The Rambam wrote at the beginning of the Laws of Marriage: "Before the giving of the Torah, a man would meet a woman in the market; if he and she desired to marry her, he would bring her into his house and cohabit with her in private, and she would be his wife.
כתב הרמב"ם בריש הל' אישות: "קודם מתן תורה הי' אדם פוגע אשה בשוק אם רצה הוא והיא לישא אותה מכניסה לתוך ביתו ובועלה בינו לבין עצמו ותהי' לו לאשה.
Once the Torah was given, Israel was commanded that if a man wishes to marry a woman, he must first acquire her in front of witnesses, and only afterward she will be his wife, as it is said<sup>1</sup>

the practical halachic difference in this time is regarding a son of Noah,

she is his wife, and since he had relations with her for the sake of marriage, she becomes a married woman, and another non-Jew is liable for her as mentioned in chapter 9<sup>5</sup>

But at first glance, this is no reason to bring this matter at the beginning of the Laws of Marriage,

At first glance it could be explained this way based on what was stated elsewhere<sup>10</sup>,

For the concept of "a married woman"

is not that the woman is acquired to the husband as an object acquired to a person,

and only the Torah's command creates a reality of "betrothals" that makes the woman a married woman.

And it can be said that there is a practical difference also in this time regarding a Ben Noach,
ויש לומר שנפק"מ גם בזמן הזה בב"נ,
that a Ben Noach who acquires a wife through one of the methods of acquisition for the sake of betrothal etc. — nothing is effected by this act and she is still single exactly as before the act of acquisition<sup>12</sup>.

And as the words of the Rambam in Laws of Kings<sup>13</sup>

that "a Ben Noach is not liable for the wife of his fellow until etc. after she has been had by her husband,

that there the Rambam did not precede the definition of divorce from before the giving of the Torah,

even though the above distinctions between a Jew and a Ben Noach in the law of kiddushin and divorce are interdependent.

For since the matter of marriage regarding a Ben Noach is created by bringing her into his house etc.
דכיון שענין האישות גבי ב"נ נוצר ע"י ההכנסה לביתו כו'

so too should he have preceded the law of divorce from before the giving of the Torah,

In the definition of marriage for Israel there are two stages — betrothal which is the acquisition and taking

that according to the known great precision in the order of the topics in the book of the Rambam,

that there is a topical connection between the fourteen books of the Rambam,

And in our matter — the Book of Seasons and the Book of Women — the connection between them is revealed and explicit: the last halacha of the Book of Seasons is "If one had before him his house lamp and Chanukah lamp etc., his house lamp takes precedence because of peace in his house,
ובעניננו — ספר זמנים וספר נשים — הקשר ביניהם גלוי ומפורש: ההלכה האחרונה דספר זמנים היא "הי' לפניו נר ביתו ונר חנוכה כו' נר ביתו קודם משום שלום ביתו,
for the Name is erased to make peace between a man and his wife,
שהרי השם נמחק לעשות שלום בין איש לאשתו,
great is peace that the entire Torah was given to make peace in the world, as it is said<sup>25</sup>
גדול השלום שכל התורה ניתנה לעשות שלום בעולם שנאמר<sup>25</sup>
Her ways are ways of pleasantness and all her paths are peace."
דרכי' דרכי נועם וכל נתיבותי' שלום".
And this is the content of the entire Book of Women,
והרי זהו תוכן כל ספר נשים,
the matter of "the peace between a man and his wife."
ענין ה"שלום שבין איש לאשתו".
And one may add further,

that at the beginning of the book of Women it is emphasized not only the matter of "peace between a man and his wife",
שבהתחלת ספר נשים מודגש לא רק הענין ד"שלום בין איש לאשתו",
but also the detail that the matter of peace is effected by means of
אלא גם הפרט שענין השלום נפעל ע"י

as the very conclusion of the book of Seasons "that the entire Torah was given to make peace in the world".

