: "And you shall not bear sin for it when you separate its fat from it,

and the holy things of the children of Israel you shall not profane and you shall not die."
ואת קדשי בני ישראל לא תחללו ולא תמותו".
And in Rashi: "And you shall not bear sin for it etc. — for if you do not separate, you will bear sin.
ובפרש"י: "ולא תשאו עליו חטא וגו' — הא אם לא תרימו תשאו חטא.
And you shall not die — for if you profane, you will die."
ולא תמותו — הא אם תחללו תמותו".
And Rashi's intent simply
וכוונת רש"י בפשטות

that the verse did not come to inform us that if the Levites separate terumat ma'aser they will not sin and will not be punished — for what does this teach us<sup>4</sup>
שהכתוב לא בא להשמיענו שאם ירימו הלויים תרומת מעשר לא יחטאו ולא יענשו — דמאי קמ"ל<sup>4</sup>
— but rather came to teach us in a negative formulation the prohibition and the punishment,
— אלא בא ללמדנו בלשון שלילה את האיסור והעונש,
that "if you do not separate, you will bear sin,"
ד"אם לא תרימו תשאו חטא",
and "if you profane, you will die."
ו"אם תחללו תמותו".
And behold, the lengthiness of the language of the verse and Rashi's commentary implies,
והנה מאריכות לשון הכתוב ופרש"י משמע,
that there are here two matters

For it could be said that the entire verse speaks about one matter,
דאת"ל שכל הכתוב איירי בענין אחד,
and the bearing of sin is itself the punishment of death stated at the end of the verse,
ונשיאת החטא היא היא העונש מיתה שנאמר בסיום הכתוב,
it should have said "And you shall not bear a sin on it to die"
הול"ל "ולא תשאו עליו חטא למות"

— like the language of the verse earlier in our parshah<sup>5</sup>

"And they shall not approach etc. to the Tent of Meeting to bear a sin to die",

and similarly earlier in Parshas Emor<sup>6</sup>

(regarding the prohibition of eating terumah in impurity)

it is stated "And they shall not bear a sin on it and die through it".
נאמר "ולא ישאו עליו חטא ומתו בו".
And it is puzzling,
וצ"ע,
why did Rashi remain silent and not explain what are the two prohibitions in this verse.
מדוע סתם רש"י ולא פירש מה הם שני האיסורים שבכתוב זה.
And especially that we find several explanations in Chazal and commentators of Scripture in explaining the duplication in the verse,
ובפרט שמצינו כמה פירושים בחז"ל ומפרשי המקרא בביאור הכפל שבכתוב,
and in Rashi's commentary there is no mention,
ואילו בפרש"י אין זכר,
apparently,
לכאורה,
to resolve this question<sup>7</sup>.

At first glance, one could say,
לכאורה יש לומר,
that Rashi does not need to explain it,
שאין רש"י צריך לפרשו,
because it is understood from the language of the verse itself: "And you shall not bear sin for it when you remove its fat from it" refers to maaser from which terumat maaser has not been removed,
כי מובן מלשון הכתוב עצמו: "ולא תשאו עליו חטא בהרימכם את חלבו ממנו" קאי במעשר שלא הורמה ממנו תרומת מעשר,
that "if you do not remove, you shall bear sin"; and the end of the verse,
ש"אם לא תרימו תשאו חטא"; וסיום הכתוב,
"And the holy things of the children of Israel you shall not profane etc." refers to a stranger
"ואת קדשי בני ישראל לא תחללו גו'" קאי על זר
(an Israelite or a Levite)

who eats terumat maaser,

as the language of the verse "And the holy things of the children of Israel you shall not profane"

