The author wrote at the beginning of the laws of Sukkah<sup>1</sup>
כתב המחבר בריש הלכות סוכה<sup>1</sup>
: "In sukkot you shall dwell seven days etc. for in sukkot I settled the children of Israel<sup>2</sup>,
: "בסוכות תשבו שבעת ימים וגו' כי בסוכות הושבתי את בני ישראל<sup>2</sup>,
they are clouds of glory that surrounded them so that<sup>3</sup>
הם ענני כבוד שהקיפם בהם לבל<sup>3</sup>
the heat and sun should not strike you."
יכם שרב ושמש".
And its source is in the Tur there,
ומקורו בטור שם,
which brings the language of the verses<sup>2</sup>
שמביא לשון הכתובים<sup>2</sup>
"In sukkot you shall dwell seven days etc. so that your generations may know that in sukkot I settled the children of Israel when I brought them out etc.",
"בסוכות תשבו שבעת ימים וגו' למען ידעו דורותיכם כי בסוכות הושבתי את בני ישראל בהוציאי אותם וגו'",
and in the continuation of the matter he explains,
ובהמשך הענין מבאר,
that "the sukkot that the verse says I settled them in are clouds of His glory<sup>4</sup>
ש"הסוכות שאומר הכתוב שהושיבנו בהם הם ענני כבודו<sup>4</sup>
that surrounded them so that the heat and sun should not strike them and an example of this He commanded us to make sukkot so that we remember His wonders and His awesome deeds."

And it requires explanation: Is it not the way of the author to explain the reasons of the laws or to bring their source in the Written Torah,
וצריך ביאור: הלא אין דרכו של המחבר לבאר טעמי ההלכות או להביא מקורן בתושב"כ,
but only to rule the law in practice?
אלא רק לפסוק הלכה למעשה?
And the later authorities explained<sup>5</sup>
וביארו באחרונים<sup>5</sup>
that this is a law,
שזוהי הלכה,
that there is an obligation to intend at the time of fulfilling the commandment of dwelling in the sukkah that it is a memorial to the "clouds of glory that surrounded them etc."
שיש חיוב לכוון בשעת קיום מצות ישיבה בסוכה שהיא זכר ל"ענני כבוד שהקיפם כו'".
And it is in the manner of the words of the Bach<sup>6</sup>,
והוא ע"ד דברי הב"ח<sup>6</sup>,
who asked this question on the Tur
שהקשה קושיא זו על הטור
(that "he elaborated to explain and expound the verse 'In sukkot you shall dwell'"),
(ש"האריך לבאר ולדרוש המקרא דבסוכות תשבו"),
and he explains,
ומבאר,
"that he holds that since it is written 'so that they shall know etc.' he did not fulfill the commandment properly if he did not know the intention of the commandment of the sukkah according to its simple meaning."
"שסובר דכיון דכתיב למען ידעו כו' לא קיים המצוה כתיקונה אם לא ידע כוונת מצות הסוכה כפי פשטה".
Except that the Beit Yosef disagrees with the Bach regarding the essence of this intention<sup>7</sup>,
אלא שהב"י פליג על הב"ח במהותה של כוונה זו<sup>7</sup>,
for the Bach holds that "the main intention in sitting in the sukkah is that he remember the Exodus from Egypt"<sup>8</sup>

(and according to his approach this is the intention of the Tur, who explained here the reason that "the Torah linked the commandment of sukkah to the Exodus from Egypt",

to inform us that the commandment of sukkah is a remembrance of the Exodus from Egypt)

for I caused the children of Israel to dwell in sukkot, they are the Clouds of Glory etc.'),

for in his opinion a person must intend only this, that the commandment of sukkah is a remembrance of the Clouds of Glory.

[And with this is also understood the precise wording of the Alter Rebbe in his Shulchan Aruch<sup>1</sup>,

that he changed from the language of the author and copied

(as in the Tur)

also the end of the verse "when I brought them out of the land of Egypt",

for the Alter Rebbe ruled<sup>10</sup>

according to the approach of the Bach that "every person must<sup>11</sup>

intend in his sitting in the sukkah that he sits in order to fulfill the commandment of the Holy One, blessed be He, who commanded us to sit in the sukkah as a remembrance of the Exodus from Egypt",

and therefore he copied the words "when I brought them out of the land of Egypt" at the beginning of the section,

for this is the main point of "so that they know",

the knowledge and intention that the commandment of sukkah is a remembrance of the Exodus from Egypt].

And one must examine this,
ויש לעיין בזה,
for according to this, the author should have written explicitly "and he should intend in his sitting etc."<sup>12</sup>,
דלפ"ז הו"ל להמחבר לכתוב בפירוש "ויכוין בישיבתו כו'"<sup>12</sup>,
in the manner that he wrote in the laws of tzitzis<sup>13</sup>
ע"ד שכתב בהל' ציצית<sup>13</sup>
"he should intend when wrapping himself etc. so that we remember etc.",
"יכוין בהתעטפו כו' כדי שנזכור כו'",
and similarly in the laws of tefillin<sup>14</sup>
וכן בהל' תפילין<sup>14</sup>
he wrote "he should intend when laying them etc. so that we remember etc."
כ' "יכוין בהנחתם כו' כדי שנזכור כו'"
[And as explained in the Bach<sup>15</sup>,
[וכמבואר בב"ח<sup>15</sup>,
that regarding these three commandments,
שבשלש מצות אלה,
tzitzis, tefillin, and sukkah,
ציצית תפילין וסוכה,
"the essence of the commandment and its fulfillment depends on its intention",
"עיקר המצוה וקיומה תלוי' בכוונתה",
since it is stated regarding them<sup>16</sup>
כיון שנאמר בהן<sup>16</sup>
"in order that etc."].

