To understand the opinion of the Rambam, one must first explain the continuation and conclusion of the Rambam's words in the aforementioned halacha:

Also one must understand several nuances in the language of the Rambam where he changes from the language of the Gemara:

In the reason for the prohibition of leaving Bavel for other lands one finds two opinions: The Rambam brings on this the verse "Bavlah yuvau",
אין דעם טעם פון איסור יציאה מבבל לשאר ארצות געפינט מען צוויי דעות: דער רמב"ם ברענגט אויף דעם דעם פסוק „בבלה יובאו",
and Rashi says "because there are yeshivos there that disseminate Torah constantly"<sup>24</sup>.

The practical difference between them is: According to the opinion of Rashi the prohibition of leaving applies only as long as there are yeshivos in Bavel,
די נפק"מ צווישן זיי איז: לויט דעת רש"י איז דער איסור יציאה חל נאָר כל זמן ס'זיינען דאָ ישיבות אין בבל,
but when the yeshivos there become nullified one may leave from there; in contrast according to the opinion of the Rambam,

that this is because of the verse "Bavlah yuvau",

it implies that the prohibition exists always.

One must however understand,

the verse speaks indeed about the time of the first exile,

that "Until Eretz Yisrael was chosen, all lands were fit <b>for divine speech,</b> once Eretz Yisrael was chosen, all lands were disqualified"<sup>34</sup>.

And in these two matters consists the connection of Jews with Eretz Yisrael: a)

From the aspect of the <b>choice</b> of the Holy One, blessed be He — and as our Rabbis, of blessed memory, said: "He chose the Land of Israel, etc., and He chose Israel as His portion, etc. The Holy One, blessed be He, said: Let Israel, who came to My portion, come and inherit the land that came to My portion."<sup>35</sup>

with which he emphasizes that the prohibition of leaving that he speaks <b>here </b>is not from the aspect of <b>the holiness </b>of Eretz Yisrael,

but from the aspect that the Almighty chose it as a land for Jews; and in the time of exile the same rationale applies to leaving Bavel just as to leaving EY.

On this the Rambam brings the verse "as it is said, 'To Babylon they shall be brought, and there they shall be'" — a proof that the Almighty chose Babylon as the place of exile for Jews.

since one finds that specifically Babylon the Most High chose as a place of exile in a manner of "there they shall be" of permanence,

in the manner of the choice of the Holy One, blessed be He, in the Land of Israel in a manner of permanence before the time of the redemption and the years in their proper order<sup>47</sup>.

According to this, there may be another practical difference between the opinions of Rashi

for he says "Whoever ascends from Babylon <b>to the Land of Israel</b> transgresses a positive commandment",

and in connection with ascending to the Land of Israel this is also

According to this, the continuation of the halachot in the Rambam is understandable: after the halachot<sup>51</sup>

and details of laws in the prohibition to dwell in the land of Egypt, and concluding that the prohibition "to dwell in it etc." is "because its deeds are <b>corrupt</b> more than all the lands etc." — he continues in halacha 9 with the opposite extreme: "It is forbidden to leave the Land of Israel to the Diaspora forever," which is <b>primarily</b> due to the <b>holiness</b> that exists in Eretz Yisrael relative to other lands.

And in this matter of the holiness of Eretz Yisrael, the Rambam continues in the subsequent halachot: "The great among the sages would kiss the borders of the Land of Israel etc.,
און אין דעם ענין פון קדושת א"י איז דער רמב"ם ממשיך אין די ווייטערדיקע הלכות „גדולי החכמים היו מנשקין על תחומי ארץ ישראל כו',
The sages said: Whoever dwells in the Land of Israel, his sins are forgiven etc."<sup>52</sup>
אמרו חכמים כל השוכן בארץ ישראל עונותיו מחולין וכו'" .
And afterwards, first in halacha 12 he states the law "A person should always dwell in the Land of Israel even in a city that is mostly idolaters and should not dwell outside the land ..
און נאָכדעם ערשט אין הלכה י"ב זאָגט ער דעם דין „לעולם ידור אדם בארץ ישראל אפילו בעיר שרובה עכו"ם ואל ידור בחוצה לארץ ..
for whoever goes out of the land is as if he worships idolatry, as it is said 'For they have driven me out today from attaching to the inheritance of the Lord, saying: Go serve other gods' and regarding punishment it says 'And to the land of Israel they shall not come'" -

There are both reasons: because of the unique holiness that is in the Land of Israel from the aspect of the indwelling of the Divine Presence,

As it is implied from the wording that "one who goes out of the land <b>is as if he worships idolatry</b>"<sup>53</sup>,

Because of that which the Most High <b>chose</b> the Land of Israel

there is in this a fixed term,

and when he earns he must return; in contrast, the one who goes out "to learn Torah",

which is without a fixed term,

then as long as he can still gain further in the study of Torah he may remain in Eretz Yisrael.

