("<b>Hew for yourself </b>two tablets of stone like the first" learns the Gemara<sup>3</sup>,

that "the chips shall be yours."

In the Mishnah at the end of tractate Bava Kamma<sup>4</sup>
אין דער משנה בסיום מס’ ב”ק
are brought the laws of a worker who does a certain craft for the homeowner and there is waste from the thing in which he works – whether it is his or it belongs to the homeowner: says the Mishnah "The lint that the launderer removes, behold these are his, and that which the comber removes, behold these are of the homeowner":
ווערן געבראַכט די דינים פון אַן אַרבעטער וואָס טוט אַ געוויסע מלאכה פאַרן בעה”ב און ס’איז דאָ אָפּפאַל פון דער זאַך אין וועלכער ער אַרבעט – צי דאָס איז זיינע אָדער דאָס געהערט דעם בעה”ב: זאָגט די משנה „מוכין שהכובס מוציא הרי אלו שלו ושהסורק מוציא הרי אלו של בעה”ב”:
therefore it belongs to the launderer; but that which the one who “combs” removes through combing belongs to the homeowner,
דעריבער באַלאַנגט עס צום כובס; אָבער דאָס וואָס דער וואָס „קעמט” איז מוציא דורך קעמען באַלאַנגט עס צום בעה”ב,
because “it is a significant thing and he does not forgo it”<sup>5</sup>].

Further the mishnah brings other cases,
ווייטער ברענגט די משנה אַנדערע פאַלן,
when this is the launderer’s and when it is the homeowner’s: “What the carpenter removes with the adze
ווען דאָס איז שלו און ווען עס איז של בעה”ב: „מה שהחרש מוציא במעצד
(which are very thin splinters)
(וואָס דאָס זיינען זייער דינע שפּענדלעך)
behold these are his,
הרי אלו שלו,
and with an axe
ובכשיל
(which is with a "hammer and produces thick splinters"<sup>5</sup>)
(וואָס איז מיט אַ „קרדום ומפיל שפאין גסין” )
of the homeowner,

and the Mishnah concludes "and if he was working at the homeowner's, even sawdust<sup>6</sup>

("even the very fine [dust] that comes out from under the drill, which is very fine"<sup>5</sup>)

and the Gemara questions this and brings a baraitha: "The Sages taught: Stone hewers have no [violation of] theft in them" –

On this baraitha the Rebbe Maharash
אויף דער ברייתא שטעלט זיך דער רבי מהר”ש
(in a brief note<sup>7</sup>,

at a siyum on tractate Bava Kamma)

asks
און פרעגט
(on the law "Stone hewers have no [violation of] theft in them")

and his language: "And one must say, if so, what did the Holy One, blessed be He, say to Moses: 'Hew for yourself' since there is no theft in them, and the explanation is because they are ownerless and do not belong to the owners, and the craftsman is closer to this, and if so why must it say 'Hew for yourself'",
וז”ל: „וצ”ל א”כ מה א”ל הקב”ה למשה פסל לך מאחר שאין בהם משום גזל ופי’ מפני שהם הפקר ואינם שייכים להבעלים והאומן קרוב יותר לזה וא”כ למה צ”ל פסל לך”,
and he answers "But there<sup>8</sup>
און ער ענטפערט „אך שם
sapphires<sup>9</sup>

and here it says stones

An ordinary but there was a precious stone.
סתם אבל שם הי’ אבן טוב”.
And seemingly,
ולכאורה,
the explanation of the Rebbe Maharash – that by the “chippings” of the tablets one must come to the announcement
דער ביאור פון רבי’ן מהר”ש – אַז ביי די „פסולתן” פון די לוחות דאַרף מען אָנקומען צום אָנזאָג

