In the Zohar on our parshah<sup>1</sup>
בזהר פרשתנו<sup>1</sup>
it is told about R' Yosi and R' Chiya who were walking on the road and spoke about matters of Torah,
מסופר אודות ר' יוסי ור' חייא שהלכו בדרך ודברו בעניני תורה,
and finally<sup>2</sup>
ולבסוף<sup>2</sup>
R' Chiya said a discourse on the verse<sup>3</sup>
אמר ר' חייא דרוש עה"פ<sup>3</sup>
"And it shall be in the end of days, the mountain of the House of G-d shall be established at the top of the mountains..
"והי' באחרית הימים נכון יהי' הר בית ה' בראש ההרים..
and all nations shall flow to it",
ונהרו אליו כל הגוים",
and afterwards<sup>4</sup>
ולאח"ז<sup>4</sup>
R' Yosi said "Fortunate is this path that we merited this matter,
אמר ר' יוסי "זכאה ארחא דא דזכינא להאי מלה,
He said to him

וז"ל:
"Rabbi Chiyya at first, when he said to Rabbi Yossi this discourse, did not say it in the name of Rabbi Shimon or Rabbi Shimon,
"ר' חייא בתחלה כשאמר לר' יוסי זה הדרוש לא אמרו בשם ר"ה או ר"ש,
And at first glance, behold, one must say a thing in the name of its sayer,
ולכאורה הרי צריכין לומר דבר בשם אומרו,
And as the statement<sup>6</sup>
וכמאמר<sup>6</sup>
Whoever says a thing in the name of its sayer brings redemption to the world,
כל האומר דבר בשם אומרו מביא גאולה לעולם,
Behold, according to the simple explanation, one can say that when must one say a thing in the name of its sayer? It is when the sayer of the thing said it to this one who says it, then he is required to say it in the name of its sayer,
הנה עפ"י פשוט י"ל שאימתי צריכים לומר דבר בשם אומרו הוא כשהאומר הדבר אמר לו זה האומרו אז הוא צריך לומר בשם אומרו,
And as with Mordechai and Esther, from where we learn this, that Mordechai said to Esther as it is written<sup>7</sup>
וכמו במרדכי ואסתר שמשם נלמד זה שאמר מרדכי לאסתר כמ"ש<sup>7</sup>
And he told Esther the queen,
ויגד לאסתר המלכה,
Then the one who hears from him is required to say it in the name of its sayer, as it is written<sup>7</sup>
אז צריך השומע ממנו לאמרו בשם אומרו כמ"ש<sup>7</sup>
And Esther said to the king in the name of Mordechai,
ותאמר אסתר למלך בשם מרדכי,
But not so in our case: Rabbi Shimon or Rabbi Shimon did not say this to Rabbi Chiyya, only to Rabbi Acha,
משא"כ בנדו"ד לא אמר זה ר"ה או ר"ש לר' חייא רק לר' אחא,
And Rabbi Chiyya, who happened to be there, heard this as well, but Rabbi Shimon or Rabbi Shimon did not say it to him,
ור' חייא שאירע התם שמע זה ג"כ אבל לא לו אמר ר"ה או ר"ש,
Then he is not obligated to say it in the name of its sayer,
אז אינו מחוייב לומר בשם אומרו,
For regarding this there is no proof from Mordechai and Esther, for there Mordechai said to Esther,
כי ע"ז אין ראי' ממרדכי ואסתר שהתם אמר מרדכי לאסתר,
And only when Rabbi Yossi asked him, 'From whom did you hear this?' then Rabbi Chiyya told him from whom he heard.
ורק כשר' יוסי שאלו ממאן שמעת לה אז סיפר לו ר"ח ממי שמע.
And based on this, it is also explained the language of "from whom did you hear it" and not "who told you",
ועפ"ז א"ש ג"כ הלשון דר"י ממאן שמעת לה ולא אמר מאן אמר לך,
it is because Rabbi Yosi understood that they did not say this exposition to Rabbi Chiya, because if so he would have said it in the name of its speaker..
הוא כי ר' יוסי הבין שלא אמרו דרוש זה לר' חייא כי א"כ הי' אומר לו בשם אומרו..
Therefore he asked "from whom did you hear it",
לכן שאלו ממי שמעת לה,
meaning not "who told you" but "from whom did you hear it",
היינו לא מאן אמר לך אלא ממאן שמעת לה,
that they did not say this to Rabbi Chiya, but rather Rabbi Chiya heard this".
שלא אמרו זה לר"ח אלא שר"ח שמע זה".

