In Rashi at the beginning of our portion: "Judges and officers" — judges are the decisors who decide the law,

who coerce the people to follow their command<sup>2</sup>

And it is written in the commentaries<sup>3</sup>,

That is to say, in addition to the appointment of the "judges"

And even more puzzling — that specifically here,

Rashi elaborates more than in his commentary in Parshat Devarim: there he wrote briefly "these are the binders and those who strike with a strap by the order of the judges",

and here he adds: a)

At the beginning of the commentary — "the rulers<sup>8</sup>

Also there are several changes in Rashi's language:

And therefore it seems to say,

that according to Rashi, the "officers" here and the "officers" in Parshat Devarim are not the same,
דלפרש"י ה"שוטרים" דהכא וה"שוטרים" דפ' דברים לאו היינו הך,
but rather they are two types of officers:
אלא הם שני סוגי שוטרים:
In parshas Devarim it stands regarding "officers" who are the ones who carry out the ruling of the court,
בפ' דברים קאי ב"שוטרים" שהם המוציאים בפועל את הוראת הב"ד,
that the judges decide what the punishment is,

and the officers are the ones who punish in practice.
והשוטרים הם המענישים בפועל.
And in our parshah it stands regarding officers whose function is to threaten the defendant that he accept upon himself the judgment of the judge.
ובפרשתנו קאי בשוטרים שענינם לאיים על הנדון שיקבל עליו את דין השופט.
That is, not the execution of the court's ruling,
היינו לא ביצוע הוראת הב"ד,
but rather to compel the defendant that he accept upon himself to fulfill the court's ruling
אלא לכפות את הנדון שהוא יקבל על עצמו לקיים הוראת הב"ד
(such as one whom the court ruled that he is obligated to pay money to his fellow and he does not want to pay,
(כגון מי שפסקו הב"ד שחייב לשלם ממון לחבירו ואינו רוצה לשלם,
that the officers compel him to pay the money)<sup>13</sup>.

And with this are explained the differences of language between the two commentaries of Rashi mentioned above:

In Parshat Devarim he writes that the officers are "those who bind and strike etc. according to the judges,"
בפ' דברים כותב שהשוטרים הם "הכופתין והמכין כו' על פי הדיינין",
that is,
היינו,
that they carry out in practice the instructions of the judges,
שהם מקיימים בפועל את הוראות פי הדיינין,
and therefore he wrote "these are the ones who bind and strike with a strap" — in accordance with the order of the punishment of lashes,
ולכן כתב "אלו הכופתין והמכין ברצועה" — בהתאם לסדרו של עונש מלקות,
that at first they bind the one being lashed<sup>14</sup>,
שבתחילה כופתין את הנלקה<sup>14</sup>,
and afterwards they strike him with a strap.

But in our parshah Rashi writes that the officers are "those who coerce the people...
משא"כ בפרשתנו כותב רש"י שהשוטרים הם "הרודין את העם..
until he accepts upon himself the judgment of the judge",

that this is the second manner of the officers — that they coerce the litigant
שזהו האופן השני שבשוטרים — שכופים את בעל הדין
("they coerce the people"),

"until he accepts upon himself the judgment of the judge".
"עד שיקבל עליו את דין השופט".
And therefore it is not written here "according to the judges" but "after their command",

meaning that their function is not

to carry out the instruction of the court

(and not as in parshas Devarim — "they bind and beat")

— because here the intent is to coerce the defendant to accept the judgment upon himself,
— כי כאן הכוונה לכפיית הנדון לקבל עליו את הדין,
and therefore Rashi enumerates two modes of coercion from the light to the severe: "they beat
ולכן מונה רש"י שני אופני הכפי' מן הקל אל הכבד "מכין
(and if this does not help —)
(ואם אין זה מועיל —)
and they bind"
וכופתין"
(meaning that they restrain him etc.).

In parshas Devarim it mentions only "strap" and not<pg>100</pg>

"Makel" — because the punishment of lashes is with a strap<sup>16</sup>
"מקל" — כי עונש מלקות הוא ברצועה<sup>16</sup>
and not striking with a stick<sup>17</sup>
ולא הכאה במקל<sup>17</sup>
; but not so in our parshah where the intent is to the officers "who rule over the people" that they will fear the judge and accept upon themselves the judgment of the judge,
; משא"כ בפרשתנו שהכוונה לשוטרים "הרודין את העם" שייראו מהשופט ויקבלו עליהם את דין השופט,
they need

And on the contrary — Rashi precedes "Makel" because this is a sign of "ruling"<sup>18</sup>.