of “Carve for yourself” because they were of “sapphire” – depends,

From where did He carve them? One says from under the Throne of Glory He carved them,
מהיכן פסלן אחד אומר מתחת כסא הכבוד פסלן,
and one says from within his tent,
ואחד אומר מתוך אהלו,
he created for himself a quarry and from there he quarried two stone tablets and took the waste and from there he became wealthy because they were of sapphire” – according to the first opinion the tablets were from above,
ברא לו מחצב ומשם חצב שני לוחות אבנים ונטל את הפסולת ומשם העשיר שהיו של סנפירינון” – לויט דער ערשטער דיעה זיינען די לוחות געווען מלמעלה,
and according to the second opinion the quarrying was below<sup>12</sup>
און לויט דער צווייטער דיעה איז די חציבה געווען למטה
that the command was “Carve for yourself two stone tablets like the first” and afterwards – “<b>And ascend </b>to Me on the mountain” and so is also the order in the verse at the fulfillment of the command<sup>13</sup>
אַז דער ציווי איז געווען „פסל לך שני לוחות אבנים כראשונים” און נאָכדעם – „ ועלה אלי ההרה” און אַזוי איז אויך דער סדר אין פסוק ביים קיום הציווי
“And I made an ark of acacia wood and I carved two stone tablets like the first
„ואעש ארון עצי שיטים ואפסול שני לוחות אבנים כראשונים
And I went up on the mountain and two tablets in my hand
ואעל ההרה ושני לוחות בידי”
(And the same is in Parshat Tisa)

And according to the opinion that the hewing
און לויט דער דיעה אַז די חציבה
(and their smoothing)

of the tablets Moses did above,

one need not come to the explanation that because it was sapphire therefore the Almighty had to say "Carve for yourself"
דאַרף מען דאָך ניט אָנקומען צום תירוץ אַז ווייל דאָס איז געווען סנפירין דעריבער האָט דער אויבערשטער געדאַרפט זאָגן „פסל לך”
– for the law is indeed

that "if he was working at the homeowner's" it belongs in any case to the homeowner;

That even if there were "plain stones",

since Moshe did this above "by the Owner" – the Holy One, blessed be He,

one must have the permission of "Hew for yourself" that "your hewn stone"

In the aforementioned list he continues,
אין דער רשימה הנ”ל איז ער ממשיך,
that the Rashbatz asked "regarding above, it does not occupy space even a precious stone" and the Rebbe Maharash answered "behold he made them <b>below</b>,
אַז רשב”ץ האָט געפרעגט „לגבי למעלה אינו תופס מקום אפילו אבן טוב” און דער רבי מהר”ש האָט געענטפערט „הרי עשאן למטה ,
for those above there was no waste"<sup>17</sup>,
דבאותן של מעלה לא הי’ פסולת” ,
and consequently falls
ובמילא פאַלט
Also [it] answers the aforementioned question because he was not "working in the house of the master".
אויך אָפּ די שאלה הנ”ל ווייל ער איז ניט געווען „עושה אצל בעה”ב”.
It is, however, still difficult,
עס איז אָבער נאָך אַלץ שווער,
because also below – everywhere – it is indeed "in the house of the master"
וואָרום אויך למטה – אומעטום – איז עס דאָך „אצל בעה”ב”
(the Holy One, blessed be He),
(הקב”ה),
"the whole earth is full of His glory",
„מלא כל הארץ כבודו”,
and in the language of our Sages
ובלשון חז”ל

"wherever something is, it is in the treasury of the Merciful One<sup>18</sup>
„כל היכא דאיתי’ בבי גזא דרחמנא איתא
as it is written: 'The earth is the Lord's and its fullness'"*<sup>18</sup>

so even when "he made them below",
איז אפילו אַז „עשאן למטה”,
the carving of the tablets was "in the house of the master"<sup>19</sup>,

so is it indeed necessary [to have] the special permission of "Carve for yourself" also for ordinary stones – so what is the explanation of the Rebbe Maharash's answer?
איז דאָך נויטיק דער היתר מיוחד פון „פסל לך” אויך ביי סתם אבנים – טאָ וואָס איז דער פירוש פונעם רבי’ן מהר”ש’ס תירוץ?
And although that on the contrary,
און כאָטש אַז לאידך,
in the case of "BaHa"B" – HaKadosh Baruch Hu,
אין דעם פאַל פון „בעה”ב” – הקב”ה,
is not applicable the reason of "<b>kapeid </b>BaHa"B
איז ניט שייך דער טעם פון „ קפיד בעה”ב
(even for the finest vessels)
(אפילו אשפאים דקים)
because regarding HaKadosh Baruch Hu there is indeed no thing that occupies space and it is not applicable any kapeid