And more difficult,
ויותר קשה,
that also in the Tur here he did not write "and he should intend etc.",
דגם בטור כאן לא כתב "ויכוין כו'",
as he wrote regarding tzitzis and tefillin<sup>17</sup>,
כמ"ש גבי ציצית ותפילין<sup>17</sup>,
and simply the reason for this is,
ובפשטות הטעם לזה הוא,
because he copied from the verse also the words "in order that your generations may know",
לפי שהעתיק מהכתוב גם התיבות "למען ידעו דורותיכם",
in which it is explicit that the commandment is knowledge and intention<sup>18</sup>,
שבזה מפורש שהמצוה היא ידיעה וכוונה<sup>18</sup>,
therefore there is no place to write that a person needs to intend because this is explicit in the language of the verse that he brought.
ולכן אין מקום לכתוב שהאדם צריך לכוין כי זה מפורש בלשון הכתוב שהביא.
And based on this, it will be puzzling regarding the author,
ועפ"ז ייפלא בהמחבר,
that he omitted these words
שהשמיט תיבות אלו
("so that your generations may know"),
("למען ידעו דורותיכם"),
and in his language there is not
ואין בלשונו
("In sukkot you shall dwell..
("בסוכות תשבו..
for I caused the children of Israel to dwell in sukkot..
כי בסוכות הושבתי..
they are clouds of glory etc.'")
הם ענני כבוד כו'")
only an explanation of the reason for the commandment and there is in this no instruction and command to man.
אלא ביאור טעם המצוה ואין בזה הוראה וציווי אל האדם.
And therefore it seems to explain the intention of the author
ולכן נראה לפרש כוונת המחבר
(not that this reason is part of the intention of the commandment,

that in this reason and verse he explains the definition of the commandment of sukkah,

that in this there is a practical difference for several laws,

And this will be understood according to the language of the Alter Rebbe there,
ויובן זה ע"פ לשון אדה"ז שם,
that he wrote: "In sukkot you shall dwell seven days, so that your generations may know that I caused the children of Israel to dwell in sukkot when I brought them out of the land of Egypt,
שכתב: "בסוכות תשבו שבעת ימים למען ידעו דורותיכם כי בסוכות הושבתי את בני ישראל בהוציאי אותם מארץ מצרים,
they were clouds of His glory that He encircled them with for shade, so that the heat and sun should not strike them,
הם היו ענני כבודו שהקיפם בהם לצל לבל יכה בהם שרב ושמש,
and corresponding to this He commanded us to make sukkot that are made for shade, so that we may mention His wonders and awesome deeds."
ודוגמא לזה צונו לעשות סוכות העשויות לצל כדי שנזכיר נפלאותיו ונוראותיו".
And one must clarify the content of the addition of the Alter Rebbe to the language of the Tur
ויש לברר תוכן הוספת אדה"ז על לשון הטור
(and the Shulchan Aruch)

"clouds of His glory that He encircled them with for shade, so that the heat and sun should not strike them",
"ענני כבודו שהקיפם בהם לצל לבל יכה בהם שרב ושמש",
for seemingly that they were "for shade" is included in what is said "so that the heat and sun should not strike them",
דלכאורה זה שהיו "לצל" נכלל במ"ש "לבל יכה בהם שרב ושמש",
and what does he add by saying "for shade".
ומאי מוסיף במ"ש "לצל".
And similarly in the continuation of his language,
ועד"ז בהמשך לשונו,
the Alter Rebbe adds to the language of the Tur — "and corresponding to this He commanded us to make sukkot that are made for shade",
מוסיף אדה"ז על לשון הטור — "ודוגמא לזה צונו לעשות סוכות העשויות לצל",
these words
שתיבות אלו
("that are made for shade")
("העשויות לצל")
are not in the Tur.
ליתא בטור.
And we must say,
ויש לומר,
that it teaches us a beneficial point,
דטובא קמ"ל,
that from this that the verse attributes the mitzvah of sukkah to "the clouds of His glory with which He surrounded them for shade",
דמזה שהכתוב תולה מצות סוכה ב"ענני כבודו שהקיפם בהם לצל",
we infer,
שמעינן,
that the definition of the mitzvah of sukkah is that it must be "made for shade"<sup>19</sup>.
שגדרה של מצות סוכה הוא שצ"ל "עשוי' לצל"<sup>19</sup>.
And this is that in addition to this that one of the conditions of the sukkah is that its shade must be greater than its sunlight<sup>20</sup>,
והיינו שנוסף לזה שמתנאי הסוכה הוא שצ"ל צלתה מרובה מחמתה<sup>20</sup>,
behold its definition<pg>142</pg>

and essence of the sukkah
ומהותה של סוכה
(of the mitzvah)

