In our parshah are explained the last two positive commandments<sup>1</sup>

of the Torah — the commandment of Hakhel

("At the end of seven years etc. when all Israel etc. gather the people etc.")<sup>2</sup>

and the commandment of writing a Torah scroll
ומצות כתיבת ספר תורה
("And now write for yourselves etc.")<sup>3</sup>.

And according to the known<sup>4</sup>
וע"פ הידוע<sup>4</sup>
that "the order in the Torah — it is Torah",

the verse "And now write for yourselves this song" does not speak of writing a Torah scroll but refers to the song of Haazinu<sup>6</sup>

; and this song belongs specifically to the end of Moses' days,

"Behold you lie with your fathers and this people will rise up and stray etc. and My anger will burn etc. And now write for yourselves this song etc. so that it may be...

that it should be said to Bnei Yisrael specifically in immediate proximity to the passing of Moshe Rabbeinu — for behold many mitzvot were commanded to Israel,
שתאמר לבנ"י דוקא בסמיכות ממש להסתלקותו של משה רבינו — שהרי כו"כ מצות נצטוו ישראל,
and especially in Mishneh Torah<sup>9</sup>,

whose fulfillment is only in Eretz Yisrael after they will cross the Jordan and in the Beis HaMikdash and the like.

And since the time of this mitzvah is "at the end of seven years, at the appointed time of the year of Shemittah",

its place is apparently in continuation of the mitzvah of Shemittah

At first glance it is possible to answer,

the commandment of Hakhel is part of Moshe's words to Yehoshua,

in continuation of his words to him regarding the entry into the land — "for<sup>14</sup>
בהמשך לדבריו אליו ע"ד הכניסה לארץ — "כי<sup>14</sup>
you will bring this people to the land which He swore etc.",

that following this he commanded him regarding the commandment of Hakhel — "you shall read<sup>15</sup>

the mitzvah of Hakhel comes in continuation of the words of the command to Joshua regarding the coming and conquest of the land etc.
מצות הקהל באה בהמשך לדברי הצוואה ליהושע אודות ביאת וכיבוש הארץ כו'.
However, according to the halacha, clarification is needed regarding the commandment of writing a Sefer Torah
אמנם ע"ד ההלכה צריך ביאור בנוגע למצות כתיבת ס"ת
(for from the verse "And now write for yourselves etc." we derive the commandment of writing a Sefer Torah,

And one must explain the reason that there are two mitzvot so that there will always be a semblance of the giving of the Torah at Sinai:
ויש לבאר הטעם שישנם שתי מצות כדי שיהי' תמיד מעין קבלת התורה בסיני:
At the giving of the Torah at Mount Sinai there were
במ"ת בהר סיני היו

And as explained in the verse, the content of the mitzvah of Hakhel is "in order that they hear and in order that they learn and fear the Lord your God and observe to do all the words of this Torah, and their children who do not know will hear and learn to fear the Lord your God all the days etc." — meaning that the main emphasis is on fear of God which leads to the performance of the commandments; in contrast, the content of the mitzvah of writing a Sefer Torah is "And now write etc. and teach it to the children of Israel, place it in their mouths,"
וכמפורש בכתוב שתוכן מצות הקהל הוא "למען ישמעו ולמען ילמדו ויראו את ה' אלקיכם ושמרו לעשות את כל דברי התורה הזאת ובניהם אשר לא ידעו ישמעו ולמדו ליראה את ה"א כל הימים גו'" — היינו שעיקר ההדגשה היא על יראת ה' המביאה לידי עשיית המצות; משא"כ מצות כתיבת ס"ת תוכנה הוא "ועתה כתבו גו' ולמדה את בני ישראל שימה בפיהם",

And this distinction between these two mitzvos — we find also in halachah,

Regarding the mitzvah and matter of Hakhel, the Rambam wrote<sup>29</sup>
במצות וענין הקהל כתב הרמב"ם<sup>29</sup>
"It is a positive commandment to assemble all Israel, men, women, and children, etc., and to read in their ears from the Torah portions that encourage them in the mitzvos and strengthen their hands in the true religion,"

but nowadays that they write a Sefer Torah and place it in synagogues to read in it in public, it is a positive commandment upon every Jewish man whose hand reaches to write Chumashim of the Torah and Mishnah and Gemara and commentaries to ponder in them, he and his children,