(no difference between precious stones and ordinary stones

– is however there a difference if "they made below"<sup>21</sup>,
– איז אָבער דאָ אַ חילוק אויב „עשאן למטה” ,
because <b>below </b>one considers oneself as the matters

are from the side of below,
זיינען מצד למטה,

Therefore is "every<sup>22</sup>
דערפאַר איז „כל
thing that is for the sake of the God the good shall be from the beautiful and the good etc. and so it says all fat to Hashem'"*<sup>22</sup>
דבר שהוא לשם הא־ל הטוב שיהי’ מן הנאה והטוב כו’ וכן הוא אומר כל חלב לה’”*
must indeed seemingly turn out that even with ordinary stones,
דאַרף דאָך לכאורה אויסקומען אַז אפילו ביי אבנים סתם,
since that it is "by BaHa"B" – HaKadosh Baruch Hu,
וויבאַלד אַז עס איז „אצל בעה”ב” – הקב”ה,
is behold these are of BaHa"B – when it is in the domain of BaHa"B kapeid BaHa"B on everything<sup>23</sup>
איז הרי אלו של בעה”ב – ווען עס איז ברשות בעה”ב קפיד בעה”ב על הכל
(And furthermore – since everything that the Holy One, blessed be He, created in His world, He did not create a single thing in vain<sup>24</sup>,
(ואדרבא – וויבאַלד אַז כל מה שברא הקב”ה בעולמו לא ברא דבר אחד לבטלה ,
then seemingly the question is the opposite: the Almighty is particular about everything).

Seemingly, one could say that regarding stone hewers, the law of the Mishnah "And if he was working in the homeowner's [premises], even the sawdust belongs to the homeowner" does not apply,
לכאורה וואָלט מען געקענט זאָגן אַז ביי מסתתי אבנים איז ניטאָ דער דין פון דער משנה „ואם הי’ עושה אצל בעה”ב אף הנסורת של בעה”ב”,
and the proof: the baraita "Stone hewers have no [violation of] theft" is brought in the Gemara not on that part of the Mishnah where it discusses the details of the laws whether it is "his" or "the homeowner's",
והראי’: די ברייתא „מסתתי אבנים אין בהם משום גזל” ווערט געבראַכט אין דער גמרא ניט אויף דעם טייל פון דער משנה וואו עס רעדט זיך וועגן די פרטי דינים צי עס איז „שלו” אָדער „של בעה”ב”,
but on the conclusion of the Mishnah "And if he was working in the homeowner's [premises], etc."<sup>25</sup>
נאָר אויף דעם סיום המשנה „ואם הי’ עושה אצל בעה”ב כו’”
From this it is understood,
פון דעם איז משמע,
that that which "stones that are scattered have no issue of theft" is
אַז דאָס וואָס „מסתתי אבנים אין בהם משום גזל” איז
not only when the worker works at his own [place],
ניט בלויז ווען דער פועל אַרבעט ביי זיך,
but also "if he was working at the homeowner's [place]"
נאָר אויך „אם הי’ עושה אצל בעה”ב”
(like the other cases in the baraisa "those who trim trees, those who trim vines, etc." where the work is indeed simply in the vineyard
(ווי די אַנדערע פאַלן אין דער ברייתא „מפסגי אילנות מפסגי גפנים כו’” וואָס די אַרבעט איז דאָך בפשטות אין דעם כרם

And based on this it is simply understood what the Rebbe Maharash says,

that that which it was necessary to come to "Pesal Lecha" is because the tablets were of sapphire,
אַז דאָס וואָס מ’האָט געדאַרפט אָנקומען צו „פסל לך” איז ווייל די לוחות זיינען געווען סנפירין,
for by ordinary stones there is no difference whether it is in the domain of the worker or in the domain of the homeowner,
וואָרום ביי אבנים סתם איז קיין נפק”מ ניט צי ס’איז ברשות פון פועל אָדער אין רשות פון בעה”ב,
always "there is in them [no issue] of theft."
אַלעמאָל „אין בהם משום גזל”.
This is however forced,
דאָס איז אָבער אַ דוחק,
because the <b>reasoning </b>to distinguish between the work that the worker does at the homeowner's or not,
ווייל די סברא צו מחלק זיין צווישן די אַרבעט וואָס דער פועל טוט אצל בעה”ב אָדער ניט,
also applies to hewn stones – so why should it be different by hewn stones
איז אויך באַ מסתתי אבנים – איז פאַרוואָס זאָל באַ מסתתי אבנים זיין אַנדערש
(and especially since no posek fails to say that by hewn stones the law that "if he was working at the homeowner's, even the sawdust belongs to the homeowner"<sup>26</sup> does not exist).

that also that which "stones that are smoothed have no [prohibition of] theft" is specifically when this is not "by the homeowner",

because if it also concerns with the permission of the homeowner, it is not fitting to say "the craftsman is closer to this".
וואָרום אויב ס’רעדט זיך אויך ברשות בעה”ב פּאַסט דאָך ניט זאָגן „האומן קרוב יותר לזה”.