and the profanation of the holy is through eating<sup>8</sup>

But it is very forced to say that according to Rashi the <pg>66</pg>

It is written "And My holy things of the children of Israel you shall not profane and you shall not die" refers to a non-priest who eats terumah of maaser,
כתוב "ואת קדשי בנ"י לא תחללו ולא תמותו" קאי בזר האוכל תרומת מעשר,
for according to Rashi this thing is already learned from what is said above<sup>9</sup>
כי לפרש"י דבר זה כבר נלמד ממ"ש לעיל<sup>9</sup>
"And it shall be considered for you your terumah like grain from the threshing floor",
"ונחשב לכם תרומתכם כדגן מן הגורן",
and according to Rashi there "Your terumah of maaser is forbidden to non-priests and to those impure and they are liable for it death<sup>10</sup>
וכפרש"י שם "תרומת מעשר שלכם אסורה לזרים ולטמאים וחייבין עלי' מיתה<sup>10</sup>
and an additional fifth like terumah gedolah"
וחומש כתרומה גדולה"
(And it is included in the prohibition of terumah gedolah).

And in several simple-sense interpreters of the verse<sup>11</sup>
ובכמה פשטני המקרא<sup>11</sup>
they explained,

that what is said "And My holy things of the children of Israel you shall not profane" is a prohibition

And seemingly,

since Rashi is silent and did not explain for what matter "And My holy things of the children of Israel you shall not profane etc." is said — and in this portion it speaks only about the laws of terumah of maaser<sup>12</sup>
כיון שרש"י סתם ולא פי' לאיזה ענין נאמר "ואת קדשי בני ישראל לא תחללו גו'" — ובפרשה זו איירי רק בדיני תרומת מעשר<sup>12</sup>
— it must be said,

that also Rashi holds thus.

For if it does not refer to the prohibition of eating terumah of maaser
דאם לא קאי באיסור אכילת תרומת מעשר
(which is learned from "And your terumah shall be considered" as above),
(שזה נלמד מ"ונחשב לכם תרומתכם" כנ"ל),
it necessarily follows that it speaks about the prohibition of eating maaser from which terumah of maaser was not taken.

At first glance, one can explain the repetition,
לכאורה יש לבאר הכפל,
that "and you shall not bear sin for it when you remove its fat from it" refers to the actual prohibition of raising the terumah of the maaser
ש"ולא תשאו עליו חטא בהרימכם את חלבו ממנו" קאי על עצם האיסור שבאיהרמת תרומת מעשר
(even if one does not eat the maaser that is tevel to terumah of maaser),
(גם אם לא אוכלים את המעשר הטבול לתרומת מעשר),
as the precise language "if you do not raise, you shall bear sin",
כדיוק הלשון "אם לא תרימו תשאו חטא",
but "and the holy things of the children of Israel you shall not profane" is the prohibition of eating<sup>8</sup>
משא"כ "ואת קדשי בנ"י לא תחללו" הוא איסור אכילת<sup>8</sup>
maaser that is tevel to terumah of maaser.

But it is difficult to explain thus,

Behold, the very prohibition of not separating the terumah of the maaser we know from the obligation and positive commandment "And you shall separate from it a terumah for Hashem, a maaser from the maaser"<sup>13</sup>,
הרי עצם האיסור של אי הרמת תרומת מעשר יודעים מהחיוב ומ"ע "והרמותם ממנו תרומת ה' מעשר מן המעשר"<sup>13</sup>,
and consequently it is understood<sup>14</sup>

that if they do not separate, they transgress a positive commandment<sup>15</sup>.

And further: Simply, one must say,

that "And you shall not bear a sin on account of it" means that there is a punishment for this,

for the term "bearing a sin" simply and usually indicates a matter of punishment<sup>16</sup>.

it is very difficult,

for the nullification of separating the terumah of the maaser?

And likewise it is difficult to say that "You shall bear a sin on account of it" means a punishment of lashes,
וכן קשה לומר ד"תשאו עליו חטא" היינו עונש מלקות,
since there is no warning here<sup>17</sup>,
שהרי אין כאן אזהרה<sup>17</sup>,
and furthermore — behold, in not separating the terumah of the maaser there is no action
ועוד זאת — הרי אין באי הרמת תרומת מעשר מעשה
(and one is not lashed for a prohibition that has no action)<sup>18</sup>.