ויש שיוצא י"ח בפסוק אחד שחרית ופסוק אחד ערבית
(as explained in the laws of Talmud Torah<sup>35</sup>),
(כמבואר בהלכות ת"ת<sup>35</sup>),
so also in the comprehension of the Torah they are different from one another,
הרי גם בהשגת התורה חלוקים זמ"ז,
that each one understands according to his level etc. — and therefore the commandment of writing a Sefer Torah,
שכל אחד מבין לפי ערכו כו' — ולכן מצות כתיבת ס"ת,
which is connected to the study and comprehension of the Torah,
השייכת ללימוד והשגת התורה,
is a commandment upon each and every individual by himself;
היא מצוה על כל יחיד ויחיד בפ"ע;
but not so regarding the performance of the commandments, for "one Torah and one law for all of us in the fulfillment of the entire Torah and commandments in the aspect of action"<sup>36</sup>
משא"כ בנוגע לעשיית המצות הרי "תורה אחת ומשפט אחד לכולנו בקיום כל התורה ומצות בבחי' מעשה"<sup>36</sup>
; and likewise regarding the matter of accepting the yoke of commandments — the fear that brings to the performance of the commandments
; וכן בענין קבלת עול מצות — היראה המביאה לידי עשיית המצות
("and they shall fear ... and they shall observe to do ...")
("ויראו גו' ושמרו לעשות גו'")
— for the acceptance of the yoke of the kingdom of heaven is above division and is equal for every soul — and therefore,
— דקבלת עול מלכות שמים היא למעלה מהתחלקות והיא שווה לכל נפש — ולכן,
also the commandment of Hakhel,
גם מצות הקהל,
whose purpose is to arouse Israel to fear of God and observance of the commandments,
שענינה לעורר את ישראל ליראת השם ושמירת המצות,
is an obligation of the community,
היא חובת הציבור,
which includes all the people of Israel equally.
הכולל את כל עם ישראל בשווה.
[And we find these two matters in the Giving of the Torah itself — that the entirety of the standing at Mount Sinai was for all of Israel as one,
[ומצינו שני ענינים אלה במ"ת גופא — שכללות מעמד הר סיני הי' לכל ישראל כאחד,
specifically at once,
בבת אחת דוקא,
in the singular<sup>37</sup>
ל' יחיד<sup>37</sup>

(And our Sages said<sup>38</sup>
(ואחז"ל<sup>38</sup>
that “if Israel were missing even one person” they would not have merited the Giving of the Torah),
ד"אילו היו ישראלים חסרים אפילו אדם אחד" לא היו זוכים למ"ת),
and on the other hand our Sages said<sup>39</sup>
ולאידך ארז"ל<sup>39</sup>
that one of the reasons that the Ten Commandments were stated in the singular — is because they were stated to each and every individual by himself.
שאחד מהטעמים שעשה"ד נאמרו בלשון יחיד — הוא משום שנאמרו לכל יחיד ויחיד בפ"ע.
And one could say,
ויש לומר,
that these two matters in the manner of the giving of the Torah correspond to the two matters that were given at Matan Torah: the giving of the Torah and the commandments to Israel in a manner equal to all — and from this side, Matan Torah includes the particulars of all of Israel as one entity; unlike the study of Torah that was given at Matan Torah,
ששני ענינים אלו באופן נתינת התורה הם בהתאם לשני הענינים שניתנו במ"ת: נתינת התורה ומצות לישראל באופן השווה לכל — ומצד זה הרי מתן תורה הוא כולל פרטי כלל ישראל כמציאות אחת; משא"כ לימוד התורה שניתן במ"ת,
it is in each one according to his level].
הוא בכאו"א לפי ערכו].