And it will be understood with an introduction to explain the distinction that is found between the laws as they

They stand in the aforementioned baraisa and as they stand in the Tosefta:
שטייען אין דער ברייתא הנ”ל און ווי זיי שטייען אין דער תוספתא:
In the baraisa they are divided,
אין דער ברייתא זיינען זיי איינגעטיילט,
as above,
כנ”ל,
into two cases and laws: "One who clears stones [from his field], there is no [violation of] robbery in them; one who prunes trees, one who prunes vines, one who cuts down hyssop, one who weeds seeds, and one who hoes vegetables—when the owner is particular about them, there is [a violation of] robbery in them; [when] the owner is not particular about them, these are his"; in the Tosefta they all stand together,
אין צוויי פאַלן און דינים: „מסתתי אבנים אין בהם משום גזל מפסגי אילנות מפסגי גפנים מנקפי היגי מנכשי זרעים ועודרי ירקות בזמן שבעה”ב מקפיד עליהם יש בהן משום גזל אין בעל הבית מקפיד עליהן הרי אלו שלו”; אין דער תוספתא שטייען זיי אַלע צוזאַמען,
in <b>one</b> case and law: "One who clears stones, one who prunes vines, one who cuts down the hyssop, one who weeds seeds—when the owner is particular about them, they are forbidden because of robbery; [when] the owner is not particular about them, they are permitted regarding robbery."
אין איין פאַל און דין: „מסתתי אבנים מפסקי גפנים מנקפי הגין מנכשי זרעים בזמן שבעל הבית מקפיד עליהן אסורים משום גזל אין בעל הבית מקפיד עליהן מותרין משום גזל”.
There is a dispute between them whether regarding "one who breaks stones" the objection of the homeowner helps – what is the reason for the dispute?
עס איז אַ פלוגתא צווישן זיי צי באַ מסתתי אבנים העלפט קפידת הבעה”ב – וואָס איז דער טעם הפלוגתא?
And to note that in the Tur*<sup>26</sup>
ולהעיר אַז אין טור*
(Although he also brings the law regarding "those who trim trees" and "those who hoe vegetables" which is stated only in the Baraisa and not in the Tosefta),
(כאָטש ער ברענגט אויך דעם דין באַ „מפסגי אילנות” און „עודרי ירקות” וואָס שטייט בלויז אין דער ברייתא און ניט אין תוספתא),
he says however
זאָגט ער אָבער
(according to the Tosefta)<sup>27</sup>

regarding "one who breaks stones" it depends on the objection of the homeowner.
באַ „מסתתי אבנים” איז תלוי אין קפידת בעה”ב.
And the explanation in this: according to the Baraisa there is a distinction between "one who breaks stones" and the other cases – "those who trim trees" etc. "those who weed seeds",
והביאור בזה: לויט דער ברייתא איז דאָ אַן אונטערשייד צווישן מסתתי אבנים און די אַנדערע פאַלן – מפסגי אילנות וכו’ מנכשי זרעים,
because the waste from "those who trim trees etc." has more importance than from "one who breaks stones"; and therefore this depends on the objection
ווייל דער אָפּפאַל פון „מפסגי אילנות כו’” האָט מער חשיבות ווי פון מסתתי אבנים; און דעריבער איז דאָס תלוי אין דער קפידת
Owner: "At a time when the owner is particular about them, they have the status of theft; if the owner is not particular about them, these are his."
בעה”ב: „בזמן שבעה”ב מקפיד עליהם יש בהן משום גזל אין בעה”ב מקפיד עליהן הרי אלו שלו”
that the custom