And there are commentators<sup>19</sup>
ויש מפרשים<sup>19</sup>
who explained,
שפירשו,
that "and you shall not bear sin because of it" refers to the prohibition of eating tithe that is tevel to terumat maaser
ש"ולא תשאו עליו חטא" קאי באיסור אכילת מעשר הטבול לתרומת מעשר
[And according to this,
[ולפ"ז,
what is written "and you shall not bear sin because of it when you separate etc." — "that if you do not separate you will bear sin" — that is,
מ"ש "ולא תשאו עליו חטא בהרימכם גו'" — "הא אם לא תרימו תשאו חטא" — היינו,
because "if you do not separate" they will come to sin when they eat the tithe].
כי "אם לא תרימו" יבואו לידי חטא כשיאכלו המעשר].
And according to this it works out well that there is here a "bearing of sin",
ועפ"ז אתי שפיר שיש כאן "נשיאת חטא",
punishment for the act of eating.

But if this is Rashi's method in his commentary on the Torah,
אבל אם זוהי שיטת רש"י בפירושו עה"ת,
the question returns to its place — since both parts of the verse speak of one prohibition
הדרא קושיא לדוכתא — כיון ששני חלקי הכתוב איירי באיסור אחד
(eating tithe that is tevel to terumat maaser)
(אכילת מעשר הטבול לתרומת מעשר)
— what is the repetition in the verse?
— מהו הכפל בכתוב?
And furthermore: what bearing of sin — punishment — is there here besides the punishment of death
ועוד זאת: איזו נשיאת חטא — עונש — יש כאן מלבד העונש מיתה
("if you profane it you will die")
("אם תחללו תמותו")
that is at the end of the verse?
שבסיום הכתוב?
And one cannot say that "and you shall not bear sin on account of it" refers to the punishment of lashes — for
ואין לומר ש"ולא תשאו עליו חטא" היינו עונש מלקות — שהרי<sup>20</sup>
since eating tevel of terumat ma'aser carries the punishment of death
כיון שיש באכילת טבל לתרומת מעשר עונש מיתה
("if you profane [it] you shall die"),
("אם תחללו תמותו"),
there is no law of lashes here, because "it stands
הרי אין כאן דין מלקות כי "קם<sup>21</sup>
for him in a rabbinic [prohibition] of a more severe [punishment]"
לי' בדרבא מיני'"<sup>22</sup>
(which is a simple reasoning also in study according to the plain meaning).

[And although the punishment of death here is only death by the hands of Heaven,

and only according to Abaye

(in the opinion of Rabbi Nechunya ben HaKaneh)

we say regarding this "it stands for him in a rabbinic [prohibition] of a more severe [punishment]" — nevertheless, according to the plain meaning of the verse, there is no room to distinguish between death by human hands and death by the hands of Heaven,

for the reasoning of "it stands for him in a rabbinic [prohibition] of a more severe [punishment]"

what is the practical difference of this that Scripture called the maaser by the name "terumah" before they separate from it terumat maaser<sup>28</sup>.

And it cannot be said that it comes to teach us the prohibition of eating maaser before the separation of terumas maaser,

because this matter is explicit at the end of the portion,
כי דבר זה מפורש בסוף הפרשה,
"And you shall not bear sin on account of it etc. and the holy things of Bnei Yisrael you shall not profane etc."

And furthermore,
ועוד זאת,
behold, the prohibition to eat maaser that is tevel for terumas maaser applies also to a kohen,
הרי האיסור לאכול מעשר הטבול לתרומת מעשר הוא גם על כהן,
and how is it appropriate to make known this prohibition by means of "the verse called it terumah"
ואיך מתאים להודיע איסור זה ע"י ש"קראו תרומה"
(which is permitted to a kohen)?