And one must say the explanation in this:

"Judge" in the Torah
"שופט" בתורה
(in the plain sense)

is not only a judge who decides the law,
אינו רק דיין הפוסק את הדין,
but also the one who executes the law in practice<sup>20</sup>,
אלא גם זה המבצע את הדין בפועל<sup>20</sup>,
and as explained above at the end of Parshat Balak<sup>21</sup>,
וכמפורש לעיל בסוף פ' בלק<sup>21</sup>,
that Moses said "to the judges of Israel, slay each man his men."
שאמר משה "אל שופטי ישראל הרגו איש אנשיו".
And it is explained in Rashi there "slay each man his men — each and every one of the judges of Israel would kill two etc."
ומפורש ברש"י שם "הרגו איש אנשיו — כל אחד ואחד מדייני ישראל הי' הורג שנים כו'".
And likewise later regarding the punishment of lashes it is explicit in the verse<sup>22</sup>
וכן לקמן בעונש מלקות מפורש בקרא<sup>22</sup>
"and the judge shall cause him to fall and strike him etc."
"והפילו השופט והכהו וגו'".
And based on this it is understood that it is impossible to explain that "officers" here are those who carry out the sentence in practice
ועפ"ז מובן שא"א לפרש ש"שוטרים" כאן הם המבצעים את גזר הדין בפועל
(as in Parshat Devarim)
(כבפ' דברים)
— for this is included in the command of "judges..
— שהרי זה נכלל בהציווי ד"שופטים..
you shall give for yourself."

And it is not comparable to "and officers for your tribes" in Parshat Devarim,
ואינו דומה ל"ושוטרים לשבטיכם" דפ' דברים,
that Rashi explained that it was a separate appointment<sup>23</sup>
שפרש"י שהי' מינוי בפ"ע<sup>23</sup>
over "those who bind and strike..
על "הכופתין והמכין..
according to the judges" — because in the verse there the judges were not called by the name "judges"<sup>24</sup>
על פי הדיינין" — כי בכתוב שם לא נקראו הדיינים בשם "שופטים"<sup>24</sup>
(rather as it is stated "And I took the heads of your tribes, wise and well-known men, and I appointed them as heads over you, captains of thousands etc."),
(כ"א כנאמר "ואקח את ראשי שבטיכם אנשים חכמים וידועים ואתן אותם ראשים עליכם שרי אלפים גו'"),
and it is understood that what is stated afterwards "and officers for your tribes" can be interpreted as those who carry out the instructions of the judges in practice<sup>25</sup>

And therefore Rashi here<sup>27</sup>

that the intention is to those "who coerce the people according to the command

But still needs explanation — to the other side:

Since it is possible to explain that "shotrim" are "those who rule the people" — from where does Rashi have to explain in Parshat Devarim that "shotrim" there means "those who bind and strike...
כיון שאפשר לפרש ש"שוטרים" הם "הרודין את העם" — מנ"ל לרש"י לפרש בפ' דברים ש"שוטרים" שם היינו "אלו הכופתין והמכין..
according to the judges"?

And especially that we find in several places

that the judges themselves carry out the judgment in practice,

and from where does Rashi have that there was a special appointment for such shotrim?

Rashi hints at the necessity for his interpretation,

by the extra wording there "And officers — I appointed over you for your tribes these are the binders etc.'",

for at first glance,

the novelty in Rashi there is<sup>23</sup>

that the officers are an appointment in themselves

(and not that the judges that he gave "heads over you" are themselves the officers),

which is a commandment for generations,

in every situation that may be,

therefore they were commanded to appoint "shotrim" — "who coerce the people...

And it requires explanation — why did Rabbi Yochanan mention only "a staff and a strap" and omit the other tools of the judges that were mentioned before this — "a shofar and a sandal"?

Regarding the "sandal" that is for chalitzah, one can answer,

And everything they see as a perverted matter they bring him to the court and they judge him according to his wickedness" — behold, these police are not those who execute the verdict of the judges,

And in this way another question is simply resolved regarding the commandment of appointing "judges and officers":
ובדרך זו מתורצת בפשיטות עוד שאלה במצות מינוי "שופטים ושוטרים":
All enumerators of the commandments counted the appointment of judges and officers as one commandment,
כל מוני המצות מנו מינוי שופטים ושוטרים במצוה אחת,
even though superficially they are two separate actions,
אף שלכאורה הם שני מעשים נפרדים,
the appointment of judges and the appointment of officers
מינוי שופטים ומינוי שוטרים
(as emphasized in the language of the baraita<sup>38</sup>

"From where [do we derive] that judges are appointed for Israel? The verse states 'Judges you shall appoint,'

— and why were they not enumerated as two commandments?