of the country there is not to be particular about this insignificant thing, then even when a private owner is particular – his opinion is nullified<sup>28</sup>,
המדינה דאָרט איז ניט צו מקפיד זיין אויף דעם דבר מועט איז אפילו ווען אַ בעה”ב פרטי איז מקפיד – בטלה דעתו ,
because the way of people in that place is that they are not particular] <sup>29</sup>.
ווייל דער דרך בני אדם אין דעם אָרט איז אַז לא קפדי] .
What in this case,
וואָס אין דעם פאַל,
when it depends on the owner's being particular,
ווען עס איז תלוי אין קפידת בעה”ב,
and the owner is not particular,
און דער בעה”ב איז ניט מקפיד,
there are two rationales<sup>30</sup>
זיינען דאָ צוויי סברות
why the thing is permitted – either because his not being particular is as if he had abandoned ownership,
פאַרוואָס די זאַך איז מותר – אָדער ווייל זיין ניט מקפיד זיין איז כאילו ווי ער וואָלט מפקיר געווען,
in which case it must be ownerless property for every person,
וואָס דעמאָלט דאַרף עס זיין הפקר לכל אדם,
not only for the worker or a private individual<sup>31</sup>
ניט נאָר צום פועל אָדער אַן איש פרטי
; or it is in the manner of a gift,
; אָדער ס’איז ע”ד ווי אַ מתנה,
since it is an insignificant thing,
וויבאַלד עס איז אַ דבר מועט,
the owner is gracious and gives to anyone who will take it,
איז דער בעל הבית חונן ונותן צו יעדערן וואָס וועט דאָס נעמען,
even without his knowledge<sup>32</sup>.
אפילו שלא מדעתו .
But “stones that crumble” that the language of the baraita is “they are not subject to [the prohibition of] theft,”
אָבער „מסתתי אבנים” וואָס דער לשון הברייתא איז „אין בהם משום גזל”,
is the importance of the stone fragments
איז די חשיבות פון די ברעקלעך אבנים
less than regarding “those who break off branches from trees,”
ווייניקער ווי באַ „מפסגי אילנות”,
by them one does not need to come to the permission of “the owner does not care about them,”
ביי זיי דאַרף מען ניט אָנקומען צום היתר פון „אין בעה”ב מקפיד עליהן”,
but from the aspect of the lowliness of importance they are ownerless from themselves,
נאָר מצד פחיתות החשיבות זיינען זיי הפקר מצד עצמם,

but because essentially there is no ownership over it from the aspect of the non-importance of the thing)<sup>33</sup>,

as is precise in the list: <b>And he explained: Because they are ownerless and do not belong to the owners</b>.

In a slightly different style: in the case of those who strip trees and the like,

Based on this, one can say,
עפ”ז יש לומר,
that this is the reason for the dispute between the Baraisa and the Tosefta which says that the crushing of stones depends on the objection of the homeowner.
אַז דאָס איז דער טעם הפלוגתא צווישן דער ברייתא און דער תוספתא וואָס זאָגט אַז מסתתי אבנים זיינען תלוי אין קפידת בעה”ב.
And with an introduction:

The general difference between Baraisa and Tosefta,
דער חילוק כללי צווישן ברייתא און תוספתא,
as is explained in the commentators on the rules of the Talmud<sup>34</sup>
ווי ס’איז מבואר במפרשי כללי הש”ס
is,