And it needs to be understood: saying a matter in the name of its speaker is not only a segulah for redemption as per the aforementioned words of our Sages "Whoever says a matter in the name of its speaker brings redemption to the world"
וצריך להבין: אמירת דבר בשם אומרו אינה רק סגולה לגאולה כמרז"ל הנ"ל "כל האומר דבר בשם אומרו מביא גאולה לעולם"
(whose source is in Tractate Avot,

"אמר רבי חזקי' אמר רבי ירמי' בר אבא בשם רבי יוחנן כל שאינו אומר דבר בשם אומרו עליו הכתוב אומר<sup>13</sup>
Do not rob the poor because he is poor, and a person, when he hears a thing, must say it in the name of its speaker"<sup>14</sup>].

And according to this, it is puzzling in what my master and father, of blessed memory, wrote, that simply one can say that the time when one must say a thing in the name of its speaker is when the speaker said it to this one who says it, then he must say it in the name of its speaker,

But regarding the prohibition of "Do not rob the poor", it is understood that it also applies when one hears a thing that was said to another person,
אבל בנוגע להלאו ד"אל תגזול דל" מובן ששייך גם כששומע דבר שנאמר לאדם אחר,
And on the contrary,
ואדרבה,
at first glance it is more in the category of "robbery"<sup>15</sup>
לכאורה הוי יותר בגדר "גזילה"<sup>15</sup>
from the author of the statement when he hears a thing that was said to another,
מבעל המאמר כששומע דבר שנאמר לאחר,
For the author of the statement did not intend to say it to him but to someone else,
שבעל המאמר לא נתכוין לאמרו אליו אלא למישהו אחר,
And it is as if he snatches and says what he heard from the mouths of others without mentioning the name of its speaker.
והוא כאילו חוטף ואומר מה ששמע מפי אחרים מבלי להזכיר שם אומרו.
And it must be said that it speaks here in a manner that there is not in this the prohibition of "Do not rob the poor."
ועכצ"ל שמדבר כאן באופן שאין בזה האיסור ד"אל תגזול דל".

And this will be understood with the introduction that we find several statements of our Sages that were not said in the name of their speaker,
ויובן זה בהקדם שמצינו כמה מאמרי רז"ל שלא נאמרו בשם אומרם,
as emphasized especially regarding Rabbi Eliezer the Great,
כמודגש במיוחד אצל רבי אליעזר הגדול,
that even though "he never said a thing that he did not hear from his teacher"<sup>16</sup>,
שאף ש"לא אמר דבר שלא שמע מפי רבו לעולם"<sup>16</sup>,
nevertheless there are many of his statements in which he did not mention the name of his teacher<sup>17</sup>,
מ"מ יש ריבוי מאמרים שלו שלא הזכיר בהם שם רבו<sup>17</sup>,
and why did he not care about that which anyone who does not say a thing in the name of its speaker transgresses a negative commandment.
ומדוע לא חש להא דכל שאינו אומר דבר בשם אומרו עובר בלאו.
[At first glance, one could say based on what is said in the Gemara<sup>18</sup>
[לכאורה יש לומר ע"פ מ"ש בגמ'<sup>18</sup>
"R' Elazar went and stated the teaching in the study hall and did not state it in the name of R' Yochanan; R' Yochanan heard and became angry, etc. R' Ami and R' Asi came to him and said to him, etc. And is it that for every matter that Yehoshua said, he would say to them, 'Thus said Moshe to me'? Rather, Yehoshua would sit and expound anonymously, and everyone knew that his Torah is from Moshe.