“If there are officers there are judges; if there are no officers there are no judges”,
"אם יש שוטרים יש שופטים אם אין שוטרים אין שופטים",
and in the Tanchuma<sup>43</sup>
ובתנחומא<sup>43</sup>
“If there is no officer there is no judge,
"אם אין שוטר אין שופט,
how so,
כיצד,
since when a person is obligated in court to his fellow, if there is no officer to extract from him, because when he departs from the judge, the judge has no power to do anything to him unless he hands him over to the officer”,
כיון שנתחייב אדם בב"ד לחבירו אם אין שוטר שיוציא ממנו כיון שפורש מן הדיין אין ספוק ביד הדיין לעשות לו כלום אא"כ מוסר ביד השוטר",
and it is found that “through these and these together the judgment is completed”.
ונמצא ש"על ידי אלו ואלו יחד המשפט נגמר".
But it is forced to explain thus,
אבל דוחק לתרץ כן,
for in practical law it is not mentioned in the Rambam that judges and officers hinder each other,
שהרי להלכה למעשה לא נזכר ברמב"ם ששופטים ושוטרים מעכבים זא"ז,
and simply, even if they are unable
ובפשטות גם אם אין יכולים
(for whatever reason)

to appoint officers,

they are obligated in the appointment of judges<sup>44</sup>.

that without officers it is possible that the matter of judgment will not come to fruition — but in practice they are obligated to appoint judges even without officers<sup>45</sup>.
שבלי שוטרים יתכן שענין המשפט לא יבוא לידי פועל — אבל למעשה חייבים במינוי שופטים גם בלי שוטרים<sup>45</sup>.
And it is possible that the matter of judgment will come to fruition even without

And furthermore, primarily there is need and necessity for "judges" to instruct in all matters of the Torah

Seemingly, one can say based on the words of the Rambam<sup>41</sup>

(regarding techelet and white that were counted as one commandment,
(לענין תכלת ולבן שנמנו כמצוה אחת,
even though they do not impede each other)
אף שאינן מעכבין זא"ז)
"that even the parts that do not impede each other sometimes will be<pg>104</pg>

One mitzvah when the matter is one" — and indeed also in our case
מצוה אחת כשיהי' הענין אחד" — והרי גם בנדו"ד

"Certainly judges and police officers their matter is one."
"ודאי שופטים ושוטרים ענינם אחד הוא".
But still one can discuss this,
אבל עדיין יש לדון בזה,
because the aforementioned rule in the Rambam was not stated and established in every place,
כי הכלל הנ"ל שברמב"ם לא נאמר וקיים בכל מקום,
and as the commentators elaborated<sup>47</sup>
וכמו שהאריכו במפרשים<sup>47</sup>
to raise difficulties upon it and among them — from the matter of tefillin of the hand and of the head were counted as two mitzvot,
להקשות עליו ומהם — מהא דתפילין של יד ושל ראש נמנו בשתי מצות,
and "behold the tefillin are considered more one matter
ו"הרי התפילין יחשבו יותר ענין אחד

" — and they answered that in tefillin they are "two actions"

And based on this, also in our subject — behold, the appointment of the judges and the appointment of the officers are "two actions,"
ועפ"ז גם בנדו"ד — הרי מינוי השופטים ומינוי השוטרים הם "שני מעשים",
and also in their content "there is a great difference between them" — and the difficulty returns to its place,
וכן בתוכנם "יש בהם שינוי רב" — והדרא קושיא לדוכתא,
why were they not counted as two commandments?
מדוע לא נמנו כשתי מצות?
And according to what we have learned regarding the nature of the officers — the matter is resolved simply:

If the matter of the officers is to uphold and carry out the verdict of the judges in practice,

and "judges" are only those who instruct and rule the law — then it turns out that the matter of judgment is divided

The meaning of the Torah in Rashi's commentary:

Known are the words of the Shach on the Torah<sup>52</sup>,
ידועים דברי הש"ך עה"ת<sup>52</sup>,
that "Judges and officers you shall appoint for yourself in all your gates" also refers to "the gates of the body",
ש"שופטים ושוטרים תתן לך בכל שעריך" קאי נמי על "שערי הגוף",
the eyes and the ears etc.,
העינים והאזנים וכו',
"to teach a person that he should have an officer and a ruler over each and every one of these limbs etc."
"ללמד לאדם שיהי' לו שוטר ומושל על כל אחד ואחד מאלו האיברים כו'".
And behold, simply,
והנה בפשטות,
the distinction between "judges" and "officers" in this matter is,
החילוק בין "שופטים" ל"שוטרים" בענין זה הוא,
that the appointment of "judges"

is fulfilled through the study of the laws of the Torah,

לדעת את המעשה אשר יעשון ואלה אשר לא תעשינה; ומינוי "שוטרים" מתקיים ע"י קיום הלכות התורה במעשה בפועל.
But according to what was explained above, it is understood,
אבל ע"פ משנת"ל מובן,
that also the matters of the "deed" are included in the appointment of "judges" itself<pg>105</pg>
שגם עניני ה"מעשה" נכללים במינוי "שופטים" גופא<pg>105</pg>
(Like "judges" simply, whose role is also to carry out their judgment,

for "the purpose of wisdom is repentance and good deeds"<sup>53</sup>,

that then one needs an "officer" — to incite his good inclination against his evil inclination<sup>56</sup>,

but only "judges" — the study of Torah and the fulfillment of the commandments,
כי אם רק "שופטים" — לימוד התורה וקיום המצות,
"they will go from strength to strength" in holiness itself<sup>59</sup>.