ו.
And behold, the reason and the need that from time to time
והנה הטעם והצורך לכך שמזמן לזמן
(every seven years<sup>40</sup>)
(בכל שבע שנים<sup>40</sup>)
they need to relive
צריכים לחיות מחדש

the event of Mount Sinai in Hakhel,
את מעמד הר סיני בהקהל,
and also that each one is obligated to write a Sefer Torah so that it will be "as if he received it from Mount Sinai"
וכן זה שכל אחד חייב לכתוב ס"ת שיהי' "כאילו קבלו מהר סיני"
— Even though all souls were at the time of the Giving of the Torah<sup>41</sup>
— אף שכל הנשמות היו בעת מ"ת<sup>41</sup>
as it is written<sup>42</sup>
כמ"ש<sup>42</sup>
"Those who are here with us..
"את אשר ישנו פה..
and those who are not here with us",
ואת אשר איננו פה",
and we were also commanded "Only<sup>43</sup>
וגם נצטווינו "רק<sup>43</sup>
take heed to yourself and guard your soul very much, lest you forget the things which your eyes saw, and lest they depart from your heart all the days of your life, and you shall make them known to your children and your children's children, the day you stood before the L-rd your G-d at Horeb"<sup>44</sup>
השמר לך ושמור נפשך מאוד פן תשכח את הדברים אשר ראו עיניך ופן יסורו מלבבך כל ימי חייך והודעתם לבניך ולבני בניך יום אשר עמדת לפני ה"א בחורב"<sup>44</sup>

It is because the main innovation of the event of Mount Sinai and the Giving of the Torah was not in the study of Torah and hearing the commandments of G-d,
הוא משום שעיקר החידוש דמעמד הר סיני ומ"ת הי' לא בלימוד התורה ושמיעת מצוות ה',
and especially that this was also before the Giving of the Torah by the Patriarchs etc.,
ובפרט שזה הי' גם קודם מ"ת אצל האבות כו',
rather the innovation was that then it was in a manner of seeing,
אלא החידוש הוא שאז הי' זה באופן של ראי',
as it is written "And all<sup>45</sup>
כמ"ש "וכל<sup>45</sup>
the people saw the sounds etc. You<sup>46</sup>
העם רואים את הקולות גו' אתם<sup>46</sup>
saw etc.",
ראיתם גו'",
"Show us<sup>47</sup>
"הראנו<sup>47</sup>
the L-rd our G-d Your glory etc.",
ה"א את כבודו גו'",
and this was "in order that
וזה הי' "בעבור
(for specifically through this one comes to the perfection which)
(שעי"ז דוקא באים להשלימות אשר)
His fear be upon your faces, that you may not sin"<sup>48</sup>.
תהי' יראתו על פניכם לבלתי תחטאו"<sup>48</sup>.
And as is known<sup>49</sup>
וכידוע<sup>49</sup>
that hearing is not comparable to seeing<sup>50</sup>,
דאינה דומה שמיעה לראי'<sup>50</sup>,
for hearing is from afar
דשמיעה היא מרחוק
(and therefore it can grasp only a spiritual thing like sound and the like,
(ולכן ביכולתה לתפוס רק דבר רוחני כמו קול וכה"ג,
and is grasped only by hearing — understanding and comprehension,
ונתפס רק בשמיעה — הבנה והשגה,
the spirituality of man),
רוחניות האדם),
but seeing is from near
משא"כ ראי' היא מקרוב
(and therefore seeing grasps a physical thing,
(ולכן ראי' תופסת בדבר גשמי,
and also affects the physicality of his body until the thing seen is actualized in the seer),
וגם פועלת על גשמיות גופו עד שהדבר הנראה מתאמת אצל הרואה),
and so it was at the Giving of the Torah,
וכן הי' במ"ת,
that "all the people see the sounds" — they see the audible<sup>51</sup>,
ש"כל העם רואים את הקולות" — רואים את הנשמע<sup>51</sup>,
and therefore it was actualized for each and every one of Israel that "I am the Lord your God" etc.
ולכן נתאמת אצל כאו"א מישראל ש"אנכי ה"א" וכו'.
And it can be said that this is the reason that in order for the generation after the generation of the Giving of the Torah and the coming generations to "fear the Lord your God and keep to do all the words of this Torah" — remembering the event of Mount Sinai is not sufficient — that one remembers a thing that was in the past,
וי"ל שזהו הטעם שבכדי שהדור שלאחרי דור מ"ת והדורות הבאים "יראו את ה"א ושמרו לעשות את כל דברי התורה הזאת" — אינה מספיקה זכירת מעמד הר סיני — שזוכר דבר שהי' בעבר,
for then the person is at a distance from the thing; rather there must be a special matter,
שאז האדם הוא בריחוק מהדבר; אלא צ"ל ענין מיוחד,
the commandment of Hakhel,
מצות הקהל,
that all Israel,
שכל ישראל,
men, women, and children,
אנשים נשים וטף,
gather together as at the event of Mount Sinai "and he will see himself<pg>193</pg>
נקהלים יחד כמו במעמד הר סיני "ויראה עצמו<pg>193</pg>
as if now commanded in it and from the mouth of the Almighty hears it, that the king is an agent to make heard the words of G-d.
כאילו עתה נצטווה בה ומפי הגבורה שומעה שהמלך שליח הוא להשמיע דברי האל".
And so it is in the commandment of writing a Sefer Torah,
וכן הוא במצות כתיבת ס"ת,
that specifically when he writes it himself,
שדוקא כאשר כותבו בעצמו,
that he acts in himself and in his action,
שפועל בעצמו ובמעשה שלו,
then it is "as if he received it from Mount Sinai",
אזי הוי "כאילו קבלו מהר סיני",
in the manner of the proof of the Giving of the Torah that
ע"ד הראי' דמ"ת ש