And based on this, one could say that in this manner it is also regarding R' Eliezer<pg>182</pg>

the Great,
הגדול,
who did not need to say his words in the name of his teacher because everyone knows that all his words are of his teacher<sup>20</sup>.
שלא הוצרך לומר דבריו בשם רבו כי הכל יודעים שכל דבריו הם של רבו<sup>20</sup>.
But at first glance it is forced to explain thus the conduct of Rabbi Eliezer the Great,
אבל לכאורה דוחק לתרץ כן הנהגת ר' אליעזר הגדול,
for from what he said "much Torah I learned and I did not lack from my teachers"<sup>21</sup>,

According to simple understanding, one must say that the prohibition of "Do not rob the poor" is like robbery in its simple sense,
ע"פ פשוט יש לומר דהלאו ד"אל תגזול דל" הוא ע"ד גזילה בפשטות,
that a matter about which the owner is not particular has no [issue of] robbery<sup>23</sup>,
שדבר שאין בעה"ב מקפיד עליו אין בו משום גזל<sup>23</sup>,
and likewise in matters of Torah, that the prohibition is only when the speaker is particular that the matter be said in his name,
ועד"ז בדברי תורה שהאיסור הוא רק כשהאומר מקפיד שיאמרו הדבר משמו,
but when he is not particular, there is no prohibition of "Do not rob the poor",
אבל כשאינו מקפיד ליכא הלאו דאל תגזול דל,
and therefore it is understood that Rabbi Eliezer did not transgress this, because his teachers were not particular about this.
ולכן מובן שר' אליעזר לא עבר ע"ז כי רבותיו לא היו מקפידים בזה.
But beyond the difficulty in the matter itself,
אבל נוסף על הדוחק בעצם הדבר,
that seemingly the teacher must explicitly announce that he is not particular, and it is not sufficient that the student knows this from reasoning
דלכאורה צריך הרב להודיע בפירוש שאינו מקפיד ולא מספיק שהתלמיד יודע זאת מסברא
[And further,
[ועוד,
that seemingly in order to nullify the obligation to say a matter in the name of its speaker due to the honor of one's teacher,
דלכאורה כדי לבטל חיוב לומר דבר בשם אומרו מחמת כבוד רבו,
it is not sufficient that his teacher only not be particular about this, but rather forgiveness is required],
אינו מספיק שרבו רק לא יקפיד ע"ז אלא צ"ל מחילה],

Even though Rabban Yochanan ben Zakkai said about his student Rabbi Eliezer that he is "a plastered cistern that does not lose a drop"<sup>27</sup>,
אף שריב"ז אמר על תלמידו ר"א שהוא "בור סוד שאינו מאבד טיפה"<sup>27</sup>,
it is understood that Rabbi Eliezer was not satisfied with knowledge of his teacher's Torah,
מובן שר"א לא הסתפק בידיעת תורת רבו,
but certainly he toiled and delved into understanding the matters until they were solidified in his intellect and his comprehension,
אלא ודאי התייגע והתעמק בהבנת הדברים עד שהם נתעצמו בשכלו והשגתו,
in a manner that he was convinced and understood the matters and they became his intellect,
באופן שהשתכנע והבין הדברים ונעשים שכלו,
and if so, what he said afterwards this thing is not a matter of repetition of his teacher's words alone but rather this thing was necessary from the side of his intellect.
וא"כ מה שאמר אח"כ דבר זה אינו ענין של חזרה על דברי רבו בלבד אלא שדבר זה הי' מוכרח מצד שכלו.
And as explained in various places<sup>28</sup>

