The Rambam wrote<sup>1</sup>

: "The exile does not leave his city of refuge ever,
: "הגולה אינו יוצא מעיר מקלטו לעולם,
And even for a matter of a mitzvah or etc. And even to save a life through his testimony or to save from the hand of the idolater or from the hand of the river or from the hand of the fire or from the collapse,
ואפילו לדבר מצוה או כו' ואפילו להציל נפש בעדותו או להציל מיד העובד כוכבים או מיד הנהר או מיד הדליקה ומן המפולת,
Even if all Israel need his salvation like Yoav ben Tzeruyah, he does not leave there ever until the death of the Kohen Gadol,
אפילו כל ישראל צריכין לתשועתו כיואב בן צרוי' אינו יוצא משם לעולם עד מות הכהן הגדול,
And if he left, he permitted himself to death as we have explained<sup>2</sup>

And the source of his words is in the Mishnah Makkot

: "And he does not go out, neither etc. nor for capital testimony
: "ואינו יוצא לא כו' ולא לעדות נפשות<sup>4</sup>
And even an Israelite
ואפילו ישראל<sup>5</sup>
they need him, and even the commander of the army of Israel, like Yoav ben Tzeruyah, does not go out from there forever, as it is said, 'who fled there'
צריכים לו ואפי' שר צבא ישראל כיואב בן צרוי' אינו יוצא משם לעולם שנאמר אשר נס שמה<sup>6</sup>,
there shall be his dwelling, there shall be his death, there shall be his burial."

And the later authorities asked
והקשו באחרונים<sup>7</sup>
why does he not go out to save lives,
מדוע אינו יוצא להצלת נפשות,
and behold, saving a life overrides the entire Torah,
והרי פקו"נ דוחה כל התורה כולה,
and why is the commandment of dwelling in his city of refuge not set aside for the sake of saving a life?
ולמה אין מצות ישיבה בעיר מקלטו נדחית מפני פקו"נ?
And especially when all of Israel need his salvation,
ובפרט כאשר כל ישראל צריכים לתשועתו,
for then it is saving lives
דאז הוי הצלת נפשות
(not only of an individual but)
(לא רק דיחיד אלא)
of many,
דרבים,
saving the lives of all of Israel,
פקו"נ דכל ישראל,
and behold, there is nothing that stands before saving a life,
והרי אין לך דבר העומד בפני פקו"נ,
even of an individual,
גם דיחיד,
and all the more so and how much more so of many and of the entirety of Israel.
וכ"ש וק"ו דרבים ודכלל ישראל.
And several answers were said in settling the matter:
וכמה תירוצים נאמרו ביישוב הדבר:
a)
א)
Since a murderer who goes out from his city of refuge, it is a commandment
כיון שרוצח שיוצא מעיר מקלטו מצוה
(or at least permission)
(או עכ"פ רשות)
in the hand of the blood avenger to kill him,
ביד גואל הדם להורגו,
and likewise all other people are not liable for him
וכן שאר כל אדם אין חייבים עליו
(as per the opinions in the continuation of the Mishnah),
(כב' הדיעות בהמשך המשנה),
behold, by his going out he endangers himself — and therefore there is no obligation on him to endanger himself for the sake of saving his fellow,
הרי ביציאתו הוא מסכן את עצמו — ולכן אין חיוב עליו לסכן עצמו בשביל הצלת חבירו,
for your life takes precedence<sup>8</sup>.
דחייך קודמין<sup>8</sup>.
And based on this they explain<sup>9</sup>

what the Rambam added at the end of the halacha "And if he went out, he freed himself<pg>128</pg>

to death",

that with this his intention is to explain the reason of the law that he does not go out from there even to save lives — because he should not bring himself into a situation of doubt of danger for the sake of saving his fellow
שבזה כוונתו לבאר טעם הדין דאינו יוצא משם אפילו להצלת נפשות — כי אין לו להכניס עצמו בספק סכנה עבור הצלת חבירו