According to this, it is understood simply that several Amoraim ascended from Bavel to Eretz Yisrael,
עפי"ז איז מובן בפשטות וואָס כמה אמוראים האָבן עולה געווען מבבל לא"י,
because this was from <b>the </b>permission; and those who remained there permanently, this was because so it was required from <b>their </b>manner of Torah study<sup>60</sup>.
וואָרום דאָס איז געווען מצד דעם היתר; און די וואָס זיינען דאָרט געבליבן בקביעות איז דאָס געווען דערפאַר ווייל אַזוי האָט זיך געפאָדערט מצד זייער אופן פון לימוד התורה .
But by Rav and likewise by Shmuel,
אָבער ביי רב און עד"ז ביי שמואל,
although that also they ascended from Bavel to Eretz Yisrael,
כאָטש אַז אויך זיי האָבן עולה געווען מבבל לא"י,
in order to learn Torah,
כדי ללמוד תורה,
but when they received there in Torah study from Rebbe etc. in a complete manner,
בשעת אָבער זיי האָבן דאָרט מקבל געווען אין לימוד התורה פון רבי וכו' אין אַ שלימות'דיקן אופן,
they had to return to Bavel<sup>61</sup>.
האָבן זיי געמוזט זיך אומקערן לבבל .
And furthermore: specifically in Bavel they later acquired that which they had learned in Eretz Yisrael,
און נאָכמער: דוקא אין בבל איז זיי שפּעטער צוגעקומען אויף דעם וואָס זיי האָבן געלערנט אין א"י,
in depth study and dialectic of Torah
אין עיון ופלפול דתורה
(and dialectic of the students),

which in this was the advantage of Bavel over Eretz Yisrael<sup>62</sup>.

Just as there are two virtues in Eretz Yisrael — that which the Holy One, blessed be He, chose it from all the lands and the holiness that is in it — so too are there both virtues also by Jews: that which Jews are those whom the Most High chose,
כשם ווי ס'זיינען דאָ צוויי מעלות אין א"י - דאָס וואָס הקב"ה בחר בה מכל הארצות און די קדושה וואָס איז דאָ אין איר - אַזוי זיינען דאָ די ביידע מעלות אויך ביי אידן: דאָס וואָס אידן זיינען די וואָס דער אויבערשטער האָט זיי בוחר געווען,
and that which Jews have in themselves holiness<sup>63</sup>
און דאָס וואָס אידן האָבן אין זיך קדושה
by virtue of their connection with Torah and mitzvos.
מצד זייער פאַרבונד מיט תורה ומצות.
And the difference between them: that which the Most High chose the Jews from other nations,
און דער חילוק צווישן זיי: דאָס וואָס דער אויבערשטער האָט בוחר געווען די אידן פון אַנדערע אומות,
"And Your son You chose from every <b>nation and language</b>",
„ובנו בחרת מכל עם ולשון ",
is not connected with their virtue and holiness<sup>63</sup>

from the side of Torah and commandments,
מצד תורה ומצות,
because then it is not a matter of choice; true choice applies in a manner where there is a similarity between two things from which one chooses<sup>64</sup>

- and with the power of choice one selects one of them.

And therefore,

since that from the side of the virtue of holiness and Torah and commandments there is no similarity between Jews and all the nations,
וויבאַלד אַז מצד מעלת הקדושה און תורה ומצות איז ניט שייך קיין שום דמיון צווישן אידן און כל העמים,
the matter of choice does not apply here.

One must say,

that the choice is not because of the holiness of Israel,

but on the contrary,

from the side of the choice of the Most High, holiness etc. was drawn into them.

According to this it turns out: that the connection of Jews with the Most High from the side of the choice of the Holy One, blessed be He, is an essential one and touches the essence of Jews more than the connection from the side of their holiness and Torah and commandments,
לפי"ז קומט אויס: אַז די התקשרות פון אידן מיטן אויבערשטן מצד בחירת הקב"ה איז אַן עצמיות'דיקע און רירט אָן אין עצם פון אידן מער ווי די התקשרות מצד זייער קדושה און תומ"צ,