is — a sukkah made for shade
הוא — סוכה העשוי' לצל
(and a sukkah that lacks this condition does not have the name sukkah at all).
(וסוכה שחסר בה תנאי זה אין עלי' שם סוכה כלל).
[And one should say,
[ויש לומר,
that this matter is from the practical halachic differences between the two opinions<sup>21</sup>,
שענין זה הוא מהנפק"מ להלכה בין שתי הדיעות<sup>21</sup>,
if "I caused the children of Israel to dwell in sukkot" means "actual sukkot" or "clouds of glory": according to the opinion that they were "actual sukkot",
אם "בסוכות הושבתי" היינו "סוכות ממש" או "ענני כבוד": להדיעה שהיו "סוכות ממש",
the primary definition of a sukkah is a temporary dwelling<sup>22</sup>,
עיקר גדר סוכה הוא דירת עראי<sup>22</sup>,
like the sukkot that the Jewish people made in the desert,
ע"ד הסוכות שעשו ישראל במדבר,
which were "a temporary dwelling"<sup>23</sup>

; but according to the opinion that they were "clouds of glory",

the sukkot that we make are a remembrance
הסוכות שאנו עושין הם זכר

of this detail of the clouds of glory,

"that He surrounded them with them for shade so that the heat of the sun and the sun should not strike them"

and therefore the definition of a sukkah is that it is made for shade<sup>24</sup>].

And this foundation is explicit in the language of the Alter Rebbe immediately at the beginning of the following section<sup>25</sup>
ויסוד זה מפורש בלשון אדה"ז תיכף בריש הסימן שלאחריו<sup>25</sup>
(in which he begins to explain the laws of the actual making of the sukkah),
(שבו מתחיל לבאר דיני עשיית הסוכה בפועל),
that he wrote "A person does not fulfill his obligation except with a sukkah that is made only for shade, like the clouds of glory, but if it is made also for dwelling..
שכ' "אין אדם יוצא י"ח אלא בסוכה שאינה עשוי' אלא לצל בלבד דוגמת ענני כבוד אבל אם היא עשוי' גם לדירה..
and not to take shelter in its shade alone,
ולא להסתופף בצלה בלבד,
or it is made also to use it for a modest use..
או שעשוי' גם להשתמש בה תשמיש של צניעות..
or it is made also for a shelter and a refuge from a storm and from rain,
או שהיא עשוי' גם למחסה ולמסתור מזרם וממטר,
any [sukkah] that is not made for shade alone is not a sukkah but a house etc.".
כל שאינה עשוי' לצל בלבד אין זו סוכה אלא בית כו'".
In the Gemara<sup>26</sup>
דבגמ'<sup>26</sup>
this condition is mentioned only regarding the fitness of a stolen sukkah
נזכר תנאי זה רק לענין כשרות סוכת גנב"ך
(for even though these sukkahs were not made for the sake of the mitzvah,
(דאף שסוכות אלה לא נעשו לשם מצוה,
nevertheless they are fit if they were made for the sake of shade),
מ"מ כשירות באם נעשו לשם צל),
but the Alter Rebbe writes that this is a condition for every sukkah<sup>27</sup>,
אבל אדה"ז כותב שזהו תנאי בכל סוכה<sup>27</sup>,
to the extent that the intention of its making must be solely for "shade only",
ועד שכוונת עשייתה צ"ל אך ורק לשם "צל בלבד",
without admixture of any other intention<sup>28</sup>

And it can be said that therefore the Alter Rebbe began the laws of making a sukkah with this law

(and likewise in the Shulchan Aruch)
(ועד"ז בשו"ע)
who did not mention this law here at all,
שלא הזכיר כאן כלל דין זה,
and begins the siman with the laws of "the fit place
ומתחיל הסימן בהלכות ה"מקום הראוי
(for making a sukkah)
(לעשיית סוכה)
how?<sup>31</sup>,
כיצד<sup>31</sup>,
that he should make it under the air of the heavens, as it is written "in sukkot you shall dwell" and they expounded<sup>32</sup>
שיעשנה תחת אויר השמים דכתיב בסוכות תשבו ודרשינן<sup>32</sup>
"and not in a sukkah that is under a sukkah, and not in a sukkah that is under a house, and not in a sukkah that is under a tree"],
ולא בסוכה שתחת סוכה ולא בסוכה שתחת הבית ולא בסוכה שתחת האילן"],
since this is not one of the conditions of the sukkah,
כיון שאין זה אחד מתנאי הסוכה,
but rather this is the definition of a sukkah,

that "any [sukkah] that is not made for shade alone is not a sukkah."