For,

in the first laws of the book of Women the Rambam emphasizes
בהלכות הראשונות דספר נשים מדגיש הרמב"ם
(as above)
(כנ"ל)
the innovation that was innovated by the giving of the Torah<sup>26</sup>
החידוש שנתחדש ע"י מתן תורה<sup>26</sup>
regarding the matter of marital relations,
בענין האישות,
"Before the giving of the Torah, a person would meet a woman in the market etc. Once the Torah was given, Israel were commanded that if a man wishes to marry a woman, he should acquire her first etc. and afterwards she shall be his wife."
"קודם מ"ת הי' אדם פוגע אשה בשוק כו' כיון שנתנה תורה נצטוו ישראל שאם ירצה האיש לישא אשה יקנה אותה תחלה כו' ואח"כ תהי' לו לאשה".
And it is understood simply,
ומובן בפשטות,
that this order, that an acquisition is required before she is his wife,
שסדר זה שצריך קנין קודם שתהי' לו לאשה,
indicates the strength of the bond and permanence between them.
מורה על חוזק הקשר והקביעות שביניהם.
For before the giving of the Torah, immediately and at once when he and she wanted, "he would bring her into his house etc.",
דקודם מ"ת הרי תיכף ומיד כשרצה הוא והיא "מכניסה לתוך ביתה כו'",
and it is understood that there is no strong bond here,
ומובן שאין כאן קשר חזק,
and just as he brought her in, so could he send her away from his house immediately and at once when he wished<sup>27</sup>,
וכמו שהכניסה כך יכול לשלחה מביתו תיכף ומיד כשירצה<sup>27</sup>,
like the expression "a son of a night he was and a son of a night he perished"<sup>28</sup>
ע"ד "בן לילה הי' ובן לילה אבד"<sup>28</sup>
; but after the giving of the Torah,
; משא"כ לאחרי מ"ת,
since he does not bring her into his house immediately and at once when he meets her,
כיון שאינו מכניסה לביתו תיכף ומיד שפוגע בה,
but only after the preamble that "he should acquire her first etc.",
אלא רק לאחרי ההקדמה ש"יקנה אותה תחלה כו'",
it is understood,
מובן,
that this has a greater endurance and validity.
שיש לזה קיום ותוקף גדול יותר.
To the extent that he cannot send her away immediately and at once when he wishes,
ועד שאינו יכול לשלחה תיכף ומיד כשירצה,
but rather "if he wishes to divorce, a get is required"<sup>29</sup>.
אלא "אם רצה לגרש צריכה גט"<sup>29</sup>.
[And based on this, the reason is also understood that afterwards<sup>30</sup>
[ועפ"ז מובן גם הטעם שאח"כ<sup>30</sup>
the Rambam continues with another law that was innovated at the giving of the Torah — "Before the giving of the Torah, a person would meet a woman in the market etc. and this is the one called a prostitute,
ממשיך הרמב"ם בעוד דין שנתחדש במתן תורה — "קודם מ"ת הי' אדם פוגע אשה בשוק כו' וזו היא הנקראת קדשה,
once the Torah was given, the prostitute was forbidden etc.",
משנתנה תורה נאסרה הקדשה כו'",
that also the content of this law is to increase peace,
שגם תוכן דין זה הוא להוסיף שלום,
as the Rambam explained in the Guide for the Perplexed<sup>31</sup>
כמו שביאר הרמב"ם במו"נ<sup>31</sup>
regarding the reason for the prohibition of prostitution,
בטעם איסור קדשה,
that "the benefits..
שה"תועלות..
prevention of quarrels..
מניעת הקטטות..
if prostitution were permitted..
אלו היתה הקדשה מותרת..
they would not escape from strife and most of the time they would kill each other or they would kill her etc."].
לא היו נמלטים מהמחלוקת וברוב הפעמים היו הורגים זה את זה או היו הורגים אותה כו'"].