regarding Tannaim and Amoraim,
לגבי תנאים ואמוראים,
that their rulings of laws were according to the root of their souls,
שפסקי הדינים שלהם היו ע"פ שורש נשמתם,
and like in the dispute of Beit Shammai and Beit Hillel,
וכמו בפלוגתא דב"ש וב"ה,
that Beit Shammai whose root is from the aspect of gevurot<pg>183</pg>
שב"ש ששרשם מבחי' הגבורות<pg>183</pg>
are stringent,
מחמירים,
and Beit Hillel whose root is from the aspect of chassadim are lenient<sup>29</sup>
וב"ה ששרשם מבחי' החסדים מקילים<sup>29</sup>
— for seemingly,
— דלכאורה,
the Torah is not in heaven<sup>30</sup>,
תורה לא בשמים היא<sup>30</sup>,
and how is it possible to rule according to the root of their souls?
וכיצד אפשר לפסוק ע"פ שורש נשמתם?
— but their ruling was after contemplation and exertion in their intellect as they are below,
— אלא שהפס"ד שלהם הי' לאחרי ההתבוננות והיגיעה בשכלם כפי שהם למטה,
souls in bodies specifically,
נשמות בגופים דוקא,
that is,
היינו,
that they were not satisfied with what was received by them from the aspect of the root of their souls,
שלא הסתפקו במה שהתקבל אצלם מצד שורש נשמתם,
but they exerted themselves in understanding and grasping the matter until they understood it thus in their intellect below in the body<sup>31</sup>].
אלא התייגעו בהבנת והשגת הענין עד שהבינו כך בשכלם למטה בגוף<sup>31</sup>].
And this matter,
וענין זה,
that a matter of Torah that becomes absorbed with his intellect is considered his,
שדבר תורה המתעצם עם שכלו ה"ה נחשב שלו,
we also find in halachah,
מצינו גם להלכה,
as it is brought in the Gemara<sup>32</sup>
כדאיתא בגמ'<sup>32</sup>
that "a teacher who forgives his honor, his honor is forgiven, as it is said<sup>33</sup>

because he becomes the owner of the Torah that he learned.

And now it is understood why my master, my father, and my teacher did not mention in the explanation of the words of the Zohar the prohibition of "Do not rob the poor" but only the matter of "brings redemption to the world" — because regarding Rosh Chodesh the matter of "Do not rob the poor" does not apply
ומעתה מובן מה שלא הזכיר אאמו"ר בביאור דברי הזהר האיסור ד"אל תגזול דל" אלא רק הענין ד"מביא גאולה לעולם" — כי גבי ר"ח לא שייך הענין ד"אל תגזול דל"
[As is proven from this very fact that Rosh Chodesh did not mention the name of the one who said the teaching until Rabbi Yosi asked him "From whom did you hear it"],

And this is because he toiled in the matter<sup>36</sup>

until he understood the thing with his intellect and internalized it,
עד שהבין הדבר בשכלו ונתעצם עמו,

[And similarly is that which my master, my father, and my teacher brought<sup>37</sup>

"That which we find in Chullin page 104 and in Keritot page 23 and in Niddah page 19 that they taught in the Mishnah the opinion of the first Tanna and afterwards the opinion of Rabbi Yosi,
"מה שמצינו בחולין דק"ד ובכריתות דכ"ג ובנדה די"ט ששנו במשנה דעת הת"ק ואח"כ דעת ר' יוסי,
and the Gemara there asks: Rabbi Yosi is the same as the first Tanna,
ופריך בגמרא שם ר' יוסי היינו ת"ק,
and it answers: This teaches us that the first Tanna is Rabbi Yosi,
ומתרץ הא קא משמע לן מאן ת"ק ר' יוסי,
all<sup>38</sup>

And behold, it is understood that the matter of "one who says a thing in the name of its speaker" that is stated in the chapter "Acquisition of Torah,"
והנה מובן דענין "האומר דבר בשם אומרו" שנאמר בפרק קנין תורה,
is not in a place where there is a prohibition,
אינו במקום שיש לאו,
but rather it is a matter of the quality of piety,
אלא הו"ע של מדת חסידות,
like the other matters in Pirkei Avot<sup>40</sup>.