And based on this, it can be said,

his intention is to define,

that also the sukkot that we were commanded to make,

And one should add to this,
ויש להוסיף בזה,
and immediately,
ובהקדם,
that it is puzzling in what the Alter Rebbe added the word "for shade" — "His clouds of glory that surrounded them for shade so that it should not strike etc." — for even though this is in accordance with the continuation of his language "He commanded us to make sukkot that are made for shade"
שצ"ע במה שהוסיף אדה"ז תיבת "לצל" — "ענני כבודו שהקיפם בהם לצל לבל יכה כו'" — דאף שזהו בהתאם להמשך לשונו "צונו לעשות סוכות העשויות לצל"
(as above),
(כנ"ל),
this is a repetition of language,
ה"ז כפל לשון,
and even if he had written only "so that the scorching heat and sun should not strike them" the continuation to this that "He commanded us to make sukkot that are made for shade" would be understood.
וגם אם הי' כותב רק "לבל יכה בהם שרב ושמש" הי' מובן ההמשך לזה ש"צונו לעשות סוכות העשויות לצל".
And according to the above that the intention of the Alter Rebbe here is to define the essence of a sukkah in halachah,
וע"פ הנ"ל שכוונת אדה"ז כאן להגדיר מהותה של סוכה בהלכה,
it can be said,
י"ל,
that even this precision pertains to halachah.
שגם דיוק זה נוגע להלכה.
And this will be understood by first introducing the difference in plain meaning between "for shade" or "so that sun and heat should not strike them": In "so that sun and heat should not strike them" the benefit to the person sitting in the sukkah is emphasized,
ויובן זה בהקדם החילוק בפשטות בין "לצל" או "לבל יכה בהם שרב ושמש": ב"לבל יכה בהם שרב ושמש" מודגש התועלת לאדם היושב בסוכה,
that the heat of the sun does not strike him; in "for shade" the existence of the "shade" is emphasized
שחום השמש אינו מכה בו; ב"לצל" מודגש מציאות ה"צל"
(created by the sukkah)

as an entity in itself.

And it can be said,

that the practical difference between them concerns the matter that its shade must be greater than its sunlight,

whether this is a measure regarding the roofing,
אם זהו שיעור בהסכך,
that its shade should be greater than its sunlight<sup>33</sup>,
שתהי' צלתו מרובה מחמתו<sup>33</sup>,
or that the main point is that regarding the person sitting in the sukkah the shade should be greater than the sunlight.
או שהעיקר הוא זה שאצל האדם היושב בסוכה יהי' הצל מרובה מהחמה.
And according to this — in that the Alter Rebbe adds that the clouds of glory were "for a shade, so that the sun and heat should not strike them" hints,
ולפ"ז — בזה שאדה"ז מוסיף שענני כבוד היו "לצל לבל יכה בהם שרב ושמש" מרמז,
that in the shade of the sukkah there are two aspects:
שבצל סוכה יש שני דינים:

From the aspect of the sechach — in the manner of the clouds of glory that were "for a shade",
מצד הסכך — ע"ד ענני הכבוד שהיו "לצל",

(ב)
From the aspect of the person,
מצד האדם,
just as the clouds of glory effected that "they should not be struck"
כמו שענני הכבוד פעלו ל"בל יכה בהם

by sun and heat".

And with this we can explain the words of the Alter Rebbe regarding the law that its shade is greater than its sunlight,

and his language is<sup>34</sup>

The sechach is more than the air, but if they are equal, it is invalid, because the sun that enters the air of the sechach, when it reaches the ground of the sukkah, spreads more than it is above in the air of the sechach, and it turns out that the sukkah below on its ground has more sun than shade.
הסכך מרובה מן האויר אלא הן שוין פסולה לפי שהחמה הנכנסת באויר הסיכוך כשהיא מגיעה לקרקעית הסוכה מתפשטת יותר ממה שהיא למעלה באויר הסיכוך ונמצא שהסוכה למטה בקרקעיתה היא חמתה מרובה מצלתה",
And in the next section

he continues "But if below on its ground its sun and its shade are equal, it is kosher, because it is known that above in the sechach the air is less than the sechach, and its shade above is more than its sun
ממשיך "אבל אם למטה בקרקעיתה היא חמתה וצלתה שוין כשרה לפי שידוע שלמעלה בהסכך האויר הוא מועט מן הסיכוך וצלתה למעלה היא מרובה מחמתה<sup>36</sup>
And this is complete sechach."
וה"ז סכך גמור".
And at first glance his words contradict each other,
ולכאורה דבריו סותרים זא"ז<sup>37</sup>,
that from his words in the first law it follows that if the shade and the sun are equal, it should be a kosher sukkah,
שמדבריו בדין הראשון יוצא שאם הצל והחמה שוין הי' צ"ל סוכה כשרה,
and the reason we invalidate it is only because "the sukkah below on its ground has more sun than shade",
והטעם שפסלינן לה הוא רק משום "שהסוכה למטה בקרקעיתה היא חמתה מרובה מצלתה",
whereas from his words in the second law it follows the opposite, that if the shade and the sun are equal, this is not sufficient to validate the sukkah,
ואילו מדבריו בדין השני יוצא להיפך שאם הצל והחמה שוין אין זה מספיק להכשיר הסוכה,
and that the sukkah is kosher when they are equal below is only because "its shade above is more than its sun".
וזה שהסוכה כשירה כשהם שווין למטה הוא רק משום "שצלתה למעלה היא מרובה מחמתה".
Also, one must understand the precision of his language there that "if below..
גם יש להבין דיוק לשונו שם ד"אם למטה..
its sunlight and its shade are equal, it is valid according to..
חמתה וצלתה שוין כשרה לפי..

its shade above is greater than its sunlight and this is "complete s'chach" which seemingly is superfluous language,

And why is the reason that "its shade above is greater than its sunlight" not sufficient?
ולמה לא מספיק הטעם ש"צלתה למעלה היא מרובה מחמתה"?
And based on the above, one can say,
וע"פ הנ"ל יש לומר,
that the measure of s'chach "above" and the measure of s'chach "below" are two different laws,
ששיעור סכך "למעלה" ושיעור סכך "למטה" הם שני דינים שונים,
different in their essential definition<sup>38</sup>