And they already raised a difficulty on this explanation<sup>10</sup>,
וכבר הקשו על פי' זה<sup>10</sup>,
that in addition to this that the essence of the law that there is no obligation to put oneself in a doubt of danger in order to save one's fellow from certain danger,
דנוסף על זה שעצם ההלכה שאין חיוב להכניס עצמו בספק סכנה כדי להציל חבירו מסכנה ודאית,
is disputed,

for it is obvious that one whom all of Israel need his salvation like Yoav ben Tzeruyah,

the general of the army of Israel,
שר הצבא לישראל,
can defend himself against the avenger of blood,
יכול להגן על עצמו מפני גואל הדם,
and furthermore — who can say<sup>13</sup>
ועוד זאת — מי יימר<sup>13</sup>
that it is forbidden to close the door against the avenger of blood until the refugee saves all of Israel.
שאסור לסגור הדלת בעד גואל הדם עד שיציל הגולה את כלל ישראל.
And also what is said that the conclusion of the language of the Rambam is a reason for the above is not so clear,
וגם מ"ש שסיום לשון הרמב"ם הוא טעם אדלעיל אינו מחוור כ"כ,
for from the language of the Rambam "And if he went out he permitted himself to death" it does not imply that this is a matter of a reason for the law
כי מלשון הרמב"ם "ואם יצא התיר עצמו למיתה" לא משמע שזהו ענין דטעם לדין
(that he does not go out),

for then it should have said that "he does not go out from there forever..

There are those who wrote<sup>14</sup>,
יש שכתבו<sup>14</sup>,
that since through him the killing of a soul was caused, it is far that merit should be caused through him.
דכיון שנתגלגלה על ידו הריגת נפש רחוק הוא שיתגלגל זכות על ידו.
And it is difficult to say that this is the reason of the law,
וצע"ג לומר שזהו טעם הדין,
for how is it possible to rely on this reasoning to push aside because of it the obligation of saving a life — which pushes aside the entire Torah entirely,
דאיך אפשר לסמוך על סברא זו לדחות בגללה חיוב פקו"נ — שדוחה כל התורה כולה,
and even a doubt and a doubt of a doubt.
ואפילו ספק וספק ספיקא.

And there are those who say it is a decree of the verse<sup>15</sup>
ויש אומרים דהוי גזירת הכתוב<sup>15</sup>
"There shall his dwelling be etc.",

But also this answer needs explanation — for it is a great principle that pikuach nefesh overrides the entire Torah,

And how we learn the interpretation of this principle — whether in a place of pikuach nefesh the obligations of the Torah do not apply at all
ואיך שנלמוד הפירוש דכלל זה — אם שבמקום פקו"נ אין חלים כלל חיובי התורה
(as we learn<sup>17</sup>
(כמו שנלמד<sup>17</sup>
from "and live by them<sup>18</sup>,

And this will be understood with an introduction to the explanation of what the Rambam wrote "And if he went out, he surrendered himself to death as we explained."
ויובן זה בהקדם ביאור מ"ש הרמב"ם "ואם יצא התיר עצמו למיתה כמו שביארנו".
In simple terms, the intention,
בפשטות הכוונה,
there is room to say,
דיש מקום לומר,
that although according to the law he does not leave there forever,
שהגם שמצד הדין אינו יוצא משם לעולם,
nevertheless,
מ"מ,
if he left in order to save a life through his testimony or to save from the hand of etc. — this is not considered as if he left willfully
אם יצא בשביל להציל נפש בעדותו או להציל מיד כו' — אין זה נחשב כיצא בזדון
(regarding which the Rambam wrote above<sup>2</sup>
(שבזה כתב הרמב"ם לעיל<sup>2</sup>
that he permitted himself to death)

but rather as if he left unintentionally,
אלא כיצא בשוגג,
in which case "whoever kills him, whether the blood avenger or any other person, is exiled on his account"<sup>19</sup>,

and that is to say that then we do not say he permitted himself to death,

And on this the Rambam teaches us,
וע"ז קמ"ל הרמב"ם,
that since it is forbidden to leave,

therefore if he left to save etc. "he permitted himself to death".

