In the current Torah portion<sup>1</sup>

it is told that Moses asked the Most High "Let the L-rd, G-d of the spirits of all flesh, appoint a man over the congregation,"
ווערט דערציילט אַז משה האָט געבעטן ביים אויבערשטן „יפקוד ה’ גו’ איש על העדה”,
and the Most High said to him: "Take Joshua the son of Nun, a man in whom is spirit, and lay your hand upon him,"
און דער אויבערשטער האָט אים געזאָגט: „קח לך את יהושע בן נון גו’ וסמכת את ידך עליו”,
and Moses did so — "and he laid his hands upon him and commanded him, as the L-rd spoke by the hand of Moses."
און משה האָט אַזוי געטאָן — „ויסמוך את ידיו עליו גו'".
Regarding the appointment of a king,
בנוגע מינוי מלך,
it states in the Rambam<sup>2</sup>
שטייט אין רמב”ם
: "They do not appoint a king initially except by the court of seventy elders and by a prophet,
: „אין מעמידין מלך בתחילה אלא על פי בית דין של שבעים זקנים ועל פי נביא,
<b>as Joshua </b>whom Moses our teacher and his court appointed.”
כיהושע שמינהו משה רבינו ובית דינו”.
From this it is proven,
דערפון איז מוכח,
that the Rambam holds that the appointment of Joshua
אַז דער רמב”ם האַלט אַז דער מינוי פון יהושע’ן
(which is in our Torah portion),

was a matter of appointing a king<sup>3</sup>.

although Moshe Rabbeinu "was a king" — as the Rambam rules<sup>7</sup>

— but Moshe Rabbeinu became a king <b>before </b>there was the commandment of the laws of the king and of the anointing oil<sup>8</sup>].

At first glance one could explain<sup>9</sup>

According to another ruling of the Rambam<sup>10</sup>

"They do not anoint from it

(from the anointing oil)

for generations except ..

kings of the house

and since Joshua was not from the kings of the House of David,
און וויבאַלד אַז יהושע איז ניט געווען פון מלכי בית דוד,
therefore they did not anoint him with the anointing oil<sup>11</sup>.
דעריבער האָט מען אים ניט מושח געווען בשמן המשחה .
But,
איז אָבער,
on the contrary,
אדרבה,
according to the opinion of <b>the Rambam</b> this is not an excuse.
לויט שיטת הרמב”ם איז דאָס ניס קיין תירוץ.
Because as a source for this aforementioned law — “When they appoint the king they anoint him with the anointing oil” — the Rambam brings<sup>5</sup>
ווייל אַלס מקור צו דעם דין הנ”ל — „כשמעמידין המלך מושחין אותו בשמן המשחה” — ברענגט דער רמב”ם
the verse<sup>12</sup>

“And Samuel took the flask of oil and poured it on his head and kissed him,”
„ויקח שמואל את פך השמן ויצק על ראשו וישקהו”,
where it speaks about the anointing of <b>Saul</b>,
וואו עס רעדט זיך וועגן דער משיחה פון שאול ,
who was not from the kings of the House of David — and from this [it is evident] that the Rambam holds that Saul was anointed with the anointing oil<sup>13</sup>.

It is proven from this,

that what the Rambam writes "when appointing the king they anoint him with the anointing oil" he means thereby <b>every king</b>,

even not from the kings of the House of David

And the question returns to its place: Why do we not find that Yehoshua

(who was a king according to the Rambam)

was anointed with the anointing oil,
מושח געווען בשמן המשחה,
just as Shaul was anointed

This will be understood by prefacing the explanation in the words of the Midrash<sup>16</sup>
וועט מען דאָס פאַרשטיין בהקדם הביאור אין דברי המדרש
regarding what Moshe Rabbeinu said, "Let the Lord appoint a man over the congregation"<sup>17</sup>,
אויף דעם וואָס משה רבינו האָט געזאָגט „יפקוד ה’ גו’” ,
that Moshe considered, "My sons will inherit My glory
אַז משה האָט גערעכנט „שירשו בני את כבודי
(My greatness<sup>18</sup>)

and the Almighty said to him: "He who guards a fig tree will eat its fruit"<sup>19</sup>,
און דער אויבערשטער האָט אים געזאָגט: „נוצר תאנה יאכל פרי’ ,
Your sons will sit for themselves and not engage in Torah,
בניך ישבו להם ולא עסקו בתורה,
Yehoshua...