: The law of the shade of the sukkah relative to the person
: הדין דצל סוכה כלפי האדם
("below"),
("למטה"),
is primarily a negative law,
הוא בעיקר דין שלילי,
i.e., it is invalid if by him its sunlight is greater than its shade,
היינו פסול אם אצלו חמתה מרובה מצלתה,
because then it is not similar to the Clouds of Glory that caused "that the scorching heat and sun should not strike them"
כיון שאז אינו דומה לענני הכבוד שפעלו "לבל יכה בהם שרב ושמש"
(but if they are equal, there is no invalidity here)
(אבל אם הם שווין אין כאן פסול)
; however, the law regarding the s'chach of the sukkah
; משא"כ הדין בסכך הסוכה
("above")
("למעלה")
is a positive matter,
הוא ענין חיובי,
that the s'chach of the sukkah should be "for shade",
שסכך הסוכה יהי' "לצל",
and this is specifically when "its shade is greater than its sunlight",
וזהו דוקא כאשר "צלתו מרובה מחמתו",
for then it is "complete s'chach"
שאז הוא "סכך גמור"
(but also when they are only equal, there is no invalidity here,
(אבל גם כשהם רק שווים אין כאן פסול,
rather it is not "complete s'chach" — according to the precise language of the Alter Rebbe).
אלא שאינו "סכך גמור" — כדיוק ל' אדה"ז).
And this is the difference between the two laws: the first law comes to teach us the law of the measure of the roofing "below",
וזהו החילוק בין שני הדינים: הדין הראשון בא ללמדנו דין שיעור סכך "למטה",
which is invalid as above,
שהוא פסול כנ"ל,
and therefore the reason that they invalidate the sukkah when above its shade and its sun are equal,
ולכן הטעם שפוסלים הסוכה כאשר למעלה צלתה וחמתה שווין,
is because "the sukkah below..
הוא לפי "שהסוכה למטה..
its sun is more than its shade"
חמתה מרובה מצלתה"
(and because of this the name "invalid" applies to the sukkah<sup>39</sup>)
(ומשום זה חל על הסוכה שם "פסול"<sup>39</sup>)
; and the second law comes to inform us of the measure of the roofing "above",
; והדין השני אתי לאשמעינן שיעור סכך "למעלה",

that this is a positive law,

that "complete roofing" is only when its shade is more than its sun,

it is not a valid sukkah

since there is no "complete roofing" in it).

And furthermore it must be said,
ויתר על כן יש לומר,
that in this that in the definition of the mitzvah of sukkah the Alter Rebbe emphasizes that the sukkah is "for shade"
שבזה שבהגדרת מצות סוכה מדגיש אדה"ז שהסוכה היא "לצל"
(as above),
(כנ"ל),
his intention is to hint,
כוונתו לרמז,
that the primary definition of the sukkah is not that for a person it is forbidden to have a situation of "its sunnier side is greater than its shaded side"
שעיקר גדר הסוכה אינו זה שאצל האדם אסור להיות מצב של "חמתה מרובה מצלתה"
(in the manner of "neither sun nor heat shall strike them"),
(ע"ד "בל יכה בהם שרב ושמש"),
but rather the obligation<sup>40</sup>,
אלא החיוב<sup>40</sup>,
that the sechach be made "for shade"<sup>41</sup>,
זה שהסכך יהי' עשוי "לצל"<sup>41</sup>,
"its shaded side is greater than its sunnier side".
"צלתה מרובה מחמתה".
And the practical difference: if the sechach above its shaded side is greater than its sunnier side,
ונפק"מ למעשה: אם הסכך למעלה צלתו מרובה מחמתו,
but the sukkah below its sunnier side is greater than its shaded side<sup>42</sup>
אבל הסוכה למטה חמתה מרובה מצלתה<sup>42</sup>
(by this "that the sun that enters the airspace of the sechach when it reaches the floor of the sukkah spreads more than it is above in the airspace of the sechach"),
(עי"ז "שהחמה הנכנסת באויר הסיכוך כשהיא מגיעה לקרקעית הסוכה מתפשטת יותר ממה שהיא למעלה באויר הסיכוך"),
and it is found that above there is "complete sechach",
ונמצא שלמעלה יש "סכך גמור",
but below there is a disqualification of its sunnier side is greater than its shaded side.
אבל למטה יש פסול דחמתה מרובה מצלתה.
And behold, it stands to reason to say,
והנה מסתבר לומר,
that since there is a disqualification in the sukkah,
דכיון שיש פסול בהסוכה,
if so, what does it help that above there is "complete sechach".
א"כ מה מועיל זה שיש למעלה "סכך גמור".
But according to the above
אבל ע"פ הנ"ל
(that the essential definition of the sukkah is that the sechach is made "for shade")
(שעיקר גדר הסוכה הוא מה שהסכך יהי' עשוי "לצל")
it can be said,
יש לומר,
that if above there is "complete sechach",
שאם למעלה יש "סכך גמור",
we do not take into account what is done below on the floor of the sukkah; for only when above they are equal
אין מתחשבים בהנעשה למטה בקרקעית הסוכה; דרק כשלמעלה הם שווין
(and there is no "complete sechach")
(ואין כאן "סכך גמור")
then the sukkah is disqualified when below its sunlight is greater than its shade,
אזי הסוכה פסולה כשלמטה חמתה מרובה מצלתה,
but if above there is "complete sechach",
אבל אם למעלה יש "סכך גמור",
it does not matter to us what is below, that its shade is not greater than its sunlight,
לא נפק"מ לן מה שלמטה אין צלתה מרובה מחמתה,
since the essential definition of the sukkah is that the sukkah
כיון שעיקר גדר הסוכה הוא זה שהסוכה
(namely the sechach)
(היינו הסכך)
is "made for shade".
"עשוי' לצל".
[And based on this, perhaps one may add explanation in the addition of the Alter Rebbe,
[ועפ"ז אולי יש להוסיף ביאור בהוספת אדה"ז,
that he adds
שמוסיף
(as above)
(כנ"ל)
that when "its shade above is greater than its sunlight" it is kosher because "it is complete sechach" — it can be said,
דכש"צלתה למעלה היא מרובה מחמתה" כשרה משום ש"ה"ז סכך גמור" — שיש לומר,
that his intention in this is also to teach us,
שכוונתו בזה גם ללמדנו,
that when a person makes "complete sechach"
שכאשר האדם עושה "סכך גמור"
(that its shade is greater than its sunlight),
(שצלתה מרובה מחמתה),
it does not matter to us what is below, that its shade is not greater than its sunlight<sup>43</sup>,
לא נפק"מ לן מה שלמטה אין צלתה מרובה מחמתה<sup>43</sup>,
since the essential definition of the sukkah is that the sukkah
כיון שעיקר גדר הסוכה הוא זה שהסוכה
(namely the sechach)
(היינו הסכך)
is "made for shade"].
"עשוי' לצל"].