But this itself requires a reason — what is the reason of the matter,
אבל הא גופא טעמא בעי — מאי טעמא דמילתא,
that leaving in order to save etc. is considered as leaving willfully that permits himself to death<sup>20</sup>,
שהיציאה בשביל להציל וכו' נחשבת כיציאה במזיד שמתיר עצמו למיתה<sup>20</sup>,
and yet he left to save a life from Israel.
והרי יצא כדי להציל נפש מישראל.
And it appears to say,
ונראה לומר,
that the Rambam wrote it here as a law in itself,
שהרמב"ם כתבו כאן כדין בפ"ע,
and the intention is not only to inform the law,
ואין הכוונה רק להודיע את הדין,
but rather that this is also a reason for this that he does not leave from there ever.
כ"א שזה הוא גם טעם ע"ז שאינו יוצא משם לעולם.

And the explanation in this:
והביאור בזה:
Regarding the definition of one who leaves his city of refuge, the Rambam wrote above<sup>2</sup>
בגדרו של היוצא מעיר מקלטו כתב הרמב"ם לעיל<sup>2</sup>
: "He entered his city of refuge and left its boundary intentionally, behold this one permitted himself to death,
: "נכנס לעיר מקלטו ויצא חוץ לתחומה בזדון הרי זה התיר עצמו למיתה,
and permission is given to the blood avenger to kill him, and if anyone else killed him, they are not liable for him<sup>21</sup>,
ורשות לגואל הדם להרגו ואם הרגו כל אדם אין חייבין עליו<sup>21</sup>,
as it is said<sup>22</sup>
שנאמר<sup>22</sup>
he has no blood".
אין לו דם".
And simply it implies,
ובפשטות משמע,
that this that "he permitted himself to death" is because permission is in the hand of the blood avenger to kill him, and anyone else is not liable for him.
דהא ד"התיר עצמו למיתה" הוא לפי שרשות ביד גואל הדם להרגו וכל אדם אין חייבין עליו.
But according to this, it is difficult in the language of the Rambam,
אבל לפ"ז צ"ע בלשון הרמב"ם,
that he should have said "behold this one permitted himself to death because permission is given to the blood avenger to kill him, and if anyone else killed him etc."?
דהול"ל "הרי זה התיר עצמו למיתה לפי שרשות לגואל הדם להרגו ואם הרגו כל אדם כו'"?
And furthermore, the main point — why did the Rambam add "behold this one permitted himself to death" — what does he inform us with this?
ועוד ועיקר — למה הוסיף הרמב"ם "הרי זה התיר עצמו למיתה" — מה משמיענו בזה?
And why did he not suffice with copying the language of R. Akiva "
ולמה לא הסתפק בהעתקת לשון רע"ק "

permission is in the hand of the blood-avenger to kill him, and if any person killed him, they are not liable for him"?

And it appears to say,

that the Rambam says here two laws concerning the law of one who goes outside the boundary intentionally: a)

"he permitted himself to death",

"and permission is in the hand of the blood-avenger to kill him, and if any person killed him, they are not liable for him" — and they are two different laws that are not dependent on each other:

The first law is regarding the conduct of the murderer himself — that when he goes outside his city of refuge "he permits himself to death",

And this is not a result of the permission and license for the blood-avenger to kill him<sup>23</sup>,

And the second law — in relation to the killing of the murderer by another
והדין השני — בשייכות להריגת הרוצח ע"י אחר
(the one who finds him outside his city of refuge),

And in this there is a distinction between the blood-avenger and other people,
ובזה יש חילוק בין גואל הדם לשאר בני אדם,
That the blood-avenger has permission to kill him,
דגואל הדם יש לו רשות להרגו,
And all other people only "they are not liable for him"
ושאר כל אדם רק "אין חייבין עליו"
(but they are forbidden ab initio,

even though he is a "dead man").