And it seems to me,

that the intention of the verse in this that "it called it terumah" is to inform us of the definition of the prohibition of maaser that is tevel for terumas maaser,

that it is not because of the obligation to separate terumas maaser from it,

which refers to eating maaser that is tevel for terumat maaser,

and nevertheless the verse calls it "the holy things of the children of Israel",

because even before the separation of terumat maaser, the terumah is mixed in the maaser

(and causes it to be holy),

and this itself is the reason that there is a punishment of death for eating it,

However, seemingly there is room for questioning about this:

It is said "And they shall not profane the holy things of the children of Israel, which they set apart to the Lord",
נאמר "ולא יחללו את קדשי בני ישראל את אשר ירימו לה'",
And in the Gemara<sup>33</sup>
ובגמ'<sup>33</sup>
They learned from this the prohibition of tevel,
למדו מזה איסור טבל,
And they expounded that what is written "the holy things etc. which they set apart etc." — "Of that which is destined to be set apart the verse speaks".
ודרשו דמ"ש "קדשי גו' אשר ירימו גו'" — "בעתידים לתרום הכתוב מדבר".

In Rashi on the Torah there explains,
בפרש"י עה"ת שם מפרש,
That "they shall not profane the holy things of the children of Israel" is a prohibition "to feed them to strangers".

And superficially it requires clarification,
ולכאורה צ"ע,
since the prohibition of tevel is because of the terumah mixed in it,

why did Rashi strain to explain that it is a prohibition of feeding sacred things

there is a distinction between tevel and great terumah and tithe that is liable for terumah of the tithe:

In the study according to the plain meaning it is not reasonable to say,
בלימוד ע"ד הפשט לא מסתבר לומר,
that from the aspect of the obligation itself to separate terumah,
שמצד עצם החיוב להפריש תרומה,
there already exists in actuality in the tevel the part of terumah
כבר ישנו בפועל בהטבל חלק התרומה
(which he will separate in the future)<sup>35</sup>.

And therefore it is impossible to interpret the verse "And they shall not profane the holy things of Bnei Yisrael"

that is, the action of man is in this that he clarifies,
היינו שפעולת האדם היא בזה שמברר,
separates and distinguishes the portion of the terumat ma'aser

from the ma'aser
מן המעשר
("from it"),
("ממנו"),
and this is because the terumat ma'aser is mixed in the ma'aser.
והיינו לפי שהתרומת מעשר מעורבת בהמעשר.

According to all the above, the repetition in the verse "and you shall not bear sin because of it when you separate [the fat] etc. and the holy things of the children of Israel you shall not profane etc." is resolved — even though both speak of tevel ma'aser that is liable for terumat ma'aser:
ע"פ כל הנ"ל מתורץ הכפל שבכתוב "ולא תשאו עליו חטא בהרימכם גו' ואת קדשי בני ישראל לא תחללו גו'" — אף ששניהם איירי במעשר הטבול לתרומת מעשר:
According to what was explained above, that the definition of its prohibition is from the aspect of the portion of terumat ma'aser that is in it,

it follows,
נמצא,
that in eating ma'aser that is tevel to terumah and ma'aser there are two prohibitions: a)
שיש באכילת מעשר הטבול לתרו"מ שני איסורים: א)
the prohibition of theft — that he robs from the kohanim the portion of terumat ma'aser that is in it,
איסור גזילה — שגוזל מהכהנים את חלק התרומת מעשר שבו,
for since the sanctity of terumat ma'aser has already taken effect on it,
דכיון שכבר חלה עליו קדושת תרומת מעשר,
it can be said that this portion already belongs to the kohanim<sup>44</sup>
י"ל שחלק זה כבר שייך לכהנים<sup>44</sup>
(even before giving it to the kohen<sup>45</sup>).
(גם קודם נתינתו לכהן<sup>45</sup>).

the prohibition of profaning sacred things,
איסור חילול קדשים,
for the sanctity of terumat ma'aser has taken effect on it
שהרי חלה עליו קדושת תרומת מעשר
(and it is called "terumat Hashem"<sup>46</sup>).
(ונקראת "תרומת ה'"<sup>46</sup>).
And these two prohibitions are the ones explained in the verse here: a)
ושני איסורים אלה הם המפורשים בכתוב כאן: א)
"And you shall not bear sin on account of it when you lift up its fat from it" — "behold, if you do not lift up, you shall bear sin",
"ולא תשאו עליו חטא בהרימכם את חלבו ממנו" — "הא אם לא תרימו תשאו חטא",
this is the prohibition of robbing the kohanim,
שזהו איסור גזל הכהנים,
and therefore it says "when you lift up"
ולכן נאמר "בהרימכם"
("behold, if you do not lift up"),
("הא אם לא תרימו"),
for the robbery is done immediately when the Levite does not lift up and separate the portion of terumat ma'aser that is in the ma'aser
כי הגזילה נעשית תיכף כאשר הלוי אינו מרים ומפריש את חלק התרומת מעשר שבמעשר
[rather, as long as he has not eaten it
[אלא דכל זמן שלא אכלו
(and the like)

it is in his power to separate it and return the stolen object,
בידו להפרישה ולהשיב הגזילה,
and as will be explained below in section 7]