that "the Tosefta is that which was added to the Mishnah, therefore it is not written in the language of 'Tanya' nor in the language of 'Tanu Rabbanan' etc., for the Toseftas are what Rebbi Chiya arranged before Rebbi, and he would say to him: write thus and thus, and that is what we say: Rebbi did not teach it, from where did Rebbi Chiya have it?
אַז „תוספתא היא שנתוספה על המשנה לפיכך אינה כתובה לא בלשון תניא ולא בלשון תנו רבנן כו’ שהתוספתות הם שסדר רבי חייא בפני רבי והי’ אומר לו כתוב כך וכך והיינו דאמרינן רבי לא שנאה ר’ חייא מנין לו,
And Baraisos are Mishnayos that were said without Rebbi's knowledge, except from his exposition etc."
וברייתות הם משניות שנאמר שלא מדעת רבי חוץ ממדרשו כו’”.
"And thus Rebbi Chiya and Rebbi Elazar and other Sages compiled,
„וכך חברו רבי חייא ור”א וחכמים אחרים,
Baraisos, meaning the language of 'bara' (outside), that they were said outside of Rebbi's exposition"<sup>35</sup>.
ברייתות ר”ל לשון ברא חוץ שנאמרו חוץ למדרשו של רבי” .
Based on this it comes out,
עפ”ז קומט אויס,
that the Tosefta which R. Chiyya arranged before Rebbe was said in Eretz Yisrael
אַז די תוספתא וואָס סידר ר’ חייא בפני רבי איז געזאָגט געוואָרן אין ארץ ישראל
(where the yeshiva of Rebbe was),
(וואו ישיבת רבי איז געווען),
but the baraitot which are "outside the study hall of Rebbe" could be that these were studied in Babylonia
משא”כ די ברייתות וואָס איז „חוץ למדרשו של רבי” קען זיין אַז דאָס איז געלערנט געוואָרן בבבל
(and especially since R. Chiyya came from Babylonia<sup>36</sup>),
(ובפרט אַז ר’ חייא איז געקומען פון בבל ),
and in general it is logical that the baraitot have more connection to Babylonia,
ובכלל איז מסתבר אַז די ברייתות האָבן מער שייכות צו בבל,
for in the days of Rebbe "Israel were scattering
וואָרום בימי רבי איז „ישראל מתגלגלין
and going to the ends [of the earth] etc."<sup>37</sup>,
והולכין לקצוות כו’” ,
and Babylonia then became even more a place of Torah.
און בבל איז דעמאָלט געוואָרן נאָך מער מקום תורה.
And behold – on the verse
והנה – אויפן פסוק
"Come, let us make bricks, etc. and the brick served them as stone," Rashi says "because there are no stones in Babylon, for it is a valley."
„הבה נלבנה לבנים וגו’ ותהי להם הלבנה לאבן” זאָגט רש”י „שאין אבנים בבבל שהוא בקעה”.
Therefore, in Babylon,
דעריבער איז אין בבל,
where they did not use stones
וואו מ’האָט ניט גענוצט קיין אבנים
(they were not common),
(זיי זיינען ניט געווען מצוי),
the leftover pieces of stones
האָבן די איבערגעבליבענע שטיקלעך אבנים
(from the stones that were brought there <b>when</b> they were brought)
(פון די אבנים וואָס מ’האָט דאָרטן ווען עס איז געבראַכט)
had no importance,
ניט געהאַט קיין חשיבות,
and therefore the baraisa says that stones that are hidden have no prohibition of theft,
און דערפאַר זאָגט די ברייתא אַז מסתתי אבנים אין בהם משום גזל,
they are inherently ownerless
זיי זיינען הפקר בעצם
(in Babylon),
(אין בבל),
and one who is particular [about them] his opinion is nullified.
און המקפיד איז בטלה דעתו .
In the land of Israel, however,
אין ארץ ישראל אָבער,
where stones are a common thing,
וואו אבנים זיינען אַ דבר המצוי,
they use them for building and other uses,
מ’נוצט זיי אויף בנין און שאר תשמישים,
and on the contrary,
ואדרבה,
the land of Israel is praised that it is "a land whose stones are iron,"
נשתבחה ארץ ישראל אַז זי איז „ארץ אשר אבני’ ברזל” ,
the pieces of stones also have importance,
האָבן אויך די שטיקלעך אבנים אַ חשיבות,
like the prunings of vines, etc.,
בדוגמת מפסגי גפנים כו’,
and therefore their prohibition and permission
און דערפאַר איז איסורן והתירן
depends on the owner's being particular.
תלוי אין קפידת בעל הבית .

Based on this one will also understand the above list of the Rebbe Maharash:
עפ”ז וועט מען אויך פאַרשטיין די רשימה הנ”ל פון רבי’ן מהר”ש:
Since Jews were then travelers in the desert where it is not customary
וויבאַלד אידן זיינען דעמאָלט געווען הולכי מדבר וואו ס’איז ניט רגיל
(Although stones are mentioned regarding them — for example regarding the wood gatherer<sup>43</sup>)
(כאָטש ס’ווערן דערמאָנט באַ זיי אבנים – לדוגמא באַ מקושש עצים )
to use stones<sup>39</sup>
צו נוצן זיך מיט אבנים
(And especially building — they did not build any permanent buildings,
(ובפרט בנין – מ’האָט דאָך ניט געבויט קיינע בנינים קבועין,
since they were traveling and encamping and traveling etc.)
וויבאַלד זיי זיינען געווען ויסעו ויחנו ויסעו כו’)
applies to this the rule “Stones that one hews from the ground are not subject to the prohibition of theft”:
איז אויף דעם חל דער כלל „מסתתי אבנים אין בהם משום גזל”:
“And the explanation is because they are ownerless and do not belong to the owners,”
„ופי’ מפני שהם הפקר ואינם שייכים להבעלים”,
They are completely ownerless from the perspective of the object
זיי זיינען הפקר לגמרי מצד דער חפצא
(Not only from the perspective that the owner is particular — the person)