And that is, that it does not deal with a tradition and a law

וזה שאומר דבר זה אינו משום שקיבלו מרבו אלא הוא ענין המיוחד לשכלו דוקא,
to the extent that all of it is his study and his explanation and his rationale,
ועד שכולו הוא לימוד ופירוש שלו וסברתו,
behold, even in this there is a special virtue
הנה גם בזה יש מעלה מיוחדת
(because of a matter of piety)
(משום מילתא דחסידותא)
when he says the thing in the name of its speaker.
כשאומר הדבר בשם אומרו.
And one must understand why in a case such as this, where this thing is verified in his intellect, there is in this the matter of "one who says a thing in the name of its speaker brings redemption to the world,"
וצריך להבין מדוע בנדון כזה שדבר זה נתאמת בשכלו יש בזה משום "האומר דבר בשם אומרו מביא גאולה לעולם",
since this saying is not because he heard the thing from the speaker but because he so understood in his intellect.
מאחר שאמירה זו היא לא לפי ששמע הדבר מהאומר אלא לפי שכן הבין בשכלו.
And on the other hand,
ולאידך,
since in this matter there is the concept of brings redemption to the world,
מכיון שבנדו"ז ישנו הענין דמביא גאולה לעולם,
what is the explanation in this that when the speaker did not say it to him but he heard when the other said it to another person,
מהי ההסברה בזה שכאשר האומר לא אמרו לו אלא הוא שמע כשהלה אמרו לאדם אחר,
in this there is not the segulah of "brings redemption to the world"
בזה ליכא הסגולה ד"מביא גאולה לעולם"
(as above section 1).

And this will be understood by prefacing the explanation of the concept of "one who says a thing in the name of its speaker" which is brought first in Tractate Avot in the Baraitha of the acquisition of Torah,
ויובן זה בהקדם ביאור הענין ד"האומר דבר בשם אומרו" שהובא לראשונה במס' אבות בברייתא דקנין תורה,
which is the last of the forty-eight things by which the Torah is acquired,
שהוא האחרון מהמ"ח דברים שהתורה נקנית בהם,
and afterwards it concludes "you have learned: anyone who says a thing in the name of its speaker brings redemption to the world, as it is said 'And Esther said to the king in the name of Mordechai'".
ולאח"ז מסיים "הא למדת כל האומר דבר בשם אומרו מביא גאולה לעולם שנאמר ותאמר אסתר למלך בשם מרדכי".
And it is understood from this,
ומובן מזה,
that even though the matter of the attribute of piety
דאף שהו"ע של מדת חסידות,
like the other matters in Pirkei Avot<sup>40</sup>,
כשאר הענינים שבפרקי אבות<sup>40</sup>,
and not an actual obligation,
ולא חיוב ממש,
nevertheless, this relates to the acquisition of Torah,
מ"מ ה"ז נוגע לקנין תורה,
and furthermore,
ועוד זאת,
from the fact that this matter is counted at the end of the forty-eight things
מזה שדבר זה נמנה בסוף המ"ח דברים
(which are counted from the light to the heavy),
(שנמנו מן הקל אל הכבד),
it implies,
משמע,
that in matters of piety of the acquisition of Torah itself,
שבמילי דחסידותא דקנין תורה גופא,
it is in a superior level and rank
הרי הוא במעלה ובמדריגה עליונה
(and afterwards it adds yet another level,
(ולאח"ז מוסיף עוד מעלה,
that it brings redemption to the world<sup>41</sup>).
שמביא גאולה לעולם<sup>41</sup>).
And the explanation of the matter:
וביאור הדבר:
Just as it is in the entirety of the Torah,
כשם שהוא בכללות התורה,
