The Rambam wrote in ch.6 of the Laws of Damages by Property<sup>1</sup>

: "An ox that was warned and was sold or given as a gift returns to its innocuousness, for the ownership that changed changes its law"
: "שור שהועד ונמכר או ניתן במתנה חזר לתמותו שהרשות שנשתנית משנה דינו"

And it is puzzling the reason for the change in the language of the Rambam,
וצע"ק טעם השינוי בלשון הרמב"ם,
that regarding change of ownership through sale or gift he stated "that the ownership that changed changes its law",
דגבי שינוי רשות דמכר או מתנה נקט "שהרשות שנשתנית משנה דינו",
and regarding a borrower he wrote "since its ownership changed the warning is nullified".
וגבי שואל כתב "הואיל ונשתנית רשותו בטלה ההעדה".

for seemingly it should have said that he is exempt because the status of an attested gorer has been nullified from the ox and "it has returned to its innocuous state" and consequently they are no longer liable for more than half-damages

And this will be understood with the introduction of the explanation and elucidation of this law of "change of ownership",

for at first glance it is puzzling: what reason is it said that a change of ownership will nullify the status of muad from the ox — for "muad" means
דלכאורה תמוה מה טעם נאמר דשינוי רשות יבטל דין מועד מהשור — הרי "מועד" פירושו
(in the language of the Rambam<sup>9</sup>)

"one who does an act that is his way to do it always",

And at first glance it is puzzling,

why should a change of ownership cause a change in the mazal and nature of the ox.

he wrote "A change of domain,

once it left this domain and came into the hands of other owners, the domain changes the law of its testimony."

And it appears to explain the intention of Rashi,
ונראה לפרש כוונת רש"י,
that the explanation is not that the nature of the ox changed,
שאין הפירוש שנשתנה טבע השור,
that the nature of goring was nullified from it,

but rather this is a matter of law,

But see the Meiri's method, who wrote explicitly that "the ox's going from domain to domain changes its mazal and nature"<sup>31</sup>.

And it can be said,

that the Meiri holds,

that the Rambam holds that the law of "change of ownership" includes both manners,

except that it depends in which manner: regarding a sale or a gift that is a change of ownership completely

It could be said that even though the ox was already returned to the domain of the owner,

דמ"ש הרמב"ם גבי אפוטרופוס "שהרי ברשות בעלים הן",
The intention is not only to the law of domain,
הכוונה לא רק לדין רשות,
But also "domain" in its simple sense,
אלא גם "רשות" בפשטות,
That regarding an administrator, the ox remains in the domain and house of the orphans,
דגבי אפוטרופוס נשאר השור ברשות ובית היתומים,
And if so, it is even more simple<sup>46</sup>
וא"כ פשוט יותר<sup>46</sup>
That the nature of the ox did not change when "the administrators were nullified"].
שטבע השור לא נשתנה כש"בטלו האפוטרופוסין"].

