable things of the past become transformed into blessings revealed in good that is seen and revealed.