that the student must know the tradition, who received from whom, as the Tanna arranged at the beginning of Tractate Avot,
שהלומד צריך לידע המסורה מי קיבל ממי כמו שסידר התנא בריש מס' אבות,
and as the Rambam elaborated in his introduction to the book Yad, regarding the forty generations in the transmission of the Torah<sup>42</sup>,
וכפי שהאריך הרמב"ם בהקדמתו לס' היד בארבעים דורות שבמסירת התורה<sup>42</sup>,
so too is it in every particular matter in the halacha and the reasoning of the halacha,
עד"ז הוא בכל ענין פרטי בהלכה וסברת ההלכה,
even matters that he innovated on his own and the like,
אף דברים שחידש מעצמו וכיו"ב,
behold, when one says from which study hall this innovation comes — there is in this an aspect of strengthening the matter of the "tradition" in the Torah.
הרי כאשר אומרים מאיזה בית מדרש בא חידוש זה — יש בכך משום חיזוק ענין ה"מסורה" שבתורה.
And this is not only in matters that came from the mouth of the <pg>185</pg>
והיינו לא רק בדברים שבאו מפי ה<pg>185</pg>
A tradition or a law [given] to Moses from Sinai and the like,
שמועה או הלכה למשה מסיני וכיו"ב,
that in this there is no novelty [in] saying from whom he received this tradition<sup>43</sup>,
שבזה אין חידוש שאומר ממי קיבל שמועה זו<sup>43</sup>,
but also in matters dependent on reasoning,
אלא גם בדברים התלויים בסברא,
that a worthy student innovated<sup>44</sup>
שתלמיד ותיק חידש<sup>44</sup>
by means of one of the principles by which the Torah is expounded,
ע"י א' מהמדות שהתורה נדרשת בהן,
or by means of reasoning in the depth of the reasons of the laws<sup>45</sup>,
או ע"י סברות בעומק טעמי ההלכות<sup>45</sup>,
behold, the foundation and the "way of study" he received from his teacher
הרי את היסוד ו"דרך הלימוד" קיבל מרבו
(and the like),
(וכיו"ב),
therefore there is a matter to mention the name of his teacher<sup>46</sup>.
ולכן יש ענין להזכיר את שם רבו<sup>46</sup>.
And this is the inner explanation of that which it concludes "you have learned: whoever says a thing in the name of its speaker brings redemption to the world"
וזהו הפירוש הפנימי במה שמסיים "הא למדת כל האומר דבר בשם אומרו מביא גאולה לעולם"
(for at first glance,
(דלכאורה,
redemption to the world — what is it doing here?)
גאולה לעולם — מאי בעי הכא?)
— that the virtue in this, that even these things he says in the name of its speaker, is thus,
— שהמעלה בזה שגם דברים אלו אומר בשם אומרו היא כך,
that through this he reveals
שעי"ז מגלה
(redeemer)
(גואל)
the concealment of all matters of the Torah,
ההעלם דכל עניני התורה,
that the root and truth of all details of laws, explanations and reasoning that were innovated by each and every one is in that which was said to Moses from Sinai<sup>*46</sup>.
ששורש ואמיתית כל פרטי הלכות פירושים וסברות שנתחדשו ע"י כאו"א הוא במה שנאמר למשה מסיני<sup>*46</sup>.
That is,
והיינו,
that in addition to the knowledge of the entire Torah which he knows from its tradition up to Moses from Sinai,
דנוסף על הידיעה בכלל התורה שיודע מסורתה עד למשה מסיני,
he redeems every detail of the words of Torah,
הרי הוא גואל כל פרט מדברי תורה,
by means of this that he reveals the first speaker,
עי"ז שמגלים את האומר הראשון,
who is Moses our teacher from the mouth of the Almighty<sup>47</sup>.
שהוא משה רבינו מפי הגבורה<sup>47</sup>.