Since<sup>20</sup>

and he served you with all his strength, he is worthy to serve Israel."
והוא שרתך בכל כחו כדאי הוא שישמש את ישראל”.
It is seemingly not understandable: since the children of Menashe "sat by themselves and did not engage in Torah" — how does it come that Moshe initially thought that "my sons will inherit my glory"<sup>21</sup>?
איז לכאורה ניט פאַרשטאַנדיק: וויבאַלד אַז בני משה „ישבו להם ולא עסקו בתורה” — ווי קומט עס אַז משה האָט מלכתחילה געמיינט אַז „ירשו בני את כבודי” ?
In simple terms one could answer,
בפשטות וואָלט מען געקענט פאַרענטפערן,
that with his request "let the Lord, etc., appoint a man over the congregation" Moshe meant
אַז מיט זיין בקשה „יפקוד ה’ גו’ איש על העדה” האָט משה געמיינט
(Not such a "man" who should teach Torah to Jews,
(ניט אַזאַ „איש” וואָס זאָל לערנען תורה מיט אידן,
but only,
נאָר בלויז,
<b>as explained </b>in his request<sup>22</sup>)
כמפורש אין זיין בקשה )
A king "who goes out before them and who comes in before them" — <b>to war</b>; and therefore Moses considered that "<b>inherit </b>my sons My glory"
אַ מלך „אשר יצא לפניהם ואשר יבא לפניהם” — למלחמה ; און דעריבער האָט משה גערעכנט אַז „ ירשו בני את כבודי”
(even though "they did not engage in Torah")

Based on this, however, it is not understood why the Most High answered him "He who guards a fig tree will eat its fruit,

your sons will sit for themselves and did not engage in Torah" — in this matter, Torah, who mentioned it?
בניך ישבו להם ולא עסקו בתורה” — בנדו”ז תורה מאן דכר שמה?
Here it is speaking, after all, about the inheritance of <b>the kingdom</b>!

The Megaleh Amukot<sup>24</sup>
דער מגלה עמוקות
explains the double language in the verse "who will go out before them and who will come in before them
איז מבאר דעם כפל הלשון אין פסוק „אשר יצא לפניהם ואשר יבא לפניהם
(and afterwards)
(און דערנאָך)
and who will bring them out and who will bring them in" — that Moshe wanted that there should be "two men who lead,"
ואשר יוציאם ואשר יביאם” — אַז משה האָט געוואָלט אַז עס זאָלן זיין „שני בני אדם המנהיגים”,
"namely one man over the congregation who will go out before them <b>in war</b> etc. and one man who will bring them out <b>in Torah</b> etc."
„דהיינו איש אחד על העדה אשר יצא לפניהם במלחמה כו’ ואיש אחד אשר יוציאם בתורה כו’”.
And the Most High answered him "<b>that one</b> will lead them ..
און דער אויבערשטער האָט אים געענטפערט „ שאחד ינהג אותם ..
Yehoshua who will be king and Av Beit Din<sup>25</sup>
יהושע שיהי’ מלך ואב”ד
of Israel and their sage in Torah,"
של ישראל וחכם שלהם בתורה”,
because "it is impossible for two kings to use one crown<sup>26</sup>..
ווייל „אי אפשר לב’ מלכים שישתמשו בכתר אחד ..
for a thing<sup>27</sup>
כי דבר
one for a generation and not two things."

And based on this, the aforementioned midrash is also resolved: Since Moshe thought that there should be two leaders — one a king and another an “Av Beis Din of Israel” — therefore it came out by him that the appointment to kingship should be inherited by one of his sons,
ועפ”ז איז אויך פאַרענטפערט דער מדרש הנ”ל: וויבאַלד אַז משה האָט געמיינט אַז עס זאָלן זיין צוויי מנהיגים — איינער אַ מלך און נאָך איינער אַן „אב”ד של ישראל” — דערפאַר איז ביי אים אויסגעקומען אַז די התמנות למלוכה זאָל ירש’נען איינער מבניו,
as above.