And it can be said,
ויש לומר,
that also what was said above regarding the intention of the Rambam at the beginning of Hilchos Ishut,
שגם משנת"ל בכוונת הרמב"ם בריש הל' אישות,
that the innovation of the Torah is primarily in the matter of kiddushin,
שחידוש התורה הוא בעיקר בענין הקידושין,
whereas the matter of marriage is like the matter of marital relations before the giving of the Torah,
ואילו ענין הנישואין הוא כמו ענין האישות דקודם מ"ת,
has a connection to the words of the Rambam at the end of Sefer Zemanim.
יש לו קשר לדברי הרמב"ם בסוף ספר זמנים.
And this will be understood by prefacing the precise wording of the Rambam "the Torah was given to make peace in the world",
ויובן זה בהקדים דיוק לשון הרמב"ם "התורה ניתנה לעשות שלום בעולם",
and behold the Torah was given to Israel specifically,
והרי התורה ניתנה לישראל דוקא,
"an inheritance of the congregation of Jacob"<sup>32</sup>,
"מורשה קהלת יעקב"<sup>32</sup>,
and if so it should have said "to make peace in Israel"
וא"כ הול"ל "לעשות שלום בישראל"
(and the like),
(וכיו"ב),
and what is its saying "to make peace in the world"?
ומהו אומרו "לעשות שלום בעולם"?

At first glance it would be possible to explain this based on the words of the Rambam<sup>33</sup>,
לכאורה הי' אפשר לבאר זה ע"פ דברי הרמב"ם<sup>33</sup>,
that "Moses our teacher commanded from the mouth of the Almighty to compel all inhabitants of the world to accept the commandments that were commanded to the children of Noah",
ד"צוה משה רבינו מפי הגבורה לכוף את כל באי העולם לקבל מצות שנצטוו בני נח",
and likewise,
וכן,
that a son of Noah who accepted upon himself the seven commandments and is careful to perform them is not among the pious of the nations of the world unless he performs them "because the Holy One, blessed be He, commanded them in the Torah"<sup>34</sup>,
שב"נ שקיבל על עצמו שבע מצות ונזהר לעשותן אינו מחסידי אומות העולם אלא א"כ עושה אותן "מפני שצוה בהן הקב"ה בתורה"<sup>34</sup>,
and if so the action of the Torah is also regarding a son of Noah,
וא"כ פעולת התורה היא גם בב"נ,
that through the observance of the seven commandments of the sons of Noah peace is made among them.
שע"י קיום ז' מצות ב"נ נעשה שלום בהם.
[And based on this, we can also explain the double language in the verse "Her ways are ways of pleasantness and all her paths are peace": the difference between "way" and "path" is,
[ועפ"ז יש לבאר גם כפל הלשון בכתוב "דרכי' דרכי נועם וכל נתיבותי' שלום": החילוק בין "דרך" ו"נתיב" הוא,
that a way is a wide and large road,
דדרך היא דרך רחבה וגדולה,
whereas a path is a narrow and small trail<sup>35</sup>.
ואילו נתיב הוא שביל צר וקטן<sup>35</sup>.
And in our matter — "way" refers to the 613 commandments of the Torah which were given specifically to Israel,
ובענייננו — "דרך" קאי על תרי"ג מצוות התורה שניתנו לישראל דוקא,
that this is the large and primary part of the Torah,
שזהו החלק הגדול והעיקרי שבתורה,
whereas "her paths" refers to the seven commandments of the Noahides,
ואילו "נתיבותי'" קאי על ז' מצות ב"נ,
which are only the smallest part etc.
שהם רק חלק הכי קטן כו'.
And this is the reason that regarding "her ways" it specifies "pleasantness" specifically,
וזהו הטעם שגבי "דרכי'" נקט "נועם" דוקא,
and regarding "her paths" it says "peace": the effect of the Torah upon the Noahides is the essential quality of peace,
וגבי "נתיבותי'" אומר "שלום": פעולת התורה בב"נ היא עצם גדר השלום,
but not so regarding the Children of Israel,
משא"כ בבנ"י,
that "every Jewish person etc. like one person friends"<sup>36</sup>,
