It is written in our parshah<sup>1</sup>
כתוב בפרשתנו
: "And if your brother becomes impoverished etc. a stranger and a resident and lives with you,
: ״וכי ימוך אחיך גו׳ גר ותושב וחי עמך,
do not take from him interest and increase etc."
אל תקח מאתו נשך ותרבית גו׳".
And Chazal explained in the Gemara<sup>2</sup>,
ופירשו חז״ל בגמרא ,
that what is said "do not take from him interest and increase" applies only to "your brother" and not to "a stranger and a resident"
שמה שנאמר "אל תקח מאתו נשך ותרבית" קאי רק על "אחיך" ולא על "גר ותושב"
and not "do not take from them" in the plural].
ולא "אל תקח מאתם" בלשון רבים].
And what is said "a stranger and a resident" is only regarding "and lives with you" — "that you are commanded to sustain him"<sup>3</sup>,
ומה שנאמר "גר ותושב" הוא רק לענין ״וחי עמך״ - "שאתה מצווה להחיותו" ,
but not regarding "do not take from him interest and increase".
אבל לא לענין "אל תקח מאתו נשך ותרבית".
And the Rambam wrote<sup>4</sup>
וכתב הרמב״ם
: "The nations of the world and a ger toshav borrow from them and lend to them with interest ..
: "העכו״ם וגר תושב לוין מהם ומלוין אותן בריבית ..
to your brother it is forbidden and to the rest of the world it is permitted.
לאחיך אסור ולשאר העולם מותר.
And it is a positive commandment to lend with interest to a nations of the world<sup>5</sup>
ומצות עשה להשיך לעכו״ם
as it is said<sup>6</sup>
שנאמר
to a gentile you shall lend with interest,
לנכרי תשיך,
from the oral tradition they learned that this is a positive commandment".
מפי השמועה למדו שזו מצות עשה".
That is, there are three laws regarding lending with interest: a Jew — <b>forbidden</b> to lend to him with interest,
והיינו שישנם ג׳ דינים בהלואה בריבית: ישראל - אסור להלוותו בריבית,
a resident alien — <b>permitted</b> to lend to him with interest,
גר תושב - מותר להלוותו בריבית,
a gentile — <b>a commandment</b> to take interest from him.
עכו״ם - מצוה לקחת ממנו ריבית.
And behold, that which the Torah <b>permitted</b> taking interest from a gentile

— even though “it is forbidden to rob or steal, whatever is Torah law, whether from a Jew or from a gentile”<sup>7</sup>

However, that there is also "<b>a positive commandment </b>to lend to a gentile",
אמנם זה שיש גם " מצות עשה להשיך לעכו״ם",
requires explanation: even though the borrower gives the interest of his own knowledge and will — but behold, the Torah called it by the name "neshekh"<sup>13</sup>

And this will be understood by prefacing an explanation of the dispute of the poskim whether forgiveness is effective regarding interest: the opinion of the Geonim<sup>15</sup>,
ויובן זה בהקדים ביאור פלוגתת הפוסקים אם מועלת מחילה בריבית: דעת הגאונים ,
that even if the lender already collected the interest,
שגם אם המלוה כבר גבה את הריבית,
the forgiveness of the borrower is not effective to exempt the lender from returning it to the borrower.
אין מחילת הלוה מועלת לפטור את המלוה מלהחזירה ללוה.
And the reason for this: "All interest in the world is forgiveness,
והטעם לזה: "כל ריבית שבעולם מחילה היא,
but the Torah did not forgive and forbade this forgiveness,
אבל התורה לא מחלה ואסרה מחילה זו,
therefore forgiveness is not effective regarding interest."
לפיכך אין המחילה מועלת בריבית".
But the opinion of the Rosh<sup>16</sup>
אבל דעת הרא״ש
(and so the halacha is decided in the Tur and Shulchan Aruch<sup>17</sup>),

that forgiveness is not effective to permit the taking of interest from the outset

thus from this it is proven that the prohibition of taking interest and the obligation to return it is not in the category of a law of <b>money that one owes to his fellow</b>

that forgiveness is effective for interest

And based on this, it is to be explained,
ועפ״ז יש לבאר,
in the inner dimension of the matters,
בפנימיות הענינים,
a detail in the law of retaining interest;
פרט בדין החזקת ריבית;
One who lends with interest, if he comes to do repentance and to return the interest, we do not accept from him<sup>24</sup>,
המלוה בריבית אם בא לעשות תשובה ולהחזיר הריבית אין מקבלים ממנו ,
And even though we do not accept from him, he is obligated to return to fulfill his obligation to Heaven, and nevertheless, it is a pious measure not to accept from him<sup>25</sup>.
ואע״פ שאין מקבלים ממנו חייב להחזיר לצאת ידי שמים ומ״מ מדת חסידות שלא לקבל ממנו .
And the explanation of this:
והביאור בזה;
Our Sages, of blessed memory, said<sup>26</sup>
ארז״ל
"The Torah has compassion on the money of Israel",
״התורה חסה על ממונן של ישראל",
And the reason for this, one can say:
והטעם לזה י״ל;
<b>P'sak Din</b> is "all your deeds for the sake of Heaven" and "in all your ways know Him"<sup>27</sup>
פס״ד הוא " כל מעשיך לשם שמים" ו״ נכל דרכיך דעהו״
- consequently, since this is his money, he must fulfill this P'sak Din also regarding his money<sup>28</sup>,
- במילא כיון שזהו ממונו עליו לקיים פם״ד זה גם נכל ממונו ,
and in the language of the Rambam<sup>29</sup>
ובל׳ הרמב״ם
"his heart should not be directed only toward gathering money, but rather etc."
״לא יהי׳ בלבו לקיבוץ ממון בלבד אלא כו׳".
In the style of Chassidus - in the money of Israel there are "holy sparks that belong to the root of his soul"<sup>30</sup>.
בסגנון תורת החסידות - בממונם של ישראל ישנן "ניצוצין קדושים השייכים לשרש נשמתו" .
And behold, since the Holy One, blessed be He, embedded His world in this manner and order,

nevertheless,

wherever there is another way that makes it possible that he will not need to return it — he must endeavor that the interest remain in his hand,
כל היכא שישנה דרך אחרת המאפשרת שלא יצטרך להחזירה - צריך להשתדל שתשאר הריבית בידו,
since the sparks in it belong to the root of his soul.

that the commandment of “to a foreigner you may lend at interest” is