The Most High, however, wanted that “One shall lead them”
דער אויבערשטער האָט אָבער געוואָלט אַז „ אחד ינהג אותם”
(He should be both the king and the “Av Beis Din of Israel”)
(ער זאָל זיין סיי דער מלך און סיי דער „אב”ד של ישראל”)
— and since for the matter of Torah one must be worthy
— און וויבאַלד אַז צום ענין התורה מוז מען זיין ראוי
(“He who guards a fig tree shall eat its fruit”<sup>28</sup>),
(„נוצר תאנה יאכל פרי’” ),
and the sons of Moshe were not suited for this
און בניו של משה זיינען ניט געווען מתאים דערצו
(because “they did not engage in Torah”),
(ווייל „לא עסקו בתורה”),
they could not at all inherit “his honor” of Moshe;
האָבן זיי בכלל ניט געקענט ירש’נען „כבודו” של משה;
Only specifically Yehoshua,
נאָר דוקא יהושע,
who was devoted to Torah
וואָס איז געווען איבערגעגעבן צו תורה
(not only to the study of Torah but also to <b>its service</b> of Torah<sup>29</sup>),
(ניט בלויז צו לימוד התורה נאָר אויך צו שימושה של תורה ),
could be the successor of Moshe.

One must, however, understand
מען דאַרף אָבער פאַרשטיין
(according to the explanation of the Megaleh Amukot)
(ע”פ פי’ המגלה עמוקות)
the reason why the Above did not accept the reasoning of Moshe "that there should be two men as leaders,"
דעם טעם פאַרוואָס דער אויבערשטער האָט ניט אָנגענומען די סברא פון משה „שיהיו שני בני אדם המנהיגים”,
for seemingly: although "it is impossible for two kings to use one crown," the emphasis is indeed on the crown <b>one</b>; and furthermore — we find indeed in later generations that it was so — kingship through one leader and the Av Beit Din of Israel a second leader: the leader in Torah and in the language of the Rambam<sup>30</sup>
דלכאורה: אע”פ אַז „אי אפשר לב’ מלכים שישתמשו בכתר אחד” איז דאָך די הדגשה בכתר אחד ; ועוד — מען געפינט דאָך אין שפּעטערדיקע דורות אַז ס’איז געוועז אַזוי — מלכות דורך איין מנהיג און דער אב”ד של ישראל אַ צווייטער מנהיג: דער מנהיג בתורה ובלשון הרמב”ם

who led with the needs of the people etc.
וועלכער האָט אָנגעפירט מיט צרכי העם כו’
seat a king of Israel in the Sanhedrin"]<sup>32</sup>.

One must say,
מוז מען זאָגן,
that היא הנותנת — since Torah and kingship are two <b>separate </b>types of authority,
אַז היא הנותנת — וויבאַלד אַז תורה און מלכות זיינען צוויי באַזונדערע סוגי שררה,
therefore it is no contradiction to the rule of "one thing for a generation and not two things" —

ועפ”ז the question stands in its place: why in our case could they not separate the appointment of king from the appointment

And one must say the explanation in this:

In his introduction to the Book of the Hand,
אין זיין הקדמה לספר היד,
the Rambam writes the order of the transmission of the Oral Torah from Moses until Rav Ashi,
שרייבט דער רמב”ם דעם סדר המסורה פון תורה שבעל פה פון משה’ן ביז רב אשי,
and when counting the recipients of the Torah, the Rambam is precise in his language that so-and-so received from the previous recipient "<b>and his court</b>"
און ביים אויסרעכענען די מקבלי התורה איז דער רמב”ם מדייק בלשונו אַז פלוני האָט מקבל געווען פון דעם פריערדיקן מקבל „ ובית דינו ”
(or — <b>his colleagues </b>of the previous recipient).

And as the Rambam explains elsewhere<sup>33</sup>,

that by this he wanted to emphasize "that the reception by many increases, not an individual from an individual."

One finds, however, in this an exception — regarding Joshua,
געפינט מען אָבער אין דעם אַן אויסנאַם — בנוגע צו יהושע’ן,
where the Rambam <b>changes </b>and is precise "and many elders received from Joshua"
וואו דער רמב”ם איז משנה ומדייק „וזקנים רבים קבלו מיהושע”
(and <b>does not </b>add "and his court" and the like).