ו.
And behold, the explanation of the above in the words of the Alter Rebbe,
והנה ביאור הנ"ל בדברי אדה"ז,
that his intention
שכוונתו
(at the beginning of Hilchos Sukkah)
(בריש הל' סוכה)
is to define the essence of a sukkah
להגדיר מהותה של סוכה
(and not to explain the reasons for the commandment or its intention)
(ולא לבאר טעמי המצוה או כוונתה)
is also proven from the continuation of his language in this section,
מוכח ג"כ מהמשך לשונו בסעיף זה,
that after he brought the words of the Tur and the Shulchan Aruch "In sukkot you shall dwell..
שלאחרי שהביא דברי הטור והשו"ע "בסוכות תשבו..
In sukkot I caused the children of Israel to dwell..
בסוכות הושבתי..
they were clouds of His glory that surrounded them for shade..
הם היו ענני כבודו שהקיפם בהם לצל..
And corresponding to this He commanded us to make sukkot made for shade etc.",
ודוגמא לזה צונו לעשות סוכות העשויות לצל כו'",
he continues
ממשיך
(in the words of the Magen Avraham,
(בדברי המג"א,
from the Bach)
מהב"ח)
"And so every person needs<pg>146</pg>
"וכן צריך כל אדם<pg>146</pg>
to intend in his sitting in the sukkah that he sits in it in order to fulfill the commandment of the Holy One, blessed be He, who commanded us to sit in the sukkah as a remembrance of the Exodus from Egypt".
לכוין בישיבתו בסוכה שיושב בה כדי לקיים מצות הקב"ה שצונו לישב בסוכה זכר ליציאת מצרים".
His holy words "And so every person must intend etc.'",
דצע"ק לשונו "וכן צריך כל אדם לכוין כו'",
for ostensibly it should have said "And every person must intend etc.'",
דלכאורה הול"ל "וצריך כל אדם לכוין כו'",
(since before this he did not mention any intention that a person must intend)<sup>44</sup>?
(שהרי לא הזכיר לפנ"ז איזו כוונה שצריך האדם לכוין)<sup>44</sup>?
And now, according to the words of the later authorities mentioned above
והנה ע"פ דברי האחרונים הנ"ל
(another opinion)
(ס"א)
that according to the author one must intend that the mitzvah of sukkah is a remembrance of the miracle of "For I caused the children of Israel to dwell in sukkot",
שלדעת המחבר צריכים לכוון שמצות סוכה היא זכר לנס ד"בסוכות הושבתי את בנ"י",
that He encompassed them with clouds of glory etc.,
שהקיפם בענני כבוד כו',
ostensibly it can be said,
לכאורה יש לומר,
that this is the intention of the Alter Rebbe,
שזוהי כוונת אדה"ז,
that at first he brought the words of the
שבתחילה הביא דברי ה
(Tur and)
(טור ו)
Shulchan Aruch that the sukkot are a remembrance of the clouds of glory
שו"ע שהסוכות הם זכר לענני כבוד
[And in particular,
[ובפרט,
that
אשר
(a)
(א)
the Alter Rebbe also copies the words "so that your generations may know"<sup>45</sup>,
אדה"ז מעתיק גם התיבות "למען ידעו דורותיכם"<sup>45</sup>,
(b)
(ב)
he copies the continuation of the language of the Tur "and as a parallel to this He commanded us to make sukkot..
מעתיק המשך לשון הטור "ודוגמא לזה צונו לעשות סוכות..
in order that we recall His wonders and His awesome deeds",
כדי שנזכיר נפלאותיו ונוראותיו",
and that is,
והיינו,
that a person must intend this at the time of his sitting in the sukkah],
שהאדם צריך לכוון זה בעת ישיבתו בסוכה],
and afterwards he adds,
ואח"כ מוסיף,
"And so every person must intend in his sitting in the sukkah
"וכן צריך כל אדם לכוין בישיבתו בסוכה
[an additional intention<sup>46</sup>,
[עוד כוונה<sup>46</sup>,
namely]
דהיינו]
that he sits in it in order to fulfill the commandment of the Holy One blessed be He..
שיושב בה כדי לקיים מצות הקב"ה..
a remembrance of the Exodus from Egypt".
זכר ליציאת מצרים".
But it is forced to explain thus the wording of the Alter Rebbe,
אבל דוחק לתרץ כן לשון אדה"ז,
that his wording is a clear wording,
שלשונו היא לשון ברורה,
that if his intention was that a person should intend at the time of his sitting in the sukkah
דאם כוונתו היתה שהאדם צריך לכוין בעת ישיבתו בסוכה
(or at the time of making the sukkah)
(או בעת עשיית הסוכה)
that it is a memorial to the clouds of glory,
שהיא זכר לענני כבוד,
he should have said so explicitly<sup>46</sup>.
הול"ל כן בפירוש<sup>46</sup>.
And therefore it appears to explain the words of the Alter Rebbe,
ולכן נראה לפרש דברי אדה"ז,
that from this that "In sukkot you shall dwell..
שמזה ש"בסוכות תשבו..
in order that they know..
למען ידעו..
that in sukkot I caused to dwell..
כי בסוכות הושבתי..
they are..
הם..
the clouds of His glory etc.'",
ענני כבודו כו'",
two matters branch out:
מסתעפים שני ענינים:
(a)
(א)
The law regarding the manner of making the sukkah — "and as an example of this He commanded us to make sukkot that are made for shade, so that we should remember etc.'",
דין באופן עשיית הסוכה — "ודוגמא לזה צונו לעשות סוכות העשויות לצל כדי שנזכיר כו'",
that one is obligated "to make sukkot that are made for shade"
שחייבים "לעשות סוכות העשויות לצל"
[i.e., "for shade only",
[דהיינו "לצל בלבד",
as above],
כנ"ל],
and this law is not a matter of the intention of the commandment
ודין זה אינו ענין של כוונת מצוה
(that a person must intend at the time of making the sukkah that it is a reminder of the clouds of glory),
(שהאדם צריך לכוין בעת עשיית הסוכה שהיא זכר לענני הכבוד),
but rather the essence of the object of the sukkah,
אלא עצם החפצא של הסוכה,
that since it is "made for shade",
להיות ש"עשוי' לצל",
it is a reminder of the clouds of glory "with which He surrounded them for shade"<sup>47</sup>.
היא זכר לענני כבוד "שהקיפם בהם לצל"<sup>47</sup>.