ו.
According to all the above, the law of "authority changes" in Remez will be well explained,
ע"פ כל הנ"ל יתבאר היטב הדין ד"רשות משנה" ברמז,
in the inner meaning of the matters:
בפנימיות הענינים:
"Ox" — refers to the animal soul in man,
"שור" — קאי על הנפש הבהמית שבאדם,
that one must guard it so that it does not do something undesirable, G-d forbid,
שצריך לשמור עלי' שלא תעשה דבר בלתי רצוי ח"ו,
and on the contrary,
ואדרבה,
one must utilize<pg>107</pg>
יש לנצל<pg>107</pg>
Also the power of the "ox" that is in man
גם את כח ה"שור" שבאדם
(his animal soul)
(נפשו הבהמית)
to matters of good and holiness.
לדברים של טוב וקדושה.
And since the animal soul of Israel is from the kelipah of nogah, which has good and evil,
וכיון שגם הנפש הבהמית שבישראל היא מקליפת נוגה שיש בה טוב ורע,
behold there are in its nature also good traits<sup>47</sup>,
הרי יש בטבעה גם מדות טובות<sup>47</sup>,
and furthermore,
ועוד זאת,
that from the essence of its nature the animal soul of Israel does not desire forbidden things but only permissible desires<sup>48</sup>.
שמצד עצם טבעה אין הנפש הבהמית שבישראל מתאווה לדברים אסורים אלא רק לתאוות היתר<sup>48</sup>.
And this is the matter of an ox that is tam
וזהו ענין שור תם
("the one that changes and does an act that is not the way of all its kind to do always"<sup>9</sup>)
("המשנה ועשה מעשה שאין דרך כל מינו לעשות כן תמיד"<sup>9</sup>)
in service,
בעבודה,
namely when it desires forbidden things
והיינו כשמתאווה לדברים אסורים
(which is not the nature of the animal soul of Israel)
(שאין זה טבעה של נפש הבהמית שבישראל)
until it stumbles, may G-d spare us, into a transgression,
ועד שנכשל ר"ל בעבירה,
that then it is in the category of "tam".
שאז ה"ה בגדר "תם".
And the matter of an "ox that is muad" is when "it has become accustomed to its deviation many times"<sup>9</sup>,
וענין "שור המועד" הוא כאשר "הרגיל בשינויו פעמים רבות"<sup>9</sup>,
that it repeats this act several times until it becomes habituated to it
שחוזר על מעשה זה כמה פעמים עד שמתרגל בו
(and it becomes for it as if permitted<sup>49</sup>),
(ונעשה לו כהיתר<sup>49</sup>),
that "it becomes muad for that thing to which it has become accustomed",
ש"נעשה מועד לאותו דבר שהרגיל בו",
meaning that the undesirable conduct becomes for him like a nature.
היינו שההנהגה הבלתי רצוי' נעשית אצלו כמו טבע.
And behold, in general,
והנה בדרך כלל,
the method to nullify the status of a forewarned ox is by means of that "it withdrew from the matter for which it was forewarned..
הסדר לבטל דין מועד בבהמה הוא ע"י ש"חזרה בה מדבר שהועדה לו..
An ox that was forewarned to gore and withdrew from goring..
שור שהועד ליגח וחזר שלא ליגח..
behold it is a tam regarding goring, and from when is its return? Until the children touch it and it does not gore"<sup>50</sup>,
ה"ז תם לנגיחה ומאימתי היא חזרתו עד שיהיו התינוקות ממשמשין בו ואינו נוגח"<sup>50</sup>,
and so it is in the spiritual aspects of matters,
וכן הוא ברוחניות הענינים,
that in order that the nature of his animal soul return to its "tamut"
שכדי שטבע נפשו הבהמית יחזור ל"תמותו"
(that this habituation be nullified from him)
(שתתבטל ממנו רגילות זו)
he must toil with his animal soul to nullify the force of his desires etc. until this evil nature is nullified
צריך להתייגע עם נפשו הבהמית לבטל תוקף תאוותיו כו' עד שמתבטל טבע רע זה
(to which he had accustomed himself),
(שהרגיל את עצמו בו),
and until he can test himself that he will not fall into this again
ועד שיוכל לבחון את עצמו שלא יפול בזה עוד פעם
(as per the saying of our Sages, of blessed memory,<sup>51</sup>
(ע"ד מחז"ל<sup>51</sup>
that "complete teshuvah"<sup>52</sup>
ד"תשובה גמורה"<sup>52</sup>
is when a matter that he transgressed comes into his hand,
היא שבא לידו דבר שעבר בו,
"in that same place etc.",
"באותו מקום כו'",
and nevertheless he is not ensnared).
ומ"מ אינו נכשל).