"And the sacred things of the children of Israel you shall not profane",
"ואת קדשי בני ישראל לא תחללו",
that is, the prohibition of eating the ma'aser that is tevel because of the sanctity of terumah that is in it
היינו איסור אכילת המעשר הטבול מפני קדושת תרומה שבו
("sacred things of the children of Israel").
("קדשי בנ"י").
And this is also the difference,
וזהו גם החילוק,
that regarding "and you shall not profane" it is said "and you shall not die",
שבנוגע ל"ולא תחללו" נאמר "ולא תמותו",
for the punishment for profaning holy things is death
כי העונש על חילול קדשים הוא מיתה
(by the hand of heaven),
(בידי שמים),
but regarding "when you separate its fat from it" it is said simply "and you shall not bear a sin on account of it",
משא"כ גבי "בהרימכם את חלבו ממנו" נאמר סתם "ולא תשאו עליו חטא",
for here there is only a prohibition of robbery.
כי אין כאן אלא איסור גזילה.

And it can be said,
ויש לומר,
that what is written "and you shall not bear a sin on account of it",
דמ"ש "ולא תשאו עליו חטא",
which indicates a matter of punishment
המורה על ענין של עונש
(and not merely a prohibition)
(ולא רק איסור גרידא)
— refers to the obligation of payment to the priest
— קאי על חיוב תשלומין לכהן
(for also the obligation of payment is included in "bearing a sin").
(שגם חיוב תשלומין נכלל ב"נשיאת חטא").
For since the sanctity of terumat maaser has already taken effect on it and it belongs to the priests,
דכיון שכבר חלה עליו קדושת תרומת מעשר ושייכת לכהנים,
therefore,
לכן,
one who destroys maaser that is tevel for terumat maaser is obligated to pay the priests the tenth part
המאבד מעשר הטבול לתרומת מעשר חייב לשלם לכהנים חלק העשירי
(maaser from the maaser)
(מעשר מן המעשר)
that is in it.
שבו.
And even though as long as the tithe is in existence he can separate from it terumat ma'aser and return the stolen object — behold, if he lost the tithe
ואע"פ שכל זמן שהמעשר בעין יכול להפריש ממנו תרומת מעשר ולהשיב את הגזילה — הרי אם איבד את המעשר
(through eating or in any manner whatsoever)
(ע"י אכילה או באיזה אופן שהוא)
without raising from it terumat ma'aser,
מבלי להרים ממנו תרומת מעשר,
then he is obligated to pay the kohen.
אזי חייב לשלם לכהן.
[For the way of the halachah<sup>47</sup>
[דע"ד ההלכה<sup>47</sup>
there is a special minority that the kohen has only from the time of raising onward
יש מיעוט מיוחד שאין לכהן אלא משעת הרמה ואילך
(also according to the one who says that gifts not raised are considered as if raised)<sup>48</sup>.
(גם למ"ד שמתנות שלא הורמו כמי שהורמו דמי)<sup>48</sup>.
But according to the simple meaning it can be said that it is not so,
אבל ע"ד הפשט יש לומר שאינו כן,
for since terumat ma'aser is mixed in the tithe and the sanctity of terumat ma'aser applies to it,
דכיון שהתרומת מעשר מעורבת בהמעשר וחלה עלי' קדושת תרומת מעשר,
this portion already belongs to the kohanim
כבר שייך חלק זה לכהנים