And the reason for the difference is understood from the words of the Rambam there previously: "The Oral Torah, Moses our teacher taught all of it in his court to the seventy elders,

That Joshua was not only a recipient from Moses our teacher

(like Elazar and Pinchas and the seventy elders),

to Joshua specifically did Moses <b>transmit</b> the Oral Torah
צו יהושע’ן דוקא האָט משה מוסר געווען תורה שבעל פה
(all of it),

and as the statement of the Mishnah<sup>34</sup>
וכמאמר המשנה
: Moses received
: משה קבל
the Torah from Sinai and transmitted it to Joshua,
תורה מסיני ומסרה ליהושע,
and he received a command concerning it, special<sup>35</sup>.
און ער האָט באַקומען אַ ציווי עלי’ מיוחד .
And therefore the Rambam does not say "and his court" regarding Yehoshua — because regarding the <b>transmission of</b> the Torah,
און דערפאַר זאָגט ניט דער רמב”ם „ובית דינו” ביי יהושע’ן — ווייל בנוגע צו מסירת התורה,
the receiving was from Yehoshua alone,
איז די קבלה געווען פון יהושע אַליין,
but to him did Moshe transmit the entire Oral Torah.

It follows,

that there is a fundamental difference between Moshe and Yehoshua regarding the nasi of the Sanhedrin in the generations after this: Yehoshua and Moshe Rabbeinu are equal in that the mesorah of the entire Oral Torah was to and from

Even though that "the prince of the Sanhedrin is in the highest level in the rulership of the Torah"<sup>37</sup>,

nevertheless he does not come to the

level of the presidency of a <b>king</b>.

For the definition of a king is — "there is none above him except the Lord his God"<sup>38</sup>
וואָרום דער גדר פון אַ מלך איז — „אין על גביו אלא ה’ אלקיו”
; and not only is "there is none above him in his kingship"<sup>39</sup>,
; און ניט נאָר איז „אין למעלה ממנו במלכותו” ,
but,

even more — he is the <b>sole </b>ruler,

who does not need to reckon with anyone

And therefore a nasi of the Sanhedrin is no contradiction to the king,

and consequently it is not a matter of “two kings”,
ובמילא איז עס ניט אַן ענין פון „שני מלכים”,
“two things”.

But not so by Moshe and Yehoshua,

is <b>their</b> “presidency” in Torah constituted

(not only in his being the nasi of the Sanhedrin,

in that “Moshe received Torah from Sinai and transmitted it to Yehoshua” — and such a presidency in Torah is in the level of the presidency of a king<sup>41</sup>

And therefore,

Regarding the role of a king, the Rambam says<sup>43</sup>
בנוגע דעם תפקיד פון אַ מלך זאָגט דער רמב”ם
: "And his goal and thought shall be to raise the true religion and to fill the world with righteousness and to break the arm of the wicked and to wage the wars of the Lord, for they do not appoint a king initially except to execute justice and wars."
: „ותהי’ מגמתו ומחשבתו להרים דת האמת ולמלאות העולם צדק ולשבור זרוע הרשעים ולהלחם מלחמות ה’ שאין ממליכין מלך תחלה אלא לעשות משפט ומלחמות”.