ז.
And regarding this there is instruction and learning from the law of "change of domain",
ועל זה יש הוראה ולימוד מהדין ד"רשות משנה",
that there is another way to nullify the status of "forewarned" from his animal soul,
שיש עוד אופן לבטל דין "מועד" מנפשו הבהמית,
and to elevate it from immersion in evil, heaven forbid,
ולהגביהה מההשקעה ברע ח"ו,
and it is through the concept of change of domain.
והוא ע"י הענין דשינוי רשות.
For even if the person did not work with his animal soul until he refined it,
דגם אם האדם לא עבד עם נפשו הבהמית עד שזיככו,
but rather changed his domain,
אלא ששינה רשותו,
that he immersed himself with his entire essence in a new world of holiness,
שהשקיע את עצמו בכל מהותו בעולם חדש דקדושה,
whether in the study of Torah or in the work of prayer or in deeds of lovingkindness,
אם בלימוד התורה או בעבודת התפילה או במעש"ט,
then automatically the dominion of the evil inclination in this matter to which he was accustomed was removed from him and "it returned to its tamut".
אזי בדרך ממילא הועברה ממנו שליטת היצר בענין זה שהי' מורגל בו ו"חזר לתמותו".
[And see what was explained elsewhere<sup>53</sup>
[וע"ד שנת' במ"א<sup>53</sup>
In explanation of the content of the matter: one of the ways of repentance is "change of name"<sup>54</sup>,
בפירוש תוכן הענין דא' מדרכי התשובה הוא "שינוי השם"<sup>54</sup>,
And as the Rambam wrote<sup>55</sup>
וכמ"ש הרמב"ם<sup>55</sup>
"And he changes his name, meaning: I am another and I am not that person who did those deeds",
"ומשנה שמו כלומר אני אחר ואיני אותו האיש שעשה אותן המעשים",
That the definition of this repentance is — a change of the person.
שהגדר דתשובה זו הוא — שינוי הגברא.
For in general, the matter of repentance that atones comes about through abandoning the sin,
דבכלל ענין התשובה המכפרת בא על ידי עזיבת החטא,
regret over the past and acceptance for the future<sup>56</sup>,
חרטה על העבר וקבלה על להבא<sup>56</sup>,
And when this repentance is in truth
וכאשר תשובה זו היא באמת
(up to "complete repentance" as above),
(עד ל"תשובה גמורה" כנ"ל),
then his iniquity is atoned for him;
אזי מתכפר לו עונו;
But the matter of "he changes his name" is,
אבל הענין ד"משנה שמו" הוא,
that when a person changes the entirety of his existence,
דכאשר האדם משנה כללות מציאותו,
And as the Rambam wrote there "and he changes all his deeds for the good",
וכמ"ש הרמב"ם שם "ומשנה מעשיו כולן לטובה",
behold, that they do not punish him for the transgressions he committed is not because he nullified his sins,
הרי זה שאין מענישים אותו על העבירות שעשה אינו מפני שביטל את חטאיו,
but rather because he has become a new existence,
אלא לפי שנעשה מציאות חדשה,
"I am not that person who did those deeds" and consequently the person who committed the transgressions is not before us to punish him].
"איני אותו האיש שעשה אותן המעשים" ובמילא האדם שעבר העבירות אינו לפנינו כדי להענישו].
And in this itself it is possible to say two ways:<pg>108</pg>
ובזה גופא אפ"ל ב' אופנים:<pg>108</pg>
A)
א)
That the nature of the animal soul did not change,
שטבע נה"ב לא נשתנה,
But that nevertheless it returned to its innocence,
אלא שמ"מ חזר לתמותו,
And in avodah [service] this means that the very revelation of the G-dly soul,
ובעבודה היינו שעוצם גילוי נפש האלקית,
Through its investment in the light of holiness in the domain
ע"י השקעתו באור הקדושה ברשות
(And its level)
(ומדריגתו)
The new,
החדשה,
Causes that his animal soul will be subjugated to the revelation of the light of holiness,
פועל שנפשו הבהמית תהי' כפופה לגילוי אור הקדושה,
And consequently the nature of evil
ובמילא טבע הרע
(That he became accustomed to previously)
(שנתרגל בו מקודם)
Does not affect him.
אינו פועל בו.
b)
ב)
In a deeper manner,
אופן עמוק יותר,
that he becomes like a completely new person,
שנעשה כאיש חדש ממש,
that this "change of domain",
ש"שינוי רשות" זה,
that he invested himself in the world of holiness,
שהשקיע את עצמו בעולם הקדושה,
affects all his matters in an internal way,
פועל בכל עניניו באופן פנימי,
until even the nature of his animal soul is changed and refined,
עד שגם טבע נפשו הבהמית נשתנה ונזדכך,
that his evil nature is entirely nullified from him,
שנתבטל ממנו כליל טבעו הרע,
and "returns to his temimus",
ו"חוזר לתמותו",
including the inner explanation of this — from the language of temimus and shleimus,
כולל הפירוש הפנימי בזה — מלשון תמימות ושלימות,
that he becomes "to be<sup>57</sup>
שמהתפך "להיות<sup>57</sup>
completely good,
טוב גמור,
like a yetzer tov literally".
כמו יצר טוב ממש".