And it is to be said,

Based on the above, it is simply understood that he does not go out from his city of refuge even to save,
ע"פ הנ"ל מובן בפשטות הא דאינו יוצא מעיר מקלטו אפילו להציל,
that there is no need for the fact that a person is not obligated to put himself into a doubtful danger in order to save his fellow or for the sake of saving the entirety of Israel — but rather since according to Torah law when he goes out from his city of refuge,
שאין צריכים להא דאין אדם חייב להכניס עצמו לספק סכנה בשביל להציל חבירו או בשביל הצלת כלל ישראל — אלא שכיון שע"פ דין תורה כשיוצא מעיר מקלטו,
there is upon him the status of a "guilty man",
יש עליו דין "גברא קטילא",
it is impossible that any obligation or law should apply to him to go out from his city of refuge for any matter whatsoever.
א"א שיחול עליו שום חיוב ודין לצאת מעיר מקלטו לאיזה ענין שהוא.
And therefore it is impossible to say also in our case that saving lives of the entirety of Israel would permit him to save,
ולכן א"א לומר גם בנדו"ד שפקו"נ דכלל ישראל יתיר לו להציל,
for the law and commandment of saving lives cannot apply to one about whom the Torah says that through the act of saving he becomes a "guilty man".
כי הדין והמצוה דפקו"נ אינו יכול לחול על מי שהתורה אומרת עליו שע"י פעולת ההצלה נעשה "גברא קטילא".
[And perhaps one may add in the way of allusion and homily<sup>28</sup>
[ואולי יש להוסיף ע"ד הרמז והדרוש<sup>28</sup>
— that this very thing that the saving of lives of Israel should be dependent on a person whom the Torah forbade to go out from his city of refuge
— דזה גופא שפקו"נ דישראל יהי' תלוי באדם שהתורה אסרה עליו לצאת מעיר מקלטו
(in a manner that if he goes out "he permits himself to death"),
(באופן שאם יצא "התיר עצמו למיתה"),
compels one to say,
מכריח לומר,
that it is revealed before Heaven that there is here no saving of lives,
דכלפי שמיא גליא שאין כאן פקו"נ,
and this person has no ability to bring rescue and salvation.
ואדם זה אין ביכולתו להביא הצלה וישועה.
And according to the explanation of the Ramban
וע"ד ביאור הרמב"ן<sup>29</sup>
regarding the law of conspiring witnesses, that if "they killed, they are not killed"
בדין עדים זוממין דאם "הרגו אין נהרגין"<sup>30</sup>
— since he was killed according to the Torah in the court,
— דכיון שנהרג ע"פ תורה בב"ד,
this itself compels [us] to say,
ה"ז גופא מכריח לומר,
that before Heaven it is revealed that he was not righteous and died for his sin,
דכלפי שמיא גליא שלא הי' צדיק ובעונו מת,
for "if he were righteous, God would not have abandoned him into their hands".

And according to this, the conclusion of the Mishnah there is well explained,
ולפי זה מבואר היטב סיום המשנה שם,
that the teaching of this law is from the verse "where he fled there — there shall be his dwelling, there shall be his death, there shall be his burial",
שהלימוד של דין זה הוא מהכתוב "אשר נס שמה — שם תהא דירתו שם תהא מיתתו שם תהא קבורתו",
and this means that his life and existence is only in his city of refuge,
והיינו שחיותו וקיומו הוא רק בעיר מקלטו,
but outside of it [it is] not; and consequently it is impossible that any obligation should apply to him
משא"כ מחוצה לה; ובמילא א"א שיחול עליו שום חיוב
(including the obligation and commandment of saving a life)
(כולל חיוב ומצות פקו"נ)
connected with his leaving his city of refuge,
הקשור עם יציאתו מעיר מקלטו,
since he has no life and existence except "there".
מאחר שאין לו חיות וקיום אלא "שמה".
And it must be said,
ויש לומר,
that this is also what was brought there not only "there shall be his dwelling" but also "there shall be his death, there shall be his burial",
שזהו גם מה שהובא שם לא רק "שם תהא דירתו" אלא גם "שם תהא מיתתו שם תהא קבורתו",
at first glance what does this pertain to our subject?
דלכאורה מה זה נוגע לנדו"ד?
— But rather this comes to teach us that this that he must be in his city of refuge is not only in the category of a commandment and obligation upon him to be there,
— אלא שזה בא ללמדנו שזה שצריך להיות בעיר מקלטו אין זה רק בגדר מצוה וחיוב עליו להיות שם,
and a prohibition to go out from there,
ואיסור לצאת משם,
or even more than this — that the place of his vitality is only "there",
או אפילו יתירה מזו — שמקום חיותו הוא רק "שמה",
but rather additionally,
אלא עוד זאת,
that outside of his city of refuge he has no existence at all<sup>*30</sup>
שחוץ לעיר מקלטו אין לו מציאות כלל<sup>*30</sup>
— and therefore it is impossible for any law and obligation to apply to him
— ולכן א"א לחול עליו שום דין וחיוב
(also that which is connected with his going out from there)<sup>31</sup>.

