And the commentators wrote<sup>2</sup>,

that the reason that Rashi explained that "then he will separate" refers to the thought to separate,

"gave heart to be anxious about the matter that would separate them",

and not on the act of separation itself,

And one must understand,

and why does he strengthen and emphasize "gave heart to be anxious about the matter".

Also needs explanation: what is the precision "then Moshe set apart",

which implies that here a special event occurred because of which "he set his heart etc. to set them apart"

Below Rashi continues: "And although they do not absorb until those in the land of Canaan set them apart, Moshe said: a commandment that can be fulfilled I will fulfill it"<sup>6</sup>.

And one must be precise — why did Rashi bring this matter

There are those who explain<sup>7</sup>,
יש מפרשים<sup>7</sup>,
that the continuation of Rashi's words "And although they do not absorb etc." is the explanation<sup>8</sup>
שהמשך דברי רש"י "ואע"פ שאינן קולטות כו'" הוא הביאור<sup>8</sup>
and the answer to this that it says "Then he shall set apart" — future tense,
והתירוץ ע"ז שנאמר "אז יבדיל" — לשון עתיד,
for since they were not absorbing then,

therefore it is not appropriate to say "he set apart"
לפיכך לא שייך לומר הבדיל
(past tense).

But this explanation requires clarification<sup>9</sup>,

for although they are not absorbing,

The first time that the matter of the designation of the cities of refuge is explained in Scripture is in Parshat Massei,

behold, the preparation and designation of the cities of refuge

And behold, the novel point that is innovated in the plain meaning of the verses in the portion of Va’etchanan is,

that until then Moses was still hoping that perhaps he would be permitted to enter the land
שעד אז הי' משה עדיין מצפה שמא יורשה לו ליכנס לארץ
(and especially after the conquest of Sihon and Og,

that “I thought perhaps the vow was annulled”<sup>15</sup>),

The simple explanation of this anxiety,
הפירוש הפשוט של חרדה זו,
fear stemming from concern whether his actions in this are as required and proper.
יראה הנובעת מחשש אם מעשיו בזה הם כדרוש וכדבעי.
And this is that Moses "set his heart to be anxious about the matter to set them apart — and even though they do not absorb until those in the land of Canaan set them apart etc." — because it is a commandment dependent on the land,
וזהו שמשה "נתן לב להיות חרד לדבר שיבדילם — ואע"פ שאינן קולטות עד שיבדלו אותן שבארץ כנען כו'" — דכיון שהיא מצוה התלוי' בארץ,
that all the definition of the cities of refuge is after they cross the Jordan to the land of Canaan,
שכל גדר של ערי מקלט הוא לאחרי שיעברו את הירדן לארץ כנען,
he was concerned lest also the preparation and setting apart of the cities is only after their entry into the land of Israel,
חשש שמא גם הזמנת והבדלת הערים היא רק לאחרי כניסתם לארץ ישראל,
and there is no place for Moses to set them apart beforehand.
ואין מקום שמשה יבדילם קודם לכן.
And beyond this, it can be said,
ויתירה מזו יש לומר,
that this "trembling" is
ד"חרדה" זו היא<pg>16</pg>
if this is according to the will of G-d,
אם זה כפי רצון ה',
that just as it is the will of G-d that Moses should not enter the land,
דכשם שרצון ה' שמשה לא יכנס לארץ,
so too perhaps it is His will, blessed be He, that the commandments dependent on the land should not be performed by him,
כמו"כ אולי רצונו ית' שמצוות התלויות בארץ לא ייעשו על ידו,
and this is the reason for Moses' trembling — not only if there is some effect in his distinction,
וזהו טעם חרדתו של משה — לא רק אם יש איזו חלות בהבדלה שלו,
but if his distinction is according to the will of G-d.
אלא אם ההבדלה שלו היא כפי רצון ה'.
[Based on this, one can say,

that Rashi's intention here is only to explain the words — "then he separated" future tense on account of the thought that is before the action
שאין כוונת רש"י כאן רק לפרש התיבות — "אז יבדיל" לשון עתיד על שם המחשבה שהיא לפני העשי'
(as he explained in the verse "then he sang"),
(כמו שפי' בפסוק "אז ישיר"),
but also that all of Moses' action here is in a manner of "he separated",
אלא שגם כל מעשה משה כאן הוא באופן של "יבדיל",
that he was agitated in the making of the separation,
שחרד בעשיית ההבדלה,
and the reason for this is — "then",
והסיבה לכך היא — "אז",
since they are about to enter the land,
מאחר שעומדים ליכנס לארץ,
and he does not enter with them
והוא אינו נכנס עמהם
(and it is found that it is a thing that does not pertain to him),

And this is "he separated" future tense,

because it was a kind of separation regarding the act of separation itself].