(גם)
the physical body of the person — was with awe and fear and trembling and sweat<sup>52</sup>.
הגוף הגשמי של האדם — הי' באימה וביראה וברתת ובזיעה<sup>52</sup>.

ז.
Even though in this time,
אע"פ שבזמן הזה,
when there is no Holy Temple, the mitzvah of Hakhel is not in its simple form,
שאין ביהמ"ק אין מצות הקהל כפשוטה,
it is understood,
הרי מובן,
that just as it is with all matters dependent on the Temple
שכשם שהוא בכל הדברים התלויים במקדש
(sacrifices etc.)
(קרבנות וכו')
— that spiritually they exist also now,
— שברוחניות ישנם גם עתה,
and as our Sages said<sup>53</sup>
וכמחז"ל<sup>53</sup>
prayer in place of sacrifices they instituted,
תפלה במקום קרבנות תקנום,
there exists a parallel to this<sup>54</sup>
ישנו מעין זה<sup>54</sup>
in the mitzvah of Hakhel<sup>55</sup>.
במצות הקהל<sup>55</sup>.
That through the addition and strengthening in this awakening that each one does — by gathering men, women, and children who belong to him,
שע"י ההוספה וחיזוק בהתעוררות זו שכאו"א עושה — ע"י שמקהיל אנשים נשים וטף השייכים אליו,
and awakening them regarding the study of Torah and fulfillment of the commandments,
ומעוררם ע"ד לימוד התורה וקיום המצות,
and in general — "to fear the Lord your God",
ובכלל — "ליראה את ה"א",
this effects in those gathered — "they are reminded and they do" — to fear all the days as if now they were commanded in it from the mouth of the Almighty with the force of the vision at the Giving of the Torah,
הרי זה פועל בהנקהלים — "נזכרים ונעשים" — ליראה כל הימים כאילו עתה נצטווה בה מפי הגבורה בתוקף הראי' דמ"ת,
And that this hastens and speeds the fulfillment of the prophecy, and may our eyes see Your return to Zion with mercy and to Jerusalem, the house of Your Sanctuary, the third Holy Temple,
ועד שזה ממהר ומזרז קיום היעוד ותחזינה עינינו בשובך לציון ברחמים ולירושלים בית מקדשך ביהמ"ק השלישי,
with the coming of "the King Messiah" who will read this Torah,
בביאת "המלך המשיח" שיקרא בו את התורה הזאת,
in the true and complete redemption,
בגאולה האמיתית והשלימה,
and speedily in our very own days.
ובמהרה בימינו ממש.