Before giving it to the kohen in practice)
קודם נתינתו לכהן בפועל)
And they are obligated to pay the kohen for its loss].
וחייבים לשלם לכהן על איבודו].
And although before the giving to the kohen it is impossible to say that it is in the possession of a particular kohen,
והגם שקודם הנתינה לכהן א"א לומר שהוא ברשותו של כהן פרטי,
Nevertheless, it can be said,
מ"מ יש לומר,
That in a simple sense it has already become the property of the kohanim<sup>49</sup>
שע"ד הפשט כבר נעשה ממון כהנים<sup>49</sup>
(And only there is the right of choice<sup>50</sup>
(ורק שיש טובת הנאה<sup>50</sup>
For the Levite to give it to whichever kohen he wants,
ללוי ליתנו לכהן שרוצה,
And this is the mitzvah of giving terumat maaser),
וזוהי מצות נתינת תרומת מעשר),
And he is obligated to pay.
וחייב לשלם.
And it can be said,
ויש לומר,
That he gives it to whichever kohen he wants
שנותנו לכהן שירצה
(In that watch, in the manner of the law of the convert's stolen property<sup>51</sup>).
(באותו משמר ע"ד גזל הגר<sup>51</sup>).
And on the other hand, it can be said: since when the terumah of the tithe has not yet come into the hand of a kohen, the obligation of payment does not apply to it
ולאידך יש לומר: כיון שכשעדיין לא הגיעה התרומת מעשר ליד כהן לא שייך עלי' חיוב תשלומין
(since it is not in the private ownership of a kohen)
(כיון שאינה בבעלות כהן פרטי)
— behold, for this same reason it can be said,
— הרי מהאי טעמא גופא יש לומר,
that according to the simple understanding,
שע"ד הפשט,
one who loses untithed produce that is obligated in terumah is liable to lashes for the prohibition of robbery.
המאבד מעשר הטבול חייב מלקות על לאו דגזילה.
For this that one is not lashed for the prohibition of robbery is because it is a prohibition that is connected to a positive commandment
דזה שאין לוקין על לאו דגזילה הוא משום דהוי לאו הניתק לעשה
("And he shall return the stolen object"<sup>52</sup>),
("והשיב את הגזילה"<sup>52</sup>),
for which one is not lashed
שאין לוקין עליו

but if he has already eaten the stolen object, it is no longer connected to a positive commandment,
אבל אם כבר אכל את הגזילה שוב אינו ניתק לעשה,
and since in our case also payment<sup>54</sup>
וכיון שבנדו"ד גם תשלומין<sup>54</sup>
is not applicable
ליכא

then he is lashed for robbing the kohanim.
א"כ לוקה על גזילת הכהנים.
And based on this, it follows,
ועפ"ז נמצא,
that "And you shall not bear [sin] etc." means according to its simple meaning
ש"ולא תשאו גו'" פירושו כפשוטו
(as in most places),
(כברוב המקומות),
that there is here an actual punishment.
שיש כאן עונש ממש.
And perhaps one could say even more,
ואולי יש לומר עוד יותר,
that even if he loses the tithe through eating,
דגם אם מאבד את המעשר ע"י אכילה,
that then there is upon him the punishment of death by the hand of Heaven
שאז יש עליו עונש מיתה ביד"ש
("If you profane [them], you will die"),
("אם תחללו תמותו"),
nevertheless he is liable for payment
מ"מ חייב בתשלומין
(or lashes),
(או מלקות),
and we do not say regarding this "kim lei be-drabba minei" — because the payment
ולא אמרינן בזה קלב"מ — דכיון שהתשלומין
(or the lashes)
(או המלקות)
are from the aspect of the robbery of the kohen,
הם מצד גזילת הכהן,
whereas the punishment of death is from the aspect of the prohibition of profaning sacred things,
ואילו עונש מיתה הוא מצד איסור חילול קדשים,
and thus this is death for this and payment for that,
וא"כ ה"ז מיתה לזה ותשלומין לזה,
which in the simple sense<sup>55</sup>
שע"ד הפשט<sup>55</sup>
we do not say regarding this "kim lei be-drabba minei"<sup>56</sup>.
לא אמרינן בזה קלב"מ<sup>56</sup>.