And one can explain the matter according to the law,

and with the preface of the words of the Rambam in the Laws of Murderer and Preservation of Life<sup>18</sup>

The cities of refuge apply only in the Land of Israel

therefore it is impossible that the law of cities of refuge applies to those on the other side of the Jordan only after the three in the land of Canaan exist

And it can be said that the practical difference is regarding one who vows "from the cities of refuge that existed before they entered the land."
וי"ל דנפק"מ לענין הנודר "מערי מקלט שהיו קודם שנכנסו לארץ".

And behold, according to the above — that before the separation of those in the land of Canaan the name of city of refuge did not apply — one must examine what was the content of Moses' action in the separation of the cities of refuge on the other side of the Jordan.
והנה ע"פ הנ"ל — שקודם הבדלת אותן שבארץ כנען לא חל שם עיר מקלט — יש לעיין מה הי' תוכן דמעשה משה בהבדלת ערי מקלט שבעבר הירדן.
And this is to be explained in two ways:
ויש לבאר זה בשני אופנים:
a)
א)
The separation was merely a preparation
ההבדלה היתה הכנה בעלמא
(He chose the cities and their boundaries,
(שבחר את הערים ותחומיהן,
and perhaps also directed the roads<sup>28</sup>),
ואולי גם כיוון את הדרכים<sup>28</sup>),
That even though there was no fulfillment of a commandment nor the status of a city of refuge,
דאף שלא הי' בזה קיום מצוה ולא חלות שם עיר מקלט,
Nevertheless, it is like a preparation<sup>29</sup>
מ"מ ה"ז כמו הכנה<sup>29</sup>
and enabling<sup>30</sup>
והכשר<sup>30</sup>
for the fulfillment of the commandment of cities of refuge afterwards.
לקיום מצות ערי מקלט לאחרי זה.
b)
ב)
Even though before the separation of those in the land of Canaan the status of a city of refuge did not apply,
אף שקודם הבדלת אותן שבארץ כנען לא חל שם עיר מקלט,
Nevertheless, after Joshua separated the three in the land of Canaan, the status of a city of refuge applied to those on the other side of the Jordan automatically by virtue of Moses' separation<sup>31</sup>,
הרי לאחרי שיהושע הבדיל את הג' שבארץ כנען חל שם עיר מקלט על אותן שבעבר הירדן בדרך ממילא מצד הבדלת משה<sup>31</sup>,
And it turns out,
ונמצא,
That Moses' act caused them to be separated as cities of refuge<sup>32</sup>,
שמעשה משה פעל שיובדלו כערי מקלט<sup>32</sup>,
Except that the application of the matter did not occur until after the time of Joshua
אלא שחלות הדבר לא היתה עד אחרי זמן יהושע
[And perhaps one could say even more than this — that after Joshua separated the three in the land of Canaan,
[ואולי יש לומר יתירה מזו — שלאחרי שהבדיל יהושע ג' שבארץ כנען,
The status of a city of refuge applied to the three on the other side of the Jordan retroactively<sup>33</sup>,
חל שם עיר מקלט על הג' שבעבר הירדן למפרע<sup>33</sup>,
From the time of Moses' separation]<sup>34</sup>.
מזמן הבדלת משה]<sup>34</sup>.
And the practical difference between these two approaches<sup>35</sup>
והנפק"מ בפועל בין שני אופנים אלו<sup>35</sup>
: According to the first approach, Joshua would have needed to set apart<pg>19</pg>
: לאופן הא' הי' יהושע צריך להב<pg>19</pg>
again the cities on the other side of the Jordan after he had set apart those in the land of Canaan,
דיל עוד פעם את הערים שבעבר הירדן לאחרי שהבדיל אותן שבארץ כנען,
for only then did the name "city of refuge" apply to them,
שרק אז חל עליהם שם עיר מקלט,
and thus the commentators explain<sup>36</sup>
וכן פירשו מפרשים<sup>36</sup>
the words of the Sifri<sup>37</sup>
דברי הספרי<sup>37</sup>
"From where [do we know] that Moses commanded Joshua to set apart cities of refuge for them, etc.",
"מנין שצוה משה את יהושע להפריש להם ערי מקלט כו'",
namely "that Moses commanded Joshua that he himself should set apart all six cities, so that even those on the other side of the Jordan would not provide refuge until Joshua set apart all six cities"<sup>38</sup>
דהיינו "שצוה משה את יהושע שהוא הוא יפריש כל ששה ערים שגם אותם שבעבר הירדן לא היו קולטים עד שהפריש יהושע כל שש ערים"<sup>38</sup>
; however, according to the second approach,
; משא"כ לאופן השני,
there would have been no need for a further setting apart by Joshua,
לא הי' צ"ל עוד הבדלה ע"י יהושע,
but rather after Joshua's setting apart, the name "city of refuge" applied to them
אלא לאחרי הבדלת יהושע חל שם עיר מקלט עליהם
(retroactively?<sup>39</sup>)
(למפרע?<sup>39</sup>)
through Moses' setting apart.