ד"כל איש ישראל גו' כאיש אחד חברים"<sup>36</sup>,
"all Israel are brothers"<sup>37</sup>,
"כל ישראל אחים"<sup>37</sup>,
there is the matter of peace from the very nature of their soul,
ישנו ענין השלום מצד עצם תכונת נפשם,
and the effect of the Torah is to add in peace itself,
ופעולת התורה היא להוסיף בשלום גופא,
that there should also be the matter of "pleasantness"<sup>38</sup>].
שיהי' גם ענין ה"נועם"<sup>38</sup>].
But this is not a sufficient explanation,
אבל אין זה ביאור מספיק,
because from the wording of the Rambam "the entire Torah was given to make peace in the world",
כי מלשון הרמב"ם "כל התורה ניתנה לעשות שלום בעולם",
it is proven,
מוכח,
that what is said "peace in the world" does not intend the effect of the seven Noachide commandments for the children of Noah,
דמ"ש "שלום בעולם" אין כוונתו לפעולת ז' מצות ב"נ בב"נ,
but rather the effect of the 613 commandments of Israel.
אלא לפעולת תרי"ג מצות דישראל.
And one can say the explanation in this: in the effect of the Torah and commandments there are two types: conduct in matters of holiness that belong solely to the children of Israel and from the outset are not matters of the "world"; and matters that in general have their counterpart also among the nations of the world,
ויש לומר הביאור בזה: בפעולת התומ"צ יש ב' סוגים: הנהגות בדברים שבקדושה ששייכים אך ורק בבנ"י ומעיקרא אינם עניני ה"עולם"; וענינים שבכללות יש דוגמתם גם אצל אוה"ע,
except that in them themselves a fundamental change was made through the giving of the Torah,
אלא שבהם גופא נעשה שינוי עיקרי ע"י נתינת התורה,
in a manner that the Torah makes "peace in the world",
באופן שהתורה עושה "שלום בעולם",
that in the matters and ways of the world the matter of peace is added<sup>39</sup>.
שבעניני ודרכי העולם נתוסף ענין השלום<sup>39</sup>.
And this is what the Rambam wrote,
וזהו שכ' הרמב"ם,
that the main intention of giving the Torah below,
שעיקר כוונת נתינת התורה למטה,
is not
אינה
(so much)
(כ"כ)
for the sake of the action of Torah and mitzvos, what it effects elevation among Bnei Yisrael and lifts them above the world,
בשביל פעולת התומ"צ מה שהיא פועלת התנשאות אצל בנ"י ומגבי' אותם למעלה מן העולם,
but rather, on the contrary,
אלא אדרבה,
that through it a renewal and addition of "peace" is effected in the matters of the world itself
מה שעל ידה נפעל חידוש ותוספת "שלום" בעניני העולם גופא
("peace in the world").
("שלום בעולם").
And this matter is emphasized in the matter of "peace between a man and his wife",
וענין זה הוא בהדגשה בענין "שלום בין איש לאשתו",
that this is what the Rambam brings at the beginning of Hilchos Ishus,
שזהו מה שממשיך הרמב"ם בריש הל' אישות,
regarding the definition of marriage before the giving of the Torah,
אודות גדר אישות קודם מ"ת,
that even then there was a definition of marriage,
דגם אז הי' גדר של אישות,
that there is a way to create the matter of marriage,
שיש דרך ליצור ענין האישות,
"and she shall be to him a wife",
"ותהי' לו לאשה",
that this itself is a matter of "peace",
שזה עצמו הוא ענין של "שלום",
but in this itself the Torah effects "peace in the world",
אבל בזה גופא פועלת התורה "שלום בעולם",
that there is added in the matter<pg>36</pg>
שנתוסף בענין<pg>36</pg>
The "peace",
ה"שלום",
in a manner that there is in it
באופן שיש בו
(in addition to "peace")
(נוסף על "שלום")
also the matter of "pleasantness",
גם ענין ה"נועם",
by that before the marriage one must acquire the woman first "and afterwards she will be to him for a wife".
ע"י שקודם הנישואין צריך לקנות את האשה תחילה "ואח"כ תהי' לו לאשה".