That kingship
אַז מלכות

its subject is not merely to provide the nation with physical needs etc.<sup>44</sup>,
איז ענינה ניט סתם צו באַזאָרגן דעם עם מיט צרכים גשמיים כו’ ,
but all this begins and is connected with the fulfillment and elevation of the Torah — "to raise the true religion",
נאָר דאָס אַלץ הייבט זיך אָן און איז פאַרבונדן מיט קיום והרמת התורה — „להרים דת האמת”,
to carry out the judgments of the Torah<sup>45</sup>,
דורכצופירן די משפטי התורה ,
until that also the
ביז אַז אויך די
Wars that he needs to wage,
מלחמות וואָס ער דאַרף פירן,
they are "wars of <b>G-d</b>"<sup>46</sup>.
זיינען זיי „מלחמות ה’ ” .
It turns out,
קומט אויס,
that the concept of kingship is a continuation of the role of the Great Sanhedrin: the Great Sanhedrin are the "pillars of instruction and from them law and judgment go out to all Israel"<sup>47</sup>,
אַז דער ענין המלכות איז אַ המשך פון דעם תפקיד של בית דין הגדול: דער ב”ד הגדול זיינען די „עמודי ההוראה ומהם חק ומשפט יוצא לכל ישראל” ,
and the role of the king is,
און דער תפקיד פון מלך איז,
that the judgment of the Torah that the Great Sanhedrin issues he must implement among the people of Israel<sup>48</sup>,
אַז דעם משפט התורה וואָס דער ב”ד הגדול גיט אַרויס דאַרף ער דורכפירן ביי עם ישראל ,
that "it is a commandment upon the king to honor those who study Torah,
אַז „מצוה על המלך לכבד לומדי התורה,
and when the Sanhedrin and the sages of Israel enter before him <b>he shall stand before them </b>etc.’"
וכשיכנסו לפניו סנהדרין וחכמי ישראל יעמוד לפניהם כו’”
(And likewise "the king stands before the High Priest ..
(ועד”ז „המלך עומד לפני כהן גדול ..
when he asks him <b>by the judgment of the Urim</b>")
כשישאל לו במשפט האורים ”)
— because the king is a "receiver" from them:
— ווייל דער מלך איז „מקבל” פון זיי:
But regarding the matter of <b>the dominion </b>of the king <b>over the people</b>,
נאָר בנוגע דעם ענין השליטה פונעם מלך על העם ,
is "there is none above him except the Lord his God" and "there is none above him in his kingdom",
איז „אין על גביו אלא ה’ אלקיו” און „אין למעלה ממנו במלכותו”,
therefore "in public before the people <b>not </b>..
וואָס דערפאַר „בפרהסיא בפני העם לא ..
<b>shall he stand </b>before any person etc. so that his fear be upon the hearts of all"<sup>49</sup>].
יעמוד מפני אדם כו’ כדי שתהא יראתו בלב הכל” ].
And from this reason a king and "leadership" in Torah are not two separate rulerships
און מהאי טעמא איז אַ מלך און „נשיאות” בתורה ניט קיין צוויי באַזונדערע שררות
(that one does not touch its fellow),
(שאין אחת נוגעת בחברתה),
rather they are one continuum;
נאָר זיי זיינען איין המשך;
And when one separates them from each other it is called "two kings ..
און אַז מען טיילט זיי פאַנאַנדער הייסט עס „שני מלכים ..
<b>in one crown</b>"<sup>50</sup>.
בכתר אחד ” .

Based on this one will also understand why the appointment of Yehoshua was specifically through semichah and not through anointing.
עפ”ז וועט מען אויך פאַרשטיין פאַרוואָס מינויו של יהושע איז געווען דורך סמיכה דוקא און ניט דורך משיחה:
Since a king is a "recipient" from the Great Sanhedrin
וויבאַלד אַז אַ מלך איז אַ „מקבל” פון דעם ב”ד הגדול
(which issues the judgment of the Torah),
(וואָס גיט אַרויס משפט התורה),
as mentioned above — from this it is understandable regarding the leadership of Yehoshua
כנ”ל — איז דערפון פאַרשטאַנדיק בנוגע צו דער נשיאות פון יהושע’ן
(and likewise of Moshe),
(ועד”ז פון משה),
that he had <b>both</b> aspects of leadership
וואָס ער האָט געהאַט ביידע עניני נשיאות
(both a king and leadership of the Torah in the level of a king as mentioned above),
(סיי אַ מלך און סיי נשיאות התורה אין דער דרגא פון מלך כנ”ל),
that the leadership of the monarchy was for him a <b>continuation and result</b> of his leadership <b>in Torah</b>.
אַז די נשיאות המלוכה איז ביי אים געווען אַ המשך ותוצאה פון זיין נשיאות בתורה .