As above,
כנ”ל,
Now, because of what did one need to come to “Carve for yourself,”
היינט צוליב וואָס האָט מען געדאַרפט אָנקומען צו „פסל לך”,
“The rejected ones of yours shall be”?
„פסולתן שלך יהא”?
To this the answer is “There it is sapphires and here it says stones simply,”
אויף דעם איז דער ענטפער „שם סנפירין וכאן אמר אבנים סתם”,
And by sapphires the law of theft does not apply to them,
און ביי סנפירין איז ניט שייך דער דין אין בהן משום גזל,
As with hewn stones which have no importance.
ווי ביי מסתתי אבנים וועלכע האָבן ניט קיין חשיבות.
For the rejected ones of sapphires have importance,
וואָרום פסולתן של סנפירין האָבן אַ חשיבות,
As understood<sup>44</sup>,

And therefore it is understood why one must come to “Said the Holy One, blessed be He, to Moses: Carve for yourself.”

Another explanation that can be said regarding the permit of "a defect with you" by the tablets:
נאָך אַ ביאור וואָס מען קען זאָגן בנוגע צום היתר פון פסל לך באַ די לוחות:
That which it was necessary to arrive at the heter of "Pesel lecha" is not because their "pesultan" belongs to the homeowner
דאָס וואָס מ’האָט געדאַרפט אָנקומען צום היתר פון „פסל לך” איז ניט מצד דעם וואָס „פסולתן” באַלאַנגט צום בעה”ב
(to the One above),
(צום אויבערשטן),
but because the tablets had
נאָר וויבאַלד אַז די לוחות האָבן
(to be located in the Ark in the Mishkan,
(זיך געדאַרפט געפינען אין ארון אין משכן,
and like all matters of the Mishkan and Mikdash, also the tablets)
און ווי אַלע עניני המשכן ומקדש האָבן אויך די לוחות)
had to belong to the public<sup>45</sup>
געדאַרפט געהערן צום צבור
(It must be transmitted to the public well, well<sup>46</sup>,
(עס דאַרף זיין מוסר לצבור יפה יפה ,
the transmission after the making,
די מסירה נאָך דער עשי’,
or she had from the outset,
אָדער זי האָט מלכתחילה,
also before the making,
אויך פאַר דער עשי’,
had to belong to the public<sup>47</sup>)
געמוזט געהערן צום צבור )
The making must be on behalf of the public<sup>48</sup>
די עשי’ דאַרף זיין בשל ציבור
And as is also understood from the continuation of the Gemara<sup>49</sup>
און ווי ס’איז פאַרשטאַנדיק אויך פון המשך הגמרא
"The Torah was given only to Moshe etc., as it is said: 'Write for yourself, carve for yourself; just as their carvings are yours, so too their writings are yours,'"
„לא ניתנה תורה אלא למשה כו’ שנאמר כתב לך פסל לך מה פסולתן שלך אף כתבן שלך”,
which regarding "their writings" speaks about the "pilpul" of Torah
וואָס ביי כתבן רעדט זיך וועגן „פלפולא” של תורה
(as the Gemara explains)

this was given to Moshe and not to the public,
דאָס איז געגעבן געוואָרן צו משה’ן און ניט צום ציבור,
thus it is understood regarding "Carve for yourself" — "their carvings are yours."
עד”ז איז מובן בנוגע פסל לך „פסולתן שלך”.
And even though the carvings of the tablets,
און אע”פ אַז פסולתן של לוחות,
also were of sapphire,
אויך פון סנפירין,
since they belong to the entire Jewish people<sup>50</sup>,
וויבאַלד זיי באַלאַנגען צום כלל ישראל ,
and consequently there is no [minimum value of] a perutah for each individual<sup>51</sup>,
ובמילא איז ניטאָ קיין שוה פרוטה לכל אחד ,
and the "not
און דער „לאו
That "do not steal" does not apply except to the value of a perutah, because the Torah does not obligate except for something of monetary value, and less than the value of a perutah is not called "money"<sup>52</sup>
דלא תגזול אינו חל אלא בש”פ כי התורה לא תחייב אלא בדבר שבממון ופחות משו”פ אינו נקרא ממון”
– it is obvious that it is forbidden to steal public property in any case<sup>53</sup>,
– דפשיטא אַז עס איז אסור לגזול נכסי ציבור בכל אופן ,
and it is obvious that regarding this one cannot say "there is no element of theft"<sup>54</sup>,
ופשיטא אַז מען קען אויף דעם ניט זאָגן „אין בהם משום גזל” ,
because it is "forbidden<sup>55</sup>
וואָרום ס’איז „אסור
to steal or
לגזול או
to rob anything at all by Torah law"<sup>56</sup>.
לגנוב כל שהו מדין תורה” .