And one could say,
ויש לומר,
that in this Rashi and the Rambam disagree,
שבזה פליגי רש"י והרמב"ם,
And with the introduction of the difference between the language of the Rambam and the language of Rashi: In the Rambam the wording is "He said, since a mitzvah has come to my hand I will fulfill it",
ובהקדם השינוי בין לשון הרמב"ם ולשון רש"י: ברמב"ם הלשון "אמר הואיל ובאה מצוה לידי אקיימנה",
and it is the language of the Gemara in Makkos; but Rashi changed from the language of the Talmud and wrote "A mitzvah that it is possible to fulfill I will fulfill it".
והוא לשון הגמרא במכות; אבל רש"י שינה מלשון הש"ס וכ' "מצוה שאפשר לקיימה אקיימנה".
And the distinction between the two aforementioned languages: The language "a mitzvah has come to my hand" emphasizes the possibility of fulfilling the mitzvah from the aspect of the person
והחילוק בין ב' לשונות הנ"ל: הלשון "באה מצוה לידי" מדגיש אפשריות קיום המצוה מצד הגברא
("has come..
("באה..
to my hand"),
לידי"),
whereas the language "a mitzvah that it is possible to fulfill" speaks about the possibility from the aspect of the object,
משא"כ הלשון "מצוה שאפשר לקיימה" מדבר על האפשריות מצד החפצא,
"a mitzvah that it is possible to fulfill"<sup>40</sup>.
"מצוה שאפשר לקיימה"<sup>40</sup>.
And this is the content of the distinction between the two aforementioned manners: According to the first manner that Moses' act was only a mere preparation,
וזהו תוכן החילוק בין שני אופנים הנ"ל: לאופן הא' שמעשה משה הי' רק הכנה בעלמא,
behold his act is called by the name "mitzvah" only from the aspect of the person,
הרי מעשהו נקרא בשם "מצוה" רק מצד הגברא,
that he was occupied with
שהוא הי' עסוק ב
(preparation for)
(הכנה ל)
a matter of mitzvah,
דבר מצוה,
but from the aspect of the object no status of mitzvah has yet been effected; whereas according to the second manner, behold the name "mitzvah" applies to Moses' act also from the aspect of the object,
אבל מצד החפצא לא נפעל עדיין גדר של מצוה; משא"כ לאופן הב' הרי חל שם "מצוה" על מעשה משה גם מצד החפצא,
since he designated these cities as cities of refuge
כיון שהוא הבדיל ערים אלו לערי מקלט
(except that it did not take effect in actuality until after Joshua designated those in the land of Canaan).
(אלא שלא חל בפועל עד לאחרי שיהושע הבדיל אותן שבארץ כנען).
And in this Rashi and the Rambam disagree — for Rashi holds that the action of Moshe caused that the name "city of refuge" should apply to them<sup>41</sup>
ובזה פליגי רש"י והרמב"ם — דרש"י ס"ל שמעשה משה פעל שיחול עליהן שם עיר מקלט<sup>41</sup>
(except that the actual application was later in the days of Yehoshua),
(אלא שהחלות בפועל היתה אח"כ בימי יהושע),
and therefore he writes "a commandment that is possible to fulfill I will fulfill it"; but not so the Rambam holds that it was only a preparation,
ולכן כ' "מצוה שאפשר לקיימה אקיימנה"; משא"כ הרמב"ם ס"ל שהי' רק הכשר בעלמא,
and therefore he uses the expression "since a commandment came to my hand I will fulfill it"<sup>42</sup>.
ולכן נקט לישנא "הואיל ובאה מצוה לידי אקיימנה"<sup>42</sup>.