And according to all this perhaps one may explain the words of my master, my father, my teacher,
וע"פ כ"ז אולי יש לבאר דברי אאמו"ר,
"that simply it can be said that when one needs to say a thing in the name of its speaker is when the speaker said it to this person who says it,
"דעפ"י פשוט י"ל שאימתי צריכים לומר דבר בשם אומרו הוא כשהאומר אמרו לאדם זה האומרו,
but if he did not say it to him then he is not obligated to say it in the name of its speaker":
אבל אם לא אמר לו אז אינו מחוייב לומר בשם אומרו":
In the definition<sup>*47</sup>
בגדר<sup>*47</sup>
The Torah has two things:
התורה יש ב' דברים:
(a)
(א)
Transmission from generation to generation,
מסירה מדור דור,
(b)
(ב)
What Israel<sup>48</sup>
מה שישראל<sup>48</sup>
add and innovate in the Torah.
מוסיפים ומחדשים בתורה.
And like the Tannaim,
וכמו התנאים,
that "many matters
ש"כמה ענינים
(that)
(ש)
were innovated in the Oral Torah and only supported them on a verse"<sup>49</sup>
נתחדשו בתושבע"פ ורק אסמכוהו אקרא"<sup>49</sup>
And even there are "the decrees and enactments and customs"<sup>50</sup>
ועד שישנם "הגזירות והתקנות והמנהגות"<sup>50</sup>
that come entirely through the sages and even become Torah specifically through Israel,
שבאים לגמרי על ידי החכמים ועד שנעשו תורה דוקא על ידי ישראל,
because only matters that spread among Israel and the majority of the public can stand in them became a part of the Torah<sup>51</sup>.
כי רק דברים שנתפשטו בישראל ורוב הציבור יכולים לעמוד בהם נעשו חלק מהתורה<sup>51</sup>.
And this matter is from the essence of the definition of the Torah,
ודבר זה הוא מצד עצם גדר התורה,
because since the Torah is not in heaven but was given into the ownership of Israel,
כי כיון שהתורה לא בשמים היא אלא ניתנה לבעלותם של ישראל,
and the ruling of the laws of the Torah is according to what appears in their intellect,
ופסק דיני התורה הוא ע"פ הנראה בשכלם,
And even<pg>186</pg>
ועד<pg>186</pg>
The Holy One, blessed be He, laughed and said, "My children have defeated Me, My children have defeated Me"<sup>52</sup>,
שקוב"ה קא חייך ואמר נצחוני בני נצחוני<sup>52</sup>,
Therefore, the nature of the Torah is that there are such matters that came in a manner of innovation by the sages of Israel.
לכן הרי מגדר התורה הוא שישנם ענינים כאלו שבאו באופן של חידוש ע"י חכמי ישראל.
And these two modes also come in hearing words of Torah from one's teacher:
וב' אופנים אלו באים גם בשמיעת ד"ת מרבו:
(a)
(א)
A student whose teacher studies with him,
תלמיד שרבו לומד עמו,
(b)
(ב)
One who hears something that was not said to him,
השומע דבר שלא נאמר לו,
It is as if the matter became known to him on his own; and these are the two modes within the nature of the Torah — as it comes in tradition from one to another,
דהוי כאילו נודע לו הענין מעצמו; והם שני האופנים שבגדר התורה — כמו שהיא באה במסורה מא' לשני,
And as it comes on his own,
וכמו שהיא באה מעצמו,
Since that which he knows this matter in the Torah is not because his teacher or his friend told him, but he received it without the matter being transmitted to him specifically.
כיון שזה שהוא יודע ענין זה בתורה הוא לא לפי שרבו או חבירו אמר לו אלא הוא קיבל זה בלי שהדבר נמסר לו בייחוד.
And upon this depends the definition of saying "a thing in the name of its speaker": the obligation to say a thing in the name of its speaker emphasizes
ובזה תלוי הגדר דאמירת "דבר בשם אומרו": החיוב לומר דבר בשם אומרו מדגיש