His main essence is that he is a Nasi in Torah — he is “transmits” the entire Torah to Jews; and in addition to this, there was with him the aspect of kingship in order to carry out the judgment of the Torah among the Jewish people.
עיקר ענינו איז וואָס ער איז נשיא בתורה — ער איז „מוסר” גאַנץ תורה צו אידן; און בנוסף לזה איז ביי אים געווען דער ענין המלוכה אויף צו דורכפירן דעם משפט התורה צווישן דעם עם ישראל.
And therefore his appointment was through Semichah: the anointing that a king needs has as its purpose to effect the aspect of kingship
און דערפאַר איז זיין מינוי געווען דורך סמיכה: די משיחה וואָס אַ מלך דאַרף האָבן איז מטרתה צו אויפטאָן ענין המלוכה
(in the manner of the kingship of Shaul — the view of the Rambam as above)

; but not so the kingship of Yehoshua
; משא”כ מלכות יהושע

its <b>main </b>aspect is — leadership in the matter of Torah,
איז עיקרה — נשיאות בענין התורה,
and therefore it is effected through <b>Semichah</b>,
און דעריבער ווערט זי אויפגעטאָן דורך סמיכה ,
which is connected specifically with Torah — specifically regarding Torah
וואָס איז פאַרבונדן מיט תורה דוקא — דוקא בנוגע צו תורה
(and instruction)

one says<sup>51</sup>
זאָגט מען
Semuchin ish mipi ish,
סמוכין איש מפי איש,
samchu l’na etc.
סמוכו לנא וכו’.

According to the above explanation it is also understandable,
לויטן אויבנדערמאָנטן ביאור איז אויך פאַרשטאַנדיק,
that what stands in the Midrash<sup>52</sup>
אַז דאָס וואָס עס שטייט אין מדרש
that Shaul was the "first king" is not at all a contradiction to what is said in the Rambam
אַז שאול איז געווען דער „מלך ראשון” איז כלל ניט קיין סתירה צו דעם וואָס ווערט געזאָגט אין רמב”ם
(and in several Midrashim of Chazal<sup>53</sup>)
(ובכמה מדרשי חז”ל )
that Moshe Rabbeinu and likewise Yehoshua had the status of a king — because the definition of kingship of Moshe and Yehoshua was an entirely different definition from the kingship of Shaul and David<sup>54</sup>
אַז משה רבינו ועד”ז יהושע האָבן געהאַט אַ דין מלך — ווייל דער גדר המלוכה פון משה ויהושע איז געווען אַן אַנדער גדר לגמרי פון מלכות פון שאול ודוד
— by Moshe and Yehoshua the presidency of kingship was secondary to their presidency in Torah<sup>55</sup>.
— ביי משה ויהושע איז די נשיאות המלוכה געווען אַ טפל פון נשיאותם בתורה .
And based on this it is also answered why we do not find in Chumash explicitly<sup>56</sup>
ועפ”ז ווערט אויך פאַרענטפערט פאַרוואָס מען געפינט ניט אין חומש בפירוש
that one must anoint a king with anointing oil — which at first glance is perplexing: since the appointment of a king is an explicit commandment and with several details in it,
אַז מען דאַרף מושח זיין אַ מלך מיט שמן המשחה — דלכאורה תמוה: וויבאַלד מינוי מלך איז אַ מצוה מפורשת ובכמה פרטים בה,
it should have been stated in the Torah that his appointment comes through anointing oil<sup>57</sup>
האָט געדאַרפט שטיין אין תורה אַז זיין מינוי קומט דורך שמן המשחה
(in the manner that the law of anointing the Kohen Gadol and the Kohen anointed for war is stated)?
(ע”ד ווי עס שטייט דער דין פון משיחת כהן גדול און משוח מלחמה)?
And according to the above it is understood: the matter of kingship as it is set forth <b>from the outset </b>according to <b>Torah </b>— which is how it was by Moshe and by his successor Yehoshua — is in a manner<sup>58</sup>
וע”פ הנ”ל איז דאָס מובן: דער ענין המלוכה ווי דאָס איז אויסגעשטעלט מלכתחילה ע”פ תורה — וואָס אַזוי איז דאָס געווען ביי משה און באַם ממלא מקומו יהושע — איז אין אַן אופן
that the king is also a prince <b>in Torah</b>,
אַז דער מלך איז אויך אַ נשיא בתורה ,
and consequently one does not need to come to the anointing oil<sup>59</sup>
ובמילא דאַרף מען ניט אָנקומען צו שמן המשחה
And that which the appointment of a king must be specifically through the anointing oil came about later,
און דאָס וואָס מינוי מלך דאַרף זיין דוקא דורך שמן המשחה האָט זיך אויפגעטאָן שפּעטער,
when Shaul needed to become the king<sup>60</sup>.
ווען שאול האָט געדאַרפט ווערן דער מלך .