"From the wine of Torah" that is in Rashi's commentary:
מ"יינה של תורה" שבפירוש רש"י:
This that the three cities on the other side of the Jordan did not absorb until those in the land of Canaan were set aside requires explanation,
זה ששלש הערים שבעבר הירדן לא קלטו עד שהובדלו אותן שבארץ כנען דורש ביאור,
at first glance,
לכאורה,
since the children of Gad and the children of Reuben and half the tribe of Manasseh had already settled on the other side of the Jordan
דכיון שבני גד ובני ראובן וחצי שבט מנשה כבר התיישבו בעבר הירדן
(as related at the end of parshas Matos<pg>20</pg>
(כמסופר בס"פ מטות<pg>20</pg>
and at the end of parshas Devarim),
וס"פ דברים),
what is the reason that the protection of the cities of refuge was not immediately given to them<sup>43</sup>?
מהו הטעם שלא ניתן להם מיד ההגנה דערי מקלט<sup>43</sup>?
And although "every warrior" crossed with the rest of the tribes to conquer the land of Canaan — behold
[ואע"פ ש"כל חלוץ מלחמה" עבר עם שאר השבטים לכבוש את ארץ כנען — הרי

Israel did not cross the Jordan until after several months,
לא עברו ישראל את הירדן עד לאחרי כמה חדשים,
and during this time the children of Gad and the children of Reuben and half the tribe of Manasseh sat in their cities which they inherited on the other side of the Jordan,
ובמשך זמן זה ישבו בני גד ובני ראובן וחצי שבט מנשה בעריהם שנחלו בעבר הירדן,
(b)
(ב)
and mainly: also afterwards there remained there the men who were under twenty and above sixty years old,
ועיקר: גם אח"כ נשארו שם האנשים שקודם כ' ושלמעלה מבן ס',
aside from the women and children].
מלבד הנשים והטף].
And perhaps one could say that the inner reason for the matter is — because they did not need cities of refuge,
ואולי י"ל שהטעם הפנימי בדבר הוא — לפי שלא היו צריכים לערי מקלט,
and as Moses our teacher said<sup>44</sup>
וכמו שאמר משה רבינו<sup>44</sup>
"And you who cling to the Lord your God are all alive today",
"ואתם הדבקים בה"א חיים כולכם היום",
that the children of Israel were attached to the Omnipresent<sup>45</sup>
שבנ"י היו דבוקים במקום<sup>45</sup>
to the extent that they were not at all connected to the matter of the opposite of life, may it not be said,
עד שלא היו שייכים כלל לענין של היפך החיים ר"ל
[and behold, even one who kills a soul unintentionally needs atonement<sup>46</sup>,
[והרי גם הורג נפש בשגגה צריך כפרה<sup>46</sup>,
from which it is understood that there is lacking in him in attachment to God].
שמזה מובן שחסר אצלו בדביקות עם ה"א].
And one could say,
ויש לומר,
that this elevated state of the Children of Israel was effected in them by Moshe Rabbeinu,
שמצב נעלה זה דבנ"י נפעל בהם ע"י משה רבינו,
who raised them to this lofty attachment to the Name in a manner that "you are all alive today",
שהוא העלה אותם לדביקות נעלית זו בה"א באופן ש"חיים כולכם היום",
but after the passing of Moshe<sup>47</sup>
משא"כ לאחרי הסתלקות משה<sup>47</sup>
they descended from their level etc. and consequently needed the cities of refuge.
ירדו ממדריגתם כו' ובמילא הוצרכו לערי מקלט.