And the Rambam did not bring the teaching from the verse,

but he hints at the reason of the law at the end of his language "And if he went out he made himself liable to death",

that he is precise to bring this language specifically

(and not that permission to kill him etc.),

which is the first law that was explained above,

that the very going out of his city of refuge causes that he be like a dead man.

The lesson from all this:
ההוראה מכל זה:
Torah is compared to a city of refuge,
תורה נמשלה לעיר מקלט,
as our Sages of blessed memory [said]: "Words of Torah..
כמחז"ל "דברי תורה..
provide refuge"<sup>32</sup>.
קולטין"<sup>32</sup>.
And the relationship of Israel to Torah is like [that of] a fugitive to a city of refuge,
והיחס דישראל לתורה הוא כגולה לעיר מקלט,
that Torah is "our life and the length of our days"<sup>33</sup>,
שהתורה היא "חיינו ואורך ימינו"<sup>33</sup>,
and without Torah, Israel is, may it not be said, like "a slain man",
ובלי תורה הרי ישראל הם ר"ל כ"גברא קטילא",
as the well-known parable of Rabbi Akiva [about] fish and the waters of the sea<sup>34</sup>.
כמשל הידוע של ר' עקיבא מדגים ומים שבים<sup>34</sup>.
And from this a lesson for one who thinks that by means of this that he goes out of the "four cubits of Torah",
ומזה הוראה להחושב שעי"ז שיצא מ"ד' אמות של תורה",
i.e., making compromises in his conduct in Torah and mitzvos,
דהיינו עשיית פשרות בהנהגתו בתומ"צ,
and even in the finest of fine points — he can save souls and the like,
ואפילו בדקות דדקות — יוכל להציל נפשות וכיו"ב,
that he should know,
שעליו לדעת,
that outside the Torah he is in the category of "a slain man",
שמחוץ לתורה הרי הוא בגדר "גברא קטילא",
and he does not go out at all even
ואינו יוצא כלל אפילו
(if in his opinion it is)
(אם לדעתו הוא)
to save all of Israel — because since he is outside the refuge of Torah,
להציל כלל ישראל — כי כיון שהוא חוץ למקלט דתורה,
which is "our life and the length of our days",
שהיא "חיינו ואורך ימינו",
it is impossible that salvation for a Jewish person should come out from this.
אי אפשר שתצא מזה הצלה לאיש ישראל.
And may it be His will that through the study and the give-and-take in the laws of exile
ויהי רצון שע"י הלימוד והשקו"ט בדיני גלות
(the cities of refuge),
(דערי מקלט),
and in general through the addition of each and every one in the study of Torah,
ובכלל ע"י ההוספה דכאו"א בלימוד התורה,
this will hasten even more the going out of the children of Israel from the <pg>132</pg>
ה"ז יזרז עוד יותר יציאת בני ישראל מה<pg>132</pg>
Exile in which we are,
גלות שנמצאים אנו בו,
and fulfillment of the prophecy<sup>35</sup>
ויקויים היעוד<sup>35</sup>
"Zion shall be redeemed with justice and her captives with charity",
"ציון במשפט תפדה ושבי' בצדקה",
and these days shall become joy and gladness and good festivals,
ויהפכו ימים אלו לששון ולשמחה ולמועדים טובים,
immediately and forthwith.
תיכף ומיד ממש.