In clearer words: the connection of Jews with the Supreme One from the aspect of choice is like His essence and being connects with the essence and being of a Jew; the connection of Jews from the aspect of their holiness,
אין קלאָרערע ווערטער: די התקשרות פון אידן מיטן אויבערשטן מצד בחירה איז ווי עצמותו ומהותו פאַרבינדט זיך מיט עצמות ומהות פון אַ אידן; די התקשרות פון אידן מצד זייער קדושה,
which comes through Torah and commandments which are His wisdom and will, blessed be He -
וואָס זי קומט דורך תורה ומצות וועלכע זיינען חכמתו ורצונו ית' -
(for a commandment is indeed a term of joining and connection<sup>65</sup>,
(וואָס מצוה איז דאָך מל' צוותא וחיבור ,
he becomes thereby connected with the Supreme One; and so too through Torah,

that Israel are connected with the Torah and the Torah with the Holy One, blessed be He<sup>66</sup>)

are connected one with the other: Israel are connected with the Torah and the Torah with the Holy One, blessed be He" - for seemingly there are here only two bonds
מתקשראן דא בדא ישראל מתקשראין באורייתא ואורייתא בקוב"ה" - וואָס לכאורה זיינען דאָך דאָ נאָר צוויי קשרים
(between Israel and the Torah and between the Torah and the Holy One, blessed be He)?
(צווישן ישראל און אורייתא און צווישן אורייתא און קוב"ה)?
Rather, the explanation is that besides the connection through the Torah, there is a bond which binds them, the Jews, with the Supreme One without any intermediary,
נאָר די הסברה איז אַז אויסער די התקשרות ע"י התורה איז דאָ אַ קשר וואָס בינדט זיי די אידן מיט'ן אויבערשטן אָן שום ממוצע,
from the aspect of His choice, blessed be He<sup>68</sup>
מצד בחירתו ית'
and therefore it is three bonds
און דעריבער איז עס תלת קשרין
(in the likeness of a ring).
(בדוגמת טבעת).

Previously, the difference between the opinion of the Rambam and the opinion of Rashi was explained
מ'האָט פריער מבאר געווען דעם חילוק צווישן שיטת הרמב"ם און שיטת רש"י
(and the Meiri)
(והמאירי)
according to the Rambam, the prohibition to leave Babylonia for other lands is because of the Holy One's choice,
: לדעת הרמב"ם איז דער איסור לצאת מבבל לשאר ארצות מצד בחירת הקב"ה,
and according to Rashi — "because there are yeshivas there that spread Torah";
און לדעת רש"י -„לפי שיש שם ישיבות המרביצות תורה";
However, since there is a principle<sup>69</sup>
היות אָבער ס'איז דאָך אַ כלל
that "we do not increase dispute,"
אַז „אפושי מחלוקת לא מפשינן",
it can be said that also according to Rashi and the Meiri there is a matter of choice in Babylonia,
י"ל אַז אויך לדעת רש"י והמאירי איז דאָ ענין הבחירה אין בבל,
only the choice itself is connected with the holiness of the Torah that is in Babylonia,
נאָר די בחירה גופא איז פאַרבונדן מיט קדושת התורה וואָס איז דאָ אין בבל,
and consequently, when in Babylonia the spreading of Torah ceases,
ובמילא בשעת אין בבל ווערט אויס הרבצת התורה,
its choice is also nullified; but regarding the Land of Israel it is different,
ווערט אויך בטל איר בחירה; אָבער בנוגע לארץ ישראל איז אַנדערש,
and its choice is not because of the holiness that is in it
און איר בחירה איז ניט מצד דער קדושה וואָס אין איר
(on the contrary, the holiness comes because of and after the choice),
(אדרבא די קדושה קומט מצד ולאחרי הבחירה),
because since the Holy One's choice in the Land of Israel is an intrinsic choice
וואָרום וויבאַלד אַז בחירת הקב"ה אין א"י איז אַ בחירה עצמית
(- when He created the world),
(- כשברא העולם),
it is the heritage of God,
זי איז נחלת ה',
and He gave it to Jews with an eternal covenant as the <b>intrinsic</b> place of Jews
און ער האָט עס אָפּגעגעבן אידן מיט אַ ברית עולם אַלס דעם מקום העצמי פון אידן
(not like in Babylonia which is because of exile),
(ניט ווי ביי בבל וואָס איז צוליב גלות),
therefore there the choice is an eternal one,
דערפאַר איז דאָרט די בחירה אַ נצחיות'דיקע,
and the matter of holiness etc. that is in the Land of Israel also effects the revelation of this choice.
און דער ענין הקדושה וכו' שבא"י פּועל'ט אויך דעם גילוי פון אָט דער בחירה.
It will be understood from this how the matter is among Jews:
וועט מען עס פאַרשטיין פון דעם ווי דער ענין איז ביי אידן:
Even though there is an advantage in the connection of Jews from the aspect of choice,
אעפ"י אַז ס'איז דאָ אַ מעלה אין דער התקשרות פון אידן מצד הבחירה,
Israel and the Holy One, blessed be He,
ישראל וקוב"ה,
which is from the aspect of His Essence, as above,
וואָס דאָס איז מצד עצמותו ית' כנ"ל,
there is however also an advantage in the connection from the aspect of their holiness,
איז אָבער דאָ אויך אַ מעלה אין דער התקשרות מצד קדושתם,
from the aspect of Torah and commandments:
מצד התורה ומצות:
In the connection from the aspect of choice alone,
אין דעם פאַרבונד מצד בחירה אַליין,
since this is only from the aspect of the choice of <b>the Holy One, blessed be He</b> and not because of a certain virtue,
היות אַז דאָס איז נאָר מצד בחירתו של הקב"ה און ניט צוליב אַ געוויסער מעלה,
is even after the choice of the Holy One, blessed be He, this is not seen in the chosen one in a revealed manner.
איז אפילו לאחרי בחירת הקב"ה זעט זיך דאָס ניט אָן אין דעם נבחר באופן גלוי.
But not so the connection from the aspect of their holiness in Torah and mitzvos,
משא"כ דער קישור מצד קדושתם בתו"מ,
is indeed this a virtue in itself and revealed,
איז דאָך דאָס אַ מעלה בעצמה וגלוי',
this itself is G‑dliness and revealed<sup>70</sup>,
דאָס אַליין איז אלקות ובגלוי ,
And consequently, through the connection that is through the Torah and mitzvos, thereby is also revealed the deeper bond of Jews with the Above,
ובמילא דורך די התקשרות שע"י התורה ומצות ווערט דורכדעם אויך נתגלה דער טיפערער פאַרבונד פון אידן מיט'ן אויבערשטן,
the connection from the aspect of choice<sup>71</sup>.
די התקשרות מצד הבחירה .
Which according to this it is understood why one must arrive at that which Yisrael are connected to the Torah and the Torah to the Holy One, blessed be He,
וואָס לפי"ז איז מובן וואָס מ'דאַרף אָנקומען צו דעם וואָס ישראל מתקשראן באורייתא ואורייתא בקוב"ה,
although Jews are connected with G‑dliness itself from the aspect of His choice,
כאָטש אידן זיינען פאַרבונדן מיט אלקות אַליין מצד בחירתו ית',
but this is because the revelation in the unity of choice among Jews comes through the bond with the Torah<sup>72</sup>.
נאָר דאָס איז דערפאַר ווייל דער גילוי אין איחוד פון בחירה ביי אידן קומט דורכן קישור מיט אורייתא .