"And likewise every person must intend in his sitting in the sukkah that he sits in it in order to fulfill the commandment of the Holy One, blessed be He, who commanded us to sit in the sukkah as a reminder of the Exodus from Egypt" — in addition to the law regarding making a sukkah in the manner of "made for shade"
"וכן צריך כל אדם לכוין בישיבתו בסוכה שיושב בה כדי לקיים מצות הקב"ה שצונו לישב בסוכה זכר ליציאת מצרים" — שנוסף על הדין בעשיית סוכה באופן של "עשוי' לצל"

there is an obligation to intend at the time of sitting in the sukkah,
יש חיוב לכוין בעת הישיבה בסוכה,
that it is a reminder of the Exodus from Egypt<sup>48</sup>.
שהיא זכר ליציאת מצרים<sup>48</sup>.

But it still requires explanation in what was said there,
אלא שעדיין צריך ביאור במשנת"ל,
that since the mitzvah of sukkah is a reminder of the clouds of glory "with which He surrounded them for shade" therefore the essence of a sukkah is a sukkah made only for shade — for seemingly,
דכיון שמצות סוכה היא זכר לענני הכבוד "שהקיפם בהם לצל" לכן מהותה של סוכה היא סוכה העשוי' לצל בלבד — דלכאורה,
behold the clouds of glory that surrounded<pg>147</pg>
הרי ענני הכבוד שהקיפו<pg>147</pg>
the children of Israel were not for shade alone,
את בנ"י לא היו לצל בלבד,
but served for several other matters,
אלא שימשו לעוד כו"כ ענינים,
as explained in Chazal that the cloud would level the mountains and kill the snakes<sup>49</sup>,
כמבואר בחז"ל שהענן הי' משוה את ההרים והורג את הנחשים<sup>49</sup>,
and also protected from the arrows of the enemies<sup>50</sup>,
וכן הגינו מפני חצי האויבים<sup>50</sup>,
and why was this matter singled out from the clouds of glory "with which He surrounded them for shade",
ולמה נבדל ענין זה שבענני הכבוד "שהקיפם בהם לצל",
because of which the reminder of the clouds of glory is specifically and only in making sukkos that are made for shade
אשר משום כך הזכר לענני כבוד הוא דוקא ורק בעשיית סוכות העשויות לצל
(only)?
(בלבד)?
And it must be said,
ויש לומר,
that on the contrary,
שאדרבה,
with this is resolved the difficulty of the Bach<sup>51</sup>
בזה מתורצת קושיית הב"ח<sup>51</sup>
(and further),
(ועוד),
for "how many good qualities does the Omnipresent have upon us, that He fed us the manna and gave us the well and other kindnesses, and why did He command more in the mitzvah of sukkah to remember the kindness of the dwelling of sukkot more than other kindnesses"?
דהרי "כמה מעלות טובות למקום עלינו שהאכילנו את המן ונתן לנו הבאר ושאר חסדים ולמה ציוה יותר במצות סוכה לזכור החסד של הושבת דסוכות יותר משאר חסדים"?
And it is explained in the commentaries<sup>52</sup>
ומבואר במפרשים<sup>52</sup>
"that the well and the manna were...
"שהבאר והמן היו..
a necessary thing that it is impossible without their existence at all" and therefore "a reminder was not established for them, but the clouds of glory, which were not so necessary like them, but rather so that they would not be in heat by day and cold by night<sup>53</sup>
דבר הכרחי שא"א בלי מציאותם כלל" ולכן "לא הוקבע רמז להם אבל ענני כבוד שלא הי' כל כך הכרחי כמו הם אלא כדי שלא יהיו בחורב ביום וקרח בלילה<sup>53</sup>
the days of the festival were established as a reminder of their matter."
הוקבע ימי החג רמז לענינם".
And similarly it is regarding the matter of the details of the things that the clouds of glory served in them,