the matter of transmitting all matters of Torah from generation to generation,
הענין דמסירת כל עניני התורה מדור לדור,
and this matter is when the speaker said it to him specifically
ודבר זה הוא כאשר האומר אמרו לו בייחוד
(even when afterwards the matter was verified through his intellectual vessel)
(גם כאשר אח"כ נתאמת הדבר בכלי שכלו)
; and the manner in which he is not obligated to say in the name of the speaker
; והאופן שאינו חייב לומר בשם אומרו
(also because of matters of Chassidus)
(גם משום מילי דחסידותא)
— when he heard the matter without the speaker speaking to him — comes to teach us this definition that is in the Torah that comes from the side of Israel who add and innovate in Torah
— כאשר שמע הדבר מבלי שהאומר ידבר אליו — בא ללמדנו גדר זה שבתורה שבא מצד ישראל המוסיפים ומחדשים בתורה
(not through transmission from generation to generation).
(לא ע"י מסירה מדור דור).

And based on this, it is possible to explain what my master, my father, and my teacher said in the continuation of his words,
ועפ"ז יש לבאר מ"ש אאמו"ר בהמשך דבריו,
that the reason for this that Rabbi Yosi asked him "from whom did you hear it?" is,
שהטעם לזה שר' יוסי שאלו ממאן שמעת לה הוא,
because "Rabbi Yosi specifically is particular that they say in the name of its speaker..
כי "ר' יוסי ביחוד מקפיד שיאמרו בשם האומרו..
even if the speaker did not say it to him, only that he heard from the speaker in the manner that was regarding Rosh Chodesh here, that Rabbi Huna did not say it to Rabbi Chisda, rather to Rav Acha, and Rabbi Chisda only heard
אפילו אם לא לו אמר האומר רק ששמע מהאומר ע"ד שהי' בר"ח כאן שלא לר"ח אמר ר"ה אלא לרב אחא ור"ח רק שמע
[and even more so that "in this discourse, Rabbi Chisda understood one thing from another thing..
[ויתירה מזו ש"בדרשה זו הי' ר"ח מבין דבר מתוך דבר..
Rabbi Chisda himself innovated them",
חדשם ר"ח בעצמו",
as my master, my father, and my teacher said here<sup>53</sup>]
כמ"ש אאמו"ר כאן<sup>53</sup>]
nevertheless, he also must say in the name of its speaker, and therefore he asked him 'from whom did you hear it?'".
עכ"ז ג"כ צריך לומר בשם אומרו ולכן שאלו ממאן שמעת לי'".
And he explains,
ומבאר,
that "R' Yosi's aspect is in the manner of the aspect of Esther, for Esther is the aspect of Malchus, and likewise R' Yosi is the aspect of Malchus."
כי "ר' יוסי בחינתו הוא ע"ד בחי' אסתר כי אסתר הוא בחי' מלכות וכן ר' יוסי הוא בחי' מלכות".
And the explanation of the matters,
וביאור הדברים,
for the sefirah of Malchus is the end of all levels,
כי ספירת המלכות היא סוף כל דרגין,
it has nothing of its own,
דלית לה מגרמא כלום,
and therefore in it is emphasized that even the innovations that come from the side of Israel are from the Holy One, blessed be He,
ולכן בה מודגש שגם החידושים הבאים מצד ישראל הם מהקב"ה,
and on the contrary, from a more elevated level<sup>54</sup>,
ואדרבה מדרגא נעלית יותר<sup>54</sup>,
from this aspect that Israel and the Holy One, blessed be He, are entirely one.
מצד זה שישראל וקוב"ה כולא חד.
And for this very reason the story came regarding R. Y. that at first he did not tell him from whom he heard it,
ומטעם זה גופא בא הסיפור בנוגע לר"י שמתחלה לא אמר לו ממי שמעו,
only after R. Y. asked him from whom did you hear it,
כ"א אחר שר"י שאלו ממאן שמעת לי',
[And similarly regarding the Mishnah in Chullin, Keritot, and Niddah that they taught in the Mishnah the opinion of Tanna Kamma and afterwards the opinion of R. Y.,
[וכן בנוגע להמשנה בחולין כריתות ונדה ששנו במשנה דעת ת"ק ואח"כ דעת ר"י,
that the Tanna did not mention his name at first and then repeated and mentioned his name,
שהתנא לא הזכיר שמו בתחלה וחזר והזכיר שמו,
it teaches us who is Tanna Kamma? R. Yosi],
הא קמ"ל מאן ת"ק ר' יוסי],
Because from the level of revelation as it is arranged according to the order of the chain of descent of the Torah
כי מצד דרגת הגילוי כפי שנסדר ע"פ סדר השתלשלות התורה
(both in the revealed part of Torah and in the inner dimension of Torah in the Zohar),
(הן בנגלה דתורה והן בפנימיות התורה בזהר),
there is not here the concept of mesorah, but rather its content is entirely from the innovation of Israel,
אין כאן הענין דמסורה אלא ענינו הוא כולו מצד החידוש דישראל,
and only from the perspective of Rabbi Yosi,
ורק מצד ר' יוסי,
the aspect of Malchus,
בחי' המלכות,
it is felt as it is from the aspect of the Essence<sup>55</sup>,
נרגש כמו שהוא מצד העצמות<sup>55</sup>,
that also the innovation that comes from the recipient,
דגם החידוש שמצד המקבל,
behold the power of the innovation itself is from the Holy One, blessed be He,
הרי כח החידוש גופא הוא מהקב"ה,
as above.