Based on this, it is understood also regarding Eretz Yisrael: Even though the choice of the Holy One, blessed be He, is an eternal matter,
עפ"ז איז מובן אויך בנוגע לא"י: אעפ"י אַז בחירת הקב"ה איז אַן ענין נצחי,
which becomes the essence of the chosen thing,
וואָס דאָס ווערט דער מהות פון דעם דבר הנבחר,
nevertheless,
פונדעסטוועגן,
since it comes from the aspect of the choice of the Holy One, blessed be He,
וויבאַלד דאָס קומט מצד בחירת הקב"ה,
the revelation thereof is connected with the actual holiness that exists in Eretz Yisrael.
איז דער גילוי דערפון פאַרבונדן מיט דער קדושה בפועל וואָס איז דאָ אין א"י.
And it can be said that this is the reason why when the Rambam speaks about the prohibition of leaving Eretz Yisrael and the like,
וי"ל אַז דאָס איז דער טעם וואָס בשעת דער רמב"ם רעדט וועגן דעם איסור יציאה מא"י וכיו"ב,
he does not distinguish explicitly between the two virtues — the choice of the Holy One, blessed be He, and its holiness
טיילט ער ניט פאַנאַנדער בפירוש צווישן די צוויי מעלות - בחירת הקב"ה און קדושתה
(he emphasizes this only when he speaks regarding the prohibition of leaving Bavel,
(ער איז דאָס מדגיש בלויז ווען ער רעדט לגבי איסור יציאה מבבל,
as above),
כנ"ל),
because also the virtue of choice is connected,
וואָרום אויך מעלת הבחירה איז פאַרבונדן,
regarding its revelation — with the holiness of Eretz Yisrael<sup>73</sup>
בנוגע צו איר גילוי - מיט קדושת א"י
And the ultimate perfection in this will be in the future,
און דער תכלית השלימות בזה וועט זיין לעת"ל,
which very soon "Yisrael, who are called nachalah, will come to the land that is called nachalah, and will build the Beis HaMikdash, which is called nachalah, in the merit of the Torah, which is called nachalah"<sup>74</sup>.
וואָס בקרוב ממש „יבואו ישראל שנקראו נחלה לארץ שנק' נחלה ויבנו ביהמ"ק שנקרא נחלה בזכות התורה שנקראת נחלה" .