And it is to explain the above matter in the category of betrothal and marriage according to the inwardness of the matters:
ויש לבאר ענין הנ"ל בגדר קידושין ונישואין ע"פ פנימיות הענינים:
It is known that a man and a woman,
ידוע שאיש ואשה,
groom and bride,
חתן וכלה,
are a parable for the Holy One, blessed be He, and the Congregation of Israel,
הם משל על הקב"ה וכנסת ישראל,
that the connection of Israel to their Father in heaven is compared to betrothal and marriage.
שהקשר של ישראל לאביהם שבשמים נמשל לאירוסין ונישואין.
And the difference between them is: Betrothal which is "Kiddushin" — from the term "prohibited to all the world like consecrated property"<sup>40</sup>
והחילוק ביניהם הוא: אירוסין שהם "קידושין" — מלשון "אסר לה אכולי עלמא כהקדש"<sup>40</sup>
— indicates the drawing down of a supernal holiness upon the person,
— מורה על המשכת קדושה עליונה על האדם,
which is above and beyond the boundaries of the world,
שלמעלה מעלה מגדרי העולם,
therefore it is in separation from the world — holiness from the term separation<sup>41</sup>
שלכן היא בהבדלה מן העולם — קדושה מלשון הבדלה<sup>41</sup>
— which effects in the person abstinence and separation from the world
— הפועלת באדם פרישות והבדלה מן העולם
(prohibition,
(איסור,
negation)<sup>42</sup>
שלילה)<sup>42</sup>
; but the matter of marriage is,
; משא"כ ענין הנישואין הוא,
when this holiness is drawn into the person internally,
כאשר קדושה זו נמשכת בהאדם בפנימיות,
until the person,
עד שהאדם,
even as he is within the limitations of the body and the world,
גם כפי שהוא בהגבלות הגוף והעולם,
becomes a vessel for this holiness.
נעשה כלי לקדושה זו.
And this is that the matter of marriage in itself
וזהו שענין הנישואין כשלעצמו
(i.e., the union and the drawing down internally)
(היינו היחוד וההמשכה בפנימיות)
is not the main innovation of the Giving of the Torah,
אינו עיקר החידוש דמ"ת,
for the movement of drawing down the light of holiness internally exists also before the Giving of the Torah
כי התנועה דהמשכת אור הקדושה בפנימיות ישנה גם קודם מ"ת
(i.e., in the limited Divine light,
(היינו באור האלקי המוגבל,
which is according to the measure of the worlds)
שלפי ערך העולמות)
; and the main innovation of the Torah is in the matter of Kiddushin,
; ועיקר חידוש התורה הוא בענין הקידושין,
which is the drawing down of holiness that is above the boundaries of the world,
שהיא המשכת קדושה שלמעלה מגדרי העולם,
which is not within the power of a person from himself but only through the power of the Torah;
שזו אינה בכחו של אדם מצד עצמו אלא רק בכח התורה;
But after a person is given the power to draw down this holiness,
אלא שלאחרי שניתן לאדם הכח להמשיך קדושה זו,
the marriage that comes afterward,
הרי הנישואין הבאים אחר כך,
in which this supernal holiness is drawn down internally,
שבהם נמשכת קדושה עליונה זו בפנימיות,
they are automatically in a completely different manner,
הם בדרך ממילא באופן אחר לגמרי,
in a manner of permanence and strong connection
באופן של קביעות וקשר חזק
(as above),
(כנ"ל),
because the drawing down internally is from this holiness that is above the limits of the world<sup>43</sup>.
כיון שההמשכה בפנימיות היא מקדושה זו שלמעלה מגדרי העולם<sup>43</sup>.
And on the contrary: the ultimate intention is not in the matter of kiddushin
ואדרבה: תכלית הכוונה היא לא בענין הקידושין
(where the light remains in a state of separation and encompassing),
(שהאור נשאר בבחי' הבדלה ומקיף),
but specifically in the matter of marriage,
אלא דוקא בענין הנישואין,
as the language of the Rambam: "the entire Torah was given to make peace in the world",
וכלשון הרמב"ם "שכל התורה ניתנה לעשות שלום בעולם",
which is the drawing down of holiness specifically into the world,
שהיא המשכת הקדושה בעולם דוקא,
that this matter will be revealed in the future to come,
שענין זה יהי' בגילוי לעת"ל,
and as our Rabbis of blessed memory said<sup>44</sup>
וכמרז"ל<sup>44</sup>
that at the time of the Giving of the Torah there was only the matter of betrothal,
שבעת מ"ת הי' רק ענין האירוסין,
and the matter of marriage between the Holy One, blessed be He, and the Congregation of Israel will be in the true and complete redemption through our righteous Mashiach,
וענין הנישואין בין הקב"ה לכנסת ישראל יהיו בגאולה האמיתית והשלימה ע"י משיח צדקנו,
may he come and redeem us and lead us upright to our land,
יבוא ויגאלנו ויוליכנו קוממיות לארצנו,
speedily in our days, literally.
במהרה בימינו ממש.