(That we find differences in the ownership of the second tablets – that the tablets in general belong to the community,
(וואָס מ’געפינט חילוקים אין דער בעלות אויף די לוחות שניות – אַז די לוחות בכלל זיינען שייך לצבור,
to all of Israel,
לכל ישראל,
and their waste was given to Moses "your waste shall be")
און פסולתן איז אָפּגעגעבן געוואָרן למשה „פסולתן שלך יהא”)
: In the giving of the Torah that was given in the second tablets there is the innovation,
: אין דער נתינת התורה וואָס עס איז געגעבן געוואָרן בלוחות שניות איז דאָ דער אויפטו,
as the Gemara continues
ווי די גמרא איז ממשיך

Just as your waste is yours, so too your writing is yours,
מה פסולתן שלך אף כתבן שלך,
that pilpula de'oraita was given to Moses.
אַז פלפולא דאורייתא ניתנה למשה.
And it can be said that this is the inner reasoning of the words "Behold they made them below, that in those of above there was no waste": Torah as it is from the aspect of above,
וי”ל אַז דאָס איז די הסברה פנימית פון די ווערטער „הרי עשאן למטה דבאותן של מעלה לא הי’ פסולת”: תורה ווי זי איז מצד למעלה,
which in general is like Torah as it is from the aspect of the first tablets,
וואָס בכללות איז דאָס ווי תורה איז מצד לוחות הראשונות,
is in the category of unity – there is no division,
איז בבחי’ אחדות – ס’איז ניטאָ קיין התחלקות,
and all the more so no concept of waste
ועאכו”כ ניט קיין ענין פון פסולת
(rather – entirely face).

As Torah comes down below,
ווי תורה קומט אַראָפּ למטה,
which in general is the subject of the second tablets
וואָס בכללות איז דאָס ענינם של לוחות שניות
(which were given after the repentance on the sin of the calf,
(וואָס זיינען געגעבן געוואָרן נאָך דער תשובה אויפן חטא העגל,
i.e.,

that the repentance of Israel effected, as it were, above that they should give <b>them</b> the tablets<sup>57</sup>),

The Torah that was given to Moses is indeed a lofty matter,
דאורייתא וואָס ניתנה למשה איז דאָך אַן ענין נעלה,
completely opposite from the waste of the tablets: through the second tablets the matter of toil in Torah was revealed,
היפך לגמרי פון פסולתן פון די לוחות: דורך די לוחות שניות האָט זיך אויפגעטאָן דער ענין היגיעה בתורה,
as explained at length in Chassidus<sup>59</sup>,
ווי מבואר בארוכה אין חסידות ,
that also in this there are two opposite matters: the matter of toil comes from the side of concealments and coverings and difficulties etc.,
וואָס אויך אין דעם זיינען דאָ צוויי ענינים הפכיים: דער ענין היגיעה קומט מצד די העלמות והסתרים וקושיות כו’,
which is waste relative to the essence of the intellect of the Torah; but on the other hand,
וואָס איז פסולת לגבי עצם שכל התורה; אָבער מאידך גיסא,
specifically through toil in Torah one arrives at the core and essence of the Torah,
איז דוקא ע”י היגיעה בתורה קומט מען צו צו עיקר ועצם התורה,
higher than Torah is in its own right,
העכער ווי תורה איז מצ”ע,
as it was given above from the side of the first tablets,
ווי זי איז ניתנה למעלה מצד די לוחות הראשונות,
as explained there at length<sup>61</sup>.
כמבואר שם בארוכה .
And this is the matter of pilpul of Torah that was given to Moses<sup>62</sup>,
און דאָס איז דער ענין פון פלפולא דאורייתא וואָס ניתנה למשה ,
the Gemara calls this "pilpul <b>in general</b>",
די גמרא רופט דאָס „פילפולא בעלמא ”,
on the other hand they say that this is "understanding and sharpness"<sup>63</sup>
לאידך זאָגט מען אַז דאָס איז „הבנה וחריפות”
in Torah,
אין תורה,
a most lofty and high level in the comprehension of Torah,
אַ מדריגה הכי נעלית וגבוה אין השגת התורה,
which "was given to Moses and he dealt generously with Israel"<sup>64</sup>.
וואָס „נתן לו למשה והוא נהג בו טובת עין לישראל” .