ועד"ז הוא בענין פרטי הדברים ששימשו בהם ענני הכבוד,
that the matters of protection in them
שעניני ההגנה שבהם
(like the protection from the enemies and the killing of snakes and scorpions)
(כמו ההגנה מן האויבים והריגת נחשים ועקרבים)
that pertained to lives, they do not make a remembrance for them
שהיו נוגעים לנפשות אין עושים להם זכר
[and even this that they leveled the mountains
[ואפילו זה שהשוו את ההרים
(lowering the high etc.),
(מנמיך את הגבוה כו'),
for since this relates to the essence of their walking in the desert,
הרי כיון שזה שייך לעצם הליכתם במדבר,
it can be said that this is like a necessary matter,
י"ל שזהו כמו ענין הכרחי,
so that they could reach the Land of Israel],
כדי שיוכלו להגיע לא"י],
rather the remembrance of the festival of Sukkot was established from the outset only on this detail "that He surrounded them with them for shade so that sunstroke and sun would not strike them",
אלא הזכר דחג הסוכות נקבע מלכתחילה רק על פרט זה "שהקיפם בהם לצל לבל יכה בהם שרב ושמש",
which is a kindness and extra affection so that their walking in the desert would be in a manner that has no distress at all<sup>54</sup>.
שהוא חסד וחיבה יתירה כדי שהליכתם במדבר תהי' באופן שאין בה צער כלל<sup>54</sup>.
And based on this, simply also the question of the Ra"am is resolved<sup>55</sup>
ועפ"ז מתורצת בפשטות גם קושיית הרא"ם<sup>55</sup>
(which is brought in the Bach here<sup>56</sup>),
(שהובאה בב"ח כאן<sup>56</sup>),
"Why did the Torah not command that they make in the sukkah one above and one below and four from four sides<pg>148</pg>
"למה לא ציוותה התורה שיעשו בסוכה א' מלמעלה וא' מלמטה וד' מד' רוחות<pg>148</pg>
like the clouds of glory
דומיא דענני הכבוד
[and in other commentaries<sup>57</sup>
[ובעוד מפרשים<sup>57</sup>
they added to ask,
הוסיפו להקשות,
that in the sukkah they do not even need four walls, but two walls and the third a handbreadth suffice<sup>58</sup>]?
דבסוכה אין צריכים אפילו ד' דפנות אלא מספיק ב' דפנות והשלישי טפח<sup>58</sup>]?
And some answered<sup>59</sup>
ויש שתירצו<sup>59</sup>
"that the question is fundamentally not [valid] since the sukkah is only a mere example in order that we remember His wonders and awesome deeds
"דהקושיא מעיקרא ליתא מאחר שהסוכה אינה אלא דוגמא בעלמא כדי שנזכור נפלאותיו ונוראותיו
[as the Tur says "and an example of this He commanded us to make sukkot in order that we remember His wonders and awesome deeds"]
[כלשון הטור "ודוגמא לזה צונו לעשות סוכות כדי שנזכור נפלאותיו ונוראותיו"]
that He did for our forefathers in the encompassing of the clouds, therefore with an example and a reminder any small thing suffices etc.'
שעשה לאבותינו בהיקף העננים לפיכך בדוגמא וזכר כל דהו סגי כו'".
And according to the above perhaps one could say,
וע"פ הנ"ל אולי יש לומר,
that this is not only "an example and a reminder any small thing",
שאין זה רק "דוגמא וזכר כל דהו",
but on the contrary,
אלא אדרבה,
this is precisely<sup>60</sup>.
זהו בדיוק<sup>60</sup>.
For since the entire reminder is only about this detail of the clouds of glory "that He encompassed them with them for shade",
דכיון שכל הזכר הוא רק על פרט זה שבענני הכבוד "שהקיפם בהם לצל",
therefore it suffices "to make sukkot that are made for shade",
לכן סגי "לעשות סוכות העשויות לצל",
for which two walls and a handbreadth with the roofing above are sufficient.
שבשביל זה די בב' דפנות וטפח עם סכך מלמעלה.