And based on this, one can explain the difference between the two aforementioned modes regarding the nature of Moshe's action in the designation of the cities of refuge on the other side of the Jordan — whether it was only in the category of mere preparation,
ועפ"ז יש לבאר החילוק בין שני האופנים הנ"ל בגדר פעולת משה בהבדלת ערי מקלט בעבר הירדן — אם היתה רק בגדר הכנה בעלמא,
or that his designation effected the application of the status of city of refuge — according to the inner aspect of the matters:
או שהבדלתו פעלה חלות שם עיר מקלט — ע"פ פנימיות הענינים:
The concept of the cities of refuge is not only a negation — protection from the avenger of blood — but also a concept of a positive command — "And he shall flee to one of these cities and live"<sup>48</sup>,
ענינן של ערי מקלט אינו רק שלילה — הגנה מגואל הדם — אלא גם ענין של חיוב — "ונס אל אחת מן הערים האל וחי"<sup>48</sup>,
Do for him something that will be for him a life-force<sup>49</sup>.
עביד לי' מידי דתהוי לי' חיותא<sup>49</sup>.
And in the inner aspect of the matter: killing a person unintentionally indicates the domination of the evil inclination,
ובפנימיות הענין: הריגת נפש בשגגה מורה על שליטת היצר הרע,
which is Satan and he is the angel of death<sup>50</sup>,
דהוא השטן והוא המלאך המות<sup>50</sup>,
and in the language of the Tanya<sup>51</sup>
ובלשון התניא<sup>51</sup>
— that he receives life-force from "the place of death and impurity",
— שמקבל חיות מ"מקום המיתה והטומאה",
And in the city of refuge there is drawn for him life-force from the side of holiness — "And he shall flee..
ובעיר מקלט נמשך לו חיות מסטרא דקדושה — "ונס..
and live",
וחי",
with true life,
בחיים אמיתיים,
life of holiness that comes from the source of life,
חיים של קדושה הבאים ממקור החיים,
"The Lord God is truth, He is the living God"<sup>52</sup>.
"ה' אלקים אמת הוא אלקים חיים"<sup>52</sup>.
And therefore also the commandment of designating the cities of refuge had to be done specifically through the action of Moses,
ולכן גם מצות הבדלת ערי מקלט היתה צ"ל בזה פעולת משה,
for through him was drawn the concept of "You who cling to the Lord your God are alive, all of you, today" to the children of Israel,
כי על ידו נמשך הענין ד"אתם הדבקים בה"א חיים כולכם היום" לבני ישראל,
including also — the drawing of life-force through the cities of refuge<sup>53</sup>
כולל גם — המשכת החיות ע"י ערי מקלט<sup>53</sup>
for one who kills a person unintentionally<sup>54</sup>.
להורג נפש בשגגה<sup>54</sup>.

And this is the content of the two explanations above regarding the nature of Moshe's action:
וזהו תוכן ב' הסברות הנ"ל בגדר פעולת משה:
According to the first approach, that the handiwork of Moshe was only in the category of a mere preparation but did not effect a matter of the separation of the cities of refuge in actuality — this is in order to emphasize and teach that from the level of Moshe, the entire matter of one who kills a soul unintentionally is not relevant from the outset, and there is no need for cities of refuge as above,
לאופן הא' שמעשה ידי משה הי' רק בגדר הכנה בעלמא אבל לא פעל ענין של הבדלת ערי מקלט בפועל — ה"ז כדי להדגיש ולהורות שמצד מדריגת משה לא שייך מעיקרא כל הענין דהורג נפש בשגגה ואין צורך בערי מקלט כנ"ל,
And this is that also the matter of drawing down vitality to one who kills a soul unintentionally is below the level of Moshe.
והיינו שגם ענין המשכת החיות להורג נפש בשגגה הוא למטה ממדריגת משה.
[And one can say,
[ויש לומר,
that according to this reasoning,
שלסברא זו,
this itself that Moses made only a mere preparation for the cities of refuge
זה גופא שמשה עשה רק הכנה בעלמא לערי מקלט
(without there being through this an actual effect of the name "cities of refuge"),
(מבלי שיהי' עי"ז חלות בפועל של שם ערי מקלט),
is because he wanted to achieve through this,
הוא לפי שרצה לפעול עי"ז,
that also afterwards there would not be so much need for cities of refuge,
שגם אח"כ לא יהי' צורך כ"כ בערי מקלט,
by means of there being fewer unintentional murderers who would need cities of refuge].
ע"י שיתמעטו הורגי נפש שיצטרכו לערי מקלט].
But according to the second manner, Moses effected the actuality of the name "city of refuge" — for although Moses, from his own perspective, is above any matter of an unintentional murderer
אבל לאופן הב' פעל משה חלות שם עיר מקלט — כי אע"פ שמשה מצד עצמו הוא למעלה מכל ענין של הורג נפש בשגגה
(also from drawing down vitality to him),
(גם מהמשכת חיות אליו),
nevertheless,
מ"מ,
being a faithful shepherd,
להיותו רועה נאמן,
he lowered himself to draw down vitality also to the Children of Israel who would need
הוריד את עצמו להמשיך חיות גם לבנ"י שיצטרכו
(after the time)
(לאחרי זמן)
the cities of refuge<sup>55</sup>.
לערי מקלט<sup>55</sup>.
And this is what Rashi said: "He set his heart to be anxious about the matter to set them apart,"
וזהו שכ' רש"י "נתן לב להיות חרד לדבר שיבדילם",
for the setting apart of the cities of refuge by Moshe Rabbeinu is connected with his descent from his level,
כי הבדלת ערי מקלט ע"י משה רבינו קשורה עם ירידתו ממדריגתו,
to draw down vitality also to one who fell into "the place of death and impurity, may Hashem protect us"<sup>56</sup>,
להמשיך חיות גם למי שנפל ל"מקום המיתה והטומאה ה' ישמרנו"<sup>56</sup>,
and therefore it caused him anxiety
ולכן פעל עליו חרדה
(which removes the bloods<sup>57</sup>)
(המסלקת את הדמים<sup>57</sup>)

But on the other hand, "He set his heart to be anxious about the matter to set them apart,"
אבל לאידך "נתן לב להיות חרד לדבר שיבדילם",
that not only did he do so in practice,
שלא רק שעשה כן בפועל,
but he set his heart on this,
אלא נתן לב על זה,
for this is the essence of a faithful shepherd,
כי זהו ענינו של רועה נאמן,
who gives his soul for the flock of his pasture,
שמוסר נפשו עבור צאן מרעיתו,
and draws down vitality also to one who needed to go into exile,
וממשיך חיות גם למי שנצטרך ללכת בגולה,
"And he shall flee..
"ונס..
and live",
וחי",
until even he will be elevated to be among "those who cling to Hashem, living, all of you today."
עד שגם הוא יתעלה להיות מן "הדבקים בה"א חיים כולכם היום".
And so may it be for us,
וכן תהי' לנו,
in this bitter exile of ours,
בגלותנו זה המר,
that not only is there no dominion, G-d forbid, over Israel,
שלא זו בלבד שאין להגלות שום שליטה ח"ו על ישראל,
for there is the spiritual protection of the cities of refuge — words of Torah provide refuge<sup>58</sup>,
כי ישנה ההגנה הרוחנית דערי מקלט — דברי תורה קולטין<sup>58</sup>,
but moreover,
אלא עוד זאת,
that "he shall flee..
ש"ונס..
and live",
וחי",
that is drawn to each one of Israel the matter of life,
שנמשך לכאו"א מישראל ענין החיים,
true life,
חיים אמיתיים,
until the fulfillment of the promise<sup>59</sup>
עדי קיום היעוד<sup>59</sup>
"He will revive us after two days; on the third day He will raise us up and we shall live before Him",
"יחיינו מיומיים ביום השלישי יקימנו ונחי' לפניו",
in eternal life<sup>60</sup>,
בחיים הנצחיים<sup>60</sup>,
in the true and complete redemption through our righteous Moshiach,
בגאולה האמיתית והשלימה על ידי משיח צדקנו,
and immediately, right away.
ותיכף ומיד ממש.
